Abstract

: Gender equality is one of the human rights issues that until now still cannot be realized properly, including in marriage. Gender injustice in marriage scope arises due to the existence of differences in roles, rights, and obligations between husband and wife. These differences have a significant impact on the role and freedom of wives in the public sector, particularly in their efforts to fulfill the economic needs of their families. Gender injustice still occurs because there are inconsistencies in efforts to realize gender equality. Therefore, it became the author's concern because it hinders the realization of gender equality. This research used the method of normative juridical research by presenting supporting data in the form of interviews with several wives who have dual roles as housewives and breadwinners in the industrial located in Solokan Jeruk, Bandung Regency and shoe craft centers located in Cibaduyut, Bandung City. The results show that there are inconsistencies in efforts to realize gender equality in the scope of marriage related to fulfilling family economic needs, that is, inconsistencies in efforts to realize gender equality in marriage law in Indonesia, between marriage law and other positive laws, and positive laws and  implementation in real life.

Abstract

This research aims to assess the legal considerations of the panel of judges in Decision Number 245/Pdt.Sus-PKPU/2021/PN.Niaga.Jkt.Pst., particularly in recognizing the foreign court decision in the form of a moratorium ruling from the Singapore High Court and in determining the legal standing of the PKPU applicant in this case. This research employs a normative juridical method through a case study of Decision Number 245/Pdt.Sus-PKPU/2021/PN.Niaga.Jkt.Pst based on Indonesian positive law. The data used consists of primary, secondary, and tertiary. Data analysis was conducted qualitatively by interpreting positive legal provisions, principles, and doctrines applicable in Indonesia to evaluate the panel of judges' considerations in this case. The research findings indicate that, first, the panel's recognition of the moratorium decision as grounds for rejecting the PKPU application contradicts Article 436 of the Reglement op de Rechtsvordering, which adheres to the territoriality principle. This recognition also conflicts with the principles of private international law adopted by Indonesia. Furthermore, the consideration regarding the absence of legal standing of the PKPU applicant due to the existence of the moratorium decision linked to choice of forum is inconsistent with Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations (KPKPU Law) as lex specialis that supersedes debt settlement provisions in other legislation. Second, the research demonstrates that in practice, legal standing is determined based on fulfillment of formal and material requirements as stipulated in Articles 222, 224, and 8(4) of the KPKPU Law, which were satisfied in this case.

Abstract

In carrying out their obligations to pay debts, Debtors often make various efforts to avoid having their assets being included in the guarantee of payment. Moreover, Debtors occasionally contrive, by providing grants, their assets in the bankruptcy decision to not be subsumed in the bankruptcy court. The aim of this research is to analyze how the arrangements for giving grants made by Bankrupt Debtors are reviewed from the Civil Code and Bankruptcy law as well as the role of the Curator in protecting Creditors and Debtors in the bankruptcy process. This research uses a normative juridical approach, where library data or secondary data is the main data, in addition to being supported by field data. The research results show that in the context of bankruptcy law, grants are an action that must be paid close attention because it can be said to be a legal action that is not required. If the Debtor gives away assets before being declared bankrupt, it can be indicated as an effort to avoid confiscation of collateral by the court. The curator has the authority to include a gift in the list of bankruptcy estates that will be sold to pay the debtor’s debts to his creditors. In such cases, the Curator can file an Actio Pauliana lawsuit with the commercial court to cancel the gift so that the assets can be included in the bankruptcy estate list. This study provides a focused examination on the legal status of gratuitous transfers in Indonesian bankruptcy law—a subject that, despite its practical urgency, remains underexplored compared to broader studies on bankruptcy proceedings or creditor protections.

Abstract

Jawa Barat termasuk provinsi dengan pelanggan pinjaman online terbanyak di Indonesia. Meski memberikan kemudahan, pinjaman online memiliki risiko utang bunga tinggi. Selain itu, “bank emok” juga berkembang di Jawa Barat. Banyak masyarakat, terutama yang berpendidikan rendah, kurang memahami isi perjanjian utang piutang, akibat hukum, dan hukum kepailitan. Pentingnya pemahaman hukum ini mendorong diadakannya penyuluhan bagi masyarakat Desa Rancakalong, Kecamatan Rancakalong, Kabupaten Sumedang. Masyarakat perlu memahami bahwa isi perjanjian utang piutang bersifat mengikat seperti undang-undang bagi para pihak yang membuatnya. Perjanjian tersebut harus dilaksanakan dengan itikad baik dan tidak dapat dibatalkan kecuali atas kesepakatan bersama. Risiko dari perjanjian utang piutang termasuk potensi pailit jika debitor memiliki dua atau lebih kreditor, dengan satu utang telah jatuh tempo dan dapat ditagih. Dalam kondisi ini, debitor dapat diajukan pailit ke Pengadilan Niaga. Pelatihan tentang perjanjian utang piutang dan hukum kepailitan ini berhasil meningkatkan pemahaman masyarakat Desa Rancakalong. Dengan adanya umpan balik positif dari peserta serta rencana tindak lanjut pembelajaran berkelanjutan, diharapkan masyarakat semakin berhati-hati saat berhutang dan menandatangani perjanjian utang piutang di masa depan.

Abstract

The Indonesian government has recognized the importance of entrepreneurship in supporting the country's economy. Micro, Small, and Medium Enterprises (MSMEs) have become the backbone of national economic growth, with women playing a vital role in this sector. Despite their contribution, women entrepreneurs face various challenges that hinder their business development, such as limited access to capital, gender-based discrimination, legal and administrative barriers, and a lack of institutional support. These obstacles are rooted in social norms and an insufficiently responsive legal framework. This article explores how legal advocacy and institutional support can empower women MSME entrepreneurs. It argues for a more inclusive legal policy environment, examines the role of legal services such as legal aid and consultation, and discusses successful case studies of advocacy organizations helping women overcome systemic barriers. Furthermore, this paper provides practical recommendations for improving legal access and advocates for stronger collaboration between governments, legal institutions, and global advocacy networks. Through a gender-sensitive legal approach, optimizing women’s roles in MSMEs can contribute to inclusive economic growth and strengthened gender equality.

Abstract

Di era globalisasi saat ini, Perjanjian utang-piutang merupakan elemen penting dalam kegiatan ekonomi, khususnya dalam sektor properti seperti pembangunan apartemen. Ketika debitor gagal melaksanakan kewajibannya, UU KPKPU memberikan kesempatan bagi debitor untuk menghindari kepailitan melalui rencana perdamaian. Selanjutnya, permasalahan timbul ketika rencana perdamaian pada PKPU ditolak dan debitor dinyatakan pailit, tetapi kemudian kembali mengajukan perdamaian dalam proses kepailitan. Tujuan dari Penelitian ini adalah untuk mengetahui keabsahan perdamaian pada kepailitan pasca rencana perdamaian PKPU ditolak dan akibat hukum dari dikabulkan perdamaian dalam kepailitan yang diawali dengan penolakan dalam PKPU. Penelitian ini menggunakan metode yuridis normatif dengan memperhatikan bahan hukum primer seperti peraturan perundang-undangan, bahan hukum sekunder berupa kajian literatur hukum, dan bahan hukum tersier berupa kamus hukum dan literatur pendukung lainnya. Dengan tujuan untuk memahami fenomena yang dimaksud dengan berlandaskan pada hukum yang berlaku. Melalui hasil penelitian ini, diperoleh kesimpulan bahwa pertama, perdamaian kedua yang sebelumnya telah gagal dalam proses PKPU secara yuridis tidak dapat dibenarkan dan seharusnya dinyatakan tidak sah dan kedua, akibat hukum dari dikabulkan perdamaian pada kepailitan setelah ditolaknya perdamaian pada PKPU ialah status debitor pailit dicabut dan mengembalikan kewenangan pengelolaan harta kepada perusahaan. Di samping itu, meskipun pelaksanaan rencana perdamaian dalam PKPU dan kepailitan di Indonesia telah diatur oleh Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang. Perlu adanya harmonisasi pengaturan PKPU dan Kepailitan dengan Peraturan Mahkamah Agung agar tercipta suatu kepastian hukum.

Abstract

The execution of collateral by secured creditors is a special right regulated under Article 59 paragraph (1) UU 37/2004, which stipulates that execution may only be carried out no later than two months after the insolvency period begins. However, violations of this provision frequently occur, creating legal uncertainty for bankrupt debtors. This study aims to analyze the judicial considerations in Commercial Court Decision No. 15/Pdt.Sus-Gugatan Lain-lain/2023/PN.Niaga.Smg concerning the determination of the insolvency period and the execution of collateral by secured creditors. Using a normative juridical approach, this research emphasizes secondary data obtained through literature study, analyzed qualitatively. The results show that executions conducted after the insolvency period violate Article 59 paragraph (1) and may constitute an unlawful act. Bankrupt debtors have the right to pursue further legal remedies such as cassation and judicial review. Strengthening regulations and technical guidelines is needed to enhance legal certainty and protection in bankruptcy practice.Keywords: Bankruptcy, Collateral Execution, Insolvency Period

Abstract

Giving debt or credit by creditors in their position as individuals or legal entities to debtors is a common occurrence in social life. Nowadays, it is rare to find an entrepreneur who does not use debt facilities (loans or credit) in the form of short-term debt. The regulations in bankruptcy law initially gave authority to creditors holding collateral rights, to be able to execute without being affected by bankruptcy, PT Bringin Srikandi Finance took legal action to transfer the land rights of PT Panghegar Kana Legacy, which is now in bankruptcy, to the name of PT Bringin Srikandi Finance which is one of the creditors of PT Panghegar Kana Legacy. This research will examine the application of the principle of good faith in the transfer of land rights by creditors to the assets of bankrupt debtors. Through a normative juridical approach with analytical descriptive methods, it can be determined that this is an act against the law and does not respect the principle of good faith at all.
