This research is normative research. The purpose of this research is to examine the emergency constitutional law related to the concept of health emergencies as referred to in Law No. 6 of 2018 concerning Health Quarantine; and provide comprehensive analysis and formulation related to future emergency law arrangements. The research method used in this research is a statute approach and a conceptual approach; by using primary and secondary legal materials. The results of this study are the legal implications related to the determination of the health emergency status based on Presidential Decree No. 11 of 2020 has created legal uncertainty, because the government has actually issued Government Regulation No. 21 of 2020 first; is not a Government Regulation on procedures for determining and revoking the status of determining health emergencies. On the other hand, the determination of public health emergencies is not synergistic with its implementation. Furthermore, an ideal arrangement is needed in the future related to public health emergencies in order to achieve legal certainty in public health emergencies. For this reason, a harmonization of the state of danger law is needed or the establishment of a danger state law such as the omnibus bill

Indonesia sebagai negara demokrasi dengan prinsip dari rakyat untuk rakyat mewujudkan sistem tersebut dengan Pemilihan Kepala Daerah (Pilkada). Pemilihan ini dilakukan oleh seluruh warga negara Indonesia termasuk Aparatur Sipil Negara tetapi disisi lain ASN harus memegang asas netralitas yang disebutkan Pasal 2 huruf f Undang-Undang Nomor 20 Tahun 2023 tentang Aparatur Sipil Negara. Namun, kerap kali ditemui ASN yang melanggar netralitas dalam Pilkada. Tujuan penelitian ini untuk memahami tingkat kesadaran hukum ASN terhadap netralitas dalam Pilkada serta untuk memahami faktor yang mempengaruhi tingkat kesadaran hukum tersebut di lingkup Dinas Pendidikan Kota Surabaya. Metode penelitian yang digunakan yaitu yuridis empiris dengan pendekatan sosiologi hukum dan campuran kuantitatif dengan kualitatif berdasarkan studi di lapangan. Hasil penelitian ini menunjukkan bahwa 73% ASN Dinas Pendidikan Kota Surabaya sadar hukum dapat tergolong baik. Terdapat faktor pendukung yang mempengaruhi tingkat kesadaran hukum para ASN yaitu adanya sanksi, mempertahankan integritas sebagai ASN, dan adanya peraturan yang jelas. Sementara itu, faktor penghambat yang mempengaruhi tingkat kesadaran hukum para ASN yaitu kurangnya sosialisasi dan kualitas sumber daya manusia yang bermacam-macam.

Undang-Undang Nomor 3 Tahun 2022 Tentang Ibu Kota Negara (UU IKN) mengundang permasalahan dari segi formil maupun materil yang pada ujungnya menimbulkan permohonan judicial review UU IKN ke Mahkamah Konstitusi (MK) salah satunya permohonan perkara Nomor 34/PUU-XX/2022. Para pemohon mendalilkan bahwa dalam segi formilnya yakni pembuatan RUU IKN dilaksanakan sangat cepat dengan metode fast track legislation (FTL) sehingga dinilai menjauhkan dari partisipasi masyarakat yang menyebabkan kurangnya pemenuhan asas keterbukaan. Selain itu dalam prosesnya terdapat beberapa pendapat ahli yang kurang dipertimbangkan pendapatnya dan mendapatkan penjelasan atau jawaban atas pendapat yang diberikan. Pada amar putusannya Hakim MK menolak permohonan Para Pemohon untuk seluruhnya dikarenakan tidak beralasan menurut hukum. Tujuan penelitian kali ini adalah untuk Menganalisis pertimbangan hakim Mahkamah Konstitusi dalam menolak permohonan uji formil Undang-Undang Nomor 3 Tahun 2022 Tentang Ibu Kota Negara dan menganalisis akibat hukumnya. Jenis penelitian adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan studi kasus sedangkan untuk pengumpulan bahan hukum primer dan sekunder menggunakan studi kepustakaan dan teknik analisis preskriptif. Hasil dan pembahasan yang didapat adalah ditemukan bahwa kurangnya publisitas dalam penyebarluasan RUU IKN dan masih belum ditemukannya tolak ukur atau parameter meaningful participation sehingga menimbulkan inkosistensi putusan Hakim MK antara judicial review UU Cipta Kerja dan UU IKN. Konsep FTL yang masih belum ada dasar hukumnya juga menjadi permasalahan dengan ditambah tidak selarasnya peraturan mengenai keberlakuan Ibu Kota Negara yang sekarang dengan yang sebelumnya. Alhasil akibatnya putusan ini akan mengikat secara publik dan dengan masih ditemukannya masalah, kepastian hukum masih belum terjamin.

This study focuses on the legal protection for election committee workers when they experience work accidents during general elections within the environment of the General Election Commission (General Election Commission or KPU). General elections are a cornerstone of democracy that determines the direction and leadership of a nation. In Indonesia, election organizers including the District Election Committee (Kecamatan Election Committee or PPK), Voting Committee (Positioning Committee or PPS), and Voting Organizing Group (Kelompok Organizing Pemulungan Pemulungan or KPPS) may face risks of accidents while performing their duties. This research utilizes normative research methodology, focusing on the study of legal documents and applicable regulations. The aim is to delve deeper into the legal aspects and protections that need strengthening to ensure the safety and well-being of election committee workers in carrying out their tasks. Considering the significant number of casualties during this democratic event, this study highlights the importance of health guarantees for these ad hoc bodies, which have not been sufficiently regulated in the Election Commission Regulations (Peraturan Election Commission General or PKPU). Additionally, the research examines the role of the Social Security Organizing Agency (Social Security Organizing Agency or BPJS) in providing social protection for election committee workers and the challenges faced in implementing employment social security at the regional level. The results underscore the need for policy improvements and increased collaborative capacity with relevant parties to conduct fair, transparent, and accountable elections that strengthen democracy in Indonesia.

Pada tahap kampanye pemilu ada pembatasan berdasarkan lokasi atau tempat tertentu sebagaimana tercantum dalam Pasal 280 ayat (1) huruf h UU Pemilu. Dalam perkembangannya, terdapat permohonan uji materiil terhadap penjelasan norma a quo yang diajukan oleh dua Pemohon. Para Pemohon mendalilkan objek permohonan a quo mengakibatkan kerugian konstitusional terkit hak untuk memilih dalam pemilu yang dilaksanakan secara adil dan hak mendapatkan kepastian hukum yang adil. Dalam Putusan MK Nomor 65/PUU-XXI/2023, permohonan ini dikabulkan untuk sebagian. Tujuan penelitian ini adalah untuk menguraikan dan menganalisis pertimbangan hukum Hakim Konstitusi yang mengabulkan permohonan para Pemohon untuk sebagian dan menganalisis akibat hukumnya terhadap netralias ASN. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual dengan menggunakan bahan hukum primer, sekunder, dan tersier. Hasil penelitian ini menunjukan bahwa Mahkamah menggunakan penafsiran historis atau orisinal dalam menentukan ada atau tidaknya pertentangan antara Penjelasan Pasal 280 ayat (1) huruf h UU Pemilu dengan norma pokoknya, ditemukan kesalahan teknis dalam perumusan penjelasan norma a quo dan Mahkamah memberikan putusan ultra petita dengan memperbolehkan kampanye di fasilitas pemerintah dan tempat pendidikan dengan syarat mendapat izin dari penanggung jawab tempat dimaksud dan hadir tanpa atribut kampanye. Putusan tersebut akan membahayakan netralitas ASN karena kedua tempat tersebut banyak diisi atau tempat para ASN beraktivitas. Apabila Pegawai ASN melanggar netralitas ASN, maka akan dikenakan hukuman disiplin sesuai dengan PP No. 94 Tahun 2021. Kata Kunci: Putusan MK, Kampanye Pemilu, Netralitas ASN.

The 2021 Homecoming Circular Letter was issued to regulate public mobility during the Eid homecoming period as part of the government’s effort to control the spread of COVID-19. As an instrument created under urgent circumstances, the Circular Letter reflects the implementation of freies ermessen, allowing authorized officials to exercise discretion. This study aims to analyze the legal position and implications of the 2021 Homecoming Circular Letter, especially in relation to the principles of discretionary authority and statutory hierarchy. The research is normative in nature, using a statutory and conceptual approach. Legal materials were obtained through literature study and analyzed prescriptively to evaluate the consistency of the Circular Letter with existing legal norms. The findings show that Circular Letters are not explicitly included in Law Number 12 of 2011 concerning the Formation of Laws and Regulations. However, they may still carry binding power if supported by higher legal instruments such as Government Regulation No. 21 of 2020 and Presidential Decree No. 11 of 2020. Substantively, the 2021 Circular Letter aligns with Law No. 6 of 2018 on Health Quarantine. The authority of the COVID-19 Task Force to issue the Circular is justified in the context of pandemic-related emergency response. The study recommends that the issuance of Circular Letters must not contradict the hierarchy of laws and should emphasize public benefit, clarity, and legal certainty, particularly in times of crisis when government discretion is exercised.

This study aimed to analyze legal politics and determine the broad guidelines of state policy based on the 1945 Constitution of the Republic of Indonesia. This study was included in the type of legal study with a statutory approach, a conceptual approach, and a historical approach. The People's Consultative Assembly did not establish the main points of state policy. However, they were jointly formed by the President, the People's Representative Council, and the Regional Representatives Council because the People's Consultative Assembly was no longer located as the highest state institution. The construction of the broad state policy guidelines, designed by the candidate for President or Vice President and his coalition before the general election, was then ratified into law if it had been elected as President. The regulatory period for the state law was designed for five years to make the legal norms more concrete.

Objective: The mechanism for dismissing the President and/or Vice President in Indonesia is regulated by the 1945 Constitution. This process is initiated by the House of Representatives submitting a proposal to the People's Consultative Assembly, stipulating that the President and/or Vice President has violated the provisions in Articles 7A and 7B, and this must be proven first by the Constitutional Court through examination and proof. If it is proven that the President and/or Vice President has violated these provisions, the results of the Constitutional Court trial will be submitted to the People's Consultative Assembly. Subsequently, the People's Consultative Assembly is obliged to hold a trial to decide whether the President and/or Vice President will be impeached. Article 7A of the 1945 Constitution of the Republic of Indonesia regulates the impeachment of the president and the provisions related to the presidential office in Indonesia. Method: According Mahmud Marzuki, this normative legal research, as it is defined entails the process of finding, comprehending and solving legal problems embracing the practice rather its theory. This work in particular focuses on the way in which the House of Representatives can investigate and possibly remove the President and Vice President from their offices. Result: Some of the author's findings related to the essence of impeachment in the Indonesian constitution are, first, to maintain a system of checks and balances in the presidential office through oversight. Second, the direction of the presidential impeachment regulations needs to be improved by clarifying the reasons and mechanisms for impeachment, aiming to avoid dismissing the president for political rather than legal reasons. Novelty: The present study also analyzes the Indonesian Constitution of 1945 about presidential removal from office, stressing the weak legal rationale as well as the appropriate procedure to remove a president to avoid the potential manipulation for political gains. This calls for regulatory improvement to improve checks and balances in order to prop up a better legal framework of fair and constitutional presidential accountability.

Constitutional changes are part of the political and legal dynamics of a country. Changes to the constitution aim to meet the legal demands and needs of the community so that they are clearly and firmly regulated in the constitution. This paper is oriented towards the idea of a formal review of constitutional changes in Indonesia. This research is a normative legal research. The approach used in this research is a conceptual approach, a comparative approach, and a statutory approach. The primary legal materials in this study include the text of the 1945 Constitution of the Republic of Indonesia, constitutional texts in various countries and the Constitutional Court Decision No. 91/PUU-XVIII/2020. Secondary legal materials include: books, journal articles, and websites related to the constitution and constitutional law. Non-legal materials include legal dictionaries. The results of the study indicate that a formal review of constitutional changes is needed as an effort to maintain the supremacy of the constitution, including also placing the court's function as guardians of the law and the constitution in dealing with the determination of non-legal aspects in constitutional changes

Fenomena yang saat ini sering terjadi pada bidang hukum pemerintahan adalah banyaknya kasus yang melibatkan Pegawai Negeri Sipil (Selanjutnya disebut PNS) yang terlibat penyalahgunaan narkotika. Pada Putusan Nomor 101/Pid.Sus/2020/PN.Mks melibatkan seorang PNS yang bernama Muh Arisin yang dinyatakan terbukti bersalah melakukan percobaan atau pemufakatan jahat memiliki, menyimpan, menguasai Narkotika yang kemudian dijatuhi hukuman pidana penjara selama 1 tahun 6 bulan. Penyimpangan perilaku PNS yang menyalahgunakan narkotika merupakan pelanggaran berat dan mendapat ancaman pemberhentian secara tidak hormat sebagaimana yang diatur dalam pasal 87 ayat (2) Undang-undang Nomor 5 Tahun 2014 tentang Aparatur Sipil Negara (Selanjutnya disebut UU ASN). Penegakan hukum terhadap PNS yang melakukan tindak pidana saat ini dirasakan masih jauh dan harapan dan belum mampu secara maksimal memberikan efek jera kepada para PNS. Berdasarkan permasalahan tersebut, maka penelitian ini bertujuan untuk menganalisis mengenai menetralis PNS yang sudah divonisterpidana narkotika kurang dari 2 tahun. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan melakukan pengumpulan bahan-bahan hukum serta bahan non hukum untuk menganalisis permasalahan yang diteliti. Berdasarkan hasil penelitian, PNS yang menjadi tersangka penyalahgunaan narkotika yang dihhukum pidana penjara dibawah 2 tahun dapat dibeherhentikan dengan pemberhentian sementara waktu. Selain pemberhentian sementara waktu, PNS yang diberhentikan sementara tidak mendapatkan penghasilan. Kemudian bagi PNS yang terjerat tindak pidana dengan pidana penjara kurang dari 2 tahun namun tetap diberhentikan tersedia sarana yang berdasarkan peraturan perundang-undangan yang berlaku diperuntukkan bagi PNS yang merasa diperlakukan tidak adil, sehungga dapat mencari keadilan melalui sarana perlindungan hukum yang ada.
