Abstract

The UN Declaration on the Rights of Indigenous Peoples and the Indonesian Constitution both recognize the traditional rights of indigenous peoples. New regulations in Indonesia have introduced management rights originating from customary land. However, a legal vacuum exists regarding the terms of agreements to collaborate with third parties, putting both indigenous communities and third parties at risk. The research aims to safeguard and establish clarity for the traditional rights of indigenous peoples, as well as those of third parties seeking land management rights. This research employs a normative, juridical approach. Using a statutory approach and a conceptual approach, legal construction methods analyze the basic concepts for determining management rights over customary land of indigenous peoples. The results of this study emphasize the importance of setting fair timeframes to ensure fairness for all parties involved. This aims to eliminate legal uncertainty and potential losses, particularly for indigenous communities and those seeking these management rights. Provisions for the term of land use by third parties with the goal of fairness based on rights inequality; then, to come to an agreement that is good for both sides, the maximum term is based on the term of the Business Use Rights (HGU), which was 35 years, extended to 25, and renewed for another 35 years   Hak tradisional masyarakat hukum adat telah diakui dalam Deklarasi PBB tentang Hak-Hak Masyarakat Adat dan pada Konstitusi Indonesia.

Abstract

This research endeavors to investigate the intricate process of dispute resolution pertaining to conflicts that emerge between indigenous communities inhabiting the candidate site for the State Capital (Nusantara Capital City) and the Nusantara Capital Authority, a ministry-level institution endowed with the responsibility of overseeing regional administration within the Nusantara Capital City. Spanning an expansive 256,142 hectares of land, the Nusantara Capital City landscape harbors a mosaic of 17 indigenous communities in North Penajam Paser Regency and 34 indigenous communities in Kutai Kertanegara Regency, collectively comprising over 20,000 members, as documented by the Indigenous Peoples Alliance (Aliansi Masyarakat Adat). The procurement of land for the Nusantara Capital City's expansion has engendered protracted conflicts, notably pertaining to the resettlement of indigenous communities and the determination of suitable compensation areas. These conflicts persist without the presence of regulatory safeguards that could protect the rights and interests of indigenous communities while satisfying the exigencies of Nusantara Capital City development. The Indigenous Peoples Draft Law, despite its relevance, fails to address the intricacies of resolving disputes arising from land acquisition for public purposes. Similarly, the existing frameworks for land acquisition designed for public interest do not adequately address conflicts involving indigenous communities that lack legal recognition. Consequently, this research endeavors to propose a comprehensive conflict resolution framework rooted in the fundamental human rights of indigenous peoples, while also accommodating the imperatives of developmental investment. This approach seeks to strike a harmonious balance between the preservation of indigenous rights and the fulfillment of Nusantara Capital City's development needs.

Abstract

This article analyzes the strength of written evidence and proof of physical possession in registering land rights in Indonesia. This normative juridical research examines laws and regulations related to land registration, particularly GR No. 24/1997 and GR No. 18/2021. The results show that while evidence of physical possession for 20 consecutive years can be the basis for land registration, written evidence tends to have stronger evidentiary power in dispute resolution. However, the Indonesian legal system has no clear hierarchy between the two. Judges have an important role in assessing the evidence presented based on the principles of evidentiary law. This research recommends increased socialization on the importance of land registration and the need for a clearer policy on the hierarchy of evidence in land dispute resolution to improve legal certainty.

Abstract

This research explores the legal implications of land certificate digitalization under Indonesia's Job Creation Omnibus Law, focusing on the synchronization and harmonization of related regulations. The main question examines how the transition from traditional paper-based certificates to electronic titles (e-titles) can align with Indonesia's legal framework. The study is intended to analyze primary legal challenges and compare the Indonesian experience with Rwanda's successful e-title system. The paper employs a normative-juridical method, examining legal materials, including Electronic Information and Transactions Law and government regulations regarding land registration. The research discusses the synchronization of these laws and their application in ensuring data security, legal certainty, and efficient land governance. The result of the discussion highlights that while digitalizing land certificates can improve service delivery and efficiency, successful implementation is contingent upon the careful alignment of various laws and coordination between the National Land Agency and other government bodies. The comparative analysis with Rwanda’s e-title system offers useful insights into addressing potential legal and administrative challenges in Indonesia's digital transformation of land administration. This research contributes to offering actionable insights for policymakers aiming to modernize land governance in Indonesia.

Abstract

In the case of the above decision, the judge granted the plaintiff's claim to cancel the grant deed and the grant object returned to the rights of the grantor. With the judge's consideration that the adopted child in this case the grantee has neglected the adoptive parents. However, there is a contradiction when referring to the Civil Code, the grantee as an adopted child is not an heir who is obliged to provide alimony obligations to his adoptive parents. This research uses normative legal methods, where law is conceptualized as what is written in legislation (law in books) and as rules or norms that become benchmarks of human behavior that are considered appropriate. This research is based on primary and secondary legal materials, focusing on the norms contained in the legislation. In brief, Grant according to the Civil Code is a free gift made by a person to another party while still alive. However, the obligation of alimony in the Civil Code only regulates biological children to parents, not including adopted children, resulting in a legal vacuum regarding the obligation of alimony of adopted children to adoptive parents. This causes legal uncertainty, even though there is a legal basis for canceling a grant if the recipient does not provide alimony to the grantor. This legal vacuum makes it difficult to apply the principle of grant cancellation in the context of adopted children.

Abstract

This research aims to determine if legal protection is available for the use of forests, which are the customary rights of Adat and Indigenous Community from the mineral mining sector, which demands the use of extremely large territories. Fulfillment the utilizes state-controlled forest land, including protected forests, and industrial forests could be challenges. By considering environmental sustainability, legal protection ensures sustainable growth. To legally maintain customary forest rights, this study employs normative-juridical research utilizing primary and secondary legal sources about the acquisition of land for the mining sector, particularly for mineral mining. Agrarian, forestry, mining, and environmental protection and preservation legislation and decisions of the Constitutional Court of Indonesia on mining are examples of authoritative primary legal texts. All legal publications—including books, dictionaries, journals, and comments on court judgments—are considered secondary legal sources. This study finds that the legal protection of Adat and Indigenous Community’s customary forest rights over the availability of land for mining firms must be profitable, prosperous, and fair for Adat and Indigenous Community members. Adat and Indigenous Community are community associations that live and grow happily together in a hereditary region based on ancestry and similarity of habitation. Forest use for this purpose requires a Borrowing and Use Permit, which must include criteria for periodic, quantitative, and transparent environmental management, and preservation.

Abstract

Legal regulations in the Indonesian legal framework governing state land cultivators in urban areas remain contentious and require further legal examination. Agrarian reform efforts have largely focused on rural areas, even as the phenomenon of cultivators occupying state land in urban regions has significantly grown, creating social systems rooted in the lands they cultivate. These lands serve as their primary means of livelihood, places of social interaction, sites for familial continuity, and as long-term residences. Cultivators use the land without any legal ownership rights. Current legislation does not accommodate applications for the registration of land use rights for cultivators, leaving urban cultivators (in DKI Jakarta) without legal certainty or priority rights to apply for land rights. This legal void presents an inherent injustice to cultivators seeking priority rights over their cultivated land. Furthermore, the Job Creation Law, as framed by the government, reflects a latent capitalist ideology, reserving the right to apply for land-use rights solely for business actors (developers), thereby excluding cultivators themselves. This situation underscores the urgent need for a legal reformulation based on justice principles for the utilization of state land by cultivators in Indonesia, aiming to actualize agrarian reform in urban areas.

Abstract

Land mafia is still a serious threat in Indonesia, including in Pamekasan Regency, where the need for land is increasing rapidly. This study aims to examine the role of the National Land Agency (BPN) in resolving dual certificate disputes which are often the modus operandi of land mafia. The study uses a normative legal method with a descriptive analytical approach, as well as data collection through literature studies and legal documents. The results show that land mafia exploits weaknesses in land administration, especially in issuing fake documents and falsifying dual certificates. The Ministry of Agrarian Affairs and Spatial Planning/BPN has formed policies and an Anti-Land Mafia Task Force to prevent and eradicate this practice. However, the success of handling this problem requires cross-sector coordination and consistent law enforcement. In an effort to eradicate dual certificates from land mafia practices, the Ministry of ATR/BPN has made written regulations, namely Technical Instructions for the Prevention of Eradication of Land Mafia Number: 01/JUKNIS/D.VII/2018. In addition, the Ministry of ATR/BPN also formed a Land Mafia Task Force Team in order to eradicate land mafia practices that have the potential to cause double certificates based on bad faith. This study is expected to provide input for improving land law policies, in order to ensure justice and legal certainty for the community.
