Abstract

Communal Intellectual Property (CIP) embodies the collective cultural identity that has been passed down through generations within local communities. Nevertheless, limited legal awareness among entrepreneurs and local producers often hinders the optimal protection and utilization of CIP’s cultural and economic value. This community engagement initiative seeks to improve public understanding of the legal aspects surrounding CIP protection, focusing on the Geographical Indication (GI) framework as a legal tool for safeguarding regional products. The program took place at the Grand Mercure Hotel in Medan, in partnership with the Regional Office of the Ministry of Law and Human Rights of North Sumatra, and was broadcast widely through Radio Move Online to ensure broader public outreach. Employing a participatory approach, the program included legal dissemination sessions, educational workshops, and interactive discussions that brought together MSME actors, academics, and local government representatives. The materials addressed the legal foundation of Geographical Indications as stipulated in Law No. 20 of 2016 concerning Trademarks and Geographical Indications, procedural steps for registration, and the economic and reputational advantages for local communities. The outcomes indicated that participants developed a stronger comprehension of the interconnection between CIP and GI, alongside heightened legal consciousness in protecting local products through formal mechanisms. In conclusion, the program successfully enhanced community legal capacity and promoted broader awareness of Communal Intellectual Property protection across North Sumatra.

Abstract

This study aims to analyze the role of novelty and prior art in the first to file system to protect traditional knowledge from invalid patent claims. Traditional knowledge is part of a valuable cultural heritage. Protecting it means maintaining and preserving the cultural identity of a community. In reality, most of the traditional wealth that was once owned by the people of the archipelago has been lost or moved to other countries. The study uses normative legal methods. Data collection was carried out through literature studies, observations, and document analysis. The results of the study show that in the First to File system, patent rights are granted to the first party to file a patent application, not the first party to create an invention. In the context of protecting against invalid patent claims on traditional knowledge, it is important for communities or countries to document their traditional knowledge as prior art. With adequate documentation, it can be shown that the knowledge existed before any patent claims were filed by other parties. So that it can protect traditional knowledge from invalid patent claims. Overall, the concept of novelty and prior art in the first to file system functions as a mechanism to ensure that traditional knowledge that has existed for a long time cannot be patented by unauthorized parties.

Abstract

Peningkatan kualitas pelayanan publik di tingkat kelurahan sangat dipengaruhi oleh kompetensi aparatur dalam menerapkan manajemen sumber daya manusia (MSDM). Kegiatan pengabdian kepada masyarakat ini bertujuan meningkatkan pemahaman aparatur Kelurahan Asam Kumbang terhadap konsep MSDM dan prinsip pelayanan publik. Kegiatan dilaksanakan pada 11 februari 2023 menggunakan pendekatan edukatif-partisipatif melalui ceramah, diskusi interaktif, dan studi kasus. Evaluasi dilakukan terhadap 30 peserta menggunakan desain one-group pre-test dan post-test dengan instrumen skala Likert (1–5). Hasil menunjukkan adanya peningkatan rata-rata skor dari 3,10 pada pre-test menjadi 4,32 pada post-test. Nilai N-Gain sebesar 0,64 menunjukkan efektivitas pada kategori sedang menuju tinggi, dan uji paired t-test menunjukkan perbedaan yang signifikan (p < 0,05). Hasil ini menunjukkan bahwa kegiatan penyuluhan efektif dalam meningkatkan pemahaman aparatur mengenai perencanaan SDM, akuntabilitas, dan profesionalisme pelayanan. Selain peningkatan kuantitatif, kegiatan ini juga mendorong komitmen aparatur dalam memperbaiki kualitas pelayanan publik. Model pengabdian berbasis evaluasi terukur ini dapat direkomendasikan sebagai pendekatan yang efektif dalam peningkatan kapasitas aparatur di tingkat kelurahan.

Abstract

This thesis research is entitled Law Enforcement Against Criminal Acts of Herbal Medicine Counterfeiting (Study of North Sumatra Regional Police). The formulation of the problem is: What are the legal regulations for herbal medicine counterfeiting in legislation? What factors cause the occurrence of criminal acts of herbal medicine counterfeiting? How is law enforcement carried out by the North Sumatra Regional Police against perpetrators of herbal medicine counterfeiting? The research method used is normative juridical legal research, with a descriptive analytical research type. For the problem approach, a normative juridical approach is used. The data used are primary and secondary data. The results of the study show that the legal regulations for herbal medicine counterfeiting are the Minister of Health Regulation No. 24 of 2018 concerning Permits and Implementation of Traditional Herbal Medicine Health Worker Practices, Law No. 17 of 2023 concerning Health, and Government Regulation No. 103 of 2014 concerning Traditional Health Services. A factor contributing to the occurrence of counterfeit herbal medicine is the lenient penalties for perpetrators of counterfeiting herbal medicine, which has led to increased activity, particularly in counterfeiting herbal medicine. The North Sumatra Regional Police's law enforcement efforts against perpetrators of counterfeit herbal medicine involve conducting investigations and inquiries until the files are received by the Prosecutor's Office for trial.

Abstract

This research is entitled Law Enforcement Against the Spread of Narcotics Through Vape Liquid (North Sumatra Regional Police Study). The formulation of the problem is (1) What are the factors that cause the spread of narcotics through vape liquid? (2) How is law enforcement carried out by the North Sumatra Regional Police in overcoming the spread of narcotics through vape liquid? (3) What are the obstacles for the North Sumatra Regional Police in enforcing the law against the spread of narcotics through vape liquid? The research method used is normative juridical legal research, with a descriptive analytical research type. To approach the problem, a normative juridical approach is used. The data used are primary and secondary data. The results of the study show that (1) The unemployment factor has a significant impact on perpetrators in carrying out their actions to distribute narcotics through vape liquid. Of course, this is the main source of narcotics dealers to get money even though it is done in an improper way to support their family's needs (2) Law enforcement carried out by the North Sumatra Regional Police in overcoming the spread of narcotics through vape liquid is to ensnare narcotics perpetrators with Article 114 subsidiary Article 112 of Law No. 35 of 2009 with a penalty of 20 years in prison. After an investigation at the Police level, the North Sumatra Regional Police have then submitted the case files to the Medan District Attorney's Office to be processed in court to obtain legal certainty. (3) Obstacles to the North Sumatra Regional Police in enforcing the law on the spread of narcotics through vape liquid, namely the increasing spread of cases of abuse of electronic cigarettes which contain narcotics, this is because Indonesia does not yet have specific regulations governing alternative tobacco products, other than those related to excise. These regulations must be separated from the Narcotics Law or the Narcotics Law must be immediately revised with the addition of liquid narcotics.

Abstract

This thesis examines law enforcement against juvenile motorcycle theft, focusing on the North Sumatra Regional Police. It addresses three key issues: (1) the statutory framework governing theft; (2) the enforcement strategies applied to juvenile offenders; and (3) the institutional obstacles encountered in practice. Employing normative legal research with a descriptive-analytical design, the study relies on primary and secondary legal materials through a doctrinal approach. The findings indicate that theft is regulated under Article 362 of the Indonesian Criminal Code and Articles 476–477 of Law No. 1 of 2023 on the Criminal Code. The North Sumatra Regional Police implement both penal measures, through formal criminal proceedings, and non-penal approaches emphasizing prevention and diversion in handling juvenile offenders. Enforcement challenges stem from the absence of comprehensive implementing regulations and budgetary constraints imposed at the central level, which limit operational facilities and institutional capacity. The study underscores the need for regulatory clarity, adequate institutional support, and strengthened preventive mechanisms within the juvenile justice framework.

Abstract

Intellectual property (IP) protection in higher education institutions has largely been viewed as an administrative requirement focused on documentation and registration volume. This creates a paradox, as increasing research outputs are not matched by adequate legal protection, innovation downstreaming, and societal utilization of research results. Therefore, a reorientation is needed to position IP protection as a strategic instrument for building a fair innovation ecosystem. This community engagement program was conducted in LLDIKTI Region I institutions through presentations, discussions, and strengthening IP center capacity. Activities focused on mapping IP systems, identifying management challenges, and reinforcing a paradigm oriented toward innovation downstreaming and public benefit. Results show improved participant understanding of shifting IP protection from an administrative to a strategic approach. IP is increasingly recognized as a tool for innovation, technology transfer, and institutional competitiveness. This reorientation emphasizes inventor rights protection, fair benefit distribution, and broader public access to innovation within a sustainable and equitable ecosystem.
