Abstract

Regarding the research of this thesis, the author in his research uses the normative juridical method, which means that the research refers to legal norms in national laws. This study also aims to determine the application of the new novelty principle in filing a patent application and to find out the legal consequences for patent applicants who do not use the new novelty principle. The source of this research data is obtained from the data collection in this research is done by studying documents or literature. Document or literature study is the main data collection technique because the proof of the basic assumptions of research is based on positive legal norms, legal doctrines or teachings, academic research results and court decisions, all of which are based on written documents. Related to document study, basically it is an activity of reviewing various written information regarding the law, whether it has been published or not published in general but may be known by certain parties. Document study is the activity of collecting and examining and tracing documents or literature that can provide information or information needed by researchers. The results of the study indicate that the principle of new and novelty is an absolute requirement in patent registration in accordance with Law Number 13 of 2016.

Abstract

Tenaga kerja merupakan komponen vital dalam pembangunan nasional, sehingga negara berkewajiban memberikan perlindungan hukum yang adil dan menyeluruh. Pengesahan Undang-Undang Nomor 6 Tahun 2023 yang menetapkan Perppu Nomor 2 Tahun 2022 tentang Cipta Kerja menjadi undang-undang membawa perubahan signifikan dalam kebijakan ketenagakerjaan di Indonesia. Artikel ini bertujuan untuk menganalisis kebijakan pengaturan perlindungan tenaga kerja dalam undang-undang tersebut melalui tiga aspek utama: perlindungan ekonomis, perlindungan sosial, dan perlindungan teknis. Perlindungan ekonomis mencakup jaminan pengupahan dan jaminan sosial; perlindungan sosial mencakup hak atas kondisi kerja yang layak dan nondiskriminatif; sementara perlindungan teknis meliputi keselamatan dan kesehatan kerja serta perlindungan pekerja migran. Kajian ini menunjukkan bahwa meskipun UU Cipta Kerja telah mengakomodasi prinsip-prinsip perlindungan tenaga kerja, implementasi dan pengawasan yang efektif tetap menjadi tantangan utama dalam menjamin pemenuhan hak-hak pekerja secara utuh.

Abstract

The advancement of 21st-century education demands a paradigm shift in teaching practices, including the transformation of teachers' roles from content deliverers to active facilitators. This study aims to describe the transformation of teachers' roles as facilitators in deep learning-based classroom instruction, particularly at MTs N 1 Rembang di Provinsi Jawa Tengahin Central Java Province. Addressing the persistent dominance of conventional teaching methods, this research explores how teachers transition into active facilitators who encourage student exploration, reflection, and independent learning. A descriptive qualitative approach was employed, with data collected through interviews, observations, and document analysis. The findings reveal that teachers have begun to implement contextual, interactive, and project-based learning while utilizing educational technology and formative assessment strategies. Three primary facilitator roles of teachers in deep learning contexts were identified: as motivators of learning, connectors to relevant learning resources, and assessors of students’ learning processes. This transformation encourages students to become active agents in constructing meaningful and life-relevant knowledge. Institutional support and ongoing professional development are essential to help teachers fully optimize their facilitative roles.

Abstract

Background: Urinary catheter insertion is an invasive medical procedure that often causes pain due to friction between the catheter and the urethra. This pain can lead to discomfort and stress for the patient. Based on initial observations in the Emergency Department (ED) over a period of three days, it was found that all patients undergoing urinary catheter insertion complained of pain. As an alternative pain management approach, one non-pharmacological method that can be used is a combination of Quranic murotal therapy and deep breathing relaxation techniques. This therapy is chosen because it is believed to have a calming effect and can reduce the perception of pain without the need for medication. Objective: This study aims to determine the difference in pain levels before and after the application of the combination of Quranic murotal therapy with deep breathing relaxation techniques during urinary catheter insertion in the ED. Method: This research uses a descriptive case study design involving two respondents. Both patients received an intervention consisting of Quranic murotal therapy played during the procedure, accompanied by instructions to practice deep breathing relaxation techniques. The therapy was applied during the urinary catheter insertion to assess changes in pain levels experienced by the patients. Results: The results showed that the pain level of the first respondent decreased from moderate pain to mild pain after the intervention. The second respondent experienced a reduction in pain from severe to moderate after the combined therapy was applied. Both respondents reported improved comfort after the therapy. Conclusion: The combination of Quranic murotal therapy with deep breathing relaxation techniques was proven effective in reducing pain levels in patients undergoing urinary catheter insertion in the ED. This therapy can serve as a beneficial non-pharmacological alternative for reducing pain during invasive medical procedures.

Abstract

Hypertension is the main trigger factor for stroke events, both hemorrhagic and ischemic strokes. One of the complications of hypertension is that it can cause an increase in peripheral blood pressure, causing a poor hemodynamic system and thickening of the blood vessels and hypertrophy of the heart muscle. Hypertension which continuously causes atherosclerotic plaque will trigger a stroke. Objective : to determine the results of applying dhikr therapy to reduce blood pressure in Hemorrhagic Stroke patients in the ICU. Method : Descriptive research using case studies, this application carried out blood pressure measurements before and after being given dhikr therapy, dhikr therapy was carried out 3 times a day for 3 days. Results : Blood pressure Mr. Y from 155/96 mmHg to 150/90 mmHg. Meanwhile, Mr. R from 156/116 mmHg to 148/94 mmHg. Conclusion : there was a decrease in blood pressure in both respondents after dhikr therapy.

Abstract

Background: The majority of stroke patients are in the age range of 55 years old and above. Someone who suffers from a stroke and does not immediately get assessed may experience changes in mental status, impaired speech due to facial paralysis, visual perceptual disturbances, and body paralysis, which can lead to the development of decubitus ulcers. Decubitus ulcers occur resulting from the prolonged pressures on the soft tissues that happen on bony areas against solid surfaces. The prevention of decubitus ulcers involves repositioning and mobilization. Repositioning or mobilization can also improve muscle strength and promote independence. Objective: The aim of this study is to describe the comparative final outcomes between two respondents in terms of the scale of decubitus risk before and after the implementation of mobilization. Method: A descriptive research design with a case study approach, conducted on two respondents. Results: Before the implementation of mobilization, both respondents were at moderate risk of developing decubitus ulcers. After repositioning every two hours for six days, both respondents had a low scale risk of developing decubitus ulcers and decubitus ulcers can be prevented. Conclusion: Mobilization has an influence on the degree of decubitus ulcers development in elderly stroke patients.

Abstract

Supervision is one of the systematic activities of environmental management. In the latest provision, environmental management supervision is regulated in the Ciptaker Law and several government regulations regarding risk-based business licensing. This also has implications for environmental management efforts in businesses and / or industrial activities, especially those with a high level of risk, which requires environmental approval as one of the components of the permit. Based on this, the formulation in this study is how effective the implementation of DLH supervision on industries that have a high level of risk in Boyolali Regency. This Legal Research uses empirical methods with a descriptive approach and data collection techniques with interviews. Based on the results of the study, it was found that many high-level industries in Boyolali Regency do not yet have an AMDAL as an environmental approval document as stipulated in laws and regulations. Of course, this is a problem because it is contrary to laws and regulations which are also a benchmark for the lack of effective supervision carried out by DLH. The lack of effective supervision by DLH is due to several inhibiting factors such as the lack of PPLHD and the lack of compliance of those in charge of industrial activities. However, in addition to these obstacles, several efforts have also been made to improve the effectiveness of supervision.

Abstract

The rapid growth of digital financial technology has introduced new economic instruments that require re-evaluation through the lens of Islamic economic law, one of which is Bitcoin. This study aims to analyze the legal standing of Bitcoin as a means of transaction and investment using a normative legal approach. Data were obtained through extensive literature review involving primary and secondary sources, including Islamic jurisprudence, maqāṣid al-sharī‘ah, qawā‘id fiqhiyyah, official fatwas, and contemporary technological and economic studies. The analysis employed normative and reconstructive methods to assess the compatibility of Bitcoin’s characteristics with the principles of Islamic law. The findings indicate that Bitcoin may be classified as a form of digital māl because it possesses utility, can be lawfully owned, and is tradable within open market mechanisms. However, its extreme price volatility, limited public acceptance, and absence of state-backed legitimacy make it unsuitable as a lawful medium of exchange in Islamic transactions. Conversely, Bitcoin may be permitted as an investment instrument under strict conditions, provided the activity avoids speculative motives, ensures transparency, and follows prudent financial conduct. Based on these assessments, this study concludes that Bitcoin is more appropriately categorized as a digital commodity rather than a transactional currency. This research contributes conceptually to the development of sharia-compliant crypto-asset regulations and opens avenues for further exploration on designing more stable and ethically aligned digital financial instruments.

Abstract

Historically, water resource management in Indonesia has faced significant complexities, often dominated by commercialization and investment-oriented policies that threaten the fundamental rights of farmers. The Constitutional Court’s decision to annul the previous Water Resources Law marks a crucial turning point, demanding a comprehensive policy reformulation. This entails a shift from a market-based paradigm to one grounded in human rights and social welfare, reaffirming state sovereignty over water for the prosperity of the people. The urgency of this reformulation is compounded by the imminent threat of climate change, which introduces high uncertainty into the hydrological cycle—manifesting as extreme droughts and floods—thereby directly impacting the agricultural sector. This research aims to formulate a climate-adaptive water resource management policy that secures the priority rights of farmers. Employing a Normative Legal Research Method with Statutory and Conceptual Approaches, the findings present a new, holistic legal and institu-tional framework. This framework centers on two pillars: first, the firm assertion and absolute legal protection of irrigation water allocation for farmers, even during periods of scarcity; and second, the adoption of a Climate-Adaptive Governance Model. This governance model integrates a unified climate monitoring system, resilient water infrastructure, and the empowerment of Water User Associations (P3A) at the grassroots level to independently respond to shifting climate patterns. This reformulation is essential for achieving water management that is just, sustainable, and effective in maintaining national food security

Abstract

Indonesia is still heavily dependent on fossil fuels, particularly coal and petroleum. With declining oil reserves, Indonesia is faced with an energy shortage by 2046, prompting the need for alternative solutions. However, suboptimal regulations can be an obstacle to the maximum utilization of renewable energy potential. Renewable energy is considered vital not only as an alternative to fossil energy but also as a strategic measure to maintain long-term energy supply security. Although Indonesia has large renewable energy potential, such as geothermal, wind, and solar, its utilization is still limited and not optimal. Regulations, including Presidential Regulation No. 112 of 2022, reflects the government's commitment to expand the use of renewable energy. This research uses a normative legal research method with a literature study approach. Secondary data used includes primary legal materials, secondary legal materials, and non-legal materials. Data analysis is carried out qualitatively and presented descriptively. In the discussion, the article discusses the potential of renewable energy in Indonesia, involving resources such as water, solar, wind, geothermal, and bioenergy. Regulations related to renewable energy in Indonesia are explained, including Government Regulation No. 79/2014 on National Energy Policy. There is a strong commitment from various parties, such as Commission VII of the House of Representatives, to support the development of renewable energy. The important role of regulations and policies in supporting the development of renewable energy in Indonesia. This energy transition is key to protecting natural resources, improving general welfare, and educating the nation's life, according to the objectives of the State of Indonesia as stated in the Preamble of the 1945 Constitution.
