Abstract

Performance appraisal of civil servants as stipulated in article 77 number (6) of Law Number 5 of 2014 concerning State Civil Apparatus, this article states that a civil servant whose performance evaluation is not in accordance with the established targets is subject to sanctions in the form of administrative sanctions until dismissal. Basically, the performance of civil servants is the result and assessment of work carried out by civil servants in quality and quantity that has been achieved by a civil servant in carrying out the duties, authorities, obligations and responsibilities that have been given. This changes the paradigm that has been formed so far that being a civil servant is impossible to be dismissed, and a civil servant is not an office employee who is assessed based on performance appraisal, from that background we formulate the issue What is the legis ratio of dismissal of civil servants based on performance appraisal in PP Number 30 of 2019 concerning work evaluation? and What are the legal implications of the dismissal of civil servants based on performance appraisal in PP Number 30 of 2019 concerning Performance Appraisal.

Abstract

This paper examines how the legal status of leasing the public land in deal with the State's Right of Controlling is and how the further regulating them in the implementation of regional autonomy is. The used method is a normative legal research with secondary data sources through primary legal materials, secondary and tertiary. The results show that leasing the land that the object is a public land constitutes an action against the law, because the state is in fact not the owner of the land. The state only has the right to control the public land and the only the owner has the right to lease the land. Therefore, there is a smuggling law in case of leasing the public land through enacting the regional regulations that contain the permit to use the public land, that the third parties can use public land but the third party must pay a sum of money.

Abstract

Auctions are universally believed to be the most accountable and fair trading system. This is also recognized by the Republic of Indonesia in administering the state treasury and the Management of State Property, where all sales of State Property must be carried out through auctions. The problem is, there is a legal Politics (legal policy) of differential treatment ("discrimination") for residents/civil servants in the regulation that the sale of Class III State Houses (Idle State Property) is carried out without having to go through an auction and even with a price of 50% of the fair market price assessment. . The difference in treatment raises legal (juridical) issues. The juridical problem that arises is the existence of a conflict of norms between what should be (das sollen) in the constitution contrary to the norms written in the laws and regulations (das sein). Between Article 27 paragraph (1) of the 1945 Constitution of the Republic of Indonesia which states "all citizens have the same status in law and government............." is contrary to statutory regulations which is below that relates to the sale of State Houses to occupants/civil servants without an auction. From the juridical problems mentioned above, the "question" is: how is the legal politics that provides differential treatment to residents/public servants seen from the perspective of the philosophy of social justice that is in line with the goals of the Indonesian nation, namely realizing Social Justice for All Indonesian People? From the results of the analysis carried out using the evaluative-deductive analysis method, the results of the research are that legal politics that apply differential treatment of occupants/civil servants in the arrangement of selling Class III State Houses (Idle State Property) without auction are not in accordance with the meaning of "Justice of Fairness" as meant by John Rawls

Abstract

AbstractThis paper aims to analyze the legal implications of farmers that are not allowed to work on public land controlled by Perum Perhutani which causes conflicts, especially on land abandoned by Perum Perhutani and determine the form of legal protection against farmers who work the state land ruled by Perhutani to prevent horizontal conflicts between society and Perhutani. The author uses the normative method that is supported by empirical data. Farmers are not allowed to work on land controlled by perhutani because it is considered by Perhutani to be State Land, wherea from the law perspective if the land controlled by Perhutani is abandoned the it becomes free state land that is not entitled. Forms of legal protection against Farmers who work the land ruled by Perhutani state is through preventive and repressive legal protection, namely through the issuance of land titles to the land controlled by the Perhutani but abandoned by Perhutani. AbstrakTulisan ini bertujuan untuk menganalisis implikasi hukum petani tidak diperbolehkan menggarap tanah negara yang dikuasai oleh Perum Perhutani  yang mengakibatkan konflik khususnya pada tanah yang ditelantarkan oleh Perum Perhutani dan mengetahui bentuk perlindungan hukum terhadap Petani yang menggarap tanah negara yang dikuasai oleh Perhutani agar tidak terjadi konflik horizontal antara masyarakat dan Perhutani. Penulis menggunakan metode yuridis normatif yang didukung dengan data empirik. Petani tidak diperbolehkan menggarap tanah yang dikuasai perhutani karena dianggap oleh Perhutani itu adalah Tanah Negara, padahal secara hukum apabila tanah yang dikuasai oleh Perhutani tersebut ditelantarkan maka akan menjadi tanah Negara bebas yang tidak mempunyai alas hak. Bentuk perlindungan hukum terhadap Petani yang menggarap tanah negara yang dikuasai oleh Perhutani adalah melalui perlindungan hukum preventif dan represif, yaitu melalui pemberian hak atas tanah terhadap tanah yang dikuasai oleh Perhutani tersebut tetapi ditelantarkan oleh Perhutani.

Abstract

Abstract In Indonesia there are imbalances in land ownership, namely land is mostly owned by land lords, while farmers can only be farm laborers because they do not have enough capital to buy land. This condition will result in an imbalance in the structure of land ownership because farmers should own land, not the owners of capital. This study uses a normative juridical research method using statute and case approach. The results show that one of the methods taken by the Government is a land reform program, namely a concept and strategy for changing the structure of agrarian control in a better direction for rural residents, especially the peasants by changing the structure of land ownership of landlords given to poor farmers who have no land. Reconceptualization of the right model for land reform and equitable redistribution of land is through government policies that have political will to give land to the community, especially landless farmers through the use of rights or management rights. AbstrakDi Indonesia terdapat ketimpangan dalam pemilikan tanah, yaitu tanah sebagian besar dimiliki oleh para tuan tanah (Land Lord), sedangkan para petani hanya bisa sebagai buruh tani karena mereka tidak cukup memiliki modal untuk membeli tanah. Kondisi ini akan mengakibatkan suatu ketimpangan dalam tatanan pemilikan tanah, karena seharusnya para petanilah yang memiliki tanah, bukan para pemilik modal. Penelitian ini menggunakan metode penelitian yuridis normatif dengan menggunakan pendekatan peraturan perundang undangan dan pendekatan kasus. Hasil penelitian menunjukkan bahwa salah satu cara yang dilakukan oleh Pemerintah adalah dengan program landreform yaitu sebuah konsep dan strategi tentang perubahan struktur penguasaan agraria ke arah yang lebih baik bagi penduduk pedesaan, khususnya kaum tani dengan merubah struktur kepemilikan tanah dari tuan tanah yang diberikan kepada petani miskin yang tidak punya tanah. Rekonseptualisasi model yang tepat untuk landreform dan redistribusi tanah yang berkeadilan adalah melalui kebijakan pemerintah yang mempunyai political will untuk memberikan tanah-tanah kepada masyarakat khususnya petani yang tidak punya tanah melalui alas hak yaitu hak pakai atau hak pengelolaan.

Abstract

This research is a juridical study that examines in more depth related to legal issues regarding differences in the transfer of inheritance land rights to heirs of different religions and heirs in civil law and Islamic law. There are quite significant differences related to the transfer of land rights due to inheritance for heirs of different religions. In the concept of Islamic law, an heir of a different religion may not inherit land rights from an heir who has died. Meanwhile, civil law (BW) does not regulate this. In addition, a study was conducted to determine the transfer of ownership rights to land due to inheritance for heirs of different religions. The research method used is normative-juridical, with a statutory and conceptual approach. The results of the study show that efforts to realize welfare for the community through the concept of perfect legal certainty regarding land are being made by the state against heirs of different religions to obtain land ownership rights because inheritance can be carried out with the concept of a mandatory will. This concept is very relevant to the fulfillment of inheritance land rights for heirs whose rights cannot be accommodated due to religious differences by prioritizing the principles of justice and welfare for every citizen. Tujuan penelitian ini adalah mengkaji lebih mendalam terkait isu hukum perbedaan peralihan hak tanah kewarisan terhadap ahli waris beda agama dalam hukum perdata dan hukum Islam. Tidak adanya payung hukum yang jelas dan adanya perbedaan pandangan menjadi persoalan rumit terkait peralihan hak atas tanah sebab kewarisan bagi ahli waris beda agama. Dalam waris Islam ahli waris non muslim tidak diperkenankan memperoleh warisan hak atas tanah dari pewaris muslim yang meninggal dunia. Namun hukum perdata (BW) tidak memuat hal demikian. Sehingga terdapat ketidakpastian hukum dan diskriminasi terhadap ahli waris beda agama terhadap hak tanah kewarisan dan tidak adanya paying hukum yang memadai berkaitan dengan persoalan hukum peralihan hak tanag warisan beda agama. Penelitian ini mengkaji peralihan hak milik atas tanah warisan bagi ahli waris beda agama yang berkeadilan. Penelitian menggunakan metode penelitian yuridis normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa upaya merealisasikan keadilan dan kemaslahatan melalui konsep kepastian hukum bagi ahli waris beda agama dapat dilakukan dengan konsep wasiat wajibah. Konsep tersebut sangat relevan terhadap agar terpenuhinya hak tanah kewarisan bagi ahli waris yang tidak terakomodasi haknya karena perbedaan agama dengan mengedepankan asas keadilan, persamaan hak dan kemaslahan bagi setiap warga negara.

Abstract

Penambahan zat additive berupa difa soil stabilizer dapat memperbaiki atau meningkatkan daya dukung sifat mekanis tanah asli. Nilai PI semakin menurun dan tingkat kepadatan semakin meningkat serta kuat geser tanah berkurang. Sedangkan untuk pengujian kuat geser tanah yang dilakukan di Laboratorium Mekanika Tanah Teknik Sipil Universitas Muhammadiyah Metro, dari ke empat sampel yang telah diujikan dengan campuran zat additive difa soil stabilizer yakni 0,2%, 0,4%, 0,6%, 0,8% + 8% semen dalam setiap pengujian kuat geser campuaran. Dari ke empat pengujian nilai tegangan geser rata-rata yang paling tinggi adalah pada penelitian ini yakni dengan campuran 0,8% difa soil stabilizer + 8% semen mendapat kadar campuran dengan nilai tegangan geser rata-rata 0,503 kg/cm2 dan mendapatkan nilai kohesi 0,11 kg/cm2, sedangkan untuk sudut geser dalam mendapatkan nilai 32,94˚. Sedangkan hasil dari pengujian pemadatan tanah campuran zat additive difa soil stabilizer mendapatkan kadar campuran maksimum 0,8% difa soil stabilizer + 8% semen dengan kadar air optimum 38,20%, dengan berat kering maksimum 1,15 gr/cm3. Nilai berat isi kering maksimum (γdmak) cenderung semakin meningkat dari tanah aslinya, sedangkan kadar air optimum (OMC) selalu mengalami penurunan, ini dikarenakan semakin meningkatya persentase penambahan campuran zat additive difa soil stabilizer oleh sebab itu tanah semakin kekurangan air.

Abstract

Due to the absence of an adequate legal umbrella and the strong religious beliefs and adherence of the Indonesian people, the issue of inheritance rights to land for heirs of different religions is far from being resolved without conflict and dispute. The research method used is normative juridical with the method of statutory approach, and conceptual approach. The results of the study show that the fulfilment of rights to inheritance land due to religious differences can be done by mandatory wills by court decisions and grants by the testator while still alive. There is jurisprudence that can be used as a basis for consideration by judges in deciding this case. The transfer of land rights must be registered with the Badan Pertanahan Nasional accompanied by supporting documents and a court decision after it has permanent legal force.

Abstract

This research examines the crimes of the land mafia committed by certain officials who are directly related to the registration and certification of land rights and the guarantee of legal protection for victims. The research method used is normative juridical with the method of statutory approach, and conceptual approach. The results of the study show that the low level of public awareness of land documents owned and the frequent granting of power of attorney to others paves the way for the crime of the land mafia. The lack of transparency, weak supervision and law enforcement are the main problems of land crimes by the land mafia. Legal protection for victims can be done by making a complaint to the BPN, making a cancellation of the deed / fake document to the TUN court and asking for criminal responsibility for the perpetrators, especially unscrupulous officials who participate in land mafia crimes. Penelitian ini mengkaji mengenai kejatahan mafia tanah yang dilakukan oleh oknum pejabat tertentu yang berhubungan langsung terhadap pendaftaran dan sertipikasi hak atas tanah dan jaminan perlindungan hukum terhadap korbannya. Metode penelitian yang digunakan ialah yuridis normatif dengan metode pendekatan peraturan perundang-undangan, dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa rendahnya sikap kehati-hatian masyarakat terhadap dokumen tanah yang dimiliki dan kerap kali memberikan kuasa kepada orang lain membuka jalan terhadap kejahatan mafia tanah. Tidak tranparan, lemahnya pengawasan serta penegakan hukum menjadi problem utama akan terjadinya kejahatan pertanahan oleh mafia tanah. Perlindungan hukum terhadap korban dapat dilakukan dengan melakukan pengaduan ke BPN, membuat pembatalan akte/dokumen palsu ke pengadilan TUN serta meminta pertanggungjawaban pidana terhadap pelakunya terutama oknum pejabat yang ikut serta dalam kejahatan mafia tanah.
