Abstract

Tujuan dari penulisan jurnal ini tentang Pengaruh Sejarah Hukum terhadap pembentukan hukum dan peraturan perundang-undangan di Indonesia. Secara historis, Indonesia mengambil sistem hukum dari Eropa Kontinental yang berasal dari Belanda, dan ini menjadi dasar hukum di negara ini. Namun, seiring waktu, hukum di Indonesia juga dipengaruhi oleh prinsip-prinsip hukum umum, nilai-nilai hukum Islam, dan norma-norma hukum adat yang kuat dalam budaya masyarakat. Penelitian ini bertujuan untuk menganalisis bagaimana pengaruh dari sejarah hukum terhadap berbagai sistem hukum ini berpengaruh terhadap pembentukan kerangka hukum nasional yang unik dan rumit. Dengan menggunakan metode analisis normatif, penelitian ini mencari tahu bagaimana berbagai elemen dari sistem hukum dunia turut membantu diversifikasi hukum di Indonesia. Hasil penelitian menunjukkan bahwa meskipun keberagaman ini membuat sistem hukum nasional semakin bertambah, hal itu juga membawa tantangan dalam menyelaraskan dan merapikan peraturan yang ada. Studi ini memberikan kontribusi penting untuk memahami bagaimana pengaruh dari berbagai sistem hukum berjalan dalam konteks Indonesia, serta hubungannya dengan pembaruan hukum di negara.

Abstract

This article examines the construction of legal accountability for the management of natural resource-based village assets by Village-Owned Enterprises (BUMDesa) after its recognition as a legal entity through Government Regulation Number 11 of 2021. This recognition places BUMDesa as an independent legal subject that operates based on the principle of separate legal entity. However, in practice, the application of this principle still leaves juridical problems, especially related to the separation between village wealth and BUMDesa wealth and the potential shift in the character of village assets from public wealth to objects of private interest. This condition has implications for the weakening of legal protection for village assets and the increased risk of irregularities in the management of village natural resources. This article emphasizes that the legal accountability of BUMDes is dualistic, namely corporate responsibility for business activities and public accountability for the protection of the interests of village communities and the sustainability of natural resources. The absence of a firm and systematic regulation causes a legal gray space that blurs the boundaries of responsibility between BUMDesa and the village government. Therefore, it is necessary to reconstruct the regulation and strengthening of BUMDesa governance to ensure legal certainty, maintain the public character of village assets, and ensure that its use remains in line with the constitutional goals of maximum prosperity of the people

Abstract

This research examines the implications of Constitutional Court Decision No. 28/PUU-XXIII/2025 on digital copyright licensing in Indonesia. The study addresses the anomaly where rapid creative industry growth fails to enhance creator welfare due to exploitative "direct licensing" mechanisms in Article 40 of Law No. 28 of 2014. This provision is deemed to violate constitutional property rights by allowing digital platforms to exploit works without explicit consent. Using normative legal research with statutory and conceptual approaches, the study analyzes primary and secondary legal materials. The results reveal that Decision No. 28/PUU-XXIII/2025 serves as a constitutional correction, prioritizing substantive justice over industrial efficiency. The ruling strengthens creators' bargaining positions, mandates transparency in royalty systems, and triggers a paradigm shift from efficiency-oriented to justice-oriented licensing. Practical implications include the mandatory renegotiation of licensing contracts, the integration of digital technologies like blockchain within the National Collective Management Organization (LMKN), and the realignment of global platform business models. Ultimately, this decision establishes a robust legal foundation to ensure equitable economic rights protection within Indonesia's digital ecosystem.

Abstract

Natural resource management in Indonesia is still faced with environmental damage, conflicts of interest, and weak legal accountability, where administrative compliance is often used as legitimacy even though the activities carried out have significant ecological and social impacts. This article formulates the problem of how the concept of Unlawful acts can be reconstructed to function as an instrument of accountability in natural resource management, as well as bridging civil law and state administrative law in enforcing legal responsibility for environmental damage. This study concludes that Unlawful acts can no longer be interpreted narrowly as a violation of written norms that cause individual harm, but must be understood substantively as a violation of the principles of environmental protection, ecological justice, and people's rights to a good and healthy environment. Administrative permits cannot be used as absolute legitimacy if business activities are proven to cause damage to natural resources. Unlawful acts functions as an instrument of accountability that is substantive, preventive, corrective, and as a control of power. Therefore, it is recommended to strengthen the progressive interpretation of Unlawful acts by the courts and harmonize regulations across legal regimes so that Unlawful acts can effectively realize fair, responsible, and sustainable natural resource governance.

Abstract

Land acquisition for public interest often generates conflicts, particularly in determining compensation for land rights holders in toll road projects. Disputes commonly arise due to differences in land valuation, procedural inconsistencies, and perceptions of fairness. One notable example is Supreme Court Decision Number 1655 K/Pdt/2024, in which the cassation appeal concerning the amount of compensation was rejected. This study analyzes the determination of the form and amount of compensation, as well as the available legal protection mechanisms. Using a normative juridical method with statutory, conceptual, and case approaches, the research finds that compensation determination has not fully complied with Article 37 of Law Number 2 of 2012. Although deliberation is required, the appraisal results are considered final and binding, creating inconsistencies and potential legal uncertainty. In Decision Number 1655 K/Pdt/2024, the Supreme Court rejected the petition because the applicant failed to provide valid legal proof of ownership and lawful transfer of land rights, particularly an authentic deed issued by a Land Deed Official (PPAT). The compensation assessment conducted by the Public Appraisal Office (KJPP) was based on officially registered data, namely the Certificate of Ownership classified as agricultural land. The Court found no misapplication of law or procedural error. This ruling reinforces the importance of formal legal documentation in compensation disputes and strengthens the principles of legal certainty and orderly land administration in land acquisition for public interest.

Abstract

Internet access (ISP) implementation is based on Law No. 36/1999 on telecommunications. Internet poles and fiber optic cables are often located next to PLN electricity poles. Many people have been disturbed by the presence of unlicensed poles and chaotic cables. The law regulates the use of land and buildings belonging to individuals for telecommunications implementation purposes and requires the consent of the relevant parties. However, this is rarely realized, resulting in similar issues in various places. This study aims to determine and analyze the provider's obligations as the implementing party and the indicators of errors and omissions in ISP implementation. The study employs normative legal research methodologies, encompassing the analysis of legislation and additional secondary data. This study found that providers are responsible for goods under their control. The aggrieved community can hold providers accountable for clear problems resulting from their errors or negligence. It is expected that adjusting existing rules to the status quo will address the problem of fiber optic poles and cables for communities in various regions with similar cases. This will make providers more careful when implementing the internet.
