Abstract

The use of technology for the judiciary is now a necessity. In Indonesia, information technology is used for court administration to achieve fast, simple, and low-cost trials. The Supreme Court issued a Supreme Court Regulation as the legal basis for the administration of administration and electronic trials. This is done to make it easier for people to seek justice. The electronic court began in 2018. Its implementation is carried out in stages, starting with certain religious courts as an introduction. Subsequently carried out for all Religious Courts in Indonesia. The problems of this study are: (i) the condition of the religious court from the perspective of legal culture, (ii) reforming the religious court in the perspective of legal culture, (iii) renewing the legal culture of religious courts using an electronic system / E court. The social setting is the Office of PA Kendal class 1 A and PA Pemalang Class 1 A. The study shows; (i) The reality of the number of case registrations in 2019 at the Kendal Religious Court Class 1A shows that the legal culture of registering using the E-Court is 117 cases (3.4%) whereas 5 cases litigation (0.13%). The reality of the legal culture of case registration at the Pemalang Religious Court Class 1A with E Court totaling 94 cases (1.8%). Whereas the legal culture of the trial by e-litigation at the Pemalang Religious Court since the issuance of Perma 1 of 2019 has only 4 cases (0.1%), (ii) the development of legal culture in the electronic system of religious courts is carried out by developing an internal and external legal culture in terms of pre-registration, court administration, trial. Development of an internal legal culture for judges, e-court operator officers, e-court corner officers, public service officers to invite justice seekers to use e-court in its resolution. The service officer also helps justice seekers to make an email as an electronic domicile as a requirement for e-court registration. Development of an external legal culture through socialization. Socialization for advocates is carried out through media meetings, flyers, and online web media. As well as mandatory online / e-court registration. Development of external culture for the community (other users) at the village level in the jurisdiction of the local religious court. The effort is to work at the village level to conduct socialization about electronic courts in the village by the Religious Courts.

Abstract

The purposes of this paper are: (i) to describe various problems in the philosophical, sociological and juridical aspects of the existence of civil procedural law as formal law in Indonesia; and (ii) offer solutions to these problems by updating the civil procedural law. The method in this paper uses normative legal research with a statutory approach by conducting a literature study using primary and secondary materials. The results of this paper indicate several things. The first, sociologically, people's lives develop dynamically so that the provisions of civil procedural law are not in accordance with the times. As for juridically, this provision is not unification, legal uncertainty, and a legal vacuum. The second, legal reform is part of the development of national law by taking into account the framework of the national legal system. The third, there are efforts and forms of civil procedural law reform carried out by each element of state power. The novelty of this paper is containing a comprehensive discourse that answers the problem of the applicability of civil procedural law with the efforts and forms of reform of civil procedural law in Indonesia. The conclusion in this paper is the provisions of civil procedural law need to be updated based on philosophical, sociological, and juridical considerations. Reform of civil procedural law must take into account the national legal system, principles, and content material in its formation.

Abstract

Intellectual property is used to increase economic value while providing legal protection for innovative inventions. Goyor Glove, typical of Pemalang, in fact, does not yet have legal protection on Intellectual Property, especially Industrial Design, so that the protection is low and many industrial designs of Goyor sarong are used by others without permission. The methods used to solve the problems in this service program are: (1) Training (workshop), which aims to provide knowledge and skills in quality improvement and product development (2) Product development and application management of the Goyor motif motif to be a description of IP Industrial Design; (3) Assisting and facilitating IP registration of Industrial Designs to be able to increase the economic value of the product; and (4) Monitoring and Evaluation for follow-up plans. Partners in this program, namely the Goyor Sarong Craftsmen in Pemalang District, were given the opportunity to play an active role, from the time of training to mentoring, facilitation and monitoring and evaluation especially during registration and acceleration of obtaining IP Industrial Design certificates craftsmen are given the opportunity to actively provide ideas, criticism in product development and application of management to obtain IP protection. Thus this activity is centered on partners based on the basic needs of partners to develop by increasing the economic value and welfare of the Goyor Gloves craftsman in particular.

Abstract

Small and Medium Enterprises (SMEs) in Indonesia are growing rapidly and continuing to grow. These developments had a significant impact on economic growth for various sectors in Indonesia. However, the dynamics of the development of SMEs are still overshadowed by the unclear protection of rights relating to intellectual property, including economic rights for SMEs. In fact, this right becomes an important part that is regulated both in national and international legal rules. The purpose of this study is to determine and compare the implementation of the protection of economic rights for SMEs in Central Java Province, Indonesia. This research method uses interview techniques and direct observation in several SMEs in Central Java. This study found that the protection of economic rights for SMEs had not been maximally carried out, even the number of SMEs did not yet obtain guaranteed recognition of the brand rights and copyrights of their products. This study concludes that in applying protection to economic rights for SMEs, collaboration between sectors and ministries is needed, not only the Ministry of Law and Human Rights, but also Industry, Trade and Economy.

Abstract

Peralihan hak atas tanah dapat melalui berbagai cara. Seperti jual beli, warisan dan hibah. Di setiap peralihan hak atas tanah tersebut memerlukan bukti peralihan yaitu akta otentik. Dalam hibah, masyarakat kurang paham tentang pentingnya akta otentik hibah. Padahal dengan adanya akta otentik hibah memberikan kepastian hukum bagi pemegang haknya dan meminimalisir terjadinya sengketa hibah. Pelaksanaan pengabdian telah didahului dengan survei awal daerah lokasi pengabdian di bulan april 2015. Hasil survei menunjukkan banyak masyarakat terutama yeng telah melakukan hibah tanah/ rumah tidak paham pentingnya akta hibah. Sehingga tim pengabdi merasa sangat prihatin dan bersemangat untuk memberikan pemahaman tentang aturan hukum pentingnya akta hibah. Juli 2015, tim pengabdi menindaklanjuti dengan melakukan perizinan secara lesan terhadap sasaran pengabdian yaitu masyarakat Desa Karangmanggis. Setelah mendapat jawaban bahwa bisa dilakukan di bulan September, maka secara formal/prosedur perizinan, surat tertulis kami susulkan. Sosialisasi dilakukan pada hari Ahad tanggal 7 September pukul 13.00. Kegiatan ini dilakukan dengan materi pelatihan yang diberikan oleh Tim Pengabdian Kepada masyarakat secara dengan atmosfer diskusi dengan duduk bersama dalam suatu lingkaran dan bertautan erat pada materi yang diberikan secara bergiliran. Metode yang dilakukan secara diskusi interaktif yang didahului dengan pemberian materi terkait.

Abstract

Syarat usia kawin menurut UU No. 1 Tahun 1974 adalah 19 tahun. Namun di Desa Kedungkelor Kecamatan Waru Reja Kabupaten Tegal banyak pasangan perkawinan yang melakukan perkawinan di usia anak (belum dewasa). Hal ini disebabkan dari faktor pendidikan, budaya, ekonomi dan sosial. Upaya preventif dilakukan oleh lembaga terkait melalui penyuluhan, sosialisasi, belum memperlihatkan hasil yang maksimal karena kuatnya budaya setempat yang melanggengkan perkawinan anak. Agenda Sustainable Development Goals (SDGs) atau Tujuan Pembangungan Berkelanjutan 2015-2030 yakni mencapai kesetaraan gender dan pemberdayaan seluruh perempuan dan anak perempuan, secara spesifik dalam Target 5.3 disebutkan target untuk menghilangkan segala praktek-praktek berbahaya seperti perkawinan anak, pernikahan paksa, serta khitan perempuan. Model integracy Policy digunakan untuk upaya preventif perkawinan anak dengan melibatkan pihak terkait Desa Munding. Perkawinan anak terjadi karena (1) Adat kebiasan (kultur) kawin di usia muda, (2) Kurangnya wawasan masyarakat tentang perkawinan anak, (3) Kurangnya akses dan minat untuk melanjutkan pendidikan. Upaya preventif dilakukan dengan model integracy policy yang melibatkan berbagai pihak terkait perkawinan anak yaitu orang tua, aparat desa, KUA, Kementrian Agama, Dinas Pendidikan, Dinas Kesehatan. Antusiasme mitra pengabdian Nampak dengan banyaknya peserta yang hadir. Forum diskusi dilakukan dengan sangat semangat sehingga sasaran pengabdi paham tentang perkawinan anak, dampak negatifnya serta akibat hukumnya. Kunjungan dilakukan sebanyak 3 kali yaitu tanggal 5, 12, 19 Juli 2019. Kunjungan pertama untuk mengurus perijinan dan melakukan observasi secara mendalam tentang kondisi masysrakat sasaran. Kunjungan ke dua berupa sosialisasi edukasi preventif perkawinan anak. Kunjungan ke tiga berupa evaluasi terhadap masyarakat sasaran ditinjau dari sisi perspektif terkait realita perkawinan anak, dan penundaan perkawinan anak bagi yang akan melanhsungkan perkawinan.

Abstract

Coffee is one of the leading commodities for Indonesia. The growth of coffee farming throughout Indonesia has also increased significantly in line with the growing trend of love for coffee on a national and international scale. This paper aims to discuss and explain the legal protection of coffee farmers registered with geographic indications in Tlahap Village, Kledung Temanggung, Central Java. This paper describes and analyzes various efforts to increase understanding of legal protection of geographic indications for coffee farmers. The method used in this program is direct assistance to coffee farmers in Tlahap Village and evaluation through interviews and surveys. The program found that the main obstacle faced by geographically indicated coffee farmers in Tlahap Village is human resources. The absence of a certified party to control coffee quality is one of the obstacles faced, in addition to the constraints of the geographical indication coffee farmer organizational structure. In addition, this program emphasizes that by increasing the understanding of legal protection for coffee farmers with geographical indications, the farmers are able to have readiness to face various obstacles in the field, one of which is regarding brand disputes, label fraud, and other legal problems. This program concludes that in terms of legal protection, cross-sectoral cooperation between farmer associations, government agencies and universities is required.

Abstract

The obligations of children in parental care are clearly regulated, both in Article 46 paragraph 1 of Law Number 1 of 1974 concerning Marriage and Article 321 of the Indonesian Civil Code. These two rules emphasize the obligation of children (mature) to care for and provide for their parents. However, the implementation of this rule is still not uniform. One of the contributing factors, apart from the economic level (poverty) is also the unequal perception and level of education in understanding this right which is still low. This research is a community service program funded by the Universitas Negeri Semarang. This program is located on Kedungkelor Village, Wanureja District, Tegal Regency, Central Java. This program aims to determine the level of change in understanding of the right of alimentation for the elderly group in Kedungkelor Village through the Legal Counseling Approach method. This method is a combination of methods of education, socialization, and legal assistance for residents. This program showed a pattern of significant changes in the level of understanding of the alimentation rights of the elderly. Of the 50 people surveyed showed an increasing trend of understanding. This program includes three important stages, namely: planning, advice, and legal action. In the legal action stage, this program involves the Youth Counseling Information Center (Pusat Informasi Konseling Remaja, PIKR) and the Elderly Health House (Rumah Sehat Lansia, RUSELA) in Kedungkelor Village in maximizing this level of understanding.

Abstract

Usaha Mikro kecil dan menengah (UMKM) menjadi tulang punggung ekonomi nasional sekaligus ujung tombak perputaran ekonomi dalam negeri. Mitra Asosiasi Muslimah Pengusaha Indonesia (ALISA) daerah Pemalang menghimpun UMKM di daerah Pemalang untuk lebih berdaya (mulai dari produksi, pengemasan, pemasaran, pendaftaran kekayaan inteleketual merek). Produk dari UMKM pemalang memiliki kekhasan kota pemalang telah banyak beredar dengan merek dagang yang merupakan brand dari produk UMKM seperti kamir dan ogel ogel. Merek sebagai bentuk perlindungan hukum belum sempurna bila belum di daftarkan pada Kementrian Hukum dan HAM. Sehingga merek produk dapat ditiru dengan mudah oleh sesama UMKM dengan tidak mempertimbangkan kualitas produk dan berpengaruh pada omzet pendapatan yang turun. Permasalahannya masyarakat sasaran (pelaku UMKM) belum berpengetahuan tentang urgensi pendaftaran merek. Kondisi ini dimanfaatkan oleh pihak yang mendompleng ke populeran UMKM (sudah memiliki pasar bagus). Mitra Alisa Pemalang membutuhkan pelatihan tentang edukasi, percepatan, pendampingan penyusunan dan pendaftaran berkas merek sehingga solusi pengabdi berupa kegiatan edukasi sosialisasi tentang kekayaan intelektual merek. Metode yang digunakan untuk menyelesaikan masalah program pengabdian ini adalah: Sosialisasi yang bertujuan menambah pengetahuan dan pemahaman dalam peningkatan kualitas dan pengembangan produk. Sosialisasi dierikan kepada perwakilan UMKM sejumlah 11 UMKM karena kegiatan dilakukan saat masa pandemi dengan protocol kesehatan ketat. Hasil sosialisasi berupa khalayak sasaran semula belum optimal dalam pemahaman urgensi pendaftaran Kekayaan Intelektual merek sehingga peningkatan pemahaman masyarakat UMKM Kabupaten Pemalang perlu dimaksimalkan. Pretest dan Post test dilakukan pada kegiatan.Peningkatan pemahaman pada masyarakat sasaran diukur dari rerata prosentase jawaban benar pada pre test 39 % menjadi 65% pada saat post test.

Abstract

Small Claim Court is the implementation of a case examination carried out in a simple procedure. With a court judgment being handed down in the trial process, it does not mean that the case is declared finished. It is necessary to carry out the implementation of the decision, namely execution if the losing party in the trial does not want to carry out the contents of the decision voluntarily. The problem in this study is what are the legal consequences for each party if the execution of the court jugdment in the default case through Small Claim Court in the Pengadilan Negeri Brebes is not carried out?. This research is an empirical research using a qualitative approach. Required a primary data and secondary data in an empirical legal research. To be able to obtain the necessary data, the author uses several ways, namely by conducting interviews, literature studies, reviewing documents. The results of the research that have been carried out explain that if there is no request for execution and the execution is not carried out, the legal consequences for the defendant as the debtor must still carry out the court jugdment by paying the remaining debt to the Plaintiff. In order to fulfill the debt, the defendant can independently sell the defendant's assets to pay off the remaining debt of the defendant to the plaintiff. While the legal consequences for the Plaintiff as the creditor, the Plaintiff still has the right to the debt to the Defendant as the debtor and the receivable must be paid immediately by the Defendant as the debtor. So the Plaintiff as the creditor continues to carry out parate executions based only on a power of attorney to sell the collateral, the Plaintiff can be declared to have committed an unlawful act.
