Abstract

This research aims to analyze the depositors of funds’ legal protection in MFI through the existence of the Deposit Insurance Corporation. This legal research uses a statutory approach and a conceptual approach. The establishment of a Deposit Insurance Corporation in Microfinance Institutions has been mandated since 2013 in the Microfinace Institutions act which aims to guarantee the deposits of MFI members and communities, but until the promulgation of the Financial Sector Development and Strengthening Act has not been formed. Provisions on preventive protection for depositors of funds in MFI even though they have been regulated in the Microfinance Institutions Act, the Financial Sector Development and Strengthening Act as well as POJK 10/2021 and POJK 19/2021, however the existence of the Deposit Insurance Corporation at Microfinance Institutions is still needed as the existence of the Deposit Insurance Corporation that guarantees deposits at banks. The existence of a Deposit Insurance Corporation in Microfinance Institutions is very important in order to ensure the payment of deposits from members and the public if the Microfinance Institution is revoked its license by the Financial Services Authority and to maintain the trust of members and the public. Due to the lack of position the depositor of funds in Microfinance Institutions is only a concurrent creditor so that potentially deposits are not fully paid.

Abstract

Abstract

This paper aims tp discuss the legitimacy of AIW at Nazhir Airlangga University from the perspective of the waqf law and whether it has complied with the principle of maslahah mursalah, considering that various cases of waqf property do not run optimally, are productive, are not used or are transferred to third parties. There is an interesting phenomenon, namely that at Nazhir, Airlangga University is the only one and the first time an Indonesian State University has received a Nazhir certificate to manage and develop waqf. In this case, it is interesting to discuss the practice of waqf at Nazhir Airlangga University according to the Waqf Law. This normative research uses statute approach and the conceptual approach. The results show that in practice Nazhir Universitas Airlangga in carrying out his waqf pledge practice does not use AIW un-authentic. That is, Nazhir Airlangga University in carrying out his waqf practice in terms of his pledge deed is in accordance with the procedures in accordance with Law Number 41 of 2004 concerning Waqf.

Abstract

The rapid advancement of technology during the periods of the Industrial Revolution 4.0, Society 5.0, and Policing 5.0 has resulted in indistinct shifts that diverge from previously recognized patterns, thus necessitating innovative leadership approaches. A notable deficiency in self-motivation has contributed to subpar performance. As of 2016, a significant number of Indonesian National Police personnel were implicated in disciplinary infringements, breaches of ethical standards, and even criminal transgressions. Specifically, in that year, 6,662 cases of disciplinary infractions were recorded, with 2,772 subsequently addressed. Moreover, transgressions against the professional ethics of the Indonesian National Police saw an escalation from 1,041 cases in 2015 to 1,671 in 2016. The objective of the present research is to discern and evaluate the influences of motivational enhancement and innovative leadership on the performance of the Indonesian National Police. The study employs a qualitative paradigm, drawing insights from a case study-oriented literary analysis. It is discerned that in addressing internal shifts in the Indonesian National Police, there is an imperative to bolster motivation and cultivate innovative leadership in order to attain exceptional, efficacious, and competitive outcomes. Pioneering leaders deploy diverse strategies to guide and inspire their teams, fostering active participation and collaboration towards the realization of organizational goals and peak performance. Given the evolving dynamics within the Indonesian National Police, a leader's role transcends mere adaptation to external innovative trends; truly effective leaders position their institutions as benchmarks for peers. An implication of contemporary advancements is the emergence of more intricate criminal modalities, pressing the Indonesian National Police to evolve in tandem. Concurrent with the digital age, there has been a heightened national cognizance of the need to rectify disparities and rejuvenate standards, driving a transition towards a society that is dynamic, forward-thinking, and technologically proficient.

Abstract

The legal foundation is one of the most important sources of law that has been emphasized in several legal theories. However, concepts regarding legal foundation are still heavily debated and intertwined with other legal principles, legal values, legal norms, legal theorems, and legal rules. Foundation, principles, and norms are general concepts discussed in the law field as a separate point of discussion in the study of law, especially in legal theory. This showcases that the knowledge regarding concepts and the standing of different principles, values, norms, and rules are important in studying a particular field of law. However, in practice, most legal scholars and professors in the field of law are still unaware of such concepts that often overlap with one another. Generally, foundations are meta values from principles, principles are the meta values of norms, and norms are meta values of a rule. In comparison, values are the equivalent of principles and fundamental values. A theorem is the equivalent of a norm, which is embodied in a rule, and the rule itself is the most concrete implementation of a principle, which may be in the form of a written or unwritten rule. This paper aims to explore the relationship between justice, corrective justice, restitution, and unjust enrichment. It will discuss how fundamental values, principles, and norms serve as meta-values in achieving justice. Additionally, it will examine the role of corrective justice in providing restitution for cases of unjust enrichment.

Abstract

The role of Islamic banking institutions in terms of housing finance has attracted the attention of many people, especially in countries where the majority are Muslim. This is based on the fact that most people prefer Islamic bank financing to avoid the element of usury, including in home financing in Islamic banks. Given that as is well known, many non-bank developers based on a lot of public interest in Islamic home financing products carry out this financing. The purpose of writing this journal is expected to provide knowledge to the public in conducting sharia-based housing finance. In writing this journal using legal research methods, namely legal research. The result of this writing is that in principle, Sharia-based Housing Financing must require the role of Islamic financial institutions, both through Islamic banking institutions and non-Islamic banking.
