Abstract

ABSTRACT- In an effort to maintain the quality of health workers in Indonesia, regulations have been provided that discuss maintaining health standards for the Indonesian people, as explained in the 1945 Constitution, especially in articles 28A and 28H paragraph (1) of the 1945 Constitution which states that every person has the right to live in prosperity and prosperity. and their minds have a place to live, a good living environment, and have the right to receive health services. The negligence case occurred on Friday, February 3 2023, precisely at a hospital in Palembang. Law Number 17 of 2023 concerning Health Article 276 explains that obtaining Health Services is in accordance with medical needs, professional standards and quality services. The aim of this research is to determine the legal protection of patients who experience losses and the responsibility of nurses for acts of negligence, in terms of Law Number 17 of 2023 concerning Health. The approach method used is normative juridical, the research specifications in this study are analytical descriptive. The data collection technique in this research is a literature study and the analysis method in this research uses qualitative analysis methods. Then the results were obtained that there was negligence committed by the nurse. Nurses' actions are considered unlawful and nurses must be responsible for their actions. ABSTRAK- Dalam upaya menjaga kualitas tenaga Kesehatan di Indonesia maka disediakanlah aturan yang membahas guna menjaga standar Kesehatan bagi rakyat Indonesia, seperti yang dijelaskan dalam UUD 1945 menyatakan khususnya dalam pasal 28A dan 28H ayat (1) UUD 1945 menyatakan bahwa setiap orang memiliki hak hidup secara Sejahtera lahir dan batinnya memiliki tempat tinggal, memperoleh lingkungan hidup yang baik, dan memiliki hak memperoleh layanan Kesehatan. Kasus kelalaian terjadi pada Jumat tanggal 3 Februari 2023 tepatnya di salah satu Rumah Sakit di Palembang. Undang-Undang Nomor 17 Tahun 2023 Tentang Kesehatan Pasal 276 menjelaskan bahwa mendapatkan Pelayanan Kesehatan sesuai dengan kebutuhan medis, standar profesi, dan pelayanan yang bermutu. Tujuan penilitian ini adalah untuk mengetahui perlindungan hukum pasien yang mengalami kerugian dan tanggung jawab perawat atas tindakan kelalaian, ditinjau dari Undang-undang Nomor 17 Tahun 2023 Tentang Kesehatan. Metode pendekatan yang digunakan adalah yuridis normatif, spesifikasi penelitian dalam penelitian ini bersifat deskriptif analitis. Teknik pengumpulan data dalam penelitian ini studi kepustakaan serta metode analisis dalam penelitian ini menggunakan metode analisis kualitatif. Kemudian diperoleh hasil bahwa adanya suatu kelalaian yang dilakukan oleh Perawat. Perbuatan Perawat termasuk kedalam perbuatan melawan hukum serta Perawat harus bertanggung jawab atas perbuatannya tersebut.

Abstract

Abstract. This document discusses the legal protection for patients participating in the BPJS (Social Security Organizing Agency) against hospital services that harm patients based on Law Number 17 of 2023 concerning Health and BPJS Regulation Number 1 of 2014 concerning Health Insurance. This study aims to analyze the form of legal protection for BPJS participant patients, the factors that cause hospital services that harm patients, and the impacts arising from these services.The results showed that legal protection for patients participating in BPJS is regulated in Law Number 17 of 2023 concerning Health, which includes the rights and obligations of patients and the rights and obligations of hospitals. Factors causing the occurrence of hospital services that harm patients include limited hospital resources, lack of coordination between hospitals and BPJS, and errors or negligence of medical personnel. The impacts arising from hospital services that are detrimental to BPJS participant patients are financial, psychological losses, and the potential for conflict between patients and hospitals Abstrak. Dokumen ini membahas mengenai perlindungan hukum bagi pasien peserta BPJS (Badan Penyelenggara Jaminan Sosial) terhadap pelayanan rumah sakit yang merugikan pasien berdasarkan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan serta Peraturan BPJS Nomor 1 Tahun 2014 tentang Jaminan Kesehatan. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum bagi pasien peserta BPJS, faktor penyebab terjadinya pelayanan rumah sakit yang merugikan pasien, serta dampak yang timbul dari pelayanan tersebut.Hasil penelitian menunjukkan bahwa perlindungan hukum bagi pasien peserta BPJS diatur dalam Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, yang meliputi hak dan kewajiban pasien serta hak dan kewajiban rumah sakit. Faktor penyebab terjadinya pelayanan rumah sakit yang merugikan pasien antara lain keterbatasan sumber daya rumah sakit, kurangnya koordinasi antara rumah sakit dan BPJS, serta kesalahan atau kelalaian tenaga medis. Dampak yang timbul dari pelayanan rumah sakit yang merugikan pasien peserta BPJS adalah kerugian finansial, psikologis, serta potensi terjadinya konflik antara pasien dan pihak rumah sakit.

Abstract

Article 297 paragraph (2) of Law Number 17 of 2023 concerning Health explains that every patient has the right to access the information contained in medical record documents. The regulation of patient access rights to medical records in Indonesia has given rise to various interpretations. The public has interpreted the meaning of the patient's right of access to information in medical record documents for themselves. This is where the problem arises, hospitals often face patients for some reason requiring medical records. With access rights, patients can freely use the contents of medical records as they wish. Seeing these conditions, the author wants to compare Malaysia's approach to regulating patient access rights to medical records. Objective: to examine the legal position and gaps using a comparative analysis of patient access to medical records in Indonesia and Malaysia. The research method uses normative juridical data with secondary data and is analyzed using descriptive analysis.

Abstract

Apoteker sebagai tenaga kesehatan yang melaksanakan pekerjaan kefarmasian dalam bidang distribusi obat-obatan memiliki tugas dan tanggung jawab yang diatur dalam Peraturan Badan Pengawas Obat dan Makanan Nomor 6 Tahun 2020 Tentang Pedoman Teknis Cara Distribusi Obat yang Baik (PerBPOM No. 6 Tahun 2020). Pada BAB IV H angka 4.40 PerBPOM No.6 Tahun 2020 mengatur tentang tugas Apoteker Penanggung Jawab (APJ) di Pedagang Besar Farmasi (PBF) untuk memastikan kewajaran pesanan dengan mempertimbangkan jumlah dan frekuensi pesanan, jenis obat yang sering disalahgunakan, lokasi sarana, serta jumlah resep yang tersedia di fasilitas pelayanan kefarmasian. Alprazolam, sebagai obat psikotropika yang umum digunakan untuk mengatasi kecemasan, memiliki risiko ketergantungan jika tidak digunakan sesuai aturan. Hubungan hukum antara Apoteker PBF, Apotek, dan Pasien menciptakan aspek Hukum Perdata, terutama terkait pertanggungjawaban dalam distribusi obat. Penelitian ini bertujuan untuk mengkaji tanggung jawab Apoteker PBF dalam menentukan kuota alprazolam sebagai upaya pencegahan penyalahgunaan psikotropika berdasarkan PerBPOM No. 6 Tahun 2020 Tentang Pedoman Teknis CDOB dan berdasarkan perjanjian yang dilakukan antara APJ PBF dengan Apoteker Apotek, selain itu penelitian ini juga menelaah pengawasan BPOM terhadap penentuan kuota alprazolam sebagai upaya pencegahan penyalahgunaan psikotropika. Metode yang digunakan adalah deskriptif analitis dengan pendekatan yuridis normatif, di mana teknik pengumpulan data dilakukan melalui studi kepustakaan. Hasil penelitian disimpulkan bahwa tanggung jawab APJ PBF harus melakukan penilaian kewajaran jumlah kuota alprazolam sesuai dengan PerBPOM No. 6 Tahun 2020, selain itu sesuai Pasal 1267 KUH Perdata APJ PBF bertanggung jawab untuk memenuhi jumlah kuota alprazolam sesuai  perjanjian yang telah disepakati dengan Apoteker Apotek. Pengawasan BPOM terhadap penentuan kuota alprazolam sebagai upaya pencegahan penyalahgunaan psikotropika sesuai Pasal 39 Peraturan Badan Pengawas Obat dan Makanan Nomor 21 Tahun 2020 Tentang Organisasi dan Tata Kerja Badan Pengawas Obat dan Makanan berupa inspeksi rutin ke PBF dan pengawasan melalui laporan penerimaan dan penyaluran obat psikotropika oleh PBF.

Abstract

Article 297 paragraph (1) of Law Number 17 of 2023 concerning Health explains that medical record documents belong to health service facilities. This has legal consequences for hospitals to maintain the security, integrity, and confidentiality of medical records. However, patients still assume they are the owners of the contents of the records, so violations often occur in disclosing medical records which are not by the provisions. In the Indonesian legal system, ownership of property rights, according to Article 499 BW, is known as the term material which includes the meaning of goods and rights that property rights can control. With this background, the research aims to determine the legal aspects of ownership of medical record documents as objects of property rights for hospitals, so that disclosure of information contained in medical record documents is carried out by applicable legal provisions. The approach method used is normative juridical, the research specifications in this study are analytical descriptive. The data collection technique in this research is literature study and the analysis method in the research uses qualitative analysis methods. The research results prove that medical records can be classified as objects or goods (tangible objects). When referring to the grouping of objects, medical records can be categorized as movable objects. Medical records as movable objects can be owned by the party in charge of the property rights so that whoever controls the object is considered the owner as regulated in Article 1977 of the Civil Code.

Abstract

Cyberbullying atau intimidasi dalam dunia maya, telah menjadi fenomena yang semakin meresahkan dalam era digital saat ini. Dengan semakin meluasnya akses ke platform online, tindakan ini mengancam kesejahteraan emosional individu terutama anak muda. Penelitian ini mengulas dampak negatif cyberbullying terhadap kesehatan mental korban, seperti stres, kecemasan, depresi, dan bahkan potensi bunuh diri. Faktor-faktor seperti anonimitas dan jangkauan luasnya internet memperumit upaya pencegahan. Oleh karena itu, perlunya kerjasama antara orangtua, pendidik, dan platform online dalam menciptakan lingkungan yang aman dan mendidik bagi para pengguna, serta implementasi regulasi yang lebih ketat untuk melindungi individu dari dampak buruk cyberbullying. Kegiatan ini bertujuan untuk memberikan sosialisasi terkait cyberbullying. Metode yang digunakan yaitu survei lapangan, sosialisasi, dan evaluasi. Hasil kegiatan sosialisasi ini diharapkan dapat meningkatkan kesadaran hukum sosialisasi tentang cyberbullying di pesantren merupakan langkah penting untuk membekali santri dengan pemahaman dan keterampilan yang diperlukan untuk menghadapi dunia maya dengan bijaksana dan bertanggung jawab.

Abstract

This study examines legal certainty in the regulation of medical practice through telemedicine to optimize diagnostic procedures in Indonesia. Telemedicine enables remote healthcare services through information and communication technology, which is very beneficial in remote areas with limited access to healthcare facilities. Although telemedicine offers ease of access and lower costs, there are challenges in ensuring accurate diagnosis without direct physical examination. Health law in Indonesia needs to balance aspects of legal certainty, justice, and utility in telemedicine regulation. Various countries such as Malaysia and India have adopted specific regulations for telemedicine, which can serve as references for Indonesia. The diagnostic procedure through telemedicine must still adhere to conventional stages such as anamnesis and physical examination to ensure accuracy. Detailed and specific legal arrangements for application-based telemedicine are needed to maintain the professionalism and ethics of doctors in diagnosis. This study highlights the importance of effective communication between doctors and patients in telemedicine to avoid misunderstandings and misdiagnosis. The development of telemedicine regulations in Indonesia must consider evolving technology and the public's need for equitable access to healthcare services. Further research is needed to determine the best media used in telemedicine to provide input to the government in forming regulations.

Abstract

The National Agency of Drug and Food Control (BPOM) has regulations regarding the Good Drug Distribution Method (CDOB), which is a guideline for distributing drugs properly. Community Health Centres (Puskesmas) are one of the legitimate institutions in distributing antibiotics. However, there is misuse of antibiotic distribution from community health centres to unofficial channels. This research uses normative juridical method by using secondary data from literature study and interviews with resource persons at the community health centre. The purpose of this study is to analyse the legal protection for drug users and consumers as well as the effectiveness of the legal responsibility of pharmaceutical facilities in overcoming pharmacist malpractice. The results show that legal protection for drug users is inadequate and the legal responsibility of pharmaceutical facilities is not yet effective in overcoming pharmacist malpractice, due to the lack of regulations governing pharmacist practices and firm handling of malpractice.

Abstract

Digitalization in the healthcare sector, such as electronic medical records (EMR), has opened new horizons in the storage and management of patient medical records. This may also trigger an increase in defensive medicine practice, namely providing more careful medical treatment just to avoid potential lawsuits even though it is not always mesdically necessary. This research aims to study the risk of increased defensive medicine from the digitalization of medical records and the legal implications that arise and evaluate the extent to which legal regulations in Law Number 17 of the Year 2023 concerning Health in addressing defensive medicine practices. The method used is juridical analysis using a literature study approach that examines various legal literature, statutory regulations, and previous research related to digitalization in the medical world and the legal responsibilities of medical personnel. According to the results of this research, it was found that although digitalization can increase the efficiency of health services, it also risks exacerbating the practice of defensive medicine in Indonesia. Existing legal regulations are not yet responsive enough to overcome this challenge, especially in balancing the protection of the rights of both patients and medical personnel.

Abstract

This study aims to examine and analyze the existence of lactation rooms as a form of legal protection for female workers from the perspective of labor law and health law in Indonesia. Descriptive-analytical method is used in this research, with a juridical-normative approach and qualitative research data. Primary, secondary, and tertiary data are obtained from relevant regulations and literature. The results of this study indicate that the provision of lactation rooms is regulated in Law No. 13 of 2003 on Employment, Law No. 17 of 2023 on Health, and Government Regulation No. 33 of 2012 on Exclusive Breastfeeding and its derivative regulations, the legal provision of lactation rooms remains limited and lacks comprehensive scope. This leads to the absence of adequate facilities in many workplaces, contributing to the low success rate of exclusive breastfeeding among employed mothers. Meanwhile, countries such as Sweden and Singapore, despite lacking explicit regulations mandating lactation rooms, have implemented successful workplace lactation policies through broader worker welfare frameworks. The barriers to implementation in Indonesia include unsupportive organizational culture, insufficient budget allocation, and weak government oversight. This study recommends explicit regulatory reform, widespread policy dissemination, and multi-stakeholder collaboration to strengthen the protection of female workers’ health rights.
