Abstract

The right to claim matrimonial property (jointly acquired property) is an exclusive entitlement of the husband or wife that could be pursued in the event of a divorce, polygamy, death or conversion to another religion. In cases where such claims arise following a death of either spouse, the Syariah Court has allowed heirs to continue the claim for matrimonial property on behalf of the deceased, provided that the deceased had initiated such a claim while the deceased was still alive. However, complications arise when heirs attempt to file such claims even though the deceased never pursued any claim during the deceased’s lifetime. This article explores the legal standing, or locus standi, of heirs who adduce claims on matrimonial property after the death of a relative, based on Syariah Court decisions in Malaysia. This qualitative study employed document analysis, presented descriptively through the case study methodology, involving Syariah Court proceedings. Findings indicate that, in principle, heirs, other than the husband or wife who is still living, do not automatically possess the legal standing to claim matrimonial property on behalf of the deceased, as they do in matters of inheritance under Islamic estate law, unless the deceased had explicitly delegated such authority to them. Nonetheless, it is essential to first determine why eligible parties had failed to file the claim during their lifetime. Given the absence of clear textual evidence from Islamic sources, either permitting or prohibiting such claims by heirs, and the lack of specific provisions addressing this issue in state-enacted Islamic family law, judges have exercised their discretion in varying ways when deciding these cases.

Abstract

Border Disputes related to territorial management between local Governments dominate the ongoing cases within the Ministry of Internal Affairs in Indonesia. This study aims to propose a model of a policy of border Disputes resolution using non-doctrinal legal research (socio-legal research). This research limited itself by looking at Galang Island, the which is disputed between the city of Gresik and Surabaya. To gain Appropriate analyzes, in depth interviews and secondary of data was conducted and collected both in Gresik and Surabaya. Furthermore, this research finds that the reason underpinned such Disputes lays on the weaknesses of village government in the territorial management proofing Formally they have been doing. It is submitted that in forming and affirming border delimitation, Indonesian Act Number 6 year 2014 on Village jo Ministry of Internal Affairs Regulation number 114 year 2014 can used as legal base.

Abstract

Land dispute resolution in Indonesia is complex, involving multiple legal, social, and economic factors. Current mechanisms, including civil, administrative courts, and alternative methods like mediation, often fail to provide efficient or reliable outcomes, leading to legal uncertainty. This research examines the integration of dispute resolution mechanisms into Indonesia's judicial system from an economic analysis of law perspective. By applying principles of economic efficiency, the study explores how integration can reduce transaction costs and accelerate resolution processes. Using qualitative methods, the research analyzes legal documents, regulations, and court decisions to identify systemic challenges and propose improvements. The findings suggest that incorporating economic efficiency into the judicial process could enhance legal clarity, overcome existing obstacles, and restore public trust in land dispute resolution. This study contributes to the ongoing reform of Indonesia's legal system, offering insights into more effective, cost-efficient approaches to dispute resolution

Abstract

After the enactment of Law Number 22 of 1999 concerning Regional Government, currently the authority of the sub-district head as a regional head has previously been attributive and is now delegative. the aim of this research is about how is the legality of the sub-district head’s authority to release land rights for private interests. The research method used is normative juridical. The research results showed that the legality of the sub-district head’s authority to release land rights for private interests is not fulfilled. This is because there is not a single clause that states that the sub-district head can sign documents releasing land rights after the enactment of Law Number 22 of 1999 concerning Regional Government, which currently has the authority of the sub-district head as a regional head from previously being attributive and now being delegative, so that the Letter of Relinquishment of Land Rights made and signed by the District Head regarding the location of the land in question, cannot be used as a formal requirement for registration of land rights at the Land Office. Based on the applicable legal provisions, the deed of releasing land rights for private purposes should be made by a Notary. An authentic deed provides more legal certainty so as to cause justice for the party who relinquishes its rights/owner as well as for the next prospective applicant. Statement of Relinquishment of Land Rights signed by the Subdistrict of Cileungsi declared invalid / null and void.

Abstract

Villages hold a strategic position in harnessing tourism potential as part of regional autonomy at the regency and city levels. Such development efforts can yield substantial economic gains and enhance the welfare of local communities. Despite this, the existing legal framework confines the authority to carry out land acquisition for tourism area development solely to four entities: the central government, regional administrations, state-owned enterprises (“BUMN”), and regionally owned enterprises (“BUMD”). As a result, village governments and village-owned enterprises face limitations in developing village tourism areas. This study employs a normative juridical approach, integrating conceptual and statutory methods. The findings indicate that strengthening decentralization and focusing on rural development present opportunities to empower village governments and village-owned enterprises with the authority to acquire land. The restriction of land acquisition for tourism areas to the central government, regional governments, SOEs, and ROEs is becoming increasingly irrelevant. Village tourism areas possess more significant economic potential when managed directly by village governments and village-owned enterprises, with active involvement from local communities. Therefore, a legal reconstruction is necessary to expand the entities authorized to acquire land for village tourism development. This can be achieved by harmonizing relevant legislation, particularly Law No. 2 of 2012, in conjunction with Law No. 6 of 2023 and Government Regulation No. 11 of 2021. Such harmonization will support village governments and village-owned enterprises in realizing effective, sustainable, and inclusive village tourism development.

Abstract

The purpose of this study is to analyse the existing Land Bank arrangements in Indonesia and the legal implications of its arrangements for the management and control of land by the State. The problem is that the concept of land as state property has harmed the Indonesian constitution that "The land, water and natural resources contained therein shall be controlled by the state for the greatest prosperity of the people". Land that cannot be proven to have ownership is considered to have no ownership rights on it and becomes state land. The method used in this research is normative juridical. The results of this research show that there is a conflict of norms between the rules on the Land Bank Agency and the Indonesian constitution. So it is necessary to conduct a material test related to the article in the Land Bank Agency regulation to the Supreme Court. There are several studies that examine the Land Bank, but in this study there is novelty, namely judicial review related to articles in the Land Bank Agency rules.Tujuan dari penelitian ini untuk menganalisis pengaturan Bank Tanah yang ada di Indonesia dan implikasi hukum dari pengaturannya terhadap pengelolaan dan penguasaan tanah oleh Negara. Keterbatasan tanah dan jaminan ketersediannya untuk kepentingan umum ialah ugrensi pembentukan Bank Tanah, problemnya konsep tanah sebagai hak milik negara telah mencederai konstitusi Indonesia bahwa “Bumi, air dan kekayaan alam yang terkandung di dalamnya dikuasasi oleh negara untuk sebesar-besarnya kemakmuran rakyat.” Tanah yang tidak dapat dibuktikan kepemilikannya dianggap tidak ada penguasaan hak di atasnya dan menjadi tanah negara. Metode yang digunakan dalam penelitian ini adalah yuridis normatif. Hasil penelitian ini menunjukan bahwa terdapat konflik norma antara aturan tentang Badan Bank Tanah dengan konstitusi Indonesia. Sehingga perlu dilakukan uji materil terkait pasal dalam aturan Badan Bank Tanah kepada Mahkamah Agung. Terdapat beberapa penelitian yang mengkaji tentang Bank Tanah namun dalam penelitian ini terdapat kebaharuan yaitu uji materil terkait pasal dalam aturan Badan Bank Tanah.

Abstract

The Estates Office (BHP) is a colonial legacy institution that continues to exist in the Indonesian legal system, with the authority to manage inherited assets, oversee guardianships, and implement trusts. This study aims to analyze the BHP's authority in overseeing trusts, the role of notaries and PPATs in supporting the legality of legal actions, and Limitations on the use of assets by guardians for the benefit of those under guardianship. The method used is socio-legal research with a legal and conceptual sociology approach, through a case study at the Surabaya Legal Trust Agency (BHP). The results of the study indicate that BHP has a strategic role as a supervisory guardian to ensure that the guardian carries out its obligations in accordance with the law, protects the rights of parties who are legally incompetent, and prevents abuse of authority. However, the effectiveness of supervision is still hampered by limited human resources, undigitized administrative infrastructure, difficulties in cross-agency coordination, and legal gaps regarding sanctions for negligent guardians. Concrete cases demonstrate negligence by guardians that impacts the fulfillment of the needs of the custodial party, demonstrating the weakness of existing technical regulations. This study emphasizes the importance of reformulating regulations regarding guardianship, strengthening the capacity of BHP, accelerating digitalization, and optimizing inter-agency cooperation to increase the effectiveness of supervision. Thus, BHP can function optimally as a state instrument in providing substantive legal protection for vulnerable parties, while realizing the principles of legal certainty, justice, and benefit.

Abstract

The regulation of land area for plantation cultivation rights (Hak Guna Usaha/HGU) has changed from 1960 to 2023. Paradigm theory is one of the theories that examines why and what reasons lie behind written regulations. When legal changes occur, a paradigm shift also takes place. This article addresses the issue of what paradigm is used to determine the land area for plantation cultivation rights in several laws and whether a paradigm shift has occurred. A normative research method is chosen to examine the provisions regarding the land area of cultivation rights in four laws. The analysis uses a systematic, conceptual, and historical approach. This study shows a shift in paradigm in the granting of cultivation rights, particularly from 1960, which emphasized social justice, to 2023, which prioritizes economic interests.

Abstract

This article analyzes the strength of written evidence and proof of physical possession in registering land rights in Indonesia. This normative juridical research examines laws and regulations related to land registration, particularly GR No. 24/1997 and GR No. 18/2021. The results show that while evidence of physical possession for 20 consecutive years can be the basis for land registration, written evidence tends to have stronger evidentiary power in dispute resolution. However, the Indonesian legal system has no clear hierarchy between the two. Judges have an important role in assessing the evidence presented based on the principles of evidentiary law. This research recommends increased socialization on the importance of land registration and the need for a clearer policy on the hierarchy of evidence in land dispute resolution to improve legal certainty.

Abstract

The development of Indonesia's new capital, Ibu Kota Nusantara (IKN) or the Nusantara Capital City, involves land acquisition, potentially impacting the rights of indigenous peoples. This study evaluates the effectiveness of normative law in protecting these rights during the land acquisition process. Using a normative method, it examines relevant laws, regulations, jurisprudence, and academic literature through qualitative analysis. The findings reveal that while a robust legal framework exists to protect indigenous rights, implementation challenges persist. Key issues include determining fair compensation, land ownership recognition, relocation, and cultural preservation. Addressing these problems requires improved synergy and refinement of laws and regulations. The study highlights the critical need to bridge the gap between normative legal provisions and real-world practices. It emphasizes a holistic approach involving the government, indigenous communities, and stakeholders to achieve equitable and sustainable development. By offering operational legal solutions, the research underscores the importance of consistent legal application to respect indigenous rights. The findings call for multidisciplinary studies to tackle the complexities of protecting indigenous peoples in large-scale development projects. Strengthening legal mechanisms and fostering inclusive collaboration are essential for ensuring development aligns with the rights and needs of indigenous communities.
