Abstract

­This research explores and discusses the importance of maintaining family harmony in Islamic family law according to the Madhhab of Imam Syafi'i. This article, explained that maintaining family harmony is started from the attachment between husband and wife in the marriage context. Both parties must respect, appreciate, and support each other and understanding self rights and obligations. Furthermore, this article also explained the importance of good communication between family members. Each family member have to own the ability of listening and sparing time to talk to each other, then problems arises can be resolved properly. In addition, good parenting from parents to their children is also very important in maintaining family harmony. This article also emphasized the importance of avoiding actions of damaging family harmony such as infidelity, harsh words, and household violence. This could endanger family harmony and potentially caused a rift in husband and wife relationship also between parents and children. This article also emphasized the importance of maintaining the unity and entity in family, thus each family member could feel the ownership of being part of a family that supports and holds each other in life. In conclusion, this article affirmed that harmony in the family is very important in Islamic family law according to the Madhhab of Imam Shafi'i. In maintaining family harmony, each family member need to support each other and maintain the integrity of the family as a whole unit. Therefore, promoting family harmony should always be a major concern for every Muslim family.

Abstract

Indonesia is projected to become a center for the development of the halal industry. One of the halal industry sectors that has great potential to be developed is the halal tourism sector with its supporting sector in the form of sharia hotels. This study aims to identify and analyze the concept of sharia hotel development in Indonesia which is reviewed with an Islamic economic approach and sharia maqashid. Qualitative research method with descriptive approach is used in this research by using content analysis. The results of this study indicate that the development of sharia hotels in Indonesia is in accordance with maqashid sharia, namely not only paying attention to material aspects but also immaterial aspects. Sharia hotels have standards that must be met in the maqashid sharia framework, namely by paying attention to product aspects, service aspects, and management aspects.

Abstract

The presidential threshold is a threshold requirement for a political party or a coalition of political parties supporting a presidential and vice-presidential candidate pair using the percentage of the DPR seat acquisition or the national valid vote acquisition in the DPR general election. The presence of this presidential threshold is a barrier to the right to equal opportunity in government. This research aims to evaluate the various rights that have been violated by the presidential threshold policy from the perspective of human rights and maqashid sharia as a new view of the efforts to reform a just law. This research includes normative research with statutory and legal policy approaches. The results and discussion of this research are that the general election law related to the presidential threshold has been tested by the Constitutional Court. However, the Court always rejects the application because it is of the opinion that the presidential threshold is an open authority of the legislator based on the delegation of Article 6A Paragraph (5) of the 1945 Constitution. The rejection resulted in disappointment for the Indonesian people because it was considered to limit the right to become a leader. In the perspective of Maqāṣid syarī'ah, the presidential threshold policy has also violated hifdzu 'aql. Therefore, in the future, fair legal reform efforts must be realized, namely by amending Article 6A Paragraph (2) related to presidential requirements to clearly regulate and close the loopholes of interpretation by the legislators and moral development of constitutional judges so that they really fight for the rights of citizens with a further view of the constitution.

Abstract

The global trend of the halal business and the halal lifestyle should be supported by suitable policies that align with Islamic economic theory. This concept needs to have maslahah according to sharia maqashid. However, there is also a business plan, known as the Business Model Canvas (BMC), that is universally applicable to all types of enterprises. The purpose of this study is to investigate the halal industry's business structure from a maqashid Syariah standpoint using a canvas business model approach. A qualitative literature review is the methodology employed, with data from numerous research publications pertinent to the study issue. Based on Islamic economics in the halal industry and Maqashid Syariah, including maqashid dharuriyah, hajiyat, and tahsiniat, the research results demonstrate that the BMC conceptual framework includes nine elements: customer segments, value proposition, channels, customer relationships, key resources, key activities, revenue streams, and cost structures. at a practical level.

Abstract

Tulisan ini dilatarbelakangi oleh munculnya kebijakan pencantuman status perkawinan kawin belum tercatat dalam Kartu Keluarga (KK) yang tentunya menjadi pro kontra dikalangan masyarakat dan kemudian dianalisis menggunakan konsep maslahah Memang merupakan fenomena yang terjadi di Indonesia yang dimuat dalam PERMENDAGRI nomor 109 tahun 2019. Metode penelitian yang digunakan dalam penelitian ini adalah Jenis penelitian yang akan digunakan ini adalah penelitian (library research) yang bersifat kepustakaan. Penelitian ini merupakan penelitian kualitatif yang menghadirkan data deskriptif beberapa kata tulisan. Hasil penelitian menunjukan bahwa adanya aturan yang memperbolehkan pencantuman status perkawinan kawin belum tercatat dalam KK memberikan perbedaan pendapat tentu dilatar belakangi pada sudut pandang dalam menentukan sebuah kemaslahatan. Pendapat setuju (pro) memandang bahwa kebijakan tersebut tidak bertentangan dengan nash syara’ karena pencatatan nikah hanyalah perbuatan administratif saja bukan terkait keabsahan nikah yang terletak pada terpenuhinya rukun dan syara’, mengandung kemaslahatan karena merupakan upaya pemerintah untuk mengarahkan masyarakat pada sebuah kebaikan, dan juga termasuk maslahah hajiyah karena memang harus dilakukan oleh pemerintah guna kebaikan warganya dengan tidak menyalahi hukum agama serta peraturan-peraturan yang berlaku serta menghindari efek negatif yang mungkin timbul. Sedangkan disatu sisi pendapat yang kontra memiliki alasan tersendiri.

Abstract

This study aims to analyze in depth the implementation and success of the WAFA method in the Tahfidzul Qur'an program at Mohammad Hatta Islamic Elementary School, Malang. The WAFA method is an innovation in Qur'anic learning based on right-brain optimization, utilizing the TANDUR strategy and a multisensory approach. The research employed a descriptive qualitative approach, with data collected through participatory observation, in-depth interviews, and documentation studies during the period of October–December 2021. The results showed that the implementation of the WAFA method was effective, carried out through five structured stages (5P) with an emphasis on the Hijaz rhythm and meaningful movements. Approximately 78.3% of fifth and sixth-grade students successfully memorized the entire juz 30, indicating a significant improvement compared to the previous method. This success is influenced by factors such as teacher creativity, a conducive learning environment, and systemic school support. The findings provide a theoretical contribution to the development of neuroscience-based Qur'anic learning methods and practical implications for managers of Islamic educational institutions. It is recommended that teacher training modules be developed and technology integrated into the implementation of the WAFA method.

Abstract

This study aims to determine: (1) what values are internalized through habituation at SDIT Insan Permata Kota Malang. (2) the process of internalizing religious values through habituation at SDIT Insan Permata Kota Malang, (3) the impact of internalizing religious values through habituation at SDIT Insan Permata Kota Malang. This study uses a qualitative approach with a descriptive research type. This study shows that the religious values instilled in students include values derived from divine values, namely faith and piety, and values derived from human values, including brotherhood, compassion, trustworthiness, and generosity. The internalization process is divided into three stages, namely the value transformation stage, the value transaction stage, and the value transinternalization stage. The impact of the internalization of religious values through habit formation is that students have good religious values, as seen in their more orderly and proper worship, greater responsibility for their duties and obligations, and a growing habit of giving alms.

Abstract

The Kromojati tradition in Gunung Kidul contains elements of benefit, both for husband and wife, for the community, and environmental preservation. The purpose of writing this article is to explain the Kromojati tradition in marriage in terms of the maslahah mursalah method. So that it can be analyzed the benefits that exist in this tradition. This research method uses a qualitative descriptive approach to explore the Kromojati tradition in marriage by analyzing the maslahah mursalah method. There are three research results in this article: [1] the Kromojati tradition is a requirement for the bride and groom who will enter into a marriage contract to bring ten teak seedlings, five of the seedlings are used as a means for conservation, and the other five seeds are intended for investment. [2] maslahah mursalah is maslahah that is not legal and is not opposed by the Shari'a but is supported by several arguments that show its benefit and do not cause real damage. [3] the form of benefit contained in the Kromojati tradition can be analyzed from the objectives and impacts that occur. From the objective aspect, the benefit that is born is environmental conservation and investment for the newlyweds. Meanwhile, from the aspect of impact, the benefit lies in increasing public awareness to preserve the environment, there is a balance between preserving the environment and saving for the bride and groom and the community so that it can be used as buildings that can develop advanced villages.

Abstract

The greun system is a customary mechanism used by the Lamaholot people in regulating marriage based on kinship relations and tribal structure. In practice, greun is often used as the main reference before marriage takes place, even preceding religious considerations. This study addresses the gap in integrating local customary marriage practices with the framework of maṣlaḥah mursalah in Islamic legal theory. This article aims to examine the greun system through the maṣlaḥah mursalah approach in order to assess the legitimacy and limits of its applicability in Islamic marriage law. This research uses a qualitative method with a normative-empirical approach, through the analysis of the literature on fiqh proposals and interviews with traditional and religious leaders in Leworaja Village, Lembata Regency. The results of the study show that greun functions as a customary norm that regulates the selection of mates and maintains social order in the Lamaholot community. Maṣlaḥah Mursalah provides a methodological framework for judging Greun as 'urf which is judged on the basis of maqāṣid al-Syarī'ah. Greun is at the level of maṣlaḥah ḥājiyyāt so that it acts as a mechanism of social benefit without having the authority to determine halal-haram or the legality of marriage according to shari'i. This article contributes to affirming the distinction between customary and sharia authorities and enriching the study of fiqh proposals based on local contexts. Abstract

This study aims to examine the transformation of the deleh mendeleh tradition within marriage practices in Sukowati Village, Gresik Regency, through the lens of ‘urf in Islamic law. Traditionally regarded as a form of voluntary mutual assistance, empirical findings reveal that the practice has evolved into a socially binding system of reciprocity characterized by systematic record-keeping and expectations of repayment. This qualitative field research involved 10 informants selected through purposive sampling. Data were collected through in-depth interviews, observation, and documentation, and analyzed using thematic analysis. The findings indicate a dual perception within the community. While some participants continue to view deleh mendeleh as an expression of solidarity, others experience it as a social obligation accompanied by economic pressure. Empirical evidence shows that recorded contributions ranging from IDR 50,000 to IDR 500,000 generate repayment expectations that disproportionately burden lower-income households. From the perspective of ‘urf, the practice may be classified as ‘urf ṣaḥīḥ when based on voluntariness and oriented toward ta‘āwun and maṣlaḥah. However, when shaped by social pressure and economic burden, it shifts toward ‘urf fāsid, as it undermines the principles of justice and mutual consent (riḍā). This study contributes to uṣūl al-fiqh discourse by demonstrating that ‘urf is dynamically shaped by processes of social institutionalization, thereby requiring continuous reassessment to ensure its alignment with Islamic legal principles.
