This paper aims to analyze the meaning of “certain reasons” in Article 3 Paragraph 15 of the Notary Ethics Code about the obligation to carry out his position in the office and the consequences of violating these provisions against the authenticity of the deed. This study uses the normative juridical method with the statute approach and conceptual approach. The results of the study indicate that the meaning of “certain reasons” referred to Article 3 Paragraph 15 of the Notary Ethics Code is the reasons permitted by the Law, namely related to the making of a deed that is not possible to be carried out in a notary’s office. The deed is authentic if in making it does not violate one of the terms of authenticity of the notary deed even though the notary violates the provisions of Article 3 Paragraph 15.

This study discussed the arrangement of the land value zone as the basis for a fair land valuation by the National Land Agency. The National Land Agency as an extension of the non-departmental government had the authority to regulate and carry out the allotment of land. This study used a normative juridical approach to address the legal problems encountered. The method used legislation and conceptual approaches. The results showed that the land value zone could be used as a basis for a fair land valuation by the National Land Agency. However, at present, there were no specific legal regulations governing land value zones which result in a vacuum and legal uncertainty so that regulations were needed that govern the operation of Land Value Zones. Legislation that was considered ideal was a ministerial regulation made by the Ministry of Agriculture and Spatial Planning/National Land Agency.

The purpose of this study is to describe the authority of creditors to direct sell warranty objects in the form of land and building Letter C without passing the auction. This study uses normative juridical research methods that study and analyze the application of rules, acts, positive legal norms contained in legislation, jurisprudence, and contracts. This study uses a statutory approach, a conceptual approach, and a case approach. The results show that creditors are authorized to sell warranty objects in the form of land and Letter C buildings without auctions but through underhand sales.

Tthis study aimed to analyze the validity of debt recognition letters and selling authorities (evidence P-2 and evidence P-3), the basis for judges’ considerations, and the legal consequences of the Supreme Court Decision Number 2290 K/Pdt/ 2012 for debtors and creditors. The method used in this study was normative juridical research with a statutory approach and a case approach. The results of the systematic interpretive analysis showed that the debt recognition letter (evidence P-2) and selling authorities (evidence P-3) in the Supreme Court Decision Number 2290 K/Pdt/ 2012 could be declared invalid. Juridically, the judges’ considerations were considered insufficient in examining the truth of the events in the Supreme Court Decision Number 2290 K/Pdt/2012. The legal consequences that occurred after the verdict, the creditor could have collateral for the land-based on an invalid debt acknowledgment but legalized by the panel of judges in the decision. The legal consequence for the debtor, the legal action to defend the land that was carried out by him was considered an act against the law

The concurrent authority of Notaries and Land Deed Officials (PPATs) in creating land deeds in Indonesia has resulted in legal ambiguity. This research employs a normative juridical approach, scrutinizing existing legal norms to ascertain the extent of authority granted to Notaries and PPATs and to identify potential conflicts. The findings indicate that the Notary Position Law (Law No. 30/2004, amended by Law No. 2/2014) endows Notaries with extensive authority, implying they are not confined by the restrictions in Government Regulation No. 24/2016. The existing ambiguity calls for legislative clarification. The study concludes that Notaries possess broad authority to draft land deeds, mostly unaffected by limitations on PPATs. Legislative measures are required to delineate clearer jurisdictional boundaries, ensuring legal certainty and preventing potential abuses of power. This research examines the realization of legal order in the context of overlapping authority to make land deeds in Indonesia.

This research discusses legal certainty related to the period of out-ofcourt dispute resolution through mediation at the land office and its impact on the protracted mediation process. Legal certainty is a crucial element in dispute resolution to ensure justice and certainty for the disputing parties. Through a normative juridical approach, this research analyzes the laws and regulations governing mediation and its practical implementation at the land office. The findings show that the lack of clarity and certainty in the regulation of the mediation period at the land office leads to an ineffective and time-consuming dispute resolution process. Without a clear time limit, the parties and the mediator cannot resolve cases promptly. This study uses a systematic normative juridical research method to analyze these issues. The conclusion is that existing regulations vary in defining and implementing mediation, highlighting the need for technical guidelines for mediation procedures and rules regarding the implementation period at the National Land Agency to ensure optimal and efficient mediation.

This article aims to analyze agrarian conflicts and legal protection of customary land after the establishment of the Government Regulation on the Land Bank Agency in Indonesia. The presence of the Land Bank has the potential for conflict of interest and recognition of customary land can be neglected under the pretext of stateization. This research uses normative research and is based on statutory and conceptual approaches. The results show that agrarian reform contained in the Land Bank study actually backs up agrarian reform itself in terms of land acquisition, because land can be obtained through the transfer of land ownership by the state. Therefore, within the framework of ius constutuendum, the Government needs to improve the Job Creation Law in the land sector and the Government Regulation on the Land Bank, in addition, the public can also conduct a Material Test on articles containing land stateization arrangements in the Job Creation Law and Government Regulations on the Land Bank to strengthen guarantees and fulfillment of the rights of indigenous land communities.

This research explores the challenges in eliminating population categorization in the transfer of land rights. This change is highlighted due to protests and evaluations of the perceived discriminatory articles that identify race, groups, and ethnicity. The grouping in the creation of inheritance certificates is considered to create legal politics contrary to the spirit of independence, preserving differences seen as a legacy of Dutch colonialism. This research adopts a normative juridical method. The findings indicate that the delegation of tasks and authority, as well as the classification of the population in the process of creating inheritance certificates, essentially provides legal certainty to society. Separation based on archives and historical data updates has a positive impact on the land rights transfer process. This classification strengthens the legal framework related to land registration and certification, making it more secure and efficient. Conversely, the absence of classification in the creation of inheritance certificates can create legal uncertainty in the registration of land rights transfer due to the lack of clarity in data, information, and historical developments that need to be updated and recertified.

The Industrial Revolution 4.0 era recently offers automation systems across various aspects of life. This situation challenges Indonesia's land law rooted in customary law. This article aims to explore the role and relevance of customary law as the foundation of national agrarian law in the face of rapid Industry 4.0 growth. The findings indicate that customary law, as the cornerstone of the Basic Agrarian Law, is crucial not only as a source of norms and supplementary norms in national land law. Recognition of customary law remains pivotal to ensure the sustainability of indigenous communities, protect traditional land rights, and promote inclusive agrarian justice. The integration of customary law within Indonesia's national legal framework reflects a commitment to advancing agrarian justice and supporting the principles of the Unitary State of the Republic of Indonesia. Thus, customary law continues to be relevant as a foundation and principle for legislative formation, including agrarian law. A legal pluralism system recognizing customary law as an integral part of agrarian law holds significant potential in supporting comprehensive and inclusive agrarian justice in Indonesia, aligning with agrarian law policies aimed at safeguarding pluralistic rights of indigenous communities. Revolusi Industri 4.0 baru-baru ini menawarkan sistem otomatisasi dalam berbagai bidang kehidupan. Situasi ini menantang hukum tanah Indonesia yang berasal dari hukum adat. Artikel ini bertujuan untuk mengetahui peran dan relevansi hukum adat sebagai dasar dari hukum agraria nasional dalam menghadapi pertumbuhan pesat Revolusi Industri 4.0. Hasil kajian menunjukkan bahwa hukum adat sebagai fondasi dari Undang-Undang Pokok Agraria tidak hanya penting sebagai sumber norma dan norma pelengkap dalam hukum tanah nasional. Pengakuan terhadap hukum adat tetap krusial untuk memastikan keberlanjutan komunitas adat, perlindungan hak-hak tanah tradisional, serta promosi keadilan agraria yang inklusif. Integrasi hukum adat dalam kerangka hukum nasional Indonesia mencerminkan komitmen untuk memajukan keadilan agraria dan mendukung prinsip Negara Kesatuan Republik Indonesia. Dengan demikian hukum adat masih dan akan terus relevan sebagai dasar dan prinsip untuk pembentukan peraturan perundang-undangan, termasuk hukum agraria. Sistem pluralisme hukum yang mengakui hukum adat sebagai bagian integral dari sistem hukum agraria menjadi potensi besar dalam mendukung keadilan agraria yang menyeluruh dan inklusif di Indonesia, sejalan dengan arah kebijakan hukum agraria yang bertujuan melindungi hak-hak pluralis masyarakat adat.

The government as a legal subject that has the authority to carry out legal acts can actually be tested whether there is no authority approved by the State Administrative Court. This trial can of course be triggered by demands from certain parties who feel disadvantaged by the Government's actions. This research will examine the legal position and right to sue an organization in the Onrechtmatige Overheidsdaad Dispute. This research is normative juridical legal research. This research analyzes the legal position and right to sue the community regarding the defense of the Onrechtmatige Overheidsdaad. The research results concluded three things; First, organizations have sufficient requirements to file a lawsuit because their right to sue is regulated in Law Number 32 of 2009 concerning Environmental Protection and Management (UU 32/2009), and other regulations. Second, UUAP No. 30 of 2016 also regulates the authority to decide whether or not there are elements of authority exercised by Government Officials. This means that Law Number 30 of 2014 provides space for the public to file a lawsuit if there is a rejection of a permit permitted by the government. Third, there is a need to add the word 'organization' and add 'organizational requirements for filing a lawsuit' in UUAP No. 30 of 2014 explicitly.
