Abstract

The judicial profession is a profession that has a very important role in carrying out the law enforcement process. To enforce the law, a judge is required to make a decision that will be the settlement of a case that occurs. In its implementation, the judge upholds the code of ethics that is owned to carry out a fair and correct judicial power. The implementation of professional ethics as a judge is certainly faced with many challenges. Not a few members of the judges are unsteady in upholding the code of ethics that should be followed. Integrity is needed so that there is no violation of the code of ethics.

Abstract

Container packaging (share in jar) is dividing the contents of a product into several small packages. The system in this share in jar is that you have to remove the product to be removed from the original packaging and transferred to another, smaller package. The issues that will be discussed in this journal are how is legal protection for consumers who experience losses as a result of the sale of share in jar cosmetic products and what is the responsibility of business actors for losses experienced by consumers who use share in jar cosmetic products. The purpose of writing this journal is to understand the forms and efforts to protect the law against consumers for the use of cosmetic products with share in jar packaging and to find out the responsibility of business actors for losses suffered by consumers who use cosmetic products with share in jar packaging. The type of research method used in this journal is normative juridical. Based on the journals made by the authors, this journal tells about legal protection for consumers and the responsibility of business actors for losses experienced by consumers who use cosmetic products in the form of container packaging (share in jar).

Abstract

Flight cancellations by airlines in Indonesia are a serious concern for passengers who often experience inconvenience and loss due to this situation. This journal aims to analyze the protection of the right to compensation for passengers who experience flight cancellations in Indonesia, as well as present a legal review regarding this matter. This study uses an analytical descriptive legal method and is based on existing legal regulations in Indonesia, particularly Law No. 1 of 2009 concerning Aviation. The analysis is carried out through tracing and reviewing laws and regulations, related court decisions, and relevant legal literature. The results of the study show that passengers are entitled to compensation when facing flight cancellations by the airline. The law provides a strong legal basis for the protection of these rights. Article 15 of Law Number 1 of 2009 concerning Aviation expressly states that airline companies are obliged to provide compensation to passengers who experience flight cancellations without clear reasons or without adequate notification.

Abstract

According to Article 1 of Law Number 8 of 1999 concerning Consumer Protection, consumers are defined as individuals who use goods and services available in society for personal, family, other people or other living things, not for trading. Consumer protection involves aspects of legal protection provided to consumers to avoid losses that may arise as a result of using goods and services. Therefore, consumer protection laws regulate how consumer rights are protected and how these regulations are enforced through state administrative law, criminal law, and civil law, so that consumer rights are fulfilled and goods and services received from business actors can be fully protected. The responsibility of business actors for consumer losses is to provide compensation for damage, pollution or losses suffered by consumers due to the use of goods and services produced or traded by these business actors.

Abstract

Pancasila as a value that is aspired to and used as the ideology of the nation and state and becomes the basis of laws and regulations in Indonesia. One of the development sectors guaranteed by Pancasila is development in the field of social welfare. The fifth precept of Pancasila contains the right of every citizen to have freedom of property rights, social security rights, the right to get a job and health protection. However, there are still inequalities in the right to health and education rights received by children. Child and maternal deaths and many children who drop out of school and some rural school children have not enjoyed the facilities and infrastructure of the government. The research method used is the normative juridical method. The research approach uses the statutory approach method (statute approach), concept approach (conceptual approach) and case approach (case approach). The realization of human rights in accordance with the fifth principle of Pancasila is maintaining a balance between rights and obligations, respecting the rights of other people, respecting the rights of other people including the right to education and the right to health of children. The implementation of SJJN and the APBN budget for education is an embodiment of the Pancasila values from the fifth principle so that children no longer experience inequality in their health and education rights. Legal protection for mothers and children for unequal rights based on Law Number 23 of 2002 concerning Child Protection, which includes unequal health rights and educational rights received by children and mothers. In overcoming inequality of rights, the government should optimize the implementation of UUPA regulations regarding maternal child health and the right to education.

Abstract

In this research, data and information will be collected in an interdisciplinary and multidisciplinary manner and involve different sectors. The collected data and information will be analyzed in an in-depth normative juridical way to obtain a comprehensive understanding of customary law. This shows that customary law has important values and contributions to the development of national law, even in the era of globalization and technological developments that are constantly changing. This research examines which areas of customary law are still relevant in overcoming the problems faced by the Indonesian nation in the era of globalization, and how is the revitalization of customary law as a source of law in building the legal system in Indonesia.

Abstract

People's lives in the digitalization era are heavily influenced by online activities. This online activity reflects cultural changes and digital transformation that is happening in society. The internet has become an integral part of everyday life, facilitating convenience, global connectedness and greater accessibility in various aspects of our lives. Advances in technology and the development of the internet have changed the way we interact, work, shop, communicate and access information. Online shopping has become very popular in recent years. Consumers only need to use gadgets to find the items they need, therefore it is not uncommon for manufacturers to create attractive advertisements to market their products in e-commerce. However, behind these attractive advertisements, there are not a few manufacturers who advertise their products excessively and do not match the trademarks they market, so that consumers are deceived by these attractive advertisements. This research involves collecting data through searching and analyzing literature such as journal articles, books and other resources relevant to the research topic through academic databases and digital libraries. The results of the study show that business actors must be responsible for the advertisements they create if they are not in accordance with the trademarks they market.

Abstract

This article now the content of the ethics rules for judges, which apply to sanction violations of every Code of Ethics. The technique selected by the author is a normative injunction research method that polestar on the study of legal norms. One of the infraction of the Code of Professional Decency affairs the profession of judges, whichever is reflected in the oversight of judges, which is catalogued in Article 1, Item 6, of Law No. 18 of 2011 on Respect and Obedience to Judicial Conduct. A code of ethics is a set of rules and principles that govern the conduct and burden of professionals in the legal field. The Code of Ethics is calculated to ensure that they carry out their work alongside a high degree of responsibility, integrity, honor and probity. However, unprofessional conduct persists, with in the court.
