Abstract

Freedom of speech is one of the rights that individuals possess for expressing themselves, sharing opinions, and is protected by positive law in Indonesia. With the advancement of technology, public opinions are often shared through social media, where information can be quickly and easily obtained. Expressing opinions on social media may sometimes involve elements of defamation or insults toward others, which can lead to legal consequences. One case concerning defamation on social media is Decision Case Number 986/Pid.Sus/2021/PN Tjk. The research method used is normative juridical legal research. The research results indicate two legal issues to be examined. First, what are the differences in the elements of defamation offenses under the Electronic Information and Transactions Law and the Criminal Code? Second, has Decision Number 986/Pid.Sus/2021/PN Tjk aligned with the facts presented in the trial regarding defamation? The research findings suggest that the regulation of defamation in the Criminal Code is general, while in the Electronic Information and Transactions Law it is specific. The case of Decision Number 986/Pid.Sus/2021/PN Tjk does not align with the legal facts presented in the trial, as further analysis reveals that the more appropriate charge for the defendant would be the crime of defamation under Article 311 paragraph (1) of the Criminal Code.

Abstract

The principle of equality before the law, as an integral part of the rule of law doctrine that is often applied by developing countries such as Indonesia, is an important key in creating justice, especially in the context of implementing restorative justice in law enforcement in certain cases. Although this concept does not eliminate criminal sanctions, the importance of restoring losses and reconciliation between perpetrators and victims is the main focus in determining the appropriate punishment, which is in line with the principle of the principle of equality before the law. The results of the study are that the principle of equality before the law is used as a reference for standardization in the paradigm of restorative justice law against the judge's decision trying the defendant Galan Julianda Bin Z Bulungan, it is seen that the judge used the teachings of restorative justice as a guideline in sentencing the defendant. The teachings of restorative justice are seen as restoring the relationship between the perpetrator and the victim, as well as an act of atonement by the perpetrator of the crime. The principle of equality before the law as one of the principles in law that is important in implementing the Galan Julianda Bin Z Bulungan Case, the construction of restorative justice in the judge's decision is a significant change in the paradigm of criminal law.

Abstract

The objective of the empirical study is to examine liquidity (CR), profitability (ROA), reputation of accountant public firms (KAP), public ownership and audit opinion towards the timeliness of delivering financial statement. This research is using 63 manufacturing companies which listed in Indonesian Stock Exchange from period 2008 – 2010. In this data analysis the technique used is logistic regression to test: an overall model fit by using the -2Log Likelihood, assess the feasibility of a regression model using the Hosmer and Lemeshow's Goodness of fit, Cox and Snell's R Square and Nagelkerke's R Square and parameter estimation and interpretation using the classification table. The results from this study are (1) liquidity had no significant influence to the timeliness of delivering financial statements (2) profitability had no significant influence to the timeliness of delivering financial statements (3) reputation of accountant public firms (KAP) had no significant influence to the timeliness of delivering financial statements (4) public ownership had no significant influence to the timeliness of delivering financial statement (5) audit opinion had no significant influence to the timeliness of delivering financial statement (6) liquidity (CR), profitability (ROA), reputation of accountant public firms (KAP), public ownership and audit opinion had significant influence to the timeliness of delivering financial statement. Abstract

Kasus pemanfaatan anak sebagai pengemis masih sering terjadi di Indonesia. Padahal, anak adalah generasi penerus bangsa yang seharusnya selalu dijaga dan dilindungi. Kebanyakan, orang tua mereka sendiri yang memanfaatkan anak untuk mengemis, padahal mereka seharusnya berperan penting dalam melindungi dan menjaga anak tersebut. Perlindungan terhadap anak yang digunakan sebagai pengemis telah diatur dalam berbagai peraturan perundang-undangan, salah satunya adalah KUHP Nasional. Namun, dalam undang-undang tersebut membatasi umur anak yaitu 12 tahun. Penelitian ini bertujuan untuk menganalisis unsur-unsur dalam pasal 425 KUHP Nasional dan penetuan batas usia anak dalam pasal tersebut. Metode yang digunakan adalah penelitian yuridis normatif dengan pendekatan peraturan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa unsur-unsur dalam pasal 425 KUHP Nasional terbagi menjadi dua, yaitu unsur objektif dan unsur subjektif. Selain itu, penetapan batas usia anak dalam pasal tersebut bertentangan dengan undang-undang lain, seperti UU Perlindungan Anak, yang menyatakan bahwa seseorang dapat dikategorikan sebagai anak hingga berusia kurang dari 18 tahun.

Abstract

This study focuses on the specialized rehabilitation of military personnel who have been convicted of narcotics crimes. Its aim was to comprehend the meaning, urgency, and concept of rehabilitating individuals within the military who have been found guilty of such crimes. To achieve this aim, the methodology used is normative legal study with statutory, contextual, case-based, and comparative approaches. Furthermore, the legal sources utilized consisted of both primary and secondary legislation. The results obtained from this study showed that rehabilitation for incarcerated military personnel involved in narcotic crimes corresponds to an endeavor aimed at providing exceptional rehabilitation specifically tailored to their circumstances. It is also important to note that the urgency of rehabilitation is closely related to the vested interest of the military in continuing the rehabilitation process, aligning with the initial recommendation. The state should, hence, give careful consideration to the implementation of specialized medical and social rehabilitation programs for military personnel who have been convicted of narcotic crimes. It is of utmost importance to establish a comprehensive framework within military agencies to facilitate the execution of medical and social rehabilitation measures for military members involved in narcotics offenses, including the necessary funding. In conclusion, the imposition of specialized rehabilitation measures, in conjunction with imprisonment, is essential for military personnel that are convicted of these crimes before their reintegration into society. This approach makes the state responsible for addressing the repercussions of their actions and providing tailored rehabilitation support to prevent any lingering resentment, minimize the risk of their recruitment by adversaries of the state, and enable their potential contributions if required in the future.

Abstract

Children are the next generation of the nation who must be given attention, supervision, rights and protection from all forms of violence. However, child protection has a very important existence, especially in cases of child crime. Children are indeed vulnerable to crime, therefore children need extra supervision from parents and from the government through a law that regulates the protection of children from a crime. One of the criminal acts committed by children is sexual intercourse. Like the case decided by the Kolaka District Court No. 4 / Pid.Sus-Anak / 2020 / PN.Kka concerning the crime of sexual intercourse committed by children. The public prosecutor charged the child with violating Article 81 paragraph (1) and (2) in conjunction with Article 76D of Law No. 17 of 2016 concerning the Stipulation of Government Regulation in Lieu of Law No. 1 of 2016 concerning the Second Amendment to Law No. 23 of 2002 concerning Child Protection into Law in conjunction with Article 55 paragraph (1) ke-1 of the Criminal Code. Furthermore, the identity of children in conflict with the law must be kept confidential. In the decision of the Kolaka District Court No. 4/Pid.Sus-Anak/2020/PN.Kka which does not obscure the identity of the child. In fact, Article 10 of the Supreme Court Decree No. 144 of 2007 concerning Disclosure of Information in Court regulates the obligation to obscure the identity of children in conflict with the law (ABH). Therefore, this needs to be discussed further. In this study, the author uses a normative legal research type (Legal Research) with a statutory and conceptual regulatory approach. The conclusion of this discussion is that the child perpetrator has fulfilled the elements of "committing violence or threats of violence, forcing children. Furthermore, related to the identity of the ABH, it must be kept confidential in print and electronic media, in order to maintain the confidentiality of the child's identity so that there are no bad assumptions in the public. Abstract

The Covid-19 pandemic, which has become a global epidemic, requires the implementation of health protocols in order to prevent its spread, creating its own social problems, especially for the growth and development of children, so that they are the most affected. This study uses empirical juridical methods and uses a conceptual approach. The results of this study indicate that the problem of fulfilling children's rights during the pandemic is still a priority scale program by the government in Jember Regency which must be resolved immediately, especially in terms of health and education. In the context of health, children still have not received vaccination facilities. On the other hand, online children's education is also not optimal due to limited interaction between teachers and students. This research also formulates recommendations for formulating precise policies in terms of mainstreaming the fulfillment of rights to children during the Covid-19 pandemic, especially in Jember Regency, establishing an accountable and accurate information system regarding the distribution of children affected by the Covid-19 pandemic, and making new breakthroughs related to mechanisms. education, health and the environment in favor of the fulfillment of children's rights

Abstract

Medical records contain confidential information of patient’s medical condition and treatment given.  In the public interest or for the sake of law enforcement, the confidentiality of medical records may be breached.   Stake holders (patients, health workers and law enforcers) should take cognizance of what procedures and limitation exist when requesting the acquisition of medical records in the public interest. Using a juridical doctrinal method, the prevailing rules and regulation related to medical record and its breach of confidentiality shall be analysed.  One important finding is that there is a dire need to seek a balance between satisfying public interest and the protection of patient’s privacy rights.

Abstract

Human trafficking constitutes one of the most egregious forms of human rights violations, characterized by extensive criminal networks operating at both individual and group levels. This phenomenon is not new, and certain countries, including Indonesia, report high incidences of human trafficking-related crimes. The purpose of this research is to provide an evaluation and understanding of the legal protections available to victims of human trafficking in Indonesia. This study is classified as normative legal research, involving an examination of theories, concepts, legal principles, and relevant statutory provisions pertaining to the topic. Despite significant efforts by the Indonesian government to combat human trafficking, minimum standards for eradication have not been fully met. While there have been notable advancements compared to previous periods, especially in response to the challenges posed by the COVID-19 pandemic, substantial deficiencies remain. Indonesia's upgrade to Tier 2 reflects progress in the investigation, prosecution, and adjudication of human trafficking offenses, including cases of forced labor in palm oil plantations and cyber fraud operations abroad. Additionally, there have been efforts to enhance compensation for victims of human trafficking.

Abstract

Era digital telah membawa perubahan signifikan dalam industri perbankan. Kemajuan teknologi mempermudah berbagai transaksi keuangan, namun juga meningkatkan risiko kejahatan perbankan seperti pencurian identitas, peretasan akun, dan penipuan online. Kejahatan perbankan ini memerlukan sistem penegakan hukum yang efektif untuk melindungi nasabah dan integritas sistem keuangan. Tujuan penelitian ini membandingkan sistem penegakan hukum kejahatan perbankan di era digital di negara maju dan berkembang. Penelitian ini menggunakan metode penelitian Systematic Literature Review (SLR). Data yang telah terkumpul kemudian dianalisis dalam tiga tahapan yakni reduksi data, penyajian data dan penarikan kesimpulan. Hasil penelitian menunjukan bahwa sistem penegakan hukum kejahatan perbankan di era digital di negara maju dan negara berkembang memiliki perbedaan dan persamaan. Negara maju umumnya memiliki sistem hukum yang lebih kuat, sumber daya yang lebih memadai, dan teknologi yang lebih canggih untuk memerangi kejahatan perbankan. Namun, negara berkembang juga memiliki beberapa keunggulan, seperti budaya hukum yang lebih fleksibel dan kemampuan untuk beradaptasi dengan perubahan dengan lebih cepat. Sehingga untuk memperkuat sistem penegakan hukum kejahatan perbankan di era digital, negara berkembang perlu meningkatkan kerjasama internasional, memperkuat kapasitas penegak hukum, dan meningkatkan kesadaran masyarakat tentang kejahatan perbankan.
