Abstract

The legal position of the Minutes of Boundary Documents contains many legal instruments against the state's right to control over forest areas, but this is often misunderstood, causing legal uncertainty, especially the legal position in the trial of proving ownership, for this Minutes of Boundary Demarcations need to be studied further, especially regarding certainty and classification. evidence in civil procedural law. This research is a normative juridical research, using a statutory approach. The conclusions that can be drawn from this research are, firstly, the existence of Minutes of Boundary Demarcation is not merely authentic evidence but an instrumental constitutional authority for the state to control forest areas, and contains three aspects, juridical, historical and sociological.

Abstract

Corporate Social Responsibility obligations for companies as outlined in Law Number 40 of 2007 concerning Limited Liability Companies and Law Number 25 of 2007 concerning Capital Investment create ambiguity due to differences in definitions and terminology used by the Law. The problems in this research are (1) What is the legal ratio for corporate social and environmental responsibility for companies according to the provisions of Law Number 40 of 2007 concerning Limited Liability Companies, (2) What are the implications that arise regarding regulations regarding Corporate Social Responsibilityin Indonesia. This research uses a normative juridical research method with a conceptual approach and a statutory approach. Data collection techniques were carried out by means of literature study. The results of the research state that (1) Ratio Legis according to the Limited Liability Company Law is a philosophical basis, corporate social responsibility is a concrete form of effort to provide welfare to society. The sociological basis of the Company is a capital company established on the basis of a commercial performance agreement (2)CSR regulations are unclear and overlap with other related laws and regulations. Not all companies related to natural resources have implemented social and environmental responsibility, because there is still a perception that sharing social responsibility is not mandatory and there is a lack of good government control and strict sanctions to enforce it.

Abstract

The Krame Desa tradition as an alternative solution to criminal acts of theft in the Sasak tribal community in Central Lombok. The background to the choice of this theme was the existence of a mechanism for resolving criminal acts of theft among the Sasak Traditional Law community in the Sade Traditional Tourism Village, called Krame Desa. Krame Desa is an activity carried out by two or more people and a group of people to determine who is wrong and right in terms of defending the property rights of one person or many people by drinking the ground water from the grave of the guardian of Nyatuk. Based on the above, this paper raises the formulation Problem: How is the implementation of the "Krame Desa" Customary Law in resolving criminal acts of theft among the Sasak tribe community in the Sade Traditional Tourism Village, Central Lombok Regency? What is the Strength of the Decision to Settle the Crime of Theft Through the Village Temple in the Sade Traditional Tourism Village, Central Lombok Regency? Then this paper was written using empirical research using a sociological juridical approach and a case approach. The research location is in the Sade Traditional Tourism Village, Pujut District, Central Lombok. The data obtained by the author consisting of primary and secondary data will be analyzed using qualitative descriptive analysis techniques. The results of this research show that the meaning of Krame Desa is a mechanism for resolving disputes in the Sasak Customary Law community, especially in criminal acts of theft, where the philosophical basis is to restore magical and spiritual balance in society, in the process using oaths.

Abstract

The failure to overcome various land issues in Indonesia is a big homework for the government, because there are internal factors from unscrupulous state officials who contribute to land crimes apart from negligence and lack of prudence of the community. This research examines the potential land problems and factors that cause the recurrence of land conflicts in Indonesia. The research method used is normative juridical with statutory approach and conceptual approach. The results of the research show that the recurrence of conflicts over land is due to weak legal protection of community lands, weak law enforcement and the existence of partisanship being the cause of unsolved land conflicts in Indonesia which makes legal issues regarding land do not lead to the objectives of legal certainty and justice. Abstract

The Complete Systematic Land Registration Program (PTSL) responds to the public’s grievances about complex land registration services, requiring no small cost and a long process. PTSL organizes land registration simultaneously, inexpensively, openly and quickly, but in its implementation provides opportunities for the existence of authority abuse and misconduct. This study examines the problem of complete systematic land registration versus legal uncertainty land registrations. The method of research used is the normative jurisprudence with the method of approaching legislative regulations and conceptual approaches. The results of the research show that the maintenance of a complete systematic land registration program can reduce the legal certainty and protection of its owners, due to corrupt acts, wild charges and misrepresentation in its implementation. Coordination with relevant parties between BPN, local governments, police and the public is necessary to minimize the occurrence of confusion and abuse of authority.

Abstract

The establishment of the Land Bank in Indonesia may lead to conflicts of interest and the existence of customary land may be forgotten for reasons of land stateisation. The process of acquiring customary land for reasons of stateisation may affect the legal protection of indigenous peoples' rights. This article examines agrarian conflicts after the establishment of the Land Bank Agency and the legal protection of indigenous peoples' land. This research is examined using the normative juridical method with a statutory approach. The results of the study found that the concept of the Land Bank is in contrast to agrarian reform in terms of land acquisition operations, because land can be obtained through the transfer of land ownership by the state which is intended for investment and infrastructure development. The government needs to improve the land sector Job Creation Law and the legal regulations of the Land Bank, the government must revise the rules related to the Land Bank so that this institution can maintain a balance of land utilisation for various interests fairly. The Land Bank should be a representative of the state to protect vulnerable groups of people, one of which is indigenous peoples. Then the community must be pro-active in applying for a Material Test on articles that have negative potential, especially the regulation of land stateisation in the Job Creation Law and the legal rules regarding the Land Bank in an effort to consolidate guarantees and justifications for land rights over indigenous peoples.

Abstract

This article aims to analyze agrarian conflicts and legal protection of customary land after the establishment of the Government Regulation on the Land Bank Agency in Indonesia. The presence of the Land Bank has the potential for conflict of interest and recognition of customary land can be neglected under the pretext of stateization. This research uses normative research and is based on statutory and conceptual approaches. The results show that agrarian reform contained in the Land Bank study actually backs up agrarian reform itself in terms of land acquisition, because land can be obtained through the transfer of land ownership by the state. Therefore, within the framework of ius constutuendum, the Government needs to improve the Job Creation Law in the land sector and the Government Regulation on the Land Bank, in addition, the public can also conduct a Material Test on articles containing land stateization arrangements in the Job Creation Law and Government Regulations on the Land Bank to strengthen guarantees and fulfillment of the rights of indigenous land communities.

Abstract

This research explores the challenges in eliminating population categorization in the transfer of land rights. This change is highlighted due to protests and evaluations of the perceived discriminatory articles that identify race, groups, and ethnicity. The grouping in the creation of inheritance certificates is considered to create legal politics contrary to the spirit of independence, preserving differences seen as a legacy of Dutch colonialism. This research adopts a normative juridical method. The findings indicate that the delegation of tasks and authority, as well as the classification of the population in the process of creating inheritance certificates, essentially provides legal certainty to society. Separation based on archives and historical data updates has a positive impact on the land rights transfer process. This classification strengthens the legal framework related to land registration and certification, making it more secure and efficient. Conversely, the absence of classification in the creation of inheritance certificates can create legal uncertainty in the registration of land rights transfer due to the lack of clarity in data, information, and historical developments that need to be updated and recertified.

Abstract

Agrarian disputes remain pervasive and complex, frequently involving violations of land rights, land grabbing, and overlapping claims. Such disputes often span civil, administrative, and even criminal dimensions, resulting in fragmented litigation before the General Courts and the State Administrative Courts. This fragmented adjudication has produced inconsistent and conflicting judicial decisions, thereby undermining legal certainty and justice in the land sector. These conditions underscore the urgency of establishing a specialized agrarian court with a clear institutional and procedural framework. This study aims to formulate a conceptual model of an agrarian court and to propose its future institutional mechanism in order to ensure legal certainty in the resolution of agrarian disputes. From the perspective of Islamic law, land ownership constitutes a protected right (ḥifẓ al-māl) that necessitates an effective and just dispute-resolution mechanism. This research employs a normative legal methodology using statutory, case, comparative, and conceptual approaches, supported by primary, secondary, and non-legal materials. The findings propose the Agrarian Court Concept based on the “3Ps” framework—Position, Procedure, and Professionalism—which emphasizes institutional clarity, specialized procedural rules, and competent adjudicators. This model is designed to prevent future disputes, harmonize judicial decisions, and resolve agrarian conflicts in a manner that promotes legal certainty, justice, and the broader objectives of law, including the principle of enjoining good and preventing harm.
