Abstract

Environmental pollution in Gulf of Mexico became the most acute environmental pollutionin United States (US). Pollution caused by negligence committed intentionally by officerBritish Petroleum (BP) oil pipeline resulted in the explosion happened. Omissionscommitted intentionally and caused certain damage to the environment can be categorizedas an environmental crime.Environmental contamination by BP became a threat for thenational security of the United States, as evidenced by the US government attention givento contamination occurs. One concern that was given is when President Barrack Obamacanceled a visit abroad to observe firsthand the pollution incident. This study aims todetermine the policy set by the US government in dealing with pollution case made by BPin 2010. The framework that used in this research are transnational environmental crime,public policy and precautionary principle. The type of this research is descriptiveexplanativewith qualitative data analysis techniques through data collection technique.The result of this research is an explanation about determination of the US government’spolicy in dealing with cases of environmental pollution the Gulf of Mexico, there are theestablishment of national commission, the determination of the provision of fines from theUS government to BP, agreement between BP and Environmental Protection Agency(EPA) and recovery program Gulf of Mexico.

Abstract

The influx of illegal Chinese workers has resulted in violations against the Indonesiangovernment regulations such as the Immigration, Ministry of Manpower, and Ministry ofLaw and Human Rights in Indonesia. The method of this research is using qualitativeresearch that explains about how is the impact between the relationship with Indonesia andChina of the entry of illegal foreign workers from China on Indonesia from 2015 until2017. Furthermore, this impact is being analyzed by using Neoclassical theory andRational Choice theory. Finally within this resarch it has been found that, Indonesia stillneeds economic improvement from various foreign investors especially from Chinabecause the Indonesian State Budget has not reached the target of state infrastructuredevelopment. So far, the action that Indonesia can take rationally is to maintain it's goodrelations with China, for now and in the future. Therefore, Indonesia is still committed onrevising its regulations and policies to improve its procedures in the employment andsupervision of foreign workers in Indonesia that is in the sectors of the Immigration, theMinistry of Manpower, and the Ministry of Justice and Human Rights in Indonesia.

Abstract

The Golden Triangle is a border area of three Southeast Asia countries; i.eLaos, Myanmar, and Thailand. The Golden Triangle is the largest opiumproducer in the region. It causes Southeast Asia become vulnerable of drugstrafficking. Southeast Asian countries are aware of the danger of drugstrafficking, which later brought out the issue to ASEAN. In dealing with thisproblem, ASEAN established ASEAN Senior Official on Drugs Matters (ASOD),a special committee board in drugs trafficking. This research aimed todescribe ASOD roles in coping drugs trafficking in Golden Triangle from 2006to 2013. This research employed neoliberal institutionalist theory emphasizingon the concept of cooperation among states. The method is qualitative usingdescriptive analysis through library research. The results of this researchindicate that ASOD playes role as a facilitator of interstate cooperation interms of drugs trafficking among ASEAN members. This role is compatiblewith the basic assumption of neoliberal institutionalist theory arguing thatinstitution can bridge the gap between states preferences on particular issues.Yet, this research found that the role of ASOD in combating drugs trafficking isnot succeed due to its interent lack of legitimacy to make legal bindingdecisions.

Abstract

Transnational crime is an important issue because the threat impacts take place across the borders of two or more countries. Armed violence by the Mexican Drugs Trafficking Organization is increasingly threatening the security of Mexico, due to the access of weapons smuggled from United States. The Merida Initiative was signed in 2008 with the aim of adressing the threat of transnational organized crime. But in 2007-2012, the number of smuggling of weapons continues to increase. This research then aims to analyze the constraints on Merida Initiative implementation in combating the smuggling of small arms and light weapons. This research uses the neoliberalism paradigm in understanding the inhibiting factors of the success of a cooperation, thus explaining the cause of the increased number of smuggling weapons after Merida Initiative was signed. The results showed that the inhibiting factor in combating the smuggling of small arms and light weapons is the absence of mutuality of interest. The absence of mutuality of interest is explained by the responses that are given not in accordance of what was expected from other country. The absence of mutuality of interest results in a tendency for a state to prioritize the national interest above the common interest.

Abstract

Syrian conflict which been transformed into civil war led to the emergence of refugee crisis. Syrian refugees themselves have been accommodated in Turkey since the beggining of conflict in 2011. Turkish government imposed the temporary protection regime policy for Syrian refugees which was declared in October 2011. By the enactment of temporary protection regime policy, the Turkish government suspended the geographical limitation that previously were the characteristic of Turkey’s asylum policy. This undergraduate thesis aims to seek for Turkey’s national interest through its policy on accepting Syrian refugees peroid 2011-2013. This research is done in explanatif type using case study method. The result of this research shows that Turkey’s willingness on accepting Syrian refugees is motivated by Turkey’s interest to realize the regime change in Syria.

Abstract

On December 6th 2017, the United States under Donald Trump presidency recognized the political status of Jerusalem City as the capital of Israel. Right away the decision gathered criticisms and controversy. States all over the world especially Muslim majority countries gathered on the streets to protest the policy. It was to be expected as Jerusalem is considered to be one of the key elements for peace process between Israelis and the Palestinians. Although the United States and Israel have a very close relations, there had been no president of the United States before President Trump to issue such declaration in their presidencies. This research aims to look for what factors that influenced President Trump’s decision regarding Jerusalem. In order to do that, this research uses neoclassical realism as a framework to analyze the case. Broadly speaking, this theory analyzes foreign policies from external and internal factors. Accordingly, this research argues that international circumstances were very supporting for the United States to issue the foreign policy. Moreover, President Trump’s closest advisers and his supporter bases were those who had pro-Israel view so that it’s not surprising that if President Trump wanted to fulfill their wishes in order to maintain and increase the president’s popularity among the people of the United States.

Abstract

The 2011 military intervention in Libya is the first interventionbacked by the United Nations (UN) referencing the Responsibilityto Protect (R2P) with UN Security Council (UNSC) Resolution1970 and 1973 as legal basis. R2P consists of three components:responsibility to prevent, responsibility to react, and responsibilityto rebuild. The intervention was regarded as a success by NATO,the mandate holder. However, the mandate only covers thecomponent of preventing and reacting of R2P, leaving therebuilding (post-intervention strategy) unchecked. This researchattempts to identify the extent of Responsibility to Rebuildimplementation by international community after 2011 intervention.Case study and descriptive approach used found out that therebuilding process, particularly in security, justice, and economyaspect has yet to be restored in Libya, and not fulfilling thedemands set by responsibility to rebuild.

Abstract

In human trafficking, Indonesia as a country not only act as asource, but also a transit and a destination. The number of humantrafficking cases have been increasing since Indian Ocean tsunamioccured. According to Trafficking in Persons (TIP), Indonesia’sposition is at Tier 2, meaning that Indonesia governement has notmet the minimum standards of Trafficking Victims Protection Act(TVPA), but still showing some efforts to meet the standards. Tocombat human trafficking, Indonesia has cooperated with IOMthrough one of its law enforcement body, Indonesian National Police(INP). This research aims to analyze the cause of the increasingnumber of human trafficking cases although several IOM’s countertraffickingefforts have been placed throughout 2007-2013 period.This research employs theory of international cooperation andinternational organization with neoliberalism paradigm to analyzethe data collected through literature studies, documentation, andinterview as well. The result shows that the ineffectiveimplementation of IOM’s counter-trafficking efforts was notnecessarily caused by the abscence of mutual interests, but by theinavailability of quick feedback to deal with the constraints occuringduring the cooperation.

Abstract

This research aims to determine why the Syrian refugees choose to seek shelters inLebanon and to analyze the role of identity on their influx to Lebanon. Lebanon hasbecome the second largest refugee host country in the world, receiving nearly 1,2 millionrefugees as of 2014. In fact, Lebanon is a country with a limited economic capabilitiescompounded by sectarian conflict, resource scarcity, and a political instability. From aconstructivist approaches, this researches argues that there are non-strategic considerationsthat underlines the refugees' decision to travel across border to Lebanon, particularly thepresence of kinship, brotherhood, and common identities which underlies the openness forrefugees and a positive reception from the Lebanese people. Those primordial ties led to acollaborative, integrative, and positive relations between people from two countries. Thisresearch further proves a constructivist assumption that in transnational relations is notmerely driven by a rational considerations, but also in a non-rational aspect in thisparticular case, under the basis of primordial ties.

Abstract

Association of South East Asian Nations (ASEAN) has a role to address drug trafficking inits area, thus formed a special agency to deal with this problem through a forum namedASEAN Senior Official on Drugs Matters (ASOD). ASOD, in cooperation with China,India, Laos, Myanmar, and Thailand announced Declaration of Chiang Rai, which focuseson opium production and trafficking in the Golden Triangle area. The declaration itselfreflects a common interest to control drug trafficking between Laos, Myanmar, andThailand. Based on this common interest, this research is developed to know theimplementation of Chiang Rai Declaration as a form their cooperation. Using liberalinstitutional theory, this research finds that cooperation between Laos, Myanmar, andThailand based on Declaration of Chiang Rai is implemented to address trafficking.Declaration Chiang Rai programs make Laos, Myanmar, and Thailand can collaborate toaddress opium trafficking more seriously. This research also finds that this cooperation isbased on the fact that those three countries have the same purpose, that is to maintain thestability in South East Asia.
