Abstract

Banking institutions have a strategic role in the country's economyWork as an intermediary between parties who have excess funds with those who lack funds. In carrying out its duties, the bank is obliged to maintain public trust by implementing good governance or management and must respect the principle of bank prudence. With the emergence of the impact of Covid-19, the government together with the Financial Services Authority issued Financial Services Authority Regulation Number 11/POJK.03/2020 concerning national economic stimulus as a countercyclical to the impact of the spread of Coronavirus Disease 2019, where this policy was issued to protect customers by issuing regulations that allow provision of restructuring to affected companies. Banks in carrying out their duties must run a risk management program to minimize the occurrence of failure in one or part of a transaction or instrument finance, if the bank in carrying out its duties does not carry out risk management it can be dangerous and cause losses so that the bank must be responsible for the losses of its customers.

Abstract

Ekspektasi masyarakat Indonesia terhadap kinerja dan profesionalisme institusi Polri dari waktu ke waktu terus meningkat. Hal ini menjadi tantangan bagi Polri untuk membuktikan perannya sebagai instrumen dalam menjaga keamanan dan ketertiban masyarakat. Terkhusus juga bagi Ditintelkam yang harus bisa selalu memberikan pelayanan ekstra kepada masyarakat. Berdasarkan pengamatan awal, Ditintelkan Polda Nusa Tenggara Barat memiliki tugas yang kompleks yaitu menjalankan peran dan fungsi pelayanan standar kepada masyarakat serta melaksanakan tugas dalam penanganan masalah keamanan di wilayah hukum Polda Nusa Tenggara Barat. Oleh karena itu, perlu dilakukan kajian secara mendalam mengenai implementasi Peraturan Kapolri Nomor 22 Tahun 2010 telah berjalan maksimal di Ditintelkan Polda Nusa Tenggara Barat. Tujuan dari penelitian ini yaitu menganalisis Mengenai Implementasi Fungsi Dan Peran Ditintelkam Polda Nusa Tenggara Barat Berdasarkan Peraturan Kapolri Nomor 22 Tahun 2010 Dalam Hal Pelayanan Kepada Masyarakat dan menganalisis Faktor Hambatan Apa Saja Yang Mempengaruhi Implementasi Fungsi Dan Peran Ditintelkam Polda Nusa Tenggara Barat Berdasarkan Peraturan Kapolri Nomor 22 Tahun 2010 Dalam Hal Pelayanan Kepada Masyarakat. Metode penelitian yang digunakan dalam penelitian ini yaitu hukum empiris. Hasil dari penelitian ini yakni Dalam pelaksanaan fungsi dan peran Polri dalam hal ini Ditintelkam Polri menjalankan tanggung jawab politik kepolisian, sebagaimana tercantum dalam Pasal 28 ayat (1) ayat (2) dan ayat (3) UU No 2 Tahun 2002, tanggung jawab hukum Kepolisian sebagaimana tercantum dalam Pasal 29 ayat (1) dan ayat (2) UU No 2 Tahun 2002, meliputi tanggung jawab pidana, tanggung jawab perdata, tanggung jawab moral dan etika profesi, serta tanggung jawab tata usaha negara atau administrasi, serta tanggung jawab profesionalisme Kepolisian. Faktor penghambat yang mempengaruhi implementasi fungsi dan peran ditintelkam polda nusa tenggara barat berdasarkan peraturan kapolri nomor 22 tahun 2010 dalam hal pelayanan kepada masyarakat yaitu faktor aparat atau petugas yang meliputi moral aparat penegak hukum yang masih belum memahami secara baik mengenai pelayanan kepada masyarakat, Keterampilan Polri yang masih perlu dilakukan peningkatan manajemen dan peningkatan Sumber Daya Manusia agar dapat meningkat keahliannya maupun ketrampilannya dalam hal melayani masyarakat.

Abstract

The understanding of Islamic law can not be separated from the interpretation sourced from the Quran, Sunnah and Ijtihad, which later evolved into a flexible and dynamic source of Islamic law following the demands of the times. Although it has flexible and dynamic properties but the interpretation must still maintain the basic principles that remain will never change. This is very important because misunderstand the intent expressed in the Quran and Sunnah will affect the error of understanding the Islamic law itself, therefore it is important to realize that the effort of understanding is not separated from The true interpretation of the will of Allah and the Prophet Muhammad that is contained in the Quran and Sunnah. This paper seeks to introduce the foundation of the pursuits that come from the Quran, Sunnah and Ijtihad, which is done using the method of normative assessment of various references discussing the source of Islamic law. Therefore, it is expected to find the meeting point between the understanding of the Qur'an, Sunnah and Ijtihad with the effort to interpret the source of Islamic law aimed at realizing the benefit of the people.

Abstract

Pelaksanaan pengabdian berjalan dengan baik dan sesuai rencana, Sekolah Pascasarjana Universitas Airlangga, yang memposisikan diri sebagai “School of Leadership” melihat bahwa Pesantren yang merupakan lembaga pendidikan tertua di Indonesia, dengan santri-santrinya memiliki potensi yang luar biasa bagi kemajuan masa depan bangsa. Gabungan antara ilmu hukum, sosial, dan budaya yang tetap dilandasi ilmu agama menjadi nilai plus bagi sistem pembelajaran di pondok-pondok pesantren, tak sedikit pula pesantren yang mampu menghasilkan lulusan unggul dan berkualitas. Tuntutan zaman yang membutuhkan manusia tidak hanya cerdas akan tetapi tanggap terhadap kondisi dan situasi yang terjadi, membuat Magister Kajian Ilmu Kepolisian dengan koordinator Program Studi, Dr. Prawitra Thalib, SH.,MH., ACIArb. bersama mahasiswa mengadakan acara pengabdian masyarakat dengan topik Optimalisasi Bhabinkamtibmas melalui sinergi Santri dan Kepolisian Republik Indonesia di Banyuwangi. Pada kesempatan kali ini hadir sebagai narasumber, IPDA Wahid Hasyim Basri Kanit Kamsel Polresta Banyuwangi yang membawakan paparan berjudul Edukasi Keselamatan Berlalu Lintas, menurutnya dari cara berlalu lintas dengan tertib dan taat serta patuh terhadap aturan bisa menjadi jalan melatih kedisiplinan diri yang merupakan inti dari terbangunnya jiwa kepemimpinan.

Abstract

Penggunaan teknologi digital yang semakin berkembang pesat berdampak terhadap kehidupan sehari-hari termasuk pada aspek pengadaan barang/jasa dibidang keolahragaan, pemanfaatan teknologi ini bukan tanpa masalah, regulasi yang ada saat ini dengan kondisi empiris seringkali bersinggungan menjadi problem tersendiri, terutama pada bidang keolahragaan. Pengabdian Masyarakat ini bertujuan untuk memberikan pemahaman hukum terkait penggunaan e-contract dalam pengadaan barang dan jasa di lingkungan KONI Jawa Timur. Kegiatan ini melibatkan pelatihan dan pendampingan terhadap Ketua, Bendahara dan staf KONI seluruh Kabupaten/Kota Provinsi Jawa Timur, agar dalam penyelenggaraannya dapat memahami prinsip-prinsip hukum yang mengatur e-contract, serta implikasinya terhadap pengadaan barang dan jasa keolahragaan. Diharapkan, dengan penerapan e-contract, proses pengadaan menjadi lebih transparan, efisien, dan sesuai dengan regulasi yang berlaku. Selain itu, kegiatan ini juga berfokus pada mitigasi risiko hukum yang dapat timbul dari penggunaan e-contract, sehingga dapat mengurangi potensi sengketa dan memastikan kepatuhan terhadap ketentuan hukum. Implementasi yang sukses diharapkan dapat meningkatkan tata kelola pengadaan barang/jasa di KONI Jawa Timur dalam mendukung kemajuan dunia olahraga di daerah tersebut.

Abstract

The industrial revolution 4.0 has expanded business and economic transactions beyond the domestic sphere, fostering interactions between countries. This shift necessitates business entities that can facilitate seamless international transactions. Freight forwarding, as a key player in the logistics sector, plays a crucial role in enabling the movement of goods and services across international borders. However, freight forwarding companies face challenges from fluctuations in foreign exchange rates due to transactions involving suppliers and consumers from various countries, making them vulnerable to currency exchange rate volatility. This paper aims to understand the financial business processes of freight forwarding companies, particularly in managing financial risks and addressing currency exchange rate fluctuations. Additionally, it seeks to explore strategies to minimize the negative impact of exchange rate fluctuations on the financial stability of these companies. The research methodology is descriptive, employing surveys and interviews with freight forwarding companies and stakeholders in the logistics industry. Data triangulation with relevant agencies ensures more valid and comprehensive insights into how the industry addresses currency exchange rate challenges. The findings suggest that freight forwarding companies can mitigate losses from exchange rate fluctuations by implementing hedging strategies and adopting supply chain finance practices on an ongoing basis.

Abstract

In sharia banking, Mudharabah deposits are known as banking products and are a form of investment for debtors and creditors. Mudharabah is an investment transaction from the capital owner, namely Shahibul Maal, to the Mudharib, or capital manager, to carry out certain business activities in line with sharia principles. In Mudharabah deposits, there is a profit-sharing principle used between Mudharib and Shahibul Maal. However, currently, problems have been discovered related to the deliberate act of not including records in the bank cash account transaction report documents for Mudharabah deposits. Mudharib argued on the basis of reducing the cash balance on the balance sheet due to the difference. Mudharabah deposits that are not recorded in the bank cash account transaction report document are a loss to Shahibul Maal as an investor because the funds that have been deposited are not recognized as savings. The problem that will be studied in this article relates to the directors’ responsibility for Mudharabah deposits, which are not recorded in the bank cash account transaction report document by the Mudharib. This research uses statutory, conceptual, and case approaches. The results of this research show that the directors are fully responsible for the losses experienced by Shahibul Maal on Mudharabah deposits that were not recorded in the banking cash account report carried out by the Mudharabah.

Abstract

Baitul Maal wat Tamwil is a financial institution with a sharia concept that was born as a choice that changes the concept of maal and tamwil in one institution. The concept of maal was born and became part of the lives of Muslim communities in terms of collecting and distributing funds for zakat, infaq and shadaqah) productively. While the Tamwil concept was born for purely business activities to benefit from the middle to micro sectors of society. One of the financing activities carried out by BMT is financing based on profit sharing principles. Profit sharing is done by two types with mudharabah and musyarakah contracts. musyarakah is derived from the word syirkah, also called syarikah, which means a cooperation agreement between two or more parties for certain businesses, each party providing the assistance fund, and will be borne together in accordance with the aid fund, or mutual agreement. The methods used in the writing of this article are normative research using a statute approach and a conceptual approach.the result of this research indicates distribution of funds or financing must pay attention to various matters relating to caution both from within and from outside the Islamic Financial Institutions of Islamic Banks and Non-Islamic Banks. Matters issued from internships are in the form of Legal Lending Limit (LLL), financing guidelines, operational aspects. Aside from internal, things that are of caution are also excluded from the external supported by 5C analysis (Character, Condition, Capacity, Capital, Guarantee) and sharia compliance). This analysis must be considered in channeling financing to avoid elements forbidden in Islam.

Abstract

This article has three interconnected objectives. Firstly, it reviews the recent history of technology leadership research to position the definitions used within the current historical context. Secondly, it compiles a list of definitions and summarizes them through content analysis, providing a comprehensive definition of technology leadership. Thirdly, it presents measurements of technology leadership within an organization. By conducting a systematic review, the study compiles definitions and measurements of technology leadership, emphasizing problem-solving, facilitation, human orientation, interpersonal skills, continuous innovation, organizational support, personal attributes, strategic foresight, and ethical practices. The research provides a comprehensive definition and practical tools for assessing technology leadership, serving as a crucial foundation for future research and organizational strategies.

Abstract

Introduction to the Problem: The development of information technology has given rise to various types of electronic contracts in the form of adhesion contracts. Unfair legal issues surround the contract formation process and the content of new electronic contract models, such as browser wrap agreements and sign-in wrap agreements. In several cases that have been decided by the Court, the panel of judges has its own standards for deciding disputes based on a fair electronic contract. Purpose/Study Objectives: This paper aims to elaborate on the nature of contractual fairness from an electronic contract perspective. Design/Methodology/Approach: This study employed the statute approach and the case approach. This research examines various regulations relating to agreements, electronic contracts, the doctrine of unconscionability and examizing a number of decisions pertaining to electronic contracts from courts in Indonesia as well as various other nations. Findings: The research results can be concluded that nature of fairness in electronic contracts can be tested through two indicators, the process of forming the contract and clauses in the agreement. Electronic contracts are considered procedurally unfair if the weak party does not know and realizes that they are bound by a contract. An electronic contract is considered substantively unfair if a clause in the contract places an unreasonable burden on the weaker party. In addition to the doctrine of unconscionability, the principles of transparency, duty to read, and reasonable expectation must also be used to ensure fairness in electronic contracts. These principles need to be formulated into the norms of the Indonesian Information Transaction Act to protect consumers from unfair contracts. Paper Type: Research Article
