Abstract

The spread of Covid-19 in Indonesia has had wide-ranging impacts on human life, particularly on the economy. Therefore, a breakthrough is needed to address this issue by actively involving the community and working with the government to develop a community economic development program. This background prompted this study intending to obtain the right program for MSMEs affected by Covid-19 in Lampung Province. This study uses a qualitative approach with data collection methods, including observation, interviews, and documentation. The data analysis method used is qualitative analysis, with conclusions drawn using deductive thinking frameworks. The results of this study indicate that the community economic development approach by the Lampung Provincial Government has been implemented using the processes and stages outlined in existing theories. From the process perspective, this approach has successfully gone through each process, and so far, the program is considered capable of addressing the problems faced by MSMEs affected by Covid-19. This approach is considered more effective, as the program has been widely felt and successfully fostered creativity, trust, discipline, optimism, and improving family economies. This approach has also been implemented by Islamic economic values , which consist of the values of divinity, justice, and cooperation.

Abstract

Digital transformation has brought about fundamental changes in the Indonesian civil law system. This study aims to analyze the impacts, challenges, and opportunities of digital transformation in the context of civil law, as well as to formulate an ideal transformation model to accommodate the needs of the digital era. This study uses a normative legal research method with a qualitative approach based on literature studies and analysis of primary and secondary legal documents, including the application of sharia principles in digital transactions. One example of a case raised is the implementation of the murabahah contract in sharia e-commerce transactions that have not received explicit protection and recognition in the Civil Code, especially regarding the agreement clause and non-physical objects of sale and purchase such as digital assets. In practice, this sharia contract clause is often not accommodated by the conventional civil law structure, especially Article 1320 of the Civil Code concerning the valid conditions of an agreement and Article 1457 concerning sale and purchase. The results of the study indicate that digital transformation requires a reinterpretation of the basic concepts of civil law, the development of an adaptive regulatory framework, and the strengthening of digital infrastructure. The ideal legal transformation model should prioritize the principles of neutral technology and international harmonization, while maintaining the characteristics of the national legal system and the values ​​of sharia economic law. Key challenges include the digital divide, cybersecurity, and personal data protection, while opportunities include increasing the efficiency, accessibility, and transparency of the legal system. This study recommends developing a comprehensive regulatory framework, strengthening digital infrastructure, and increasing human resource capacity to support inclusive digital civil law transformation that is in line with sharia principles.

Abstract

This article discusses the proposition of Syara’ concerning polygamy. The aim is to find out the relationship between literal meaning of the text and the socio-historical context underlying the issuance of the provosion. This study utilizes historical, textual approach to obtain a vivid, comprehensive perspective of the literal and contextual meaning. As it is already known, the proposition of polygamy is Surah an-Nisa’: [4]: 3 plus a number of hadiths relating the issue. According to history, the reasons underlying the revelation of Surah an-Nisa’: [4]: 3, actually, was to reprimand companions who wanted to marry orphans in their guardianship but unwilling to give dowry as much as when they married other women. Thus, the verse was not solely about polygamy or limitation of the number of wives, but it also contained a criticism against contemporary tradition which tended to be arbitrary in releasing lust. Furthermore, polygamy itself is not recommended nor even impulsive in Islam. As the above-mentioned shura implies, Islam prefers monogamy than polygamy, as it imposes difficult condition for those who want to do polygamy

Abstract

Marriage is a legal place to foster a peaceful, harmonious and loving household (Sakīnah mawaddah wa rahmah). In marriage, the fulfillment of the rights and obligations of husband and wife is the main means for achieving domestic happiness. In the Islamic perspective, the husband is the head of the household and the wife is the housewife. However, in modern times, along with the emergence of feminists, the concept of the rights and obligations of husband/wife are thus re-interpreted and reconstructed on the grounds that many wives are no longer serving as housewives but also help husbands in earning a living. As a result, the aspect of equality is more prioritized than the concept of mu'āsyarah bil ma'rūf (harmonious relationship). This article examines the views of Muslim feminists about the role of husband/wife in a household, while comparing them with concepts that exist in Islamic teachings. In conclusion, the Islamic concept of the rights and obligations of wife and husband, if it is carried out consistently, will actually bring more benefit and permanence in the household than the feminist’s which is only based on the equality argument.

Abstract

Higher education is an effective means of transforming thought and movement to counteract the negative influence of various extreme and deviant religious schools and understandings, one of which is radical ideology, which has recently begun to emerge among students at several tertiary institutions. This study aims to obtain an overview of the steps that have been taken by UIN Raden Intan Lampung, UIN Sunan Ampel Surabaya, and UIN Sunan Gunung Jati Bandung in grounding the concept of religious moderation to anticipate and counteract the radicalism ideology that has recently infiltrated among University students. This research is classified as descriptive qualitative field research, using the maslahah (benefit) theory. Data were obtained from reviewing several documents in the three institutions, which were then processed and analyzed using the content analysis method. This study concludes that although each University has a different approach in its efforts to prevent and overcome radical religious ideology, the concept offered is the same, namely religious moderation, which is based on the principle of welfare, namely “li jalbi al-mashālih wa li daf'i al-mafāsid” (taking benefit and eliminating harm).

Abstract

Joseph Shacht a theory developer of the origin of hadits developed by Goldziher. The study of sanad has become a central topic that has received more attention. Some of the theories developed by Schacht lead to doubts about the authenticity of the hadits sanad. Sanad is only made by people who lived later and then leaned on to an authoritative figure to seek its legality. The results of this scientific work received criticism from Azami by bringing other evidence to rely on. The claim to the correctness of Schacht's theory is then considered not objective in terms of scientific truth standards. Some of the problems above are the focus of the study in this study, based on critical analysis methods and historical approaches. The result of the research is that the Sunnah is an expression, habit and way of life even though at that time the habits agreed by the community then relied on the Prophet. The more complete the series of sanads, as an indication, the further away from the Prophet's life. Sanad as a basis for dating a hadits. Even the appearance of sanad was earlier than the hadits editorial. Schacht based the development of the hadits sanad study through the theory of back projection and common link. Azami's criticism of Schacht's theory is as a baseless scientific lie. These theories stand on some of Schacht's misunderstanding of the theory and terms formulated by hadits scholars. Schacht's theory of the Sunnah also contradicts the historical realities prevailing in the early Islamic world.

Abstract

As a religious tradition, Tahlilan cannot be put in  isolation of debate among Indonesian Muslim society. In one side, it is believed as part of Islamic teachings which do not contradict with the Shari’a, while the other considers it as a syncretistic practice that has no guidance in the Qur’an and As-Sunnah.  Apart from the controversy surrounding it, this study aims to examine, both philosophically and sociologically, how the actual process of inculturation between religious and cultural values in the Tahlilan tradition is constructed and embedded, so that it persists as a tradition constantly alive. As the field research, this study explores data from two different areas, namely Lampung and Banten. As a result, this study would like to describe although the Tahlilan tradition in both areas has the same essence and purpose, as al-adah muhakamahor customs, to recite the holy verses of the Qur’an, dzikir, and pray to the spirit of someone who has died in order to gain God’s forgiveness, the inculturation of both areas has its own distinctions and peculiarities.

Abstract

Sociologically  and culturally  speaking,  Islamic  law is the law that flows and deeply stem from cultural roots of community.  It presents together with the presence of Islam. In the current days of Indonesia, however, Islamic law is in part an unwritten  law, in addition to the trade mark that is still characteristically  attached to the Middle East. These are the reasons why a number of Indonesian Muslim scholars then gave rise to the indigenization  of Islamic law with a variety of ideas and namings. This paper attempts to depict the journey of the indigenization  of fiqh (Islamic law) discource  in Indonesia  by using analysis of social history. There were some important figures offered constructive  and  paradigmatic  jurisprudence  format  of  Indonesian fiqh. Such important  figures that will be analysed  in this paper are Hasbi ash-Shiddiqy as the originator of the early Indonesian fiqh, and Hazairin who initiated the Indonesian madzhab or Indonesian Shafi’i plus school projected to include the national inheritance law. Then KH Sahal Mahfuz, the originator of an Indonesian social jurisprudence, and the last Gus Dur (Abdurrahman Wahid KH), who offered the genuine ideas of the indigenization  of Islam and contextualization  of Islamic jurisprudence.

Abstract

Obtaining knowledge is the right of every human being to be able to bring a better and prosperous life. Humans as Muslims seek knowledge to be an important part and Islam also does not limit useful knowledge. To stay within the corridor of religiously useful knowledge such as Islamic Studies also requires a broad perspective through cross-study reviews. Construction of Islamic Studies can discuss many issues of life in terms of other scientific studies that support or can be referred to as Interdisciplinary Islamic Studies. This article is intended to find out the nature of Interdisciplinary Islamic Studies in terms of the philosophy of science. The study method used is through literature study, data collection based on literature such as books and journals. The results of the study reveal that Interdisciplinary Islamic Studies provides space for humans to overcome the complexities of existing human life problems, because these problems are not only solved based on one field of study. Interdisciplinary Islamic Studies builds a harmonious relationship between Islamic Studies and Science. The relationship between the two needs to be done to contribute to the good of both of them, so that this study can produce comprehensive and moral knowledge.

Abstract

The infrastructure development planned by the government is not only for infrastructure development for the needs of society in general, but in the education sector the government is also making changes and developments. The aim of it is to develop higher education so the implementation of education is carried out dynamically and conducively that education can carry out its function as a means of improving the welfare of society and developing the country's economy which later became the background of this conducted research. This study is field research with a qualitative approach. There were 60 respondents as data sources, data collection tools used observation and interviews, while data analysis used a qualitative approach and conclusions were drawn using a deductive thinking framework. Research findings show that the existence of UIN Raden Intan Lampung is not only an education center, but also a driving force for the local economy and an agent of positive change in improving the economy of the surrounding community. The existence of UIN Raden Intan Lampung can be interpreted as an instrument that can support the achievement of maqasid al-syari'ah goals for the good and welfare of humanity.
