Abstract

This study aims to analyze the legal regulation and law enforcement against the crime of absenteeism without permission (THTI) carried out by TNI soldiers at the Medan Military Court, as well as the relationship between the Military Criminal Code (KUHPM) and the Criminal Code (KUHP). The research methods used are normative juridical and empirical juridical, with legislative, case, and conceptual approaches, as well as data collection through document studies and interviews. The results of the study show that legal arrangements related to THTI have been comprehensively regulated in Article 87 of the Criminal Code, with sanctions aimed at maintaining military discipline. Law enforcement against the THTI case at the Medan Military Court is carried out through the stages of investigation, investigation, prosecution, and execution of the verdict. The relationship between the Criminal Code and the Criminal Code reflects the principle of lex specialis derogat legi generali, where the Criminal Code is prioritized for TNI soldiers. However, there are challenges in determining jurisdiction in cases involving civil society, so coordination between military courts and general courts is needed. This study recommends increasing the socialization of the rule of law to soldiers, strengthening the capacity of military legal officers, and moral development to prevent THTI violations. With this step, it is hoped that the handling of THTI cases can run more effectively and fairly in accordance with the principles of military law and general criminal law.

Abstract

This article aims to analyze land problems that arise from economic, social and cultural aspects and even religion. For this reason, the issue of non-litigation land dispute resolution, especially mediation, is very interesting. The research method used is applied law research which combines two normative-empirical legal studies. The starting point of this research itself departs from the problem of typology of land disputes in the city of Medan and the resolution of land disputes through mediation by the Medan City Land Office as well as obstacles in resolving land disputes through mediation at the Medan City Land Office? The results showed: First, the typology of land disputes that occurred in the city of Medan was based on problems, land tenure and ownership, procedures for determining land rights and registration, boundaries and/or location of land parcels, land reform objects, land acquisition, and implementation of court decisions; Second, the settlement of land disputes through mediation by the Medan City Land Office based on the Regulation of the Minister of Agrarian Affairs and Spatial Planning No. 21 of 2020 concerning Handling and Settlement of Land Cases is related to the Decree of the Head of the National Land Agency of the Republic of Indonesia Number 34 of 2007 concerning Technical Guidelines for Handling and Settlement of Land Problems Jo. Technical Instructions No. 05/Juknis/d.v/2007 concerning Mechanism for Implementation of Mediation; Third, the obstacles in resolving land disputes through mediation at the Medan City Land Office can be seen from the aspects, legal substance, legal structure and legal culture. The results of the study reveal that there is a need for improvement in laws and regulations related to the formation of legal rules that guide the implementation of land dispute resolution through integral and comprehensive mediation and human resources (peace maintenance). legal culture in increasing public legal awareness.

Abstract

The purpose of this paper is to analyze the law against the cancellation of land rights certificates (Case Study of Certificate Cancellation by the Decision of the Head of the Medan City Land Office No. 80/SK-12.71/VIII/2020 based on the Medan High Court Decision No. 366/PDT/2012/PT. MDN). In analyzing the problem formulation with normative juridical specifications, the approach is based on the statutory approach, the Synchronization approach, the library approach and the analytical approach. The sources of legal materials used are primary, secondary and tertiary sources of legal materials. The results and discussion found that the cause of the certificate of land rights being canceled by the authorized institution because it was declared an administrative law record or administrative record or invalid based on an error in its issuance in accordance with the provisions in Article 107 of the Regulation of the State Minister of Agrarian Affairs/Head of the National Land Agency (Permenag/KBPN). ) No. 9 of 1999 Jo. Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency no. 11 of 2016. Types of errors that result in administrative legal records as described in Article 107 of the Minister of Religion/KBPN No. 9 of 1999 are: a. procedural error, b. errors in the application of laws and regulations, c. subject error, d. object error, e. right type error, f. area calculation error, g. there is overlapping land rights, h. juridical data and physical data are incorrect or, i. other errors of an administrative law nature.

Abstract

The problems discussed in this paper are How is the legal arrangement of lenders in the Peer To Peer Lending system, especially in the city of Medan where POJK is the foundation, How is the application of legal protection to lenders in the Peer to Peer Lending system, What are the obstacles and efforts on the part of the lender? lenders in the peer to peer lending financial technology system at OJK regional office 5, Northern Sumatra. The research method used by the author is normative juridical by finding and collecting data through library research from reading sources in the form of related legal books, legal expert opinions, related legislation, related websites, and interview results. The results of this study show that legal protection for Lenders can be realized in a preventive manner based on Article 29 of POJK Number 77/POJK.01/2016, namely by applying basic principles for Providers and repressive legal protection based on Article 37 of POJK Number 77/POJK.01/ 2016 concerning Information Technology-based Lending and Borrowing Services and Article 38 of POJK Number 1/POJK.07/2013 in conjunction with POJK Number 6/POJK.06/2022 concerning Consumer and Community Protection in the Financial Services Sector. when it comes from a system error.

Abstract

The return of evidence to a third party in good faith in a narcotics crime case is an important and complex legal issue. This study aims to analyze the application of the law to the status of evidence, judges' considerations in decision-making, and obstacles faced in returning evidence at the I-02 Medan Military Court, with a focus on Decision Number 16-K/PM. I-02/AD/II/2023. This research uses a qualitative method with a normative and empirical approach through document analysis, in-depth interviews, and literature reviews. The results of the study show that the application of the law refers to Article 46 of the Criminal Procedure Code and Law Number 35 of 2009 concerning Narcotics, with the main principle of protecting the rights of third parties in good faith. The judge's considerations include proof of legal ownership, the non-involvement of a third party in the crime, and the balance of justice. However, the obstacles faced include a lack of ownership documents, difficulty assessing good intentions, complicated administrative processes, and lack of legal understanding by third parties. The conclusion of this study emphasizes the importance of synergy between the application of fair, efficient, and responsive laws and the protection of individual rights. In addition, improvements are needed in the administrative process and education to the public to increase legal understanding. This research makes theoretical and practical contributions to the development of the criminal justice system in Indonesia, especially in the case of narcotics crimes.

Abstract

Drug abuse is a serious problem that has a negative impact on individuals, families, and society. Combating drug crimes in Indonesia requires not only a repressive approach, but also effective preventive policies based on the rule of law. This study aims to analyze the legal rules underlying preventive policies in combating drug crimes, with a focus on the effectiveness of implementation and the obstacles faced in the field. This study uses a normative legal method, which analyzes laws and regulations such as Law Number 35 of 2009 concerning Narcotics, Regulation of the Chief of Police No. 8 of 2021 concerning Handling of Criminal Acts Based on Restorative Justice, and Attorney General's Guidelines No. 18 of 2021 concerning Settlement of Narcotics Crime Cases Through Rehabilitation. The results of the study indicate that preventive policies have an important role in preventing drug abuse, especially through education, socialization, and cross-sectoral cooperation. However, the implementation of this policy is often hampered by weak coordination between institutions, limited resources, and low public awareness. Therefore, preventive policies supported by strong legal regulations and effective implementation can be a significant strategy in overcoming drug crimes. This study recommends the need for evaluation and improvement of regulations, increasing the capacity of implementers in the field, and strengthening community participation to create a safer environment free from the threat of drugs.

Abstract

Fenomena pelanggaran hak cipta atas karya tulis di lingkungan kampus telah melatarbelakangi Penulis untuk mengadakan ipengabdian kepada masyarakat (PKM)iiiiitentang itingkat ipengetahuan iMahasiswa itentang iperlindungan ihak icipta. Adapun tujuan pengabdian kepada masyarakat (PKM) ini adalah untuk iimengetahui pengaruh pemahaman hukum kepada mahasiswa tentang hak cipta dengan tingkat pelanggaran hukum hak cipta atas karya tulis. iJenis ipenelitian iyang idigunakan menunjukkan bahwa tingkat pemahaman mahasiswa tentang hak cipta atas karya tulis masih kurang. Sikap hukum pada mahasiswa masih belum menunjukkan sikap positif terhadap perlindungan hak cipta atas karya tulis berupa skripsi ataupun jurnal ilmiah. Walaupun imahasiswa imempunyai kehendak menghargai hasil karya orang lain, inamun ibelum kelihatan isikap menerima undang-undang dalam penerapannya di kehidupan isehari hari.

Abstract

Tujuan dari penelitian ini adalah untuk mengetahui pengaturan hukum tentang penerapan peraturan daerah mengenai badan usaha milik desa dalam upaya pengembangan swakelola desa dan penerapan Perda Kab. Langkat No. 6 Tahun 2022 tentang BUMDes dalam upaya pengembangan swakelola desa dan kendala yang dihadapi. Metode dalam penelitian ini yaitu instrument pengumpulan data. Obeservasi, wawancara, dan studi dokumentasi. Dengan analisis data deskriftif analisis. Pengaturan BUMDes di Indonesia, yaitu diatur dalam: UU No. 6 Tahun 2014 tentang Desa, PP No. 72 Tahun 2005, Permendagri No. 39 Tahun 2010, UU No. 11 Tahun 2020 dan Perda Kab. Langkat No. 6 Tahun 2022. Penerapan Perda Kab Langkat No 6 Tahun 2022 untuk Kebijakan BUMDes di desa Ujung Teran dapat diterapkan dengan baik, tetapi penerapan pengelolaannya belum berjalan secara optimal karena rendahnya kompentensi para pelaksana dan kurangnya keterkaitan masyarakat untuk ikut memajukan BUMDes, hal tersebut juga terjadi akibat aturan perda tersebut belum dibuat sanksi pidana yang jelas dalam penerepannya. Kendala yang dihadapi kurangnya penerapan substansi hukum  tidak adanya penjelasan mengenai sanksi. Kurangnya penerapan struktur hukum yaitu tidak tegas dalam pengelolaan BUMDes atau tidak diberikan sanksi bagi pelanggaran BUMDes, dan kurangnya budaya hukum yang ada di desa Ujung Teran.

Abstract

The phenomenon of interfaith marriage in Indonesia reflects the complexity of the relationship between positive law, human rights, and religious norms, particularly within a multicultural society. This article examines the practice of registering interfaith marriages through judicial determination, focusing on the case study of Determination No. 1350/Pdt.P/2022/PN.Mdn by the Medan District Court. Using a normative juridical approach supported by empirical data, this study analyzes the applicable legal provisions, judicial considerations, and insights from the perspective of Islam and maqashid al-shari’ah. The findings reveal that the registration of interfaith marriages through court rulings represents a legal response to normative gaps that fail to accommodate the needs of a pluralistic society. In the context of Islamic law, a maslahah-based approach is employed to interpret administrative registration without legitimizing the practice religiously. Meanwhile, from the perspective of state law, the court’s decision demonstrates the application of progressive legal principles and the protection of citizens’ civil rights. Therefore, such rulings serve as an important precedent for reforming marriage registration policies to be more humane, contextual, and aligned with the principles of social justice in a democratic legal state.

Abstract

The protection of Traditional Cultural Expressions (TREs) within the framework of the modern Intellectual Property Rights system faces significant challenges, primarily due to the dominance of individualistic principles and formal mechanisms based on registration and specifically copyright ownership registration. The first-to-declare system, which initially emphasized recognition of the party who first announced a work or creation, has in practice shifted towards a system that prioritizes formal registration by the first party at the Directorate General of Intellectual Property (DJKI). This article examines the application of the concepts of originality and prior art within the framework of the first-to-declare system, and analyzes their relevance in preventing unilateral claims on TREs by unauthorized parties through the registration mechanism at the DJKI. This research uses a normative juridical approach with an analysis of laws and regulations, international documents, and related case studies. The research results indicate that systemic reforms are needed, including the recognition of collective rights, the development of a TRE database, and the strengthening of the sui generis regime, as preventive measures against TRE misappropriation on the global stage.
