Abstract

The economic development of the people is a big problem faced by people today, and indeed The solution can only be done by Muslims himself by returning to Allah's rules, in among others by: instilling entrepreneurial traits for each individual people, build strong partnerships/networks with various parties, especially with fellow Muslims, make policies that are more pro-economic growth of the people, by supporting morally and materially sourced from zakat funds, carry out transactions and economic behavior in accordance with the rules of Islamic teachings.

Abstract

Defrayal or financing is funding provided by one party to another to support the planned investment, either by themselves or institution. In other words, the financing is funding incurred to support the planned investment. Financing terms in effect means that I believe, I trust. The word financing means (trust) that means financial institutions as sahib al-mal put their trust in someone to carry out the given mandate. The fund should be used properly, fairly, and must be accompanied by a bond and the terms are clear and mutually beneficial for both parties. Each financial institution has syari’ah philosophy to seek the pleasure of Allah. to obtain good in the world and the hereafter. Therefore, any activities of financial institutions which feared deviate from the guidance of religion should be avoided. In the implementation of the financing, Islamic bank must fulfill two very important aspects, namely: (1) syar’i aspect, where in each realization of financing to customers, the Islamic bank must be oriented to the Islamic Shariah; and (2) the economic aspect, which is still considering the gains, both for banks and for Shariah bank customers

Abstract

Perumahan dengan konsep Islami berkembang sangat pesat, bahkan saat pandemi Covid 19. Tidak adanya konsep baku tentang perumahan Islami memunculkan berbagai macam model perumahan Islami. Tak jarang perumahan Islami hanya dimaknai sebagai perumahan dengan transaksi tanpa  riba. Padahal sebagai salah satu  bagian dari aktivitas ekonomi dan kebutuhan dasar seorang Muslim, pengembangan perumahan harus diarahkan untuk mencapai falah yang terangkum dalam terwjudnya Maqasid Syariah. Karena itu kajian ini bertujuan untuk menganilis perumahan Islami terbesar di kota Malang, De Prima, dengan menggunakan perspektif Maqasid Syariah. Dengan menggunakan metode penelitian kualitatif - konseptual, penelitian menemukan bahwa pada secara umum perumahan De Prima telah melakukan pengembangan perumahan Islami sesuai dengan maqasih syariah. Konsep Islam tidak hanya diaplikasikan dalam transaksi pembiayaan tanpa riba, melainkan juga pada seluruh proses  pengembangan perumahan. Selain itu kajian juga  menemukan bahwa penjagaan terhadap agama (hifdz-al-Din) terimplementasikan dengan baik. Sedangkan penjagaan terhadap jiwa / kehidupan (hifdz al-Nafs) tidak terealisasi dengan baik. Ini terlihat dari tidak adanya fasilitas kesehatan yang memadai, baik di dalam perumahan maupun diluar perumahan yang dapat dijangkau dengan cepat.

Abstract

There is no legal basis for giving testament wajibah to a grandparent in Indonesia. However, the Religious Courts of Tarakan, in decision number: 610/Pdt.G/2014/PA.Trk. the judges gave testament wajibah portion of the inheritance to the grandparent because the heir’s mother blocked their position and the parenting role carried out by the grandparent since the mother left the heir, and her existence was unknown. The judge’s decision must consider the principles of legal certainty, benefits, and a sense of justice for the parties. Therefore, this research focuses on the judge’s legal reasoning in decision number: 610/Pdt.G/2014/PA.Trk. and how the judge’s decision is seen from the perspective of Aristotle’s distributive justice theory. This research is juridical-normative with cases and conceptual approaches. The results showed that the judge’s legal reasoning through the process of de heuristic and de legitimate, legal basis that judges used are the holy Qur’an, hadith, KHI, and Islamic law. The judges consider the role of grandparents during the heir to life. And giving testament wajibah to grandparents is considered fair based on Aristotle’s distributive justice theory because they have fulfilled the proportional principle requirements.How to cite item: Saiban, K., Al Kaswy, T., SJ, F. Abstract

AbstractAl-Qur'an and Sunnah are one of the sources of law that exist in Islam and regulate all human actions. The role of the Qur'an and Sunnah extends to regulating the field of Islamic economics in great detail. This study aims to understand the role of the Qur'an and Sunnah in the development of sharia economics, especially in the study of sharia fintech related to the opportunities and challenges. The method used is library research. The data in this study were obtained using the documentary method sourced from the latest journal articles. The result of this research is that sharia fintech has been officially developed in Indonesia and has received special regulations from the National Sharia Council. The number of Muslim population and increasing technology users are special opportunities for the development of sharia fintech. The lack of understanding of the differences between sharia and conventional fintech is a challenge for financial technology players. Fintech has benefits that are in line with Islamic principles as stated in the Qur'an and Sunnah. This is what strengthens the existence of Islamic fintech, which will be able to continue to grow rapidly from time to time.AbstrakAl-qur’an dan Sunnah merupakan salah satu sumber hukum yang ada dalam Islam dan mengatur seluruh perbuatan manusia. Peran al-Qur’an dan Sunnah meluas hingga mengatur bidang ekonomi Islam dengan sangat rinci. Penelitian ini bertujuan untuk memahami peran al-Qur’an dan Sunnah dalam perkembangan ekonomi syariah terutama dalam kajian fintech syariah terkait dengan peluang dan tantangannya. Metode yang digunakan adalah dengan penelitianPustaka(library research).Data dalampenelitianinididapatdenganmenggunakanmetodedocumenteryang bersumber dari artikel-artikel jurnal terbaru. Hasil dari penelitian ini adalah fintech syariah telah resmi dikembangkan di Indonesia dan telah mendapat regulasi khusus dari Dewan Syariah Nasional. Jumlah penduduk muslim dan meningkatnya pengguna teknologi menjadi peluang khusus perkembangan fintech syariah. Minimnya pemahaman tentang perbedaan fintech syariah dengan konvensional menjadi tantangan tersendiri bagi para pelaku financial technology. Fintech memiliki manfaat yang sejalan dengan prinsip Islam sebagaimana yang tertuang dalam Al-Qur’an dan Sunnah. Hal itu yang menjadi penguat keberadaan fintech syariah akan mampu terus berkembang pesat dari waktu ke waktu.

Abstract

This study uses a qualitative approach with a descriptive analysis method. (1) in-depth interviews carried out with data collection techniques, (2) participatory observation, and (3) documentation. The data analysis process starts with data collection, editing (sorting), and checking the validity of the data. To check the validity of the data, the researchers used the data triangulation method. The results of this study indicate that: 1) The religious character of students at SMA Manggala Sakti Solokuro: The students have strong faith, devotion to Allah SWT, have strong faith, adhere to Islamic law, the students have a noble character, and have good character. As for Social Care: Devotion, help, kinship, caring, cooperation, and tolerance. 2) Implementation of PAI learning in the Formation of religious character and social care at SMA Manggala Sakti Solokuro, planning in the form of syllabus, socialization, lesson plans, implementation of Islamic Religious Education (PAI) learning in shaping religious character and social care at SMA Manggala Sakti Solokuro through 2 ways, namely intracurricular and extracurricular, evaluation with authentic assessment, assessment of reference criteria, reporting of learning outcomes. 3) Factors supporting the implementation of PAI learning in shaping religious character and social awareness include: prayer room, Islamic library, loudspeakers, culture of shaking hands with teachers before entering school, strong encouragement from the teacher council, availability of the Qur'an, teaching aids and LCD in the classroom. each class, there is an on-site evaluation. While the inhibiting factors include: student association outside school, different student backgrounds, environmental factors that are less supportive, the absence of a mosque, and friends' association

Abstract

Abstract: The purpose of this research is to find out the views of NU and Muhammadiyah scholars in Malang regarding Yusur Qardhawi's thoughts regarding misyar marriage. This research falls under the umbrella of qualitative descriptive research or empirical studies. Sort the information collected from interviews and documents into primary, secondary, and tertiary data, then edit, categorize, verify, and analyze. Based on these findings, the following can be put forward the views of NU and Muhammadiyah Malang clerics regarding Yusuf Qardhawi's fatwa regarding misyar marriage: first, NU and Muhammadiyah Malang ulema are of the view that misyar marriage is permissible as long as the conditions and pillars are met. On the second point, NU and Muhammadiyah clerics in the city of Malang said that maqashidun marriages in misyar marriages are possible but underutilized. Third, NU and Muhammadiyah clerics in the city of Malang are of the view that only a small part of the rights and obligations of husband and wife are fulfilled in misyar marriages. There is a strong tendency among NU scholars, especially those leaning towards the Shafi'i school, to consult the canonical works of the four schools in forming their own opinions. Muhammadiyah scholars, meanwhile, cite the Al-Qur'an and as-Sunnah as their main sources; they can also cite additional opinions from one of the four schools of thought, but only if both are authoritative and do not conflict with the Qur'an and As-Sunnah. Keywords: Nahdlatul Ulama, Muhammadiyah, Misyar Marriage   Abstrak: Tujuan penelitian berikut adalah untuk mengetahui pandangan ulama NU serta Muhammadiyah kota Malang menyikapi pemikiran Yusur Qardhawi berkenaan nikah misyar. Riset berikut berada di bawah payung penelitian deskriptif kualitatif atau studi empiris. Urutan informasi yang dikumpulkan dari wawancara dan dokumen menjadi data primer, sekunder, dan tersier, lalu edit, kategorikan, verifikasi, dan analisis. Berdasarkan temuan-temuan tersebut, berikut dapat dikemukakan pandangan ulama NU dan Muhammadiyah Malang terhadap fatwa Yusuf Qardhawi berkenaan nikah misyar: Pertama, ulama NU dan Muhammadiyah Malang berpandangan bahwasanya nikah misyar diperbolehkan selama syarat dan pilar terpenuhi. Pada poin kedua, ulama NU serta Muhammadiyah kota Malang mengatakan bahwasanya pernikahan maqashidun dalam pernikahan misyar dimungkinkan tetapi kurang dimanfaatkan. Ketiga, ulama NU serta Muhammadiyah kota Malang berpandangan bahwasanya hanya sebagian kecil dari hak serta kewajiban suami istri yang terpenuhi pada pernikahan misyar. Ada kecenderungan kuat di kalangan ulama NU, terutama yang condong ke mazhab Syafi'i, untuk mengkonsultasikan karya kanonik keempat mazhab tersebut dalam membentuk pendapatnya sendiri. Para ulama Muhammadiyah, sementara itu, mengutip Al-Qur'an dan as-Sunnah dijadikan sumber utama mereka; mereka juga dapat mengutip pendapat tambahan dari salah satu dari empat mazhab, tetapi hanya jika keduanya otoritatif serta tidak bersebrangan dengan Al-Qur'an serta As-Sunnah. Abstract

This article aims to examine the importance of preserving marine ecosystems from the perspective of maqāsid al-sharī’ah as an effort to realize a good food product supply chain, and to maintain and realize halal and tayyib (clean and pure) food products. The research method approach used in this article is a literature study or literature review. Sources are collected from books and various research articles on pollution of the marine environment and its consequences for human health that have been carried out by previous researchers, then studied from the perspective of maqāsid al-sharī’ah. The findings in this study show that the problem of damage to marine ecosystems due to pollution is a big problem that must be resolved, because of the impact caused not only on the environment but also on human health problems as a result of consuming marine biota exposed to waste, especially heavy metals. While preserving the ecosystem is part of maqāsid al-sharī’ah. Therefore, in realizing halal products that are tayyib, serious attention is needed on supply chain sources. The results of this research can contribute to thinking and decision-making regarding the importance of preserving the environment in realizing a good source of food supply.

Abstract

Islamic studies (dirosah islamiyyah) should be carried out and developed dynamically like scientific studies in general. But unfortunately on the contrary, Islamic studies seem to have stagnated or not experienced significant progress amidst various social issues that continue to develop. Even when there are Islamic studies conducted by Muslim insiders, they often appear dull and poor in approach and methodology. Islamic studies should be open to the methods and approaches currently being developed. Ibrahim M. Abu Rabi tries to open up this void through his study of the history of Islamic thought and awakens intellectuals so that they fully understand the role and importance of advancing Islamic studies. The scientific opinion is currently being developed. Problems that are increasingly complicated and complex cannot be explained satisfactorily by classical Islamic research theories that rely solely on textual research. According to him, Islamic studies must be open to contemporary scientific disciplines.

Abstract

­This research explores and discusses the importance of maintaining family harmony in Islamic family law according to the Madhhab of Imam Syafi'i. This article, explained that maintaining family harmony is started from the attachment between husband and wife in the marriage context. Both parties must respect, appreciate, and support each other and understanding self rights and obligations. Furthermore, this article also explained the importance of good communication between family members. Each family member have to own the ability of listening and sparing time to talk to each other, then problems arises can be resolved properly. In addition, good parenting from parents to their children is also very important in maintaining family harmony. This article also emphasized the importance of avoiding actions of damaging family harmony such as infidelity, harsh words, and household violence. This could endanger family harmony and potentially caused a rift in husband and wife relationship also between parents and children. This article also emphasized the importance of maintaining the unity and entity in family, thus each family member could feel the ownership of being part of a family that supports and holds each other in life. In conclusion, this article affirmed that harmony in the family is very important in Islamic family law according to the Madhhab of Imam Shafi'i. In maintaining family harmony, each family member need to support each other and maintain the integrity of the family as a whole unit. Therefore, promoting family harmony should always be a major concern for every Muslim family.
