Abstract

korban merupakan salah satu bentuk perbuatan yang bertentangan dengan sendi-sendi kemanusiaan. Hal ini menyebabkan perbuatan kekerasan terhadap perempuan dalam kekerasan dalam rumah tangga merupakan salah satu perbuatan yang melanggar HAM sehingga dibutuhkan instrumen-instrumen hukum yang mampu memberikan perlindungan kepada perempuan-perempuan yang menjadi korban serta mampu menghapus kekerasan terhadap perempuan di Indonesia. Tujuan penelitian ini adalah untuk mengetahui upaya perlindungan hukum yang diberikan kepada perempuan sebagai korban kekerasan dalam rumah tangga. Analisis bahan hukum yang digunakan dalam penelitian ini adalah preskriptip analisis yang merupakan penelitian dalam jenis penelitian hukum normatif.

Abstract

Legal protection for children is to give protection to the child so that the rights of children as perpetrators of crime narcotics more secure so that the child can live, and grow optimally in accordance with the dignity and the dignity of humanity. Form of legal protection of children as perpetrators of crime narcotics is by implement a diversion. Diversi in fact also has the goal to  keeping the child spared from negative effects of the application of the criminal. Diversion also has the essence to keep guarantee the child grow and develop both physically and mentally.Perlindungan hukum bagi anak adalah memberikan perlindungan kepada anak agar hak-hak anak sebagai pelaku tindak pidana Narkotika lebih terjamin sehingga anak bisa hidup, tumbuh dan berkembang secara optimal sesuai dengan harkat dan martabat kemanusiaan. Bentuk perlindungan hukum terhadap anak sebagai pelaku tidak pidana narkotika adalah dengan menerapkan diversi. Diversi pada hakikatnya juga mempunyai tujuan agar anak terhindar dari dampak negatif penerapan pidana. Diversi juga mempunyai esensi untuk tetap menjamin anak tumbuh dan berkembang baik secar fisik maupun mental.

Abstract

Women as nation asset who play a role in resumption process and creation of generation with high quality are require to get guarantee to accomplishment of their rights. Involvement of men and woman in political area is a part that can not be separated in democratization process. Democracy give the largest opportunity to all citizen who have fulfilled the requiremets to be able to select and selected as representative of citizen  without discrimination againt  tribe, race, religion, and gender. From some general elections which have been executed, representative of women in parliament is still in minimum number. The low of  women delegation in parliament can become indicator of the low role of woman in political party. Perempuan sebagai asset bangsa yang berperan dalam proses penerusan dan penciptaan generasi yang berkualitas perlu mendapatkan jaminan terhadap pemenuhan hak-haknya. Keterlibatan perempuan dan laki-laki di bidang politik adalah bagian tidak terpisahkan dalam proses demokratisasi. Demokrasi memberikan kesempatan seluas-luasnya kepada seluruh warga negara yang memenuhi syarat untuk dapat memilih dan dipilih sebagai wakil rakyat tanpa adanya diskriminasi terhadap suku, ras, agama, dan gender. Dari beberapa pemilu yang sudah dilaksanakan, wakil perempuan diparlemen masih sangat minim. Rendahnya keterwakilan perempuan di parlemen bisa menjadi indikator rendahnya peran perempuan di partai politik.

Abstract

In the discourse on land acquisition for development in the public interest, problems often arise regarding the amount of compensation to land rights holders. The problem becomes even more widespread when the land acquired intersects with and originates from customary land. This article aims to provide an elaboration of thoughts from a philosophical perspective on law and justice, especially on positive legal formalism in the implementation of land acquisition belonging to customary law communities in Indonesia. The research used in this article is normative legal research using a legislative approach, a conceptual approach and a case approach. The legal materials used are primary legal materials and secondary materials which are connected with schools of legal philosophy, such as the Natural Law School, Legal Positivism, and the Historical School. The research results show that the sharp gap between the legal positivism school and the historical legal school lies in the sources and forms of law. If legal positivism prioritizes formal forms and the authoritative institutions that create them, then the historical legal school states that laws are not made but are found in society. Sociological Jurisprudence describes a "middle way" to bridge the flow of historical law in traditional law communities whose existence is respected in the formation of law to provide just legal certainty. In the context of Indonesia, which has a civil law tradition, we can consider the formation of legislation as an important component for the social engineering process. Therefore, laws and regulations related to land acquisition should involve indigenous communities in the formation process because most of Indonesia's territory is still customary territory/land in the form of fields, forests, and so on.

Abstract

Intellectual Property Rights (IPR) play a crucial role in international trade and the economic development of a country. This is evidenced by the inclusion of IPR protection in the General Agreement on Tariffs and Trade (GATT), known as the Trade-Related Aspects of Intellectual Property Rights (TRIPs Agreement). This research aims to ascertain (1) the perception of lecturers and students regarding the legal protection of IPR, (2) the perception of lecturers and students regarding the IPR Center as an effort to protect IPR legally, and (3) the efforts that Polinema must undertake to enhance the perception of lecturers and students regarding the legal protection of IPR and the IPR Center. This study adopts an empirical legal research approach, with the population being students and lecturers at Politeknik Negeri Malang. Sampling is done randomly without considering strata (Simple Random Sampling). The research findings are as follows: (1) lecturer respondents have a high perception of IPR protection, while student respondents have a low perception of IPR protection; (2) lecturer and student respondents have a high perception of the IPR Center; and (3) suggested efforts include IPR socialization and education, integrating IPR courses into the curriculum, and fostering collaboration among stakeholders. Hak Kekayaan Intelektual (HKI) merupakan hal yang sangat penting di bidang perdagangan internasional dan pembangunan ekonomi suatu negara. Hal ini dapat dibuktikan dengan dimasukannya perlindungan HKI ke dalam kesepakatan GATT (General Agreement on Tariffs and Trade) yang dikenal dengan Trade Related Aspects of Intellectual Property Right (TRIPs Agreement). Penelitian ini bertujuan untuk mengetahui (1) persepsi dosen dan mahasiswa terhadapat perlindungan hukum terhadap HKI, (2) persepsi dosen dan mahasiswa terhadap Sentra HKI sebagai upaya perlindungan hukum terhadap HKI, dan (3) upaya-upaya yang harus dilakukan oleh Polinema untuk meningkatkan persepsi dosen dan mahasiswa terhadap perlindungan hukum HKI dan Sentra HKI. Jenis penelitian ini adalah penelitian hukum empiris. Populasi penelitian ini adalah mahasiswa dan dosen di lingkungan Politeknik Negeri Malang. Sampel diambil secara acak tanpa memperhatikan strata (Simple Random Sampling). Temuan penelitian ini sebagai berikut; (1) responden dosen memiliki persepsi yang tinggi terhadap perlindungan HKI, sedangkan responden mahasiswa memiliki persepsi yang rendah terhadap perlindungan HKI; (2) responden dosen dan mahsiswa memiliki persepsi yang tinggi terhadap sentra HKI; dan (3) upaya yang dapat dilakukan meliputi sosialisasi dan edukasi HKI, matakuliah HKI diajarkan kepada mahasiswa, dan sinergi antarstakeholder.

Abstract

Art 222 Law Number 7 year 2017 concerning General Elections, regulates the provisions of the threshold where the acquisition of seats in the DPR must be 20 percent or obtain valid votes nationally as much as 25 percent then political parties can nominate and nominate pairs of presidential and vice-presidential candidates. Setting the Presidential Threshold in the election of President and Vice President in Indonesia from a constitutional and human rights perspective brings its own problems in the Indonesian constitutional system. The Presidential Threshold system does give rise to privileges for certain parties. This is because only parties that meet the threshold can compete directly in the presidential election. It is for this reason that the privileges of these major parties have given birth to political cartels. What is bad for democracy is that it eliminates equal competition for all potential candidates to contest the Presidential election. The Presidential Threshold is not justified in eliminating or emasculating the meaning of democracy which provides rights and freedoms for citizens. Among the constitutional rights include the right to vote, the right to nominate (the right to be a candidate), and the right to nominate candidates, these are rights guaranteed by the 1945 Constitution of the Republic of Indonesia which everything is reduced because of this Presidential Threshold provision.

Abstract

In accordance with National Land Agency Regulation No. 1 of 2021, this study investigates the adoption of electronic land certificates. The need to enhance land services in Indonesia, especially in the fight against the land mafia and the settlement of intricate agrarian disputes, is what makes this research so urgent. Creating an electronic certificate system is essential to updating public services in light of the rise in fraud and land ownership disputes. Significant obstacles stand in the way of digital transformation in land management, nevertheless, such as the requirement for a strong legal framework and prepared infrastructure. The novel aspect of the study is its evaluation of infrastructure preparedness for electronic certificates, a topic that has received little attention in earlier studies. The responsive law theory of Philippe Nonet and Philip Selznick is used in this analysis to emphasize how crucial adaptable legal frameworks are for addressing societal shifts. The results indicate that increasing digital infrastructure and raising public understanding of land technology are essential to the success of electronic land certificates. This invention has the potential to improve confidence in the National Land Agency and expedite the settlement of land disputes. According to Indonesian law, both paper and electronic documents are legitimate; nevertheless, for long-term use, rules pertaining to data security, technology, and public education need to be strengthened. The digital revolution of land administration requires cross-sector cooperation.

Abstract

Protection for children separated from their parents, particularly due to parental incarceration, is a pressing issue in Indonesia that demands serious attention. The absence of parental support and guidance places these children in vulnerable situations, negatively impacting their physical, emotional, and social well-being. This study examines the importance of legal and social protection for these children and explores the role of the state and government in providing adequate protection and welfare guarantees. Previous research reveals gaps in integrating Islamic legal principles with child protection policies that are contextual and relevant to contemporary social challenges. This article presents a review of key Islamic legal concepts related to child protection, such as maslahah mursalah, and integrates them with international human rights standards, such as the Convention on the Rights of the Child (CRC). Employing an empirical approach, the study investigates the implementation and practical outcomes of child protection laws. Primary data were gathered through interviews and observations involving key stakeholders, complemented by secondary data from books, journal articles, and legislative documents, including the Child Protection Act. The findings reveal that children separated from incarcerated parents often face neglect, discrimination, and social vulnerability. A case study of the Women’s Prison Class II A in Malang City highlights inadequate child protection measures due to insufficient government funding, which hampers the effective delivery of developmental and protective services for these children. To address these challenges, stronger regulatory frameworks and increased budgetary support are essential. Enhancing the role of the state in implementing robust policies will not only ensure the welfare of affected children but also set a standard for societal participation in fostering healthy, discrimination-free environments. Such measures are critical for safeguarding the rights and development of these vulnerable children.

Abstract

Abstract This study aims to evaluate the legal protection for underage girls vulnerable to early marriage in Indonesia, analyzed from the perspective of maqashid syariah. Early marriage has shown adverse impacts on health, education, and psychological well-being, raising concerns about the sufficiency of existing legal protections. This normative study employs a conceptual approach by examining Indonesian regulations, including Law No. 16 of 2019, which amends Law No. 1 of 1974 on Marriage, assessing its alignment with maqashid syariah principles that emphasize the protection of religion (hifz al-din), life (hifz al-nafs), intellect (hifz al-aql), progeny (hifz al-nasl), and wealth (hifz al-mal). Although the legal age for marriage is set at 19, the provision for marriage dispensations with court approval presents a gap that facilitates child marriages. The findings reveal that dispensations are frequently granted without considering the long-term physical and mental health consequences for young girls. This study underscores the need for stricter regulation on marriage dispensations and advocates for community education programs involving religious and educational leaders to raise awareness about the negative effects of early marriage. The recommendations align with broader efforts to protect girls through enhanced community engagement, rigorous oversight, and legal enforcement based on maqashid. Keywords: Early Marriage; Legal Protection; Women’s RightAbstrak Penelitian ini bertujuan untuk mengevaluasi perlindungan hukum bagi anak perempuan di bawah umur yang rentan terhadap perkawinan dini di Indonesia dalam perspektif maqashid syariah. Perkawinan dini terbukti berdampak buruk terhadap kesehatan, pendidikan, dan kesejahteraan psikologis, sehingga menimbulkan kekhawatiran akan kecukupan perlindungan hukum yang ada. Penelitian normatif ini menggunakan pendekatan konseptual dengan mengkaji regulasi di Indonesia, termasuk UU No. 16 Tahun 2019 tentang perubahan atas UU No. 1 Tahun 1974 tentang Perkawinan, menilai kesesuaiannya dengan prinsip maqashid syariah yang menekankan perlindungan terhadap agama (hifz al-din), jiwa (hifz al-nafs), akal (hifz al-aql), keturunan (hifz al-nasl), dan harta (hifz al-mal). Meskipun usia minimal pernikahan ditetapkan pada 19 tahun, adanya dispensasi pernikahan dengan persetujuan pengadilan membuka celah yang memungkinkan terjadinya perkawinan anak. Hasil penelitian menunjukkan bahwa dispensasi ini sering diberikan tanpa mempertimbangkan dampak jangka panjang pada kesehatan fisik dan mental anak perempuan. Penelitian ini menekankan perlunya pengawasan lebih ketat dalam pemberian dispensasi dan menyarankan adanya program edukasi masyarakat yang melibatkan tokoh agama dan pendidik untuk meningkatkan kesadaran akan efek negatif perkawinan dini. Rekomendasi penelitian ini mendukung upaya yang lebih luas dalam melindungi anak perempuan melalui keterlibatan masyarakat, peningkatan pengawasan, dan penegakan hukum yang lebih ketat sesuai dengan prinsip maqashid syariah, guna mencegah perkawinan dini di Indonesia. Abstract

The implementation of UIN Serving activities in Tunjngsekar Subdistrict, Lowokwaru District of Malang concerning the Establishment of the "Pojok Sakinah" Village Community Care Forum is the first step towards Tunjungsekar Urban District as a legal awareness sub-district. The presence of the "sakinah corner" is expected to be able to educate the community members, provide motivation and as a learning tool, as a place for vent and will eventually lead to people who are obedient and aware of the law. Obstacles in the Establishment of the "Pojok Sakinah" Village Community Care Forum in Tunjungsekar Sub-District, Lowokwaru Sub-District of Malang, among others, the lack of activeness of the Tunjungsekar village government apparatus, lack of coordination with the government officials of Tunjugsekar, Karang Taruna, and the lack of community awareness of the importance of the presence of this Sakinah Corner.
