Abstract

Degradasi lingkungan sumber daya pesisir di Indonesia dari tahun ke tahun semakin mengkhawatirkan.. Kerusakan  ekosistem terutama  pada mangrove, terumbu karang dan estuaria (muara sungai) banyak ditimbulkan oleh kegiatan destruktif di wilayah pesisir. Wilayah pesisir juga menjadi bagian dari sumber kehidupan dan penghidupan masyarakat,  apabila tidak dilindungi akan mengancam hilangnya hak atas lingkungan bagi masyarakat pesisir sendiri. Dalam pengelolaan sumber daya alam dan lingkungan hidup, rakyat harus ditempatkan sebagai kepentingan yang utama. Negara sepenuhnya berperan sebagai instrumen pengurus dan penyelenggara kebijakan yang ditujukan untuk melindungi dan memajukan hak asasi manusia atas lingkungan hidup Semua kerusakan  lingkungan pesisir tersebut adalah hasil interaksi antara manusia dengan sumber daya pesisir yang berlebihan dan tidak memperhatikan kaedah-kaedah kelestarian dan daya dukung lingkungannya. Pelanggaran hak atas lingkungan tersebut dapat dimaknai sebagai ancaman terhadap peradaban masyarakat pesisir yang akan mengarah pada pelanggaran Hak Asasi Manusia.Kata Kunci : Hak. Lingkungan, Masyarakat, Pesisir.

Abstract

Libraries in Indonesia certainly have directions and policies to keep pace with the progress and development of knowledge needs in this 4.0 industrial era. This study aims to analyze the opportunities and challenges of libraries in Indonesia in determining new directions and policies facing the industrial era 4.0. This study uses a type of qualitative method with a descriptive approach. Data analysis was carried out using the interactive model of (1), which included data condensation, data presentation, and conclusion. The results of this study found that there are several directions and policies implemented and prepared by libraries in Indonesia facing the industrial era 4.0, namely directions and policies that focus on the management of collection by 10% by increasing the number of digital collections and developing library services towards digital libraries; directions and policies that focus on the management of knowledge by 20%, by optimizing library automation systems; and directions and policies that focus on the transfer of knowledge by 70%, by increasing the availability of working space, class library programs, as well as various training programs and user assistance. Abstract

This research aims to examine and analyse the concept and implementation model of fulfilling women's rights to inherited land in the Bagi Rusa inheritance system of the Bangka community and compare it with the concept of Islamic inheritance which distinguishes the inheritance rights of men and women. The study of the fulfilment of women's inheritance rights is always interesting, because there are issues of inequality and debate over their inheritance rights. This research is important to find out the basis of consideration for the fulfilment of women's inheritance rights in Bangka society. The method used in this research is normative juridical. The results show that in Bangka society, land as inherited property is often the object of inheritance. The fulfilment of women's rights related to the acquisition of inherited land is determined by the roles and responsibilities of women in their families. The greater the responsibilities and sacrifices made by women, the greater and more special the inherited land rights obtained. This concept is based on the principles of kinship, justice, and equality between men and women without distinguishing gender. Unlike the concept of Islamic inheritance, which does not give special rights to women for any reason, because men are considered more responsible for the sustainability and welfare of their families and this responsibility is not given to women. Penelitian ini bertujuan mengkaji dan menganalisis konsep dan model penerapan pemenuhan hak perempuan terhadap tanah warisan dalam sistem waris Bagi Rusa masyarakat Bangka dan dibandingkan dengan konsep waris Islam yang membedakan hak waris laki-laki dan perempuan. Kajian terhadap pemenuhan hak waris perempuan selalu menjadi hal yang menarik, sebab terdapat persoalan ketidaksetaraan dan perdebatan atas hak warisnya. Penelitian ini penting dilakukan untuk mengetahui dasar pertimbangan pemenuhan hak waris perempaun dalam masyarakat Bangka. Metode yang digunakan dalam penelitian ini adalah yuridis normatif. Hasil penelitian menunjukkan bahwa dalam masyarakat Bangka, tanah sebagai harta warisan sering menjadi objek warisan. Pemenuhan hak perempuan terkait perolehan tanah warisan ditentukan oleh peran dan tanggung jawab perempuan dalam keluarganya. Lebih besar tanggung jawab dan pengorbanan yang diberikan perempuan, semakin besar dan istimewa hak tanah warisan yang diperoleh. Konsep ini didasarkan pada asas kekeluargaan, keadilan, dan kesetaraan antara laki-laki dan perempuan tanpa membedakan gender. Berbeda dengan konsep waris Islam yang tidak memberikan hak istimewa terhadap perempuan dengan alasan apapun, sebab laki-laki dianggap lebih bertanggungjawab atas keberlangsungan dan kesejahteraan keluarganya dan tanggung jawab tersebut tidak diberikan kepada perempuan.

Abstract

The Public Prosecutor has the authority and responsibility to prosecute the case and prove what is alleged before the trial. Before determining criminal charges, there is a mechanism for submitting a proposed prosecution plan by the Public Prosecutor with the issuance of a prosecution plan (P-41), which contains a proposal from the Public Prosecutor who hears the case, then given advice by the Head of the Public Criminal Section and given the Opinion of the Chief Prosecutor of his work unit. On the opinion of the Chief Prosecutor of the work unit that must be read by the Public Prosecutor in front of the trial. The claim can certainly be contrary to the conscience of the Public Prosecutor who conducts evidence in the trial, either from the length of the criminal or the article that must be proven. In this title, the author will analyze the application of equity or equality of the prosecutor's position in the preparation of the prosecution plan if applied in the Indonesian criminal justice system. The research method used by the author is normative research from literature studies and materials obtained systematically compiled which is preceded by preliminary analysis continued with data analysis and discussion results and ends with conclusions. This paper aims to describe the circumstances or symptoms of an object that is thoroughly and systematically examined. In addition, to be a new reference to the freedom of prosecution of the prosecution plan because throughout the search is still very lacking references related to the application of equality or some kind of dissenting opinion from the Prosecutor in the preparation of the prosecution plan against criminal cases.

Abstract

Receivables are the right to collect debts, a means of fulfilling civil obligations, a continuation of the credit agreement contract that must be held. The principle of Pacta Sunt Servanda as the foundation of giving direction, purpose, and fundamental value and ethical judgement to debts with property collateral with a time limit determined by the parties. However, the need for money when the receivables are not yet due encourages the receivables to be transferred into cessie, doctrinally the holder of the eigendom right has the power to eigenaar freely and to act freely on the property with full sovereignty, even so, the problem arises with the submission following the formal rules of cessie raises legal consequences, if without being notified, or in writing has been acknowledged and approved. This article questions whether the submission of receivables in the form of a unilateral legal action through cessie reflects the value of pacta sunt servanda which provides equality and justice for the parties? By applying a normative juridical research method based on a statutory approach, a legal conceptual approach, and a case approach, it strengthens the results prescriptively analytically, related to cessie which is worth justice being a hope for the business world, preventing potential legal uncertainty, avoiding potential disputes over the implementation of the transfer of receivables, preventing economic losses, by internalising the value of legal certainty and justice.  The value of pacta sunt servanda in this case relates to the equal position between the creditor and the debtor, this aspect also emphasises the guarantee of human rights for the parties to the agreement, as well as legal certainty and predictability in the process of fulfilling the provisions of the rights and obligations of the agreement agreed by the parties

Abstract

Good corporate governance has 5 main principles: openness, accountability, accountability, independence, and equality. Although Law Number 40 of 2007 concerning Limited Liability Companies does not explicitly regulate it, the values of the principle are contained in it. One important principle is accountability, which includes corporate social responsibility (CSR). CSR is the company's commitment to contribute to sustainable economic development by paying attention to economic, social, and environmental aspects. Law No. 40 of 2007 and Law No. 25 of 2007 require the implementation of CSR for companies, but there are vagueness and differences in the definition and scope regulated. This raises problems related to discrimination and potential violations of private property rights of companies. In general, CSR arrangements in Indonesia are still not detailed and clear, especially related to intersections with regional interests and social responsibility to the community. Clarity of arrangements is needed so that CSR can be implemented properly and provide benefits to companies, local governments, and surrounding communities. The problem in this study is the implications caused related to the Regulation on Corporate Social Responsibility in Indonesia and how the form of social responsibility and the form of Corporate responsibility in Indonesia related to the Regulation on Corporate Social Responsibility in Indonesia. This type of research is Normative legal research. The method of approach uses legislative and conceptual approaches. Data sources come from primary and secondary legal subers. The results of this study show that the implications arising related to the regulation on Corporate Social Responsibility in Indonesia, in the UUPT regulation on Corporate Social Responsibility are unclear and overlap with other related laws and regulations. Not all companies related to natural resources carry out social and environmental responsibility, because there is still a perception that the allocation of Corporate Social Responsibility is not mandatory, and in its implementation there is no good control from the government, and there are no firm sanctions for companies that do not channel Corporate Social Responsibility. The form of social responsibility and the form of Corporate responsibility in Indonesia related to the Regulation on Corporate Social Responsibility in Indonesia can vary, depending on the needs and priorities of the company and the surrounding community. Corporate Accountability that implements CSR is needed to hold stakeholders accountable. The form of accountability can be: CSR report: a report that explains the CSR activities that have been carried out by the company, the impact that has been achieved, and the obstacles faced. CSR audit: an independent audit to ensure that CSR activities have been carried out in accordance with established standards and policies. Dialogue with stakeholders: open dialogue with stakeholders to obtain input and suggestions related to CSR implementation.

Abstract

The inheritance is agreed to fall to one heir, then the registration of the transfer of rights to the land can be directly made to one heir who has been determined. However, the fact that the land registration that must be taken by the heirs is different from the rules listed in Article 42 paragraph (4) of PP No. 24 of 1997. The Land Office does not accept applications for registration of transfer of inheritance as stipulated in Article 42 paragraph (4) PP land registration, so that the registration of the land must be registered first to all heirs, after which a deed of Division of Joint rights (APHB) is made for the refusal, of course, there will be legal consequences for the applicant. The problem in this study is a legal remedy for applicants for land registration because of inheritance that has been the division of inheritance but rejected by the Land Office and how the legal protection for applicants for land registration because of inheritance that has been the division of inheritance but rejected by the Land Office. This type of research is normative legal research. The method of approach uses a legislative and conceptual approach. Data sources come from primary and secondary sources of law. The results of this study indicate that legal remedies for applicants for land registration due to inheritance that has been the division of inheritance but rejected by the Land Office the factors that affect the inadmissibility of the registration of the transfer of land rights due to inheritance based on APHW are ignorance of service counter employees about the rules of registration of the transfer of land rights due to inheritance based on APHW, namely Article 42 paragraph (4) of Government Regulation No. 24 of 1997 on Land Registration. There has been no direction from the superior to the Front Office related to the National Land Agency circular on instructions for registration of transfer of Rights due to inheritance, probate grants and distribution of rights with B/HR number.02/1012/IV / 2023 dated April 13, 2023. Alternative efforts that can be made by the parties so that the registration of the transfer of rights due to inheritance based on APHW can be applied, can be done by a notary/PPAT or from the applicant himself. Efforts that can be done by a notary/PPAT one of them by filing a complaint related Land Office.

Abstract

The existence of the Land Bank is arguably redundant, as the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency could be optimised in seeking balance and justice in the distribution of land, including to indigenous peoples. Then, the model of open cooperation in land utilisation by not determining the priority scale from the Land Bank to business entities, individuals, or community groups, can open space for abuse of power and conflicts of interest. This type of research is normative juridical with a conceptual approach and a statutory approach. The results of the study show that the Government should form policies by striving to protect the livelihoods of indigenous peoples, the issuance of PP No.64 of 2021 concerning the Land Bank Agency can cause conflicts of interest between the community and the government, so the government needs to conduct a review and master the real land issues of land tenure in the Land Bank policy.

Abstract

Management rights are considered to be one of the Government's efforts to facilitate large entrepreneurs in investing in Indonesia. Of course, investment is expected to improve the community's economy. One of the efforts to improve the economy is done by creating jobs for the community. So it is necessary to map the land that is ready for business activities for investors. This article focuses on land management rights by the government for investment needs in Indonesia. The results show that the Management Rights (HPL) arrangement is not explicitly spelled out in Law Number 5 of 1960 concerning Basic Agrarian Regulations. that management rights are not purely from the state's control rights over land, but rather the delegation of the state's control rights to the subject or holder of management rights. The concept of a land bank in terms of its function becomes very important to consider as an instrument for land reserves in investment efforts for the prosperity of the people.

Abstract

This research aims to elaborate on the standing of Islamic law regarding regional head post-filling and how this post-filling is designed to conform with the principle of Islamic law. This research employed mixed methods and statutory, conceptual, case, and normative-theological approaches. The research results reveal that Islam holds the principles that can be adopted into the constructions of the national law in the matter of regional head post-filling. In the time to come, this post-filling should conform to the principle of al muhafadhotu ala qodimis sholih wal akhdzu bil jadidil ashlah, in which this post-filling should refer to the applicable model coupled with the development of this model with an asymmetric post-filling system. With this approach, areas with direct regional head elections will face reduction. Consequently, the areas not eligible to establish direct elections should consider another election model.
