Abstract

This research seeks to explore the divine values in the development of legal science through the lens of the philosophy of science. In the context of humans as social beings created by the Almighty God, law functions as a normative guide to achieve justice and regulate social interactions. This research focuses on two main issues: the influence of divine values on the formation and development of legal science, and the integration of these values to create a balance between legal certainty, utility, and justice. This study employs a qualitative approach using historical and analytical methods. The type of research is a literature study. This research utilizes primary legal materials such as books, scholarly articles, previous academic studies, and other documents discussing divine values, the philosophy of science, and their relationship with legal principles such as justice, utility, and legal certainty. Subsequently, all obtained data is analyzed through qualitative analysis. The findings indicate that divine values play a crucial role in shaping a divinely-oriented legal paradigm that not only prioritises the formal aspects of law but also the moral and spiritual values derived from religious teachings. From this perspective, law is understood as a manifestation of universal divine values, with Pancasila serving as the epistemological framework that ensures the integration of moral principles within Indonesian law. Furthermore, divine values can create harmony between legal certainty, utility, and justice, where the concept of justice is emphasised to be not merely formal but also substantive, reflecting social justice and human dignity as creations of God. This research underscores the importance of divine values as a foundation in the development of legal science that is adaptive to the social dynamics of society.

Abstract

The Government's Policies on Prevention and Repression against Sexual Voilance in Higher Education through the Regulation of the Minister of Education, Culture, Research, and Technology of the Republic of Indonesia Number 30 of 2021 is a symbol of follow-up from the government to address the phenomenon of sexual violence in tertiary institutions in Indonesia. This study aims to analyze the challenges and expectations related to this policy. There are a number of qualitative and quantitative methods that are used in this study, which include interviews, questionnaires, and document analyses, and all are empirical research methods. There are several tertiary institutions in Indonesia, particularly those in Bengkulu City that have implemented Government's Policies on Prevention and Repression against Sexual Voilance in Higher Education, according to the results of this study. It is also important to note that there are also tertiary institutions that have not implemented these policies, but instead have their own policies or rules in regards to dealing with incidents of sexual violence at their institutions. A number of tertiary institutions, including tertiary schools in Indonesia, follow up on the rules governing the prevention and handling of sexual violence, but they follow policies that are not in line with the Regulation of the Minister of Education, Culture, Research and Technology of the Republic of Indonesia Number 30 of 2021 on Government's Policies on Prevention and Repression against Sexual Voilance in Higher Education.

Abstract

This research aims to explore the basics of the idea of abolishing criminal justice in Indonesia and possible alternative solutions to problems that arise in prisons, especially from a theoretical perspective and comparison with Islamic law and customary law. The legal research method in this research is normative (doctrinal), research activities carried out include inventorying, explaining, interpreting and systematizing and broadcasting all Islamic law and customary law, which are related to the idea of abolishing prison sentences. The results of the research show that imprisonment is not recognized in the Islamic view, whereas currently imprisonment is acceptable only as long as the punishment provides a lot of benefits or kindness or benefits to society. Thus, imprisonment is not an absolute in the view of Islamic law. Based on the inventory of customary law as the original unwritten law of the Indonesian nation, no form of imprisonment was found. Therefore, without imprisonment, customary law can be enforced to maintain order and create justice in Indonesian society. From this analysis, especially related to the study of Islamic law and customary law, it is concluded that imprisonment can be considered for abolition if its shortcomings are more dominant than its benefits. Apart from that, the Indonesian Government should provide a forum for the idea of privatizing correctional institutions in the sense that the management of correctional institutions is carried out by private parties on a non-profit basis.

Abstract

Program pelatihan keterampilan hidup melalui teknik eco-printing ini dirancang untuk meningkatkan ketahanan keluarga di Desa Renah Semanek, Kabupaten Bengkulu Tengah. Program ini diselenggarakan oleh tim dari SPNF-SKB Bengkulu Tengah, bekerja sama dengan LPPM Universitas Bengkulu. Tujuan utama program ini adalah memberikan pengetahuan dan keterampilan baru kepada ibu-ibu rumah tangga agar dapat menghasilkan produk kreatif bernilai ekonomi, yang pada akhirnya dapat meningkatkan kesejahteraan keluarga. Pelatihan eco-printing ini melibatkan beberapa tahapan, mulai dari pengenalan teknik dasar eco-printing, pemilihan dan persiapan bahan, hingga proses pembuatan produk akhir. Setiap tahapan pelatihan dirancang secara komprehensif dan praktis, dengan metode demonstrasi langsung dan praktik mandiri. Selain itu, program ini juga dilengkapi dengan sesi diskusi dan konsultasi untuk mengatasi berbagai tantangan yang dihadapi peserta selama proses pelatihan. Hasil dari pelatihan ini menunjukkan bahwa peserta mampu menguasai teknik eco-printing dengan baik dan menghasilkan produk yang berkualitas. Produk-produk yang dihasilkan memiliki nilai estetika tinggi dan potensi untuk dipasarkan. Selain itu, pelatihan ini juga meningkatkan rasa percaya diri dan kreativitas peserta, serta memperkuat ikatan sosial antar peserta melalui kegiatan kelompok yang kolaboratif. Secara keseluruhan, program pelatihan ini berhasil mencapai tujuannya dalam memberdayakan ibu-ibu rumah tangga dengan keterampilan baru yang berpotensi meningkatkan pendapatan keluarga. Keberhasilan ini diharapkan dapat menjadi model bagi program pemberdayaan masyarakat lainnya di wilayah yang serupa

Abstract

Law Number 11 of 2012, commonly referred to as the Juvenile Criminal Justice System Law, stands as a legal framework designed to safeguard children entangled in legal conflicts. Its primary objective is to secure a promising future for these children, facilitating opportunities for identity development that fosters independence, responsibility, and constructive contributions to themselves, their families, society, and the nation. Despite the existence of these legal safeguards, their efficacy often encounters challenges within the intricate dynamics of social life. This disjunction is particularly conspicuous in institutional environments such as schools, where the assurance of safety is not guaranteed. Disturbingly, statistical data compiled by the PPA Unit of the Criminal Investigation Unit of the Seluma Police spanning from 2019 to 2021 reveals a disconcerting prevalence of eight cases of sexual abuse perpetrated by teachers against their students. A poignant instance unfolded in Talang Alai Village, Kec. Air Periukan District, wherein a child named RA became a victim of molestation by an individual identified by the initials AI on August 18, 2019. In response to these distressing occurrences, this research endeavors to formulate strategies for addressing criminal acts of sexual abuse committed by teaching staff in Seluma Regency. The study aims to meticulously scrutinize and analyze the prevalence of such crimes, providing scholarly insights into the harsh reality of sexual abuse committed by teaching staff in this specific region.

Abstract

This study analyzes the trafficking of Indonesian Migrant Workers (TKI) and Female Migrant Workers (TKW) abroad as a social pathology and the effectiveness of legal protection. Despite regulations such as Law No. 21 of 2007 and Law No. 18 of 2017, illegal agents, non-procedural departures, exploitation, and limited victim access to legal protection remain. This normative study uses literature and legal document analysis to identify gaps between regulation and implementation in the socio-economic context of migrant workers. Findings show TKI atau TKW trafficking is a systemic social issue influenced by poverty, low education, and limited employment alternatives. Effective legal protection requires strengthened regulations, agent supervision, public education, capacity building, international intervention, and socio-economic rehabilitation for victims. The study provides policy recommendations to enhance migrant worker protection and sustainably prevent human trafficking.

Abstract

Studi ini mengkaji masalah Kekerasan terhadap Anak (KTA) yang dilakukan oleh orang tua sebagai bentuk disfungsi sosial yang serius, karena tidak hanya melanggar hak dasar anak untuk tumbuh kembang secara optimal, tetapi juga merusak masa depan anak sebagai subjek hukum yang harus dilindungi. Fokus penelitian diarahkan pada kerangka hukum positif yang mengatur perlindungan anak, terutama Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak (UU PA) beserta perubahannya, serta Kitab Undang-Undang Hukum Pidana (KUHP) sebagai dasar pemberian sanksi pidana. Dengan menggunakan metode kajian hukum normatif yang bertumpu pada analisis peraturan perundang-undangan, putusan pengadilan, dan doktrin, penelitian ini menyoroti dilema antara orientasi sanksi pidana yang bersifat menghukum (retributif) dengan kebutuhan mendesak untuk memulihkan kondisi fisik, psikis, dan sosial korban anak melalui pendekatan keadilan restoratif. Hasil penelitian menunjukkan bahwa meskipun UU PA telah menyediakan ancaman sanksi yang berat terhadap pelaku, budaya hukum yang masih menempatkan pengasuhan dan pendisiplinan anak sebagai otoritas penuh orang tua menjadi hambatan utama penegakan hukum dan pelaporan kasus. Kesenjangan ini menuntut pergeseran paradigma aparat penegak hukum dan hakim untuk memprioritaskan pemulihan komprehensif terhadap korban anak, antara lain melalui penetapan kewajiban pelaku mengikuti program rehabilitasi pengasuhan, konseling keluarga, dan pengawasan sosial yang berkelanjutan, bukan sekadar menjatuhkan pidana penjara. Selain itu, penelitian ini menawarkan rekomendasi konkret mengenai penguatan regulasi, sosialisasi, dan mekanisme koordinasi lintas lembaga agar prinsip kepentingan terbaik bagi anak benar-benar terimplementasi dalam praktik peradilan pidana. This study examines the issue of Child Abuse (Kekerasan terhadap Anak/KTA) committed by parents as a form of serious social dysfunction, which not only violates the fundamental rights of children to optimal growth and development but also damages their future as legal subjects that must be protected. The research focuses on the positive legal framework governing child protection, in particular Law Number 35 of 2014 concerning Child Protection (UU PA) and its amendments, as well as the Indonesian Criminal Code (KUHP) as the basis for criminal sanctions. Employing a normative legal research method that relies on the analysis of legislation, court decisions, and legal doctrines, this study highlights the tension between penal sanctions oriented toward punishment (retributive justice) and the urgent need to restore the physical, psychological, and social conditions of child victims through a restorative justice approach. The findings indicate that, although the Child Protection Law provides for severe penalties, the prevailing legal culture that still regards child rearing and discipline as the absolute authority of parents constitutes a major obstacle to law enforcement and case reporting. This gap requires a paradigm shift among law enforcement officers and judges to prioritize comprehensive recovery for child victims, including by imposing obligations on perpetrators to participate in parenting rehabilitation programs, family counseling, and continuous social supervision, rather than relying solely on imprisonment. The study further formulates recommendations for strengthening regulations, public awareness, and inter-agency coordination so that the best interests of the child are genuinely realized in criminal justice practice.
