Abstract

Tujuan dari penulisan jurnal ini tentang Pengaruh Sejarah Hukum terhadap pembentukan hukum dan peraturan perundang-undangan di Indonesia. Secara historis, Indonesia mengambil sistem hukum dari Eropa Kontinental yang berasal dari Belanda, dan ini menjadi dasar hukum di negara ini. Namun, seiring waktu, hukum di Indonesia juga dipengaruhi oleh prinsip-prinsip hukum umum, nilai-nilai hukum Islam, dan norma-norma hukum adat yang kuat dalam budaya masyarakat. Penelitian ini bertujuan untuk menganalisis bagaimana pengaruh dari sejarah hukum terhadap berbagai sistem hukum ini berpengaruh terhadap pembentukan kerangka hukum nasional yang unik dan rumit. Dengan menggunakan metode analisis normatif, penelitian ini mencari tahu bagaimana berbagai elemen dari sistem hukum dunia turut membantu diversifikasi hukum di Indonesia. Hasil penelitian menunjukkan bahwa meskipun keberagaman ini membuat sistem hukum nasional semakin bertambah, hal itu juga membawa tantangan dalam menyelaraskan dan merapikan peraturan yang ada. Studi ini memberikan kontribusi penting untuk memahami bagaimana pengaruh dari berbagai sistem hukum berjalan dalam konteks Indonesia, serta hubungannya dengan pembaruan hukum di negara.

Abstract

This article examines the construction of legal accountability for the management of natural resource-based village assets by Village-Owned Enterprises (BUMDesa) after its recognition as a legal entity through Government Regulation Number 11 of 2021. This recognition places BUMDesa as an independent legal subject that operates based on the principle of separate legal entity. However, in practice, the application of this principle still leaves juridical problems, especially related to the separation between village wealth and BUMDesa wealth and the potential shift in the character of village assets from public wealth to objects of private interest. This condition has implications for the weakening of legal protection for village assets and the increased risk of irregularities in the management of village natural resources. This article emphasizes that the legal accountability of BUMDes is dualistic, namely corporate responsibility for business activities and public accountability for the protection of the interests of village communities and the sustainability of natural resources. The absence of a firm and systematic regulation causes a legal gray space that blurs the boundaries of responsibility between BUMDesa and the village government. Therefore, it is necessary to reconstruct the regulation and strengthening of BUMDesa governance to ensure legal certainty, maintain the public character of village assets, and ensure that its use remains in line with the constitutional goals of maximum prosperity of the people

Abstract

This research examines the implications of Constitutional Court Decision No. 28/PUU-XXIII/2025 on digital copyright licensing in Indonesia. The study addresses the anomaly where rapid creative industry growth fails to enhance creator welfare due to exploitative "direct licensing" mechanisms in Article 40 of Law No. 28 of 2014. This provision is deemed to violate constitutional property rights by allowing digital platforms to exploit works without explicit consent. Using normative legal research with statutory and conceptual approaches, the study analyzes primary and secondary legal materials. The results reveal that Decision No. 28/PUU-XXIII/2025 serves as a constitutional correction, prioritizing substantive justice over industrial efficiency. The ruling strengthens creators' bargaining positions, mandates transparency in royalty systems, and triggers a paradigm shift from efficiency-oriented to justice-oriented licensing. Practical implications include the mandatory renegotiation of licensing contracts, the integration of digital technologies like blockchain within the National Collective Management Organization (LMKN), and the realignment of global platform business models. Ultimately, this decision establishes a robust legal foundation to ensure equitable economic rights protection within Indonesia's digital ecosystem.
