Abstract

East Java was originally a sugarcane plantation and the main sugar producer in Indonesia. This inability is caused by the decreasing land for planting sugarcane, especially in Java. Since the 19th century, the islands of Java and Sumatra have been among the largest sugar producers. The largest land area is on the island of Java. The quality of the soil and climate are very good for sugar plants. The problem is land conversion. Land conversion occurs due to the development of large cities and their satellite cities. The development of these cities requires land for residential and factory functions. This is actually not a problem as long as there is careful planning and strict implementation of the spatial planning of the area. This study tries to examine the synergy between sugarcane plantations and spatial planning and its implementation. By examining the case of the closure of three sugar factories in Sidoarjo Regency, the study shows that inconsistency in maintaining planting land has resulted in sugar factories experiencing difficulties in sugarcane supply.

Abstract

The termination of employment relationship carried out by PT Synerga Tata Internasional to Muhammad Nasir on the grounds of efficiency in preventing losses resulted in a dispute between themuntil the issuance of the Supreme Court Decision Number: 179k/Pdt.Sus-PHI/2024. This layoff is carried out by injuring labor law due to the offer of layoff compensation that is not in accordance with applicable regulations. The difference between the decision of the panel of judges of the first instance stating that the lawsuit is inadmissible (niet ontcvankelijk verklaard) and the decision of the panel of judges of the cassation level stating that the Plaintiff's lawsuit was partially granted resulted in a significant difference in how the judge viewed, considered, and provided the basis for the decision on the settlement of the dispute that occurred. This study aims to examine the basis of legal considerations (ratio decidendi) used by the Panel of Judges in deciding disputes and understanding the appropriate case resolution in deciding disputes. The type of research used in this study is normative legal research or doctrinal hukm research which is carried out through literature review or secondary data. The results of this study show that the Plaintiff's lawsuit cannot be said to be formal and premature smallpox, so it cannot be declared that the lawsuit is inadmissible. Beside it,, based on Article 43 paragraph (2) of PP 35/2021, the Plaintiff is entitled to Severance Pay, Service Period Award Money, and Compensation Money as compensation received as a result of the layoffs experienced.

Abstract

Termination of employment carried out by PT Medicinal Cosmetic Industries Indonesia to Tri Dewi Purnama Sari on the grounds of violating the Joint Work Agreement resulted in a dispute between the two until the issuance of Supreme Court Decision Number: 1326 K/Pdt.SusPHI/2023. This layoff was carried out by violating labor law due to the existence of a clause in the Joint Work Agreement that was not in accordance with the development of legislation. The difference between the decision of the first instance panel of judges stating that the plaintiff's lawsuit was partially granted and the decision of the Supreme Court of Cassation which stated that the defendant's lawsuit was granted in full resulted in a significant difference in the judge's perspective, considerations, and the provision of the basis for the decision to resolve the dispute that occurred. This study aims to examine the legal considerations (ratio decidendi) used by the Panel of Judges in deciding the dispute and to find out the appropriate case resolution in deciding the dispute. The type of research used in this study is normative legal research conducted through literature review or secondary data. The results of this study indicate that there are errors in the interpretation of the collective work agreement and the calculation of severance pay for workers who are laid off.

Abstract

labels aim to provide legal literacy for the target audience, namely MI Darul Ulum Rejomulyo students, Magetan Regency by looking at knowledge, understanding, attitudes and behavior of students before and after the activities given in the form of questionnaires and sheets observation. The results of the Community Service activities after the Community Service team provided legal literacy, showed that there was a significant increase in legal knowledge, legal understanding, and legal attitudes of students regarding the laws and regulations on processed food labels. However, the legal behavior still shows students who do not really care about processed food labels.

Abstract

This study is expected to have significant implications for policymakers and stakeholders in Indonesia and other developing countries seeking to reform their labor laws. The study can validate the development of new policies and programs to protect the rights of the workers, promote decent work, and provide greater access to social protection. The discussion on comparing labor regulations before and after implementing the Job Creation Law (The Law Number 6 Year 2023) in Indonesia covers several key aspects, including wage arrangements, outsourcing, social protection, and fixed-term employment agreements (PKWT). The Job Creation Law reflects the trend to provide more flexibility to employers, allowing them to customize working conditions according to business needs. While a push exists to improve the investment climate and create jobs, these changes raise serious questions about workers’ rights and welfare, particularly concerning about social protection and job security. This comparison indicates significant changes in Indonesia’s labor regulations, providing a clearer picture of workers’ challenges and opportunities. Labor law reform in Indonesia has impacted workers’ perception and responses. While some perceive it as a positive step that strengthens legal protection against unfair termination of employment, many workers still experience inequalities in access to health insurance, pensions, and workplace accident insurance. The government and stakeholders should work to improve workers’ access to social security and strengthen law enforcement and oversight to minimize potential implementation failures that could harm the rights of the workers.
