Abstract

This study seeks to analyze and contrast the fiqh provisions and legal regulations pertaining to a wife's right to seek divorce in Indonesia and Syria, specifically in cases where the husband is absent. The author aims to employ a normative approach and comparative approaches, together with data analytic techniques like as text analysis, to identify both parallels and discrepancies between fiqh provisions and laws in Indonesia and Syria. Indonesian and Syrian state legislation predominantly aligns with the viewpoints of the Shafi'i, Hanbali, and Maliki schools of thought, which permit the possibility of challenging a divorce on the grounds of the husband's absence. From the two countries, specifically Indonesia and Syria. Indonesia has established the record for the greatest duration of being missing or unseen, spanning two continuous years. Subsequently, Syria undergoes a period of absence or invisibility lasting for one year. During the specified timeframe for assessing the divergence between the nations of Indonesia and Syria, the majority of individuals have not adhered to the teachings of the fiqh scholars. The Shafi'i, Hanbali, and Maliki schools establish a four-year time frame within which a wife may wait for her missing husband. Both Indonesia and Syria share similar provisions regarding the dissolution of a marriage due to an absent husband. Specifically, they consider an absent husband as one of the reasons that can lead to the termination of a marriage. Additionally, these countries also prohibit a wife whose husband is absent from remarrying until a court decision has been made.

Abstract

This study explored and analyzed fly wings from the perspectives of hadith and science. It used a qualitative, analytical descriptive approach and integrated Harald Motzki's Isnad Cum Matn analysis with pharmaceutical studies. The research question was: How do hadith and pharmacy view fly wings? The results showed that 21 hadith books mention fly wings, including Sahih Bukhari. The hadith of the fly wings is valid, with Utbah bin Muslim as the common link (disseminator of hadith). From the perspective of pharmaceutical science, most microorganisms on flies, such as germs, viruses, and microbes, can cause diseases. However, drowning flies can neutralize these microorganisms against the fluid they perceive. This shows that science is in harmony with the hadith of the Prophet.

Abstract

The study of interpretation methodology is very important, because the activities of the interpretation of the Koran will continue to develop along with the pace of the times. Abdul Mustaqim has mapped the interpretation methodology into three parts. First, the interpretation of the classical period. Second, the interpretation of the middle period. Third, interpretation of the contemporary period. With this mapping, it is expected that the position of the interpretation methodology of Jamal al-Banna can be known making it easier for researchers to recognize the interpretive concepts they offer. In every generation there are always products of interpretation of the Koran that have different features and characteristics. The socio-cultural condition in which the interpreter lives and the background of the disciplines they pursue is a reality that influences their interpretation of the Qur'an. The emergence of contemporary interpretations as the development of a scientific discipline is also much influenced by the development and change of the scientific epistemology itself. In this contemporary era, the name Jamal al-Banna appears which offers a new methodology for interpretation. This Egyptian-born thinker criticizes the scientific tradition of interpretation that has developed over the years (both classical and contemporary). So do not be surprised if the various ideas are always controversial. This article tries to review the methodological and philosophical interpretation of Jamal al - Banna. Starting with the effort to deconstruct the interpretation of the results of all classical commentators, Jamal proposed three stages in the interpretation of the Koran, namely the art approach, psychological approach, and rational approach. All three are hierarchical stages to arrive at an interpretation. Having arrived at the interpretation stage, Jamal al- Banna does not recommend certain methods or limit certain knowledge as methods of interpretation analysis. He refused if one particular method has a guarantee as the only way to find the truth, because the Koran does not have to be limited. Some contemporary thinkers in the study of the Koran, such as Amin al-Khuli, Mohammed Syahrur, Mohammed Arkoun, Nashr Hamid Abu Zayd, and Orientalist views on the Koran also did not escape criticism. To find out more about Jamal's thought, this article uses a descriptive qualitative method and a philosophical-rationalistic approach with hermeneutics as the ISSN: 1411-1632 (Print) 2527-5992 (Online) knife of analysis. Both of these methodologies are used to reveal the construct of Jamal's thought around the interpretation methodology that he built. This study contributes positively in order to broaden the insight of the study around the conceptual interpretation of the Koran. Because the spirit and problems faced by muslims today are growing and complex which demands the discovery of new methods in understanding the Koran more accommodatively and dynamically. Based on the method and approach above, it was found that the interpretation method conceived by Jamal wanted to place the Koran free of the various approaches that limit it. For Jamal, humans are very autonomous and free to interpret as long as it is in line with the humanist and universal principles contained in the Koran. Through the systematic-practical interpretation methodology offered above, it can facilitate the moslem community to comprehend the Koran comprehensively. Abstract

Orientalists and Sirah Nabawiyyah Studies: An Examination of Clinton Bennett's ThoughtsSirah Nabawiyah is a study that has been mostly carried out by Eastern scholars (insiders) and Western scholars (outsiders). For Muslims, the life history of the Prophet is a source of aspiration and adaptation for practical purposes in social life. Meanwhile for non-Muslims, studying sirah nabawiyah is a source of curiosity in understanding Islam as a successful religion in the past and present. This study aims to explore the views of the British orientalist, Clinton Bennett, who is concerned with the study of Islamic studies in general, and the study of sirah nabawiyah in particular. The research method used is qualitative descriptive-analytical. The academic problem that arises in the form of a research question is how Clinton Bennett views sirah nabawiyah in his work In Search of Muhammad? The results of this study indicate that Clinton Bennett has been neutral and positive when studying the Prophet's biography, although sometimes he cites negative things. Bennett has discussed the Sirah teaching methodology with its various varieties practiced in the western academic world and mentioned various orientalist views which have a critical and sensitive approach to faith. According to him, scientific criticism must be maintained without sacrificing the sensitivity of faith

Abstract

This paper discusses the contestation of women's public leadership discourse among feminist activists in Indonesia and Malaysia and how the reproduction of fiqh on women's public leadership in both countries takes place. This research is a field study with data collection through interviews and direct interaction with women activists in both countries and documenting their works. Using the Islamic activism approach, it was found that: 1) The issue of women leaders in Indonesia and Malaysia is complex. Women are often held back by culture, religion and politics. Muslim feminist groups face resistance from conservative groups when they try to challenge gender inequality. Furthermore, some sharia law make it harder for women to get legal protection and justice. More legal rights and support for women are therefore required to make politics more equal. 2) Feminist activists in Indonesia and Malaysia have reinterpreted Islamic texts to promote gender equality. They offer gender-responsive interpretation of the Qur'an and Hadith deemed to be fairer while supporting support social justice and gender equality. 3) The fiqh product of leadership concludes that the moral ideal in the Qur'an and hadith is for leaders to be competent (qawwām). People who fit this profile are well-suited to lead, particularly in a country that adheres to democratic principles.
