Abstract

This study analyzes the effectiveness of the construction contract dispute resolution mechanism in the context of accelerating Indonesia's national infrastructure development. Through a normative juridical approach with the literature study method, the research examines the coherence of the legal framework and its implementation in the settlement of construction disputes. The results of the analysis revealed that although Indonesia already has a comprehensive legal instrument, there is a significant gap between regulations and practices in the field. The gap is mainly caused by three main factors: the complexity of modern construction contracts involving multiple stakeholders, the limited understanding of the parties to the legal aspects of construction, and structural obstacles in the execution of dispute resolution decisions. Based on these findings, the study recommends three optimization strategies: improving the legal framework through regulatory harmonization, strengthening the institutional capacity of dispute resolution, and developing alternative dispute resolution mechanisms that are more responsive to the characteristics of the construction industry. The implementation of this recommendation is expected to increase the effectiveness of construction dispute resolution and support the sustainability of national infrastructure development

Abstract

Penelitian ini melakukan analisis komprehensif terhadap implementasi arbitrase dalam penyelesaian sengketa konstruksi di Indonesia. Menggunakan metodologi yuridis normatif dengan pendekatan kualitatif-deskriptif, penelitian ini mengkaji Undang-Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Undang-Undang Nomor 2 Tahun 2017 tentang Jasa Konstruksi. Analisis data BANI periode 2019-2023 mengungkapkan mekanisme arbitrase yang sistematis meliputi prosedur pengajuan, pemilihan arbiter (45% praktisi hukum konstruksi, 30% akademisi hukum, 25% ahli teknik), proses pemeriksaan, dan implementasi putusan. Penelitian mengidentifikasi empat tantangan utama: biaya awal tinggi (30% di atas litigasi), keterbatasan upaya hukum pasca putusan (23% responden keberatan), kompleksitas prosedural (35% kasus tertunda), dan potensi konflik kepentingan (18% kasus). Meski menghadapi tantangan, arbitrase menunjukkan efektivitas melalui standardisasi kualifikasi arbiter (tingkat kompetensi 92%), perlindungan kerahasiaan (tingkat kepuasan 87%), dan kepatuhan sukarela tinggi (75% putusan). Penelitian menyimpulkan bahwa meskipun arbitrase menawarkan mekanisme penyelesaian sengketa yang efisien, dibuktikan dengan rata-rata waktu penyelesaian 180 hari berbanding 2-3 tahun untuk litigasi, diperlukan penyempurnaan sistematis dalam struktur biaya, mekanisme review, modernisasi prosedur, dan verifikasi independensi arbiter

Abstract

Digital leadership is considered as the appropriate leadership to face the current rapid and dynamic environmental changes. This study is focused on investigating how moral culture and employee engagement, as well as digital leadership impact innovative work behavior. The sample of this study was 205 respondents from construction Company X. The analysis was using path analysis technique conducted using the SEM-PLS method. The analysis's findings show that digital leadership influences organizational culture  in a beneficial way.  Innovative work behavior is influenced by work engagement, organization culture, and work engagement influences innovative work behavior. However, digital leadership does not directly have a significant effect on innovative work behavior. For construction company management, increasing innovative work behavior can be done by increasing the implementation of digital leadership so that company employees can form a good organizational culture and strong work engagement.

Abstract

This study aims to analyze the legal position of notaries as witnesses in the investigation process based on the applicable laws and regulations. This research uses a normative legal research method. Data collection is carried out through library research, by examining legal documents and literature from libraries, online legal databases, and reliable academic sources. The obtained data is analyzed using qualitative analysis, which includes data reduction, data classification, legal interpretation, and drawing conclusions. The analysis results indicate that a notary's position as a witness in an investigation process is legally recognized, but its implementation must go through the approval mechanism of the Notary Honorary Council to maintain a balance between the interests of law enforcement and the protection of the confidentiality of the office. From the perspective of professional ethics, notaries face a dilemma between the obligation to maintain confidentiality and the duty to provide truthful testimony. The Notary Code of Ethics provides clear guidelines but still requires consideration of proportionality in its application. Harmonization between legal obligations and professional ethics can be achieved through the application of the principle of proportionality, optimization of the role of the Notary Honorary Council, limitation of the scope of testimony, and provision of adequate legal protection for notaries.
