Abstract

Suami yang telah menjatuhkan talak tiga kepada istrinya maka suami istri tersebut tidak boleh rujuk kecuali apabila si istri telah melakukan perkawinan dengan laki-laki lain kemudian bercerai. Permasalahannya adalah ketika perkawinan istri dengan laki-laki lain itu dilakukan dengan rekayasa dan laki-laki tersebut dibayar untuk melakukan perkawinan tersebut atau dikenal dengan istilah perkawinan Cino Buto. Penelitian ini bertujuan untuk mengkaji bagaimana pelaksanaan perkawinan cino buto tersebut di Kabupaten Tanah Datar, apa saja faktor yang mempengaruhi terjadinya perkawinan cino buto di Kabupaten Tanah Datar dan bagaimana keabsahan perkawinan cino buto tersebut dikaitkan dengan Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan. Penelitian ini menggunakan metode pendekatan yuridis empiris, yakni suatu penelitian yang tidak hanya melihat dari aspek hukum positif namun juga melihat penerapannya di lapangan dan masyarakat. Berdasarkan hasil dari penelitian ini, dapat disimpulkan bahwa pelaksanaan perkawinan cino buto di Kabupaten Tanah Datar dimulai dengan adanya rekayasa perkawinan antara pihak pasangan yang telah terkena talak tiga dengan si muhallil untuk menyepakati jangka waktu dan bayaran dari perkawinan tersebut setelah itu akan dilakukan prosesi akad nikah layaknya akad nikah pada umumnya. Kemudian dilanjutkan dengan pelaksanaan hubungan suami istri lalu si muhallil akan segera menceraikan perempuan yang dinikahinya tersebut agar si perempuan bisa kembali menikah dengan mantan suami sebelumnya. Adapun faktor penyebab terjadinya perkawinan ini dapat dilihat dari 2 sisi, yakni dari sisi pelaku dan sisi muhallil. Dari sisi pelaku, faktor penyebab dilakukannya perkawinan cino buto ini adalah pemahaman terhadap agama Islam, pemahaman terhadap mazhab syafii, penyesalan atas perceraian, praktik turun menurun, adanya kekosongan hukum, dan pertimbangan terhadap anak. Sedangkan dari sisi muhallil penyebabnya adalah faktor ekonomi, ingin membantu perempuan yang telah ditalak tiga, dan karena adanya kekosongan hukum. Perkawinan Cino Buto apabila dikaitkan dengan Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan merupakan perkawinan yang tidak sah untuk dilakukan karena tidak sesuai dengan hukum agama Islam yang menginginkan perkawinan sebagai ikatan lahir batin yang kokoh dan kekal serta dilakukan atas niat ibadah dan atas keinginan sendiri bukan atas dasar rekayasa karena perjanjian dengan jangka waktu yang telah ditentukan.

Abstract

Abstract: The Government of the Republic of Indonesia through Law Number 23 Year 2011 on Zakat Management prohibits unauthorized institutions to collect zakat because it has the potential to misuse the collected zakat funds. The collection of zakat funds by unauthorized institutions in West Sumatra Province has the effect of losing public trust in making zakat payments and zakat funds that have been collected by unauthorized institutions have the potential to fund other criminal activities such as terrorism movements that threaten the sovereignty of the Republic of Indonesia. The formulation of this research problem are: (1) How is the criminal law enforcement against unauthorized zakat collecting institution based on Law Number 23 Year 2011 on Zakat Management by law enforcement officials in West Sumatera? 2) How are the efforts that have been made in law enforcement against criminal acts of zakat management by unauthorized zakat collecting institution in West Sumatera? This research was conducted with sociological juridical research methods and the data sources of this research were primary data and secondary data, data collection techniques were carried out by interview and analyzed qualitatively. The conclusions of this study are 1) Criminal law enforcement against unlicensed zakat collection institutions based on Law number 23 of 2011 concerning zakat management by law enforcement officials in West Sumatra is carried out by the West Sumatra Regional Police which is influenced by legal factors, law enforcers, facilities, society, and culture. 2) Efforts that have been made in criminal law enforcement against unlicensed zakat collection institutions based on Law number 23 of 2011 concerning zakat management in West Sumatra are penal efforts and non-penal efforts (Socialization). Abstract

During activities, mining entrepreneurs often rent heavy equipment in the form of excavators from other entrepreneurs. It often happens that rented items are used to commit crimes, which leads to the confiscation of rented items as evidence. Therefore, renting entrepreneurs will suffer economic losses. This raises the legal question of how to protect tenants in this case. To answer this question, we need to do a study. This study is a normative legal study, which raises three (three) legal issues, namely (1) examining the reasons for the confiscated heavy equipment by law enforcement departments; (2) examining the legal consequences of confiscated on third parties renting heavy equipment; and (3) examining the forms of legal protection for third parties renting heavy equipment. The study shows that, first of all, the reason for the confiscation is to let investigators have evidence of the crime. Secondly, the legal consequence of confiscation on third parties is the inability to use their heavy equipment to earn income, resulting in delayed payment of credit for the purchase of confiscated goods. Third, the third party is protected by the laws of Article 206, Article 227-228 R.Bg and Article 195 (6) HIR. The third party has the right to make resistance efforts (derden verzet) before the case is adjudicated.

Abstract

This research aims to analyse the implementation of Blacklist Sanctions in Government Procurement, analyse the factors that can caused Providers who are subject to Blacklist Sanctions to sign contract with PPK, analyse sanctions for negligence of Procurement Actors from the Government and Legal Actions that can be taken by Service Providers subject to Blacklist Sanctions. This research adopts a normative-empiric and descriptive approach, utilizing a statute approach to legal provisions and equipped with empirical data. Research results: the implementation of Blacklist Sanctions is carried out by determining and displaying Blacklist Sanctions on the National Blacklist Portal, the sanctions are valid from the date of the Decree of Determining Blacklist Sanctions, Blacklist Sanctions do not apply retroactively (non-retroactive). The factors that can cause the Providers who are subject to Blacklist Sanctions to signed contract with PPK, among others any mistake is found in the evaluation process carried out by Selection Committee, PA/KPA being late in displaying Blacklist Sanctions on the National Blacklist Portal and the Blacklist Sanctions for Provider not appearing due to system errors. Government Procurement Actors may be subject to administrative sanctions for their negligence in contract with providers who are subject to Blacklist Sanctions. Providers can take legal action in the form of objections, postponements and cancellation of Blacklist Sanctions in accordance with applicable regulations.

Abstract

Opportunities for government infrastructure development require procurement of goods and services, the regulation of procurement of goods and services is regulated in Presidential Regulation (Perpres) Number 12 of 2021 concerning Government Procurement of Goods and Services. In this opportunity for procurement of goods and services, the government has an opportunity for a tender process, in tender procurement sometimes a tender conspiracy arises. This tender conspiracy is regulated in Article 22 of Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. In Case Number 08/KPPU-L/2023 and Case Number 17/KPPU-L/2022, there has been a tender conspiracy that has harmed job owners, business actors and the community. Problem Formulation (1) What is the legal protection for parties who are harmed due to tender conspiracy in the procurement of goods and services? (2) What are the indications of tender conspiracy in the hearing of the Business Competition Supervisory Commission? The research method used is Normative Jurisprudential, the type of data used is secondary data, to obtain secondary data, primary legal material data sources and secondary legal materials are used, data collection techniques are literature studies and interviews, qualitative analysis data analysis techniques. The results of the study (1) the form of protection provided to the injured parties in Case Number 08/KPPU-L/2023 and Case Number 17/KPPU-L/2022, namely providing protection by imposing large fines and hoping to provide a deterrent effect on business actors (Reported). (2) The indications contained in Case Number 08/KPPU-L/2023 and Case Number 17/KPPU-L/2022 are that there are indications that several participants are involved in one control, which can be seen from the similarity of the technical documents they submit. In addition, there is suspicion of collusion during the implementation and evaluation process, including, the tender winner who subcontracts the work to another company or the losing tender participant. At the evaluation and determination stage of the tender winner, there were also indications that the committee tended to give privileges to certain participants. Furthermore, when submitting objections, the committee did not seem to respond to complaints from tender participants, which further strengthened the suspicion of collusion.

Abstract

Notaris Pengganti adalah seseorang yang diangkat untuk sementara sebagai Notaris untuk menggantikan Notaris yang cuti, sakit, atau tidak dapat melakukan tugasnya. Setelah Notaris Pengganti dilantik oleh MPW, Notaris dan Notaris Pengganti harus membuat berita acara serah terima protokol. Notaris yang menjalankan cuti harus menyerahkan Protokol Notaris kepada Notaris Pengganti, dan Protokol tersebut diserahkan ke Notaris Pengganti. Pokok permasalahan adalah bagaimana implementasi ketentuan tentang serah terima protokol notaris kepada notaris pengganti di Kota Pekanbaru dan bagaimana penerapan sanksi terhadap ketentuan tentang serah terima protokol notaris kepada notaris pengganti di Kota Pekanbaru. Penelitian hukum ini menggunakan pendekatan yuridis empiris yaitu suatu penelitian yang menggunakan metode pendekatan terhadap masalah dengan melihat norma-norma hukum yang berlaku kemudian dihubungkan dengan fakta-fakta hukum yang terdapat dilapangan. Dalam penelitian ini sumber data diperoleh dari penelitian kepustakaan dan penelitian lapangan. Teknik pengumpulan data dilakukan melalui studi dokumen dan wawancara terstruktur. Hasil penelitian, Implementasi ketentuan tentang serah terima protokol notaris kepada notaris pengganti di Kota Pekanbaru tidak sesuai dengan ketentuan yang seharusnya, karena tidak ada pengawasan yang cukup dari Majelis Pengawas. Sementara Pasal 67 dan 68 UUJN mengatur beberapa bentuk Majelis Pengawas, kurangnya pengawasan terhadap Notaris menyebabkan Notaris dan Notaris Pengganti tidak tahu tentang ketentuan Pasal 32 UUJN, dan kebiasaan menyebabkan berita acara serah terima Protokol Notaris tidak dilaksanakan secara hukum. Pengawasan ini tidak hanya bertujuan untuk menciptakan Kode Etik Notaris, tetapi juga untuk memastikan bahwa notaris mematuhi peraturan undang-undang dalam menjalankan tugas mereka untuk kepentingan masyarakat. Penerapan sanksi terhadap ketentuan tentang serah terima protokol notaris kepada notaris pengganti di Kota Pekanbaru hanya memberikan sanksi administratif berupa teguran secara lisan sesuai dengan ketentuan Pasal 85 UUJN. Penjatuhan sanksi yang dilakukan oleh Majelis Pengawas terkait Pasal 32 UUJN berdasarkan ketentuan Peraturan Menteri Hukum dan HAM Nomor 61 Tahun 2016 Pasal 5 huruf e. Sedangkan dalam hal kewajiban yang terdapat dalam Pasal 5 ayat (4) tidak dipenuhi dalam waktu yang ditetapkan atau melakukan kesalahan lain maka MPW dapat mengajukan usulan pemberhentian sementara kepada MPP berdasarkan ketentuan Pasal 6 ayat (1).

Abstract

Background: The registration of the Deed of Pledge of Endowment (Akta Ikrar Wakaf) is crucial to ensure the validity and clarity of the waqf land status. Issues arise when the deed of waqf pledge for land that already has a social facility status was rejected by the Land Office in 2019. Research Metodes: This research is categorized as empirical legal research that is descriptive-analytical in nature, drawing from secondary legal materials and tertiary legal sources. Findings: The research findings include: 1) The validity of the Deed of Pledge of Waqf No. W2/07/VII/2019 complies with regulations, but the waqf pledge is invalid due to unmet waqf elements. 2) Registration constraints of the Deed of Pledge of Waqf lead to legal uncertainty and the risk of revocation of ownership rights or waqf status. Conclusion: This research concludes that the Deed of Pledge of Waqf No. W2/07/VII/2019 related to social facility land is not valid, and the registration constraints can have serious consequences, including legal uncertainty and the risk of revocation of ownership rights. The proposed solution is to transfer the land to the city government as a municipal asset to address these issues.

Abstract

The people of Nagari Sasak and Nagari Kapa, Sasak Ranah Pasisie District, West Pasaman Regency live from agriculture and trade. Communities trade their agricultural and plantation products from one area to another. However, the community also then processes agricultural and plantation products in the form of processed food. Furthermore, these processed foods are made in various types of food, such as processed food, which is their central mainstay and in the form of ripik and rending meat, and so on. The problem is that many people do not understand the need to register trademark rights and services for these products. The purpose of this service is to provide understanding to the public about the importance of registering registration rights and trade services so that the community is legally protected. The activity method is carried out through lectures, discussions, and training based on Law No. Law No. 20 of 2016 concerning Brands and Geographical Indications. The results of this activity then have added insight and understanding to the people of Nagari Sasak and Nagari Kapa, Sasak Ranah Pasisie District, West Pasaman Regency regarding the procedures and processes for registering trademark rights and services for the food products they make and helping to help improve the economy of the Nagari Sasak and Nagari communities Kapa.

Abstract

This article investigates the legal protection of divorced women outside the court from civil and criminal law perspectives. Using a qualitative empirical juridical approach, this study was conducted in Nagari Pasar Tapan, a subdistrict in Pesisir Selatan Regency, West Sumatra, where extra-judicial divorces are still prevalent due to factors such as limited legal literacy, economic hardship, and the lack of access to judicial institutions. The findings indicate that extra-judicial divorce not only causes legal uncertainty in terms of marital status but also deprives women of their post-divorce rights, including maintenance, shared asset division, and child custody. Moreover, informal divorces often expose women to criminal accusations, such as polyandry, as a result of subsequent marriages not recognized by the state. This study emphasizes the importance of legal reforms, including increased awareness of divorce procedures, access to legal aid, and the strategic role of notaries in drafting and legalizing prenuptial agreements. By strengthening the position of women in such vulnerable legal circumstances, the state can fulfill its constitutional mandate to protect the rights of its citizens.

Abstract

This research aims to analyze gender justice in the customary provisions of the division of joint property towards wives carrying the double burden in the Muslim community of Suku Anak Dalam (SAD) Batin Sembilan, Jambi, based on the principle of al-musāwah. The customary provisions of this community regulate the division formulation of joint property. Both husband and wife get half a share in the event of divorce or death of one of the parties. However, in reality, wives face the double burden today. In addition to being responsible for household affairs, wives are forced to work to earn a living due to their husbands neglecting their obligations. This research uses an empirical juridical approach. Data were collected through in-depth interviews and documentation. The informants in this research were the customary elders and some residents of SAD Batin Sembilan, while additional information was obtained from the Village Head. The data obtained were analyzed from the gender justice perspective using the principle of al-musāwah. The results showed that based on the principle of al-musāwah emphasizing equality and proportionality (tawāzun), the customary provisions on the joint property division for wives carrying the double burden have not fully promoted the values of gender equality and justice in Islam. On that basis, the joint property division should be added to the contribution/role of the husband and wife in producing marital assets. Thus, based on gender justice considerations, wives carrying the double burden are entitled to a more significant share of the joint property than husbands.
