Abstract

Terdapat permasalahan terkait berjabat tangan saat pesta perkawinan di Kecamatan Suka Makmue Kabupaten Nagan Raya, dilakukan  para masyarakat yang  menyimpang dari Al-Qur’an, Hadis dan pendapat Ulama yaitu masyarakat beranggapan berjabat tangan di saat pesta perkawinan dengan pengantin adalah suatu hal yang sopan serta beradap. Padahal para Ulama sepakat bahwasanya berjabat tangan dengan yang bukan muhrim adalah haram. Permasalahan yang ingin diteliti dalam penelitian ini adalah pertama, Bagaimana Berjabat Tangan Antara Tamu Dengan Pengantin Yang dilakukan di Kecamatan Suka Makmue Kabupaten Nagan Raya, kedua Bagaimana Pandangan Ulama Dayah Terhadap Praktek Berjabat Tangan Antara Tamu Dengan Pengantin Pada Pesta Perkawinan. Penelitian ini menggunakan pendekatan studi kasus (Case Study) yaitu menghasilkan data deskriptif berupa kata-kata tertulis atau lisan dari orang-orang yang diamati. Penelitian lapangan meliputi wawancara dan dokumentasi yang didapatkan dari masyarakat dan Ulama di kecamatan Suka Makmue. Dari hasil penelitian Adapun prosesi berjabat tangan dengan tamu memiliki dua proses yaitu pertama pihak linto atau dara baro menjumpai tamu untuk berjabat tangan  dan yang kedua tamu berjabat tangan dengan mempelai pada saat selesai proses intat linto/dara baro dengan menghampiri mempelai sambil memberikan hadiah .Hasil penelitian kedua yaitu  Padangan keempat ulama dayah terkait hal berjabat tangan dengan tamu yang bukan mahram  ini memeliki beberapa  pendapat di mana masalah hukum berjabat tangan non mahram secara langsung adalah haram, kecuali bagi anak kecil atau yang sudah lanjut usia yang tidak berpotensi menimbulkan efek negatif (syahwat dan fitnah). Hukum jabat tangan antara lawan jenis non-mahram dengan menggunakan kaos tangan atau penutup berhukum (boleh) asalkan tidak berpotensi menimbulkan syahwat dan fitnah.

Abstract

The growth of the cosmetics industry in Indonesia has led to an increasing demand for innovative and safe products, particularly among Muslim consumers. According to Law No. 33 of 2014 on Halal Product Assurance (UU JPH), all products that are imported, distributed, and traded in Indonesia are required to obtain halal certification. However, this study identifies that several cosmetic products are still available on the market without such certification, including brands such as Carla. This research employs a qualitative empirical–juridical method through interviews and observations involving business actors, shop owners, and consumers. The findings reveal that Carla products are distributed through a consignment system in offline stores and marketed via e-commerce platforms such as Shopee and TikTok Shop. The absence of halal certification is primarily attributed to financial constraints, limited knowledge among business actors regarding certification procedures, and insufficient socialization by the government and relevant institutions. In addition, public awareness regarding the halal status of cosmetic products remains low, while shop owners tend to prioritize product availability and price over halal legality. From a legal perspective, this condition contradicts Article 4 of the Halal Product Assurance Law, which mandates halal certification for all traded products, and reflects weak supervision by the Halal Product Assurance Agency (BPJPH). These findings indicate that the effective implementation of the UU JPH cannot rely solely on regulation but must be accompanied by consumer education, facilitation for business actors, and stronger government oversight.

Abstract

The development of modern trade has introduced various marketing innovations, one of which is the use of paid member cards that offer discounts, shopping points, and exclusive benefits. However, when the use of member cards requires a registration fee, questions arise regarding the clarity of benefits, compliance with the principles of Islamic economic law, and consumer rights protection. This study aims to analyze consumer rights in the use of paid member cards and to evaluate the practice from the perspective of Islamic economic law. The research employed a qualitative descriptive-analytical method with a juridical-empirical approach, through interviews and literature review. The results indicate that the practice of paid member cards has the potential to create uncertainty of benefits and an imbalance between costs and gains, especially when information is not transparent. From the perspective of Islamic economic law, this practice is permissible provided that benefits are clearly defined, free from gharar (uncertainty) and maysir (speculation), and the fees charged are limited to administrative costs. In practice, at Kotty Kosmetik Banda Aceh, some consumers reported a lack of certainty regarding products eligible for discounts, limited information on items that can be redeemed with points, and relatively high registration fees. Therefore, the implementation of information transparency and cost limitation principles is essential to ensure justice, protect consumer rights, and maintain compliance with Islamic economic law.

Abstract

Abstract: Apart from being regulated through Islamic law, the rules regarding marriage are sourced from the Al-Qur'an and hadith, in the dynamics of the state in Indonesia, marriage is also regulated in laws and government regulations. In the Marriage Law Number 1 of 1974 as amended by Law Number 19 of the year, marriages are required to be registered, but in fact many people are reluctant to register these marriages, so many people call them sirri marriages, the meaning of sirri marriage is marriage. which is valid because it is carried out in accordance with the provisions of religious law, namely by fulfilling the pillars and conditions of marriage, but the marriage does not receive state recognition because it is not registered. Siri marriages cause many problems, especially legal problems in the family, such as the absence of legal recognition of the marriage and other problems that follow such as the status of children who do not get marriage certificates, other family rights, especially the rights of women (wives) and children who often does not receive recognition from his father and/or his father's family, such as receiving maintenance and inheritance rights from his father. Marriage registration is actually an effort to provide legal protection for families regarding the rights that must be obtained properly from a marriage, and marriage registration, although not prescribed in the Islamic religion, is actually not in conflict with Islamic law and is even recommended with the aim of avoiding harm and problems that arise. it may occur later in the family.Keywords: Family, Marriage, Siri, Islamic Law, Laws and Registration. Abstrak : Aturan mengenai perkawinan selain diatur melalui syariat Islam yaitu bersumber dari Al-Qur’an dan hadits, dalam dinamika bernegara di indonesia Perkawinan Juga diatur di dalam Undang-Undang dan Peraturan Pemerintah. Didalam Undang-undang perkawinan Nomor 1 tahun 1974 sebagaimana telah dirubah melalui Undang-undang Nomor 19 tahun bahwa Perkawinan wajib untuk dicatatkan, namun pada faktanya banyak masyarakat yang enggan mencatatkan perkawinan tersebut, sehingga banyak yang menyebutnya dengan istilah perkawinan sirri, pengertian perkawinan sirri adalah perkawinan yang sah karena dilaksanakan sesuai dengan ketentuan hukum agama, yaitu dengan terpenuhinya rukun dan syarat perkawinan, hanya saja perkawinan tersebut tidak mendapat pengakuan negara karena tidak tercatat. perkawinan siri banyak menimbulkan problem terutama problem hukum dalam keluarga, seperti tidak adanya pengakuan hukum terhadap perkawinan tersebut dan problem lain yang mengikutinya seperti status anak yang tidak mendapatkan akte nikah, hak-hak keluarga lainnya terutama hak-hak perempuan (istri) dan anak yang sering tidak mendapat pengakuan dari bapak dan atau keluarga bapaknya seperti untuk mendapat hak nafkah dan waris dari bapaknya. Pencatatan perkawinan sesungguhnya adalah upaya untuk memberikan perlindungan hukum bagi keluarga terhadap hak-hak yang harus didapatkan sebagaimana mestinya dari sebuah perkawinan, dan pencatatan perkawinan meski tidak disyariat dalam agama Islam tetapi sesungguhnya tidak bertentangan dengan hukum Islam dan bahkan dianjurkan dengan tujuan menghindari kemudaratan dan problem yang mungkin akan terjadi di kemudian hari dalam keluarga.Kata kunci : Keluarga, Kawin, Siri, Hukum Islam, Undang-Undang dan Pencatatan.

Abstract

Berdasrkan Pasal 8 point c Qanun Aceh Barat Nomor 3 Tahun 2013 tentang Penertiban Pemeliharaan Hewan Ternak telah di atur larangan melepas ternak sehingga berkeliaran di dalam kota, jalan dan/atau tempat umum yang dapat mengganggu keselamatan/kelancaran pengguna jalan. Qanun tersebut juga telah mengatur berbagai sanksi yang akan diberikan bagi pelanggar Qanun tersebut.Namun dalam praktiknya sebagian pelaku hewan ternak ini masih melepas liarkan hewan ternaknya,Perbuatan pelepasan hewan ternak secara liar tersebut menimbulkan kecelakaan lalu lintas dan merusak perkebunan warga. Metode penelitian yang digunakan yuridis empiris dengan pendekatan penelitian sosiologi hukum dengan teknik penelitian yang dilakukan adalah dengan mewawancarai pihak Satpol PP dalam hal ini Penulis melakukan wawancara dengan Kabid Trantip Satpol PP Aceh Barat. Hasil Penelitian menunjukkan, penegakan hukum di Aceh Barat yang dilaksanakan oleh Satpol PP baik preventif maupun represif untuk mengendalikan dan menertibkan keberadaan hewan ternak yang dilepas bebas di wilayah permukiman maupun fasilitas umum, namun masih terkendala dengan fasilitas yang kurang memadai untuk melakukan penertiban di lapangan, dan kondisi padat penduduk menjadi tantangan mereka dalam melakukan penangkapan hewan ternak liar.

Abstract

Abandoned children remain a crucial social issue in Indonesia, including in the city of Banda Aceh. The high prevalence of abandoned children is generally triggered by complex factors, such as the death of parents, high divorce rates, structural poverty, and limited access to education. Based on 2024 data, there are approximately 53 abandoned children in Banda Aceh requiring specialized intervention. In response to this issue, this study aims to examine in depth how the Banda Aceh City Government interprets the mandate of Article 34, Paragraph (1) of the 1945 Constitution of the Republic of Indonesia as the constitutional foundation for handling abandoned children, and how this interpretation is manifested through policy formulation and operational measures in the field. This research employs a juridical-empirical method with a case study design. Data analysis was conducted through a review of positive legal norms and observations of social service practices by the Social Services Department (Dinas Sosial). The results indicate that the local government interprets the constitutional provision as an absolute state obligation to provide care, protection, and the fulfillment of basic needs for abandoned children. Operationally, this implementation is realized through a series of systematic stages: starting from proactive outreach mechanisms, rapid assessments to identify conditions, and temporary guidance at the Lamjabat Halfway House (Rumah Singgah Lamjabat), to intensive inter-agency coordination aimed at family reunification and child repatriation. This case study demonstrates that the constitutional mandate has been effectively implemented in Banda Aceh. However, field execution still faces several challenges, particularly regarding human resource constraints, minimal budget allocation, and a lack of supporting infrastructure. Consequently, strengthened synergistic collaboration across sectors is essential to ensure that the state's fundamental responsibility for the protection of abandoned children is fulfilled optimally.

Abstract

This study explores the epistemology of al-hukm al-taklifi in explaining the integration of haqq (rights) and iltizam (obligations) as the normative foundation of the Kompilasi Hukum Islam (KHI) in Indonesia. It aims to reconstruct the moral coherence of Islamic family law by grounding it in the epistemic structure of taklif. Using a qualitative, normative-philosophical approach, the study analyzes classical texts of usūl al-fiqh-including works by al-Ghazali, al-Āmidi, and al-Shaṭibi-alongside modern legal thought on Islamic normativity and pluralism.The findings reveal that al-hukm al-taklifi functions as an epistemic bridge linking divine revelation, rational cognition, and moral purpose. The codification of the KHI, however, has fragmented this unity by emphasizing legal form over ethical substance. Reintegrating haqq and iltizam within taklif restores law's moral dimension and theological legitimacy.The study concludes that reform in Islamic family law must begin with epistemological reconstruction. The implications suggest that taklif provides a universal framework for harmonizing revelation and reason, transforming Islamic law into a living moral discourse grounded in justice, compassion, and wisdom.
