Abstract

           Penelitian ini bertujuan untuk memberikan jawaban tentang polemik atau bagaimanakah ketentuan hukum tabattul (membujang) dan juga analisa dampak tabattul dari segi sosial, agama, kejiwaan, dan lainnya. Penelitian ini termasuk jenis penelitian pustaka (library research), dengan metode kualitatif. Analisis data melalui pendekatan analisis kritis deskriptif untuk menghasilkan sebuah kesimpulan. Hasil penelitian ini menyimpulkan bahwa Tabattul (membujang) dalam pandangan hukum Islam itu dikembalikan kepada asas atau pokok hukum dalam menikah, sebagaimana hukum menikah merupakan sunnah Rasul dalam bentuk ibadah kepada Allah, adapun hukum menikah itu wajib kepada seseorang yang sudah membutuhkan serta hasrat untuk menikah dengan catatan mampu, namun apabila seseorang tidak ada hasrat untuk menikah maka hukum yang berlaku atasnya adalah sunnah, dalam arti tidak diwajibkan atasnya untuk menikah. ataupun haram bagi seseorang dilihat dari alasan dan latar belakang seseorang yang akan menjalaninya. Terlepas dari itu menolak menikah dengan alasan ekonomi juga tidak dibenarkan, hal ini karena Allah SWT dalam firmannya telah menjamin kemampuan ekonomi bagi seseorang yang menikah. Seseorang yang tidak mau menikah dengan alasan yang  jelas  adalah sangat merugikan dirinya sendiri dan lingkungannya seperti dari segi kesehatan, sosial, agama, dan lain sebagainya.

Abstract

Marriage agreements are usually made before or at the time the marriage takes place. This agreement is known as a prenuptial agreement. As contained in Law Number 1 of 1974 Article 29, it is stated that at the time before the marriage took place, both parties with mutual consent can enter into a written agreement which is legalized by the marriage registrar, after which the contents also apply to third parties as long as the third party is involved. However, with the issuance of the Constitutional Court's decision no. 69/PUU-XIII/2015 regarding a material review of Article 29 of Law Number 1 of 1974 concerning Marriage, which was then followed by Regulation of the Minister of Religion of the Republic of Indonesia Number 19 of 2018 concerning Marriage Registration, which in the end said that it is not permissible to make A marriage agreement after The marriage takes place is contrary to the 1945/ inconstitutional law, so the author feels it is very necessary to conduct a study of the arguments of the Constitutional Court and what legal consequences arise from the change in the marriage agreement.In this paper the author uses the normative legal method, using an empirical juridical approach. The empirical juridical approach is an approach used in research by examining theories, concepts, legal principles and legislation related to research. The result of this study is that the decision of the Constitutional Court no. 69/PUU-XIII/2015 creates legal consequences for joint assets, results in the distribution of inheritance, as a result of causing legal uncertainty, and with this decision it can also lead to disharmony in the relationship between husband and wife in the future.

Abstract

The participation of women who have careers outside the household in order to support family finances has caused problems for women, because in the household, career women are still required to provide services like women who do not work. Even in some cases, career women are often blamed for the problems that arise in the family. The time taken to develop their careers and potential is seen as a source of conflict that shakes the unity of the family. Meanwhile, career women have different responsibilities than wives who do not work. In addition to having responsibilities in the household, the burden of work also depends on their shoulders to help the family's finances. This study aims to examine the ideal position of career women in the Qur'an, in order to educate husbands in treating working wives. The study was conducted by examining verses related to the position of women who have careers in the Qur'an. Searches for books of interpretation and the latest journals about the meaning of verses related to the research topic and then analyzed and obtained the substantive meaning of the verses. The results of this study indicate that there are no verses that prohibit women from having a career. The position of women with careers in carrying out their rights and obligations in the household is balanced. The Qur'an places a fair and equal position for women with men. Career women should be given more appreciation according to the burden they bear. A husband is expected to help his wife with housework, as an appreciation for his wife who has helped earn a living.
