Abstract

Potensi yang dimiliki masyarakat (pelaku usaha kecil) apabila diberdayakan semaksimal mungkin melalui pemberian kredit usaha dapat meningkatkan taraf hidup masyarakat. UU No. 10 Tahun 1998 tentang Perbankan Pasal 12 ayat (1)  berbunyi ‘Untuk menunjang pelaksanaan program peningkatan taraf hidup rakyat banyak melalui pemberdayaan koperasi, usaha kecil dan menengah, Pemerintah bersama Bank Indonesia dapat melakukan kerjasama dengan Bank Umum’. BTPN MUR Cabang Karangayu Semarang  turut berperan dalam pemberdayaan masyarakat melalui pemberian kredit usaha. Penelitian ini bertujuan untuk mngetahui dan menganalisa upaya preventif timbulnya kredit macet dalam pemberian kredit usaha.  Penelitian ini menggunakan metode pendekatan yuridis empiris. Berdasarkan dari hasil penelitian dapat disimpulkan pemberian kredit kepada debitur yaitu dengan mempertimbangkan  “the five of credit analysis” calon debitur. Proses analisa mendalam sesuai dengan UU Perbankan No 10 tahun 1998 Pasal 8 yang berbunyi ‘Dalam memberikan kredit atau pembiayaan berdasarkan Prinsip Syariah, Bank Umum wajib mempunyai keyakinan berdasarkan analisis yang mendalam atau itikad dan kemampuan serta kesanggupan nasabah debitur untuk melunasi utangnya atau mengembalikan pembiayaan dimaksud sesuai dengan yang diperjanjikan.”.  Selain itu juga dilakukan upaya pendampingan melalui kegiatan pelatihan  berkala seputar pengelolaan modal dan usaha serta monitoring ke tempat usaha.  Tujuan dari pendampingan agar debitur menggunakan dana kredit secara maksimal, penuh tanggung jawab sehingga dalam proses pngembalian angsuran di tiap bulan selalu lancar. Potential of community (small business agent) when empowered as much as possible through the business lending can improve people’s lives. This study uses an empirical approach of empirical juridical. The analysis results’ conclusions in business lending to debtor is consider ”the five of credit analysis” of debtor. In-depth analysis of the process in accordance with the Banking Regulation No. 10 of 1998 Paragraph 8 said that,” In providing credit or financing based on Islamic principles, public banks shall have a belief based on in-depth analysis or conviction and the ability and responsibility of debtor to repay the debt or return the financing referred to appropriate with the agreement.

Abstract

Small Claim Court is the implementation of a case examination carried out in a simple procedure. With a court judgment being handed down in the trial process, it does not mean that the case is declared finished. It is necessary to carry out the implementation of the decision, namely execution if the losing party in the trial does not want to carry out the contents of the decision voluntarily. The problem in this study is what are the legal consequences for each party if the execution of the court jugdment in the default case through Small Claim Court in the Pengadilan Negeri Brebes is not carried out?. This research is an empirical research using a qualitative approach. Required a primary data and secondary data in an empirical legal research. To be able to obtain the necessary data, the author uses several ways, namely by conducting interviews, literature studies, reviewing documents. The results of the research that have been carried out explain that if there is no request for execution and the execution is not carried out, the legal consequences for the defendant as the debtor must still carry out the court jugdment by paying the remaining debt to the Plaintiff. In order to fulfill the debt, the defendant can independently sell the defendant's assets to pay off the remaining debt of the defendant to the plaintiff. While the legal consequences for the Plaintiff as the creditor, the Plaintiff still has the right to the debt to the Defendant as the debtor and the receivable must be paid immediately by the Defendant as the debtor. So the Plaintiff as the creditor continues to carry out parate executions based only on a power of attorney to sell the collateral, the Plaintiff can be declared to have committed an unlawful act.

Abstract

Investasi adalah aktivitas mengelola dana untuk melakukan usaha guna mendapatkan keuntungan. Investasi saat ini diatur dalam UU Cipta Kerja namun sebelumnya pengaturan investasi terdapat dalam UU Nomor 25 Tahun 2007 tentang Penanaman Modal yang mana pada UU Nomor 25 Tahun 2007 tercermin pengaturan investasi memiliki dua sisi dalam pelaksanaannya. Satu sisi investasi akan membuka peluang kerja, pemasukan negara dan lain sebagainya. Sedangkan sisi lainnya, dengan dibukanya peluang investasi maka berbagai fasililitas, kemudahan akan ditawarkan kepada investor guna menarik minat investasi di suatu negara, walaupun fasilitas dan kemudahan tersebut harus mengorbankan hak warga negara sendiri yang dalam hal ini nampak liberaliralisme dalam pembukaan peluang investasi di Indonesia. Oleh karena itu penulis menganalisa UU Ciptaker sebagai aturan yang mengubah UU Penanaman Modal.  Berdasar pada telaah participatory antara penulis dengan pelaku UMKM didapatkan kesimpulan bahwa UU Ciptaker menjadi UU yang lebih memiliki keberpihakan kepada UMKM daripada UU Penanaman Modal karena mampu menjawab kebutuhan dan memberikan peluang akses sumber daya ekonomi bagi UMKM.

Abstract

Reforming the criminal application legislation in the national legal system is critical. This research uses the paradigm of legal constructivism and the type of research used is juridical-sociological. Criminal law enforcement regulations are currently still scattered in various laws and regulations, it is not impossible that they will disrupt the law enforcement system, especially in the implementation of criminal decisions/actions. Character building is an effort to establish a conservation value system to achieve the value of justice, the value of certainty and the value of benefit in law enforcement for the implementation of criminal law. Therefore, efforts are needed to enforce the law on the implementation of criminal law through a juridical-scientific-religious approach that is oriented (guided) on “science” (criminal implementation law) and “God’s guidance”. The juridical-scientific religious approach is realized as a concrete effort to reform the law through reforming the substance and culture of the law. In reforming the legal substance, the religious approach is carried out by making religious teachings a source of motivation, inspiration, and creative evaluation source in building legal people with noble character, so that concrete efforts must be developed in the content of national legal development policies.

Abstract

Judicial decisions that have permanent legal force contain definite and permanent legal rights and positions between the litigating parties that must be realized through execution. Execution is a forced effort by the court against the defendants who don’t want to implement the judicial decisions voluntarily.The aim of this research is to know the factors that caused the delay in the implementation of the real execution in civil case No. 10/Pdt.G/2018/PN PWK Jo 93/Pdt/2019/PT BDG Jo 3532 K/Pdt/2019 at Purwakarta District Court. This research uses empirical legal research methods with a qualitative approach. To be able to obtain the necessary data, the authors use several methods, namely interviews and document analysis. The results of this research show that third-party resistance and the COVID-19 pandemic are factors causing the delay in the real execution of civil case no. 10/Pdt.G/2018/PN PWK Jo 93/Pdt/2019/PT BDG Jo 3532 K/Pdt/2019. In principle, even if there is resistance, the execution is not absolutely delayed unless the reason for the resistance is rational; in that case, the execution is delayed at least until the resistance is decided by the District Court. Meanwhile, health reasons and the government’s policy not to carry out activities that create crowds (Physical Distancing) are the basis for considering the COVID-19 pandemic as the cause of the delay in the real execution. Execution is the authority of the Head of the District Court in the form of policy. Thus, executions in civil cases have been delayed because of third-party resistance, and the COVID-19 pandemic is the policy of the Head of the District Court, which has been given by law.
