Abstract

Investasi adalah aktivitas mengelola dana untuk melakukan usaha guna mendapatkan keuntungan. Investasi saat ini diatur dalam UU Cipta Kerja namun sebelumnya pengaturan investasi terdapat dalam UU Nomor 25 Tahun 2007 tentang Penanaman Modal yang mana pada UU Nomor 25 Tahun 2007 tercermin pengaturan investasi memiliki dua sisi dalam pelaksanaannya. Satu sisi investasi akan membuka peluang kerja, pemasukan negara dan lain sebagainya. Sedangkan sisi lainnya, dengan dibukanya peluang investasi maka berbagai fasililitas, kemudahan akan ditawarkan kepada investor guna menarik minat investasi di suatu negara, walaupun fasilitas dan kemudahan tersebut harus mengorbankan hak warga negara sendiri yang dalam hal ini nampak liberaliralisme dalam pembukaan peluang investasi di Indonesia. Oleh karena itu penulis menganalisa UU Ciptaker sebagai aturan yang mengubah UU Penanaman Modal.  Berdasar pada telaah participatory antara penulis dengan pelaku UMKM didapatkan kesimpulan bahwa UU Ciptaker menjadi UU yang lebih memiliki keberpihakan kepada UMKM daripada UU Penanaman Modal karena mampu menjawab kebutuhan dan memberikan peluang akses sumber daya ekonomi bagi UMKM.

Abstract

Abstrak Pengadilan agama adalah lingkup pengadilan yang ada di Indonesia yang khusus dalam menangani kasus, perkara dan hal-hal yang bersifat perdata agama. Pengadilan agama secara khusus merupakan layanan peradilan untuk warga negara Indonesia yang memiliki agama Islam seperti dalam kasus perceraian, perkawinan dini, waris, waqaf dan lain-lainnya yang diatur dalam Undang-undang Kompilasi Hukum Islam. Pada nomor perkara 609/Pdt.G/2019/PA.Kbm yang mana dalam duduk perkara yang diajukan oleh istri dalam hal 'cerai gugat' adalah seorang penggugat yang melakukan tindakan gugatan kepada seorang suami yang dalam konteks ini adalah seorang terlawsuit. Dalam gugatan pada perkara tersebut, penggugat secara gamblang memberikan hal-hal yang sekiranya kuat untuk dapat diputus oleh hakim agar terlaksananya suatu perceraian dengan pembobotan syarat yang dijatuhkan kepada pihakt tergugat. Pada perkara tersebut juga diberikan kesempatan untuk pihak tergugat dalam menyampaikan jawaban-jawaban atas lawsuitan yang diberikan oleh penggugat. Atas jawaban yang diberikan oleh pihak tergugat menjadi penentu bagaimana hasil dari pertimbangan dalam memutuskan perkara yang diajukan yang mana akan ditentukan oleh Majelis Hakim. Kata kunci: cerai gugat; penolakan; pengadilan agama; perceraian Abstract Religious courts are the scope of courts in Indonesia that specialize in handling cases, cases and matters of a religious civil nature. Religious courts are specifically a judicial service for Indonesian citizens who have a Muslim religion such as in cases of divorce, early marriage, inheritance, waqf and others which are regulated in the Compilation of Islamic Law.. In case number 609/Pdt.G/2019/PA.Kbm which in the case filed by the wife in the case of 'divorce lawsuit' is a plaintiff who takes action against a husband who in this context is a defendant. In the lawsuit in this case, the plaintiff clearly gave things that if strong enough to be decided by the judge in order to carry out a divorce with the weighting of the conditions imposed on the defendant. And in this case, the defendant is also given the opportunity to submit answers to the claim given by the plaintiff. The answer given by the defendant is what determines how the results of the considerations in deciding the proposed case will be determined by the Panel of Judges. Abstract

Pandemi Covid-19 membawa perubahan drastis dalam kehidupan, termasuk dunia peradilan. Praktik persidangan yang sebelumnya dilaksanakan secara konvensional beralih menjadi persidangan  online. Peraturan Mahkamah Agung Nomor 1 Tahun 2019 Tentang Administrasi Perkara dan Persidangan Di Pengadilan Secara Elektronik atau E-Litigasi ini dikeluarkan guna mewujudkan pelayanan administrasi perkara dan persidangan di pengadilan yang lebih efektif dan efisien. Penelitian ini akan membahas mengenai perkembangan regulasi dan pelaksanaan sidang E-Litigasi di Indonesia selama pandemi Covid-19 dan keunggulan E-Litigasi dalam persidangan perkara perdata di Indonesia selama pandemi Covid-19. Metode penelitian yang digunakan dalam  penulisan ini adalah jenis penelitian hukum normatif. Sedangkan tipe pendekatan yang digunakan adalah pendekatan perundang-undangan (statute approach), pendekatan konseptual (conseptual approach), dan pendekatan kasus (case approach). Hasil dari penelitian ini adalah penggunaan sistem E-Litigasi pada penanganan perkara perdata pada masa Pandemi Covid-19 sangat dibutuhkan. Keunggulan digunakannya sistem E-Litigasi yaitu: pertama, dapat membuat lebih sederhana serta cepat dalam sistem peradilannya. Kedua, beberapa kendala geografis di Indonesia seperti misalnya wilayah yang sangat luas dan terdiri dari ribuan pulau, dapat diatasi dengan sistem E-Litigasi ini. Ketiga, dikarenakan proses-proses seperti biaya pemanggilan, hadirnya para pihak untuk proses jawab menjawab, proses penunjukkan alat bukti sampai pembacaan putusan ini dilakukan dengan cara elektronik maka akan menekan biaya perkara menjadi lebih murah. Keempat, kepercayaan masyarakat terhadap lembaga peradilan akan dapat mengalami peningkatan.

Abstract

Religious freedom has various interpretations in practice, although the rule of law regulates this right. In many cases, freedom of religion is closely related to human rights and security studies, however, not infrequently, the cases intersect with political policies. This paper aims to analyze various cases regarding religious freedom in Indonesia concerning human rights. This paper examines various phenomena related to difficulties and establishing places of worship, especially for certain groups in Indonesia in various policies and legal regulations in Indonesia. The method used for this research is non-empirical research. All data dan information analyzed come up from various previous research. This paper found and underlined that debates on the relativity of human rights often lead to different perceptions in human rights standards. Various laws relating to communities of places of worship, in many cases and considered by many experts to violate the basic principles of human rights. This paper also emphasized that the fulfillment of human rights in Indonesia concerning religious freedom cannot be separated from historical, sociological, and cultural factors of the Indonesian people themselves.

Abstract

The purpose of  law  is  to protect  the public and provides  justice and harmony  in  the country,  besides  everyone  also  has  the  right  to  the  recognition,  guarantees, protection and legal certainty of fair and equal treatment before the law. In order to hold a judicial process that is fast, cheap, simple and open, it must be carried out regardless of  the position, group or  the social status of a person. In public  life, legal dispute among the community members can happen. If any conflict arises among the community, a lawsuit will show up. For the shake of the establishment of a harmonious community life, any lawsuit arising shall get a completion. The best  completion  is  by  implementing  deiberative  decision-making  to  reach consensus. However , if it does not succeed, in accordance with state law, the case should be  resolved  through  the court.Party  that  feels  his  or  her  right  has  been  violated, may  file  a  lawsuit  to  the competent court to adjudicate the case. The purpose of it is to get right protection as well as legal protection from the court. According to the principle of civil law, there  is cost  to  file a  lawsuit. This  is  in accordance with article 2 of paragraph 4 of the Law No. 48 of 2009 about  the Powers of  the Judiciary and article 121 of paragraph 4 HIR. However , for public members who are not able to pay for the lawsuit, should also get the same legal services, even societies like this may get legal assistance  to  litigate. One  form of  legal assistance  that can be given  to underprivileged communities in litigation of the civil case is: the allowance for litigating civil cases without cost (Prodeo). This is in accordance with the article 237 to 245 HIR that mention “those who are willing to be involved in law cases, either as plaintiffs or defendants, but they are unable to pay the cost, can litigate the  lawsuit with  the permission of not paying  the cost”.Keywords: Civil Casses, Prodeo,  Investigation.

Abstract

Moral values in legal science are important. However, the flow of law sees a variety of moral values. This paper aims to see the position of moral values in the science of law. Legal positivism separates strictly between law and morals. According to him, there is no law other than the command of the authorities. Even extreme identifying the law (Recht) as the law (wet). Legal positivism activities are aimed at concrete problems, which are different when compared to natural law thinking which engages itself with the validation of man-made law. For adherents of natural law theory, an unjust law is not law. there is an absolute relationship between law and morality. the two cannot be separated, so the law must refer to moral principles.

Abstract

Children are the most valuable assets for the sustainability of a country. Quality should be preferred over quantity. Even though the quantity is very large, it must be balanced with good quality. This paper aims to explain early marriage in terms of legal perspective and its relation to the deprivation of children's rights. With a qualitative approach, there are five reasons that the community legalizes early marriage, namely: the age limit of marriage (Law No. 1 of 1974), akil baliqh, sustenance, in order to reduce the family's economic burden and who is ideal to marry first. Early marriage also results in social problems, namely: divorce, weak family stability, gender discrimination, and parenting for children becomes less good. Everyone is allowed to marry in the hope that marriage takes place between men and women who are mature in terms of their age, thoughts, and actions. However, the problem that is very crucial nowadays in Indonesia is justifying early marriage, arguing that it has met the requirements in Law No. 1 of 1974 concerning Marriage. However, this should not be a benchmark that age is allowed to marry, but there must be many considerations in terms of maturity, maturity in thinking and acting. In order to avoid divorce especially at a young age. In fact, what happens in Indonesia, if the child is less than 16 years old, the religious court gives a dispensation for marriage due to reasons of pregnancy, religious faktors, economic faktors, and educational faktors. Even worse, there is a village in Indonesia that responds positively to underage marriage. There is an assumption that early marriage is a tradition that must be guarded because it is a heritage. There are many reasons that at the age of 20 it has not been legalized for marriage, which is one of them from the aspect of reproductive health. Abstract

UMKM adalah bentuk usaha perdagangan yang dikelola oleh badan usaha atau perorangan yang merujuk pada usaha ekonomi produktif. Sebagai salah satu tulang punggung perekonomian, kegiatan bisnis UMKM merupakan bagian integral dari kehidupan masyarakat. Dengan adanya kegiatan bisnis yang dilakukan oleh para pelaku usaha, akan tercipta berbagai produk-produk usaha dimana dalam hal ini produk-produk usaha tersebut akan menuntut perlindungan Kekayaan Intelektual agar terlindung dari persaingan-persaingan yang tidak sehat. Berdasarkan pada hal tersebut, penting adanya perlindungan dan sosialisasi bagi pemilik UMKM terkait Kekayaan Intelektual, agar kedepannya produk-produk UMKM dalam negeri dapat terus dikembangkan potensinya tanpa menghilangkan hak-hak intelektual bagi si pencipta atau pemilik hak, dalam hal ini pemilik UMKM itu sendiri. Pelaksanaan pengabdian masyarakat ini mengambil sasaran pada para pemilik UMKM yang tergabung dalam Paguyuban Teras Bulan yang masih awam terhadap perlindungan Kekayaan Intelektual itu sendiri. Hasil penyuluhan serta pendampingan memberikan pengembangan wawasan tentang pentingnya suatu produk untuk didaftarkan Kekayaan Intelektualnya serta memberikan fasilitasi pendampingan permohonan pendaftaran Kekayaan Intelektual bagi produk-produk yang dimiliki oleh para pelaku UMKM. Rekomendasi yang dapat disampaikan adalah diperlukan pembinaan dan pendampingan lebih lanjut kepada para pemilik usaha anggota UMKM Teras Bulan LPMK Kelurahan Bulustalan Kecamatan Semarang Selatan dalam kaitannya dengan pentingnya perlindungan Kekayaan Intelektual dengan cara melakukan pendaftaran KI.

Abstract

The cause of corruption in village funds is due to the lack of competence of village officials, lack of transparency and lack of government and community supervision as well as superior intervention in the implementation of physical activities that are not according to planning. A joint commitment from the Puguh Village Government and the community is needed in alleviating corruption at the village level. This paper describes and analyzes various efforts to increase anti-corruption awareness for the community and the Puguh Village Government. The method used in this program includes three things, namely: (1) exploratory; (2) topical; (3) evaluation and monitoring. The service team embodies a commitment to answer problems by establishing an anti-corruption legal clinic with programs including counseling on anti-corruption from the KPK Education Center related to transparent and corruption-free village fund management, computer and internet training from UPTTIK UNNES for the use of an online system in managing village funds and online marketing of village products, as well as assistance in resolving legal cases that occur in the community through a legal aid study center.   Pendampingan dan Pendirian Klinik Hukum Anti Korupsi di Desa Puguh, Kecamatan Boja, Kabupaten Kendal. Penyebab korupsi dana desa adalah adanya intervensi atasan dalam pelaksanaan kegiatan fisik yang tak sesuai perencanaan, tidak adanya transparansi dan kurangnya pengawasan pemerintah dan masyarakat. Komitmen bersama dari Pemerintahan Desa Puguh dan masyarakat dibutuhkan dalam mengentaskan korupsi di tingkat desa. Tulisan ini mendeskripsikan dan menganalisis berbagai upaya dalam meningkatkan kesadaran anti korupsi bagi masyarakat dan Pemerintahan Desa Puguh. Metode yang digunakan dalam program ini  meliputi  tiga  hal,  yaitu:  (1) eksplorasi; (2) topikal; (3) evaluasi dan pemantauan. Tim pengabdi mewujudkan komitmen untuk menjawab permasalahan dengan membentuk klinik hukum anti korupsi dengan program antara lain penyuluhan mengenai anti korupsi dari Pusat Edukasi KPK terkait pengelolaan dana desa yang transparan dan bebas korupsi, pelatihan komputer dan internet dari UPTTIK UNNES untuk penggunaan sistem online dalam pengelolaan dana desa dan pemasaran produk desa secara online, serta pendampingan penyelesaian perkara hukum yang terjadi di masyarakat melalu pusat kajian bantuan hukum.

Abstract

The development of transactions/contracts in Indonesia and the world is developing very rapidly. Meanwhile, Indonesian contract law is sourced from the Civil Code Book III. The Dutch colonial-made Burgerlijk Wetboek did not yet regulate national and international contracts which had undergone development. Indonesian values also do not exist in book III. So it is necessary to have contract law renewal based on the values of Pancasila. The problem discussed in this paper is how to reform the national contract law. The urgency for renewal is carried out to support the 2005-2025 National RPJP, namely "The development of legal materials/substances is directed to continue the renewal of legal products to replace colonial legacy laws to reflect the social values and interests of the Indonesian people". The juridical normative writing method is used to assess the value of the renewal of the national contract law. Renewal begins with the preparation of an academic paper. Updates are carried out with open partial codification, not closed. The reforms contain Pancasila values, are designed as a sub-codification of engagement law, and are designed to lay the foundation for contract law in Indonesia.
