Abstract

Communal Intellectual Property (CIP) embodies the collective cultural identity that has been passed down through generations within local communities. Nevertheless, limited legal awareness among entrepreneurs and local producers often hinders the optimal protection and utilization of CIP’s cultural and economic value. This community engagement initiative seeks to improve public understanding of the legal aspects surrounding CIP protection, focusing on the Geographical Indication (GI) framework as a legal tool for safeguarding regional products. The program took place at the Grand Mercure Hotel in Medan, in partnership with the Regional Office of the Ministry of Law and Human Rights of North Sumatra, and was broadcast widely through Radio Move Online to ensure broader public outreach. Employing a participatory approach, the program included legal dissemination sessions, educational workshops, and interactive discussions that brought together MSME actors, academics, and local government representatives. The materials addressed the legal foundation of Geographical Indications as stipulated in Law No. 20 of 2016 concerning Trademarks and Geographical Indications, procedural steps for registration, and the economic and reputational advantages for local communities. The outcomes indicated that participants developed a stronger comprehension of the interconnection between CIP and GI, alongside heightened legal consciousness in protecting local products through formal mechanisms. In conclusion, the program successfully enhanced community legal capacity and promoted broader awareness of Communal Intellectual Property protection across North Sumatra.

Abstract

Belawan waters are waters that directly lead to the waters of the Malacca Strait and are a human trafficking route that is frequently traversed by perpetrators. The existence of cases of human trafficking that occur in the Malacca Strait area will certainly have an impact on the security of the strait. There are three main principles of national security that could be threatened by cross-border cases, namely sovereignty, territorial integrity, political, social, economic and cultural sustainability. This research aims to examine the factors causing human trafficking through Belawan waters from a criminological perspective; to determine the forms of supervision and law enforcement in Indonesian waters in eradicating criminal acts of human trafficking and to examine obstacles to law enforcement of criminal acts of human trafficking through Indonesian waterways. This research method uses normative legal research. The data used is secondary data with primary, secondary and tertiary legal materials as research data sources. The data obtained comes from statutory regulations and developing legal theories related to human trafficking. Data analysis was carried out using qualitative analysis. The results of this research are the first that factors causing human trafficking through Belawan waters include internal factors consisting of economic influence (poverty), negligence of victims, authoritarian societal cultural factors, lack of expertise or skills of victims, low education, lack of job opportunities, lack of access to information and occupational risks. Meanwhile, external factors can be influenced by weak immigration control in a country, lack of coordination between immigration and the police and the Indonesian Navy in the Belawan waters. Second, that the form of supervision and law enforcement in Indonesian territorial waters is to eradicate criminal acts of human trafficking by carrying out penal efforts through law enforcement in accordance with Law Number 21 of 2007 and non-penal efforts by prioritizing preventive efforts. Third, that Obstacles law enforcement of criminal acts of trafficking in persons through Indonesian waterways, including weak supervision by the police and immigration which does not provide information on trafficking in persons; Community indifference in preventing human trafficking cases; The case handling process can take a relatively long time; Development of the Modus Operandi for the Crime of Human Trafficking; There is a condition that the victim does not know that he is being exploited or is a victim of human trafficking; Minimal budget for law enforcement officers.

Abstract

This study examines legal protection for good-faith third parties in the process of asset confiscation for corruption crimes, focusing on the case of PT. ASABRI. The main issues examined include: (1) what form of legal protection for good-faith third parties takes under the Indonesian legal system; (2) the legal obstacles faced by third parties in defending their rights to confiscated assets; and (3) the implementation of legal protection in the practice of asset confiscation in the PT. ASABRI corruption case. The type of research used is normative juridical, namely research that emphasizes literature studies through analysis of laws and regulations, legal doctrine, court decisions, and relevant legal literature. This study uses Gustav Radbruch's legal value approach, which includes justice, legal certainty, and utility as a normative analytical framework for legal protection. The nature of this research is descriptive and analytical, aiming to provide a comprehensive overview of legal regulations and their implementation in practice, as well as to analyze the effectiveness of legal protection for good-faith third parties. The research results indicate that although legal protection is normatively available, its implementation still faces various obstacles, such as overlapping criminal and civil law, and the lack of adequate defense mechanisms for third parties in asset confiscation proceedings.

Abstract

This study aims to analyze the role of novelty and prior art in the first to file system to protect traditional knowledge from invalid patent claims. Traditional knowledge is part of a valuable cultural heritage. Protecting it means maintaining and preserving the cultural identity of a community. In reality, most of the traditional wealth that was once owned by the people of the archipelago has been lost or moved to other countries. The study uses normative legal methods. Data collection was carried out through literature studies, observations, and document analysis. The results of the study show that in the First to File system, patent rights are granted to the first party to file a patent application, not the first party to create an invention. In the context of protecting against invalid patent claims on traditional knowledge, it is important for communities or countries to document their traditional knowledge as prior art. With adequate documentation, it can be shown that the knowledge existed before any patent claims were filed by other parties. So that it can protect traditional knowledge from invalid patent claims. Overall, the concept of novelty and prior art in the first to file system functions as a mechanism to ensure that traditional knowledge that has existed for a long time cannot be patented by unauthorized parties.

Abstract

Peningkatan kualitas pelayanan publik di tingkat kelurahan sangat dipengaruhi oleh kompetensi aparatur dalam menerapkan manajemen sumber daya manusia (MSDM). Kegiatan pengabdian kepada masyarakat ini bertujuan meningkatkan pemahaman aparatur Kelurahan Asam Kumbang terhadap konsep MSDM dan prinsip pelayanan publik. Kegiatan dilaksanakan pada 11 februari 2023 menggunakan pendekatan edukatif-partisipatif melalui ceramah, diskusi interaktif, dan studi kasus. Evaluasi dilakukan terhadap 30 peserta menggunakan desain one-group pre-test dan post-test dengan instrumen skala Likert (1–5). Hasil menunjukkan adanya peningkatan rata-rata skor dari 3,10 pada pre-test menjadi 4,32 pada post-test. Nilai N-Gain sebesar 0,64 menunjukkan efektivitas pada kategori sedang menuju tinggi, dan uji paired t-test menunjukkan perbedaan yang signifikan (p < 0,05). Hasil ini menunjukkan bahwa kegiatan penyuluhan efektif dalam meningkatkan pemahaman aparatur mengenai perencanaan SDM, akuntabilitas, dan profesionalisme pelayanan. Selain peningkatan kuantitatif, kegiatan ini juga mendorong komitmen aparatur dalam memperbaiki kualitas pelayanan publik. Model pengabdian berbasis evaluasi terukur ini dapat direkomendasikan sebagai pendekatan yang efektif dalam peningkatan kapasitas aparatur di tingkat kelurahan.

Abstract

The illegal trade of protected wildlife constitutes a serious form of environmental crime that continues to evolve, particularly through the use of social media as a platform for illicit transactions. This study aims to examine the modus operandi of protected wildlife trafficking conducted via social media, analyze law enforcement efforts undertaken by the North Sumatra Regional Police, and identify the obstacles faced in enforcing the law. This research employs a normative legal research method using statutory and conceptual approaches, supported by an analysis of primary, secondary, and tertiary legal materials. The findings indicate that wildlife trafficking has shifted toward digitally based and covert practices, posing significant challenges to conventional law enforcement mechanisms. Although the North Sumatra Regional Police have implemented both penal and non-penal measures, their effectiveness remains limited due to resource constraints, difficulties in digital evidence gathering, and low public legal awareness. Therefore, strengthening institutional capacity, enhancing inter-agency cooperation, and fostering a supportive legal culture are essential to optimizing the enforcement of laws protecting wildlife and ensuring ecological sustainability.

Abstract

This study aims to analyze the legal arrangements regarding the position, authority, and responsibilities of curators in the process of settling bankruptcy assets based on Law Number 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations, as well as examining the role of curatorial organizations in providing legal protection against the risks of civil, criminal, and ethical lawsuits faced by curators. This study uses a normative juridical method with a legislative and conceptual approach. Data were obtained through documentation studies, observations, and interviews, then analyzed descriptive-analytically. The results of the study show that the existing legal arrangements have not comprehensively regulated the limits of curatorial authority and accountability, thus creating legal vulnerabilities in practice. Curatorial organizations play a role in providing preventive protection through education and code of ethics, as well as repressive protection through advocacy and legal assistance. However, limited organizational authority and resources hinder the effectiveness of protection, so it is necessary to strengthen regulations and institutions.
