Abstract

The purpose of this study is to analyze the settlement of criminal cases on the liability of parents for negligence that results in minors becoming perpetrators of traffic accidents. This type of research is normative legal research with a statutory approach, a case approach and a conceptual approach. The analysis used in this study is a descriptive analysis. has not explicitly regulated the criminal liability of parents for accidents committed by children, although Civil Code Article 1367 has provided a basis for civil liability, and the new Criminal Code through Article 37 opens up opportunities for the application of the principle of vicarious liability. This study recommends the need to reconstruct the Indonesian criminal law regulation which explicitly establishes a model of parental criminal responsibility based on the principle of vicarious liability and the principle of Radbruch legal certainty, without overriding the principle of child protection in the SPPA Law.

Abstract

Political participation of persons with disabilities in electoral processes remains constrained by structural barriers despite constitutional guarantees and international human rights commitments. This study examines the need for electoral accessibility reform by employing the concepts of accessibility and reasonable accommodation as normative and philosophical foundations. The research adopts a normative legal method with conceptual and statutory approaches. The findings indicate that while Indonesia’s legal framework formally recognizes accessibility and reasonable accommodation, implementation gaps persist, particularly in relation to physical infrastructure, electoral information, and socio-cultural practices. Drawing on distributive justice and principles protecting vulnerable groups, the study argues that accessibility should be understood as a substantive equality requirement rather than merely a technical administrative measure. It concludes that electoral reform should prioritize universal accessibility standards and proportionate accommodation mechanisms to ensure equal political participation of persons with disabilities within Indonesia’s democratic framework.

Abstract

The open proportional system implemented in Indonesia since the 2009 elections was designed to enhance democratic participation and strengthen legislative accountability. Nevertheless, in practice, this electoral model has produced structural problems that have significantly undermined the quality of representative democracy. This study seeks to address a critical question: to what extent does the open proportional system generate structural imbalances in the distribution of political power within Indonesia’s democratic framework? A normative legal method is employed, utilizing the Structural Approach to Election Law developed by Samuel Issacharoff and refined by Nicholas Stephanopoulos and Yasmin Dawood. The research is based on doctrinal analysis of election laws, Constitutional Court decisions, relevant legal literature, and democratic theory. The findings indicate that the system reinforces the dominance of wealthy candidates, erodes the ideological foundations of political parties, and perpetuates structural exclusion of marginalized social groups. Furthermore, it demonstrates that election law, as an institutional structure, is not ideologically neutral and may be exploited to preserve unequal power relations. The study concludes that electoral reform is necessary to achieve structural justice, particularly through the reconstruction of electoral districts, revision of the parliamentary threshold, implementation of transparent campaign finance regulations, and revitalization of political parties as ideological entities. The structural approach offers a critical and holistic analytical framework for building a more just, inclusive, and substantively democratic electoral system in Indonesia.

Abstract

Penelitian ini bertujuan untuk menganalisis efektivitas penegakan sanksi pidana terhadap pelanggaran pengelolaan sampah sebagaimana diatur dalam Peraturan Daerah (Perda) Kabupaten Bolaang Mongondow Selatan Nomor 6 Tahun 2019. Latar belakang masalah ini adalah kontradiksi antara ancaman sanksi pidana yang tegas (kurungan maksimal 3 bulan atau denda maksimal Rp 50.000.000,00) dengan fenomena aktual berupa praktik pembuangan sampah ilegal yang masih merusak lingkungan. Penelitian ini menggunakan metode hukum empiris, dengan pengumpulan data melalui wawancara, observasi, dan studi dokumen di wilayah Bolsel. Hasil penelitian menunjukkan bahwa penegakan sanksi pidana dalam Perda ini belum berjalan efektif. Penemuan kunci adalah tidak adanya penerapan sanksi pidana (nihil penindakan), di mana aparat lebih memilih pendekatan persuasif yang tidak menimbulkan efek jera. Inefektivitas ini disebabkan oleh rendahnya kesadaran hukum masyarakat, keterbatasan sarana dan prasarana (TPS), serta belum optimalnya kinerja dan koordinasi antar aparat penegak hukum daerah.

Abstract

Pengaturan mekanisme pengisian kekosongan jabatan Presiden dan Wakil Presiden secara bersamaan merupakan aspek fundamental dalam menjamin kesinambungan pemerintahan dalam sistem ketatanegaraan Indonesia. Pasal 8 ayat (3) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 mengatur mekanisme pelaksanaan tugas kepresidenan oleh Menteri Luar Negeri, Menteri Dalam Negeri, dan Menteri Pertahanan secara kolektif, yang dikenal sebagai menteri triumvirat. Penelitian ini bertujuan untuk menganalisis dasar hukum, kedudukan konstitusional, serta mekanisme pelaksanaan tugas menteri triumvirat dalam mengisi kekosongan jabatan kepala negara, sekaligus mengidentifikasi tantangan normatif, administratif, dan legitimatif yang melekat pada mekanisme tersebut. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan historis. Hasil penelitian menunjukkan bahwa meskipun menteri triumvirat memiliki legitimasi konstitusional langsung sebagai otoritas transisional, ketiadaan pengaturan teknis dalam peraturan perundang-undangan menimbulkan potensi ketidakpastian hukum dan konflik kewenangan. Oleh karena itu, diperlukan pembentukan regulasi turunan yang bersifat lex specialis untuk menjamin efektivitas, akuntabilitas, dan kepastian hukum dalam pelaksanaan kewenangan menteri triumvirat sesuai dengan prinsip negara hukum dan demokrasi konstitusional.

Abstract

The UN's principal mission is to promote international stability and peace. To that end, the UN established the Security Council, its governing body with last say on the subject. The United States, Russia, China, and France—the five most militarily competent nations—are veto-wielding permanent members of the United Nations Security Council. The fundamental objective of this research is to determine the impact of veto power on the function of the United Nations Security Council in maintaining global peace and security. In that case, will we be attempting to have a lex expert on the right to veto? This work is classified as normative research. The results showed that the veto did not improve the Security Council's performance. The ability to veto decisions made by the Security Council on how to address critical international crises means that the council isn't always effective. Legal rules should be put in place to ensure that the right to veto as a controller is not misused and fulfils its original purpose. The power to reject a resolution in situations involving crimes against humanity or genocide is an important part of the veto system, as is the two-year limit on each non-permanent member's use of the veto, and the limitation of veto use to a single case if discussed consecutively in Security Council meetings.

Abstract

Penelitian ini menganalisis disparitas mekanisme penanganan pelanggaran oleh Badan Pengawas Pemilihan Umum (Bawaslu) antara Pemilu dan Pilkada serentak 2024 yang menciptakan ketidaksetaraan politik struktural, melanggar Pasal 27 ayat (1) UUD 1945 tentang kesamaan di hadapan hukum. Menggunakan pendekatan yuridis normatif dengan studi kasus empiris Bawaslu Gorontalo Utara, ditemukan perbedaan signifikan Perbawaslu No. 7/2022 (Pemilu: 14 hari kalender, rekomendasi opsional KPU) versus No. 9/2024 (Pilkada: 7 hari kerja, mengikat), menghasilkan tingkat penyelesaian hanya 58% dari 18 pelanggaran (11 Pemilu, 7 Pilkada) dengan 64% kasus pidana tak tuntas. Nasional tercatat 1.023 dugaan (479 terverifikasi), terhambat koordinasi lemah KPU/Gakkumdu, multitafsir UU, dan SDM ad hoc seperti diidentifikasi Rahmat Bagja. Analisis teoritis Rawls (fair equality of opportunity) dan electoral justice International IDEA menegaskan disparitas ini erodasi legitimasi demokrasi 23% (LSI 2024), ciptakan moral hazard partai besar, dan ancam stabilitas pasca-Pilpres Prabowo-Gibran. Dampak sistemik: degradasi indeks integritas pemilu (Perludem 67), democratic backsliding, dan fragmentasi politik. Reformasi mendesak mencakup unifikasi Perbawaslu hybrid, kewenangan eksekutorial Bawaslu, digitalisasi pengaduan AI-Sirekap, Pengadilan Pemilu Khusus MK, serta anggaran mandiri 1,5% APBN. Tanpa rekonsolidasi pengawasan ini, keadilan elektoral substansif mustahil tercapai, mengkristalkan electoral authoritarianism yang menggerus kedaulatan rakyat Pasal 22E UUD 1945.
