Abstract

The Permit to Open State Land (Izin Membuka Tanah Negara – IMTN) is an administrative instrument used by the Balikpapan City Government as a preliminary requirement for controlling state land prior to the formal registration of land rights. In practice, IMTN is often perceived by the public as a form of land ownership, which has led to legal ambiguity regarding the division of authority between local governments and the National Land Agency (Badan Pertanahan Nasional – BPN). This study aims to analyze the legal status of IMTN within the national land registration system and to examine its implications for legal certainty of land rights in Balikpapan City. The research employs a socio-legal approach combining normative juridical and empirical methods, through an analysis of relevant legislation and interviews with sub-district officials and the Balikpapan City Land Office. The findings indicate that IMTN does not constitute a legal basis for land ownership, but rather serves as an administrative permit functioning as preliminary evidence of physical control over state land. Consequently, IMTN cannot substitute for a land title certificate issued by BPN. The dual perception of IMTN has the potential to create legal uncertainty and overlapping authority between local governments and land administration institutions. This study recommends regulatory harmonization and strengthened institutional coordination to ensure legal certainty in land registration.Keywords: Permit to Open State Land (IMTN); Land Registration; Legal Certainty; Local Government; Balikpapan

Abstract

Indonesia’s legal system is characterized by legal pluralism, in which state law coexists with customary law (adat) practiced by indigenous communities. Despite constitutional recognition and supportive judicial decisions, conflicts over customary land persist, particularly among Dayak indigenous communities in Kalimantan. These conflicts largely arise from structural incompatibilities between state land law—centered on administrative legality, formal registration, and written evidence—and customary law, which is grounded in communal ownership, oral traditions, and social legitimacy. This article analyzes conflicts between Dayak customary law and state law in the governance of customary land from a legal anthropology perspective. It examines the operation of Dayak customary law as a living law, identifies the causes and forms of conflict with state legal regimes, and assesses the implications of these conflicts for customary land governance and legal certainty. The research employs a qualitative legal-anthropological approach. Data were collected through in-depth interviews with customary leaders, community members, and relevant stakeholders, complemented by participant observation and document analysis. The data were analyzed using descriptive and interpretative methods, drawing on the concepts of legal pluralism and semi-autonomous social fields. The findings demonstrate that Dayak customary law remains effective in regulating land control, use, and dispute resolution at the community level. However, conflicts persist due to the dominance of formal state legal mechanisms that marginalize customary authority in land administration, licensing, and development processes. Normative recognition of indigenous rights alone has proven insufficient to secure legal protection for customary land. The study argues that substantive integration of customary institutions into state land governance frameworks is essential to reduce conflict, enhance legal effectiveness, and ensure meaningful protection of indigenous land rights.

Abstract

Kostitusi telah mengamanatkan kepada negara untuk mengakui dan menghormati kesatuan masyarakat hukum adat beserta segala hak-haknya. Terhadap amanat tersebut kemudian secara teknis dilaksanakan oleh pemerintah sebagai penyelenggara negara. Dalam tataran yuridis telah banyak produk hukum yang diundangkan oleh pemerintah dalam hal memberikan dasar kepastian hukum untuk memberikan ruang kepada masyarakat hukum adat dalam konteks untuk menjaga eksistensi mereka. Namun hal itu, belum memberikan jaminan dalam tataran praktek bagi terjaganya eksistensi masyarakat hukum adat, konflik-konflik yang berimbas pada terampasnya hak masyarakat hukum adat masih marak terjadi. Hingga pada tahun 2014 lalu pemerintah melalui kementerian dalam negeri mengeluarkan Permendagri Nomor 52 tahun 2014 tentang Pedoman Pengakuan dan Perlindungan Masyarakat Hukum Adat, permendagri ini kemudian cukup memberi harapan bagi masyarakat hukum adat dalam hal membantu untuk menjaga eksistensi mereka melalui penetapan kepala daerah.

Abstract

This research aims to examine and analyze the regulation of Sasi customary law and the effectiveness of Sasi law in the right to conserve natural resources in Ambon society. This research is conducted using empirical legal research method. The results of the study show that Sasi customary law plays an important role in the conservation of natural resources of the Ambon community. Sasi customary law provides general guidelines on human behavior, establishes women's rights, prevents crime, distributes natural resources fairly, and determines how to manage natural resources at sea and on land.This research is also to determine the effectiveness of sasi customary law in saving the natural resources of the Ambon community, and that sasi customary law is able to be applied amidst social, economic and environmental changes in natural resource management, and researchers also examine the obstacles and challenges of implementing sasi customary law and evaluate the role of government and related stakeholders ini supporting natural resource conservation. Based on data analysis, there is a gap between the application of Sasi customary law and the real need to preserve environmental functions. As a recommendation, efforts are needed to create synergy between Sasi customary law and  regulation which applies, like Basic Agrarian Law, for ensure conservation sustainability and can provide insight into customary law which ca contribute to the conservation of natural resources. Strengthening the Ambon community's understanding and awareness of the importance of Sasi customary law is also key to improving its effectiveness.

Abstract

This study aims to analyze land policies before and after the establishment of the National Capital City (IKN), including regulations on restrictions or freezes on land rights transfers, as well as regulations on land acquisition, and their impact on local communities, both indigenous and non-indigenous. The method used is an empirical legal approach or socio-legal studies that focus not only on norms but also on the context of their enforcement in the IKN area, particularly in North Penajam Paser Regency. This is done by analyzing facts in the field related to land regulations in the IKN area, which directly impact local communities. The novelty of this research lies in the dynamics of regulations issued before and after the establishment of the IKN, particularly in terms of land, ranging from the freezing of transfer of rights to land acquisition for the development of the IKN, which has implications for conflicts over the living space of local communities. The results of this study found that the land regulations that have been in place since the establishment of the IKN have had an impact on the control and use of community land, where conflicts have been triggered by the lack of transparency in the development process, compensation issues, and the suspension of land rights registration. The concluded that land regulations related to the development of the IKN have an impact on the control and use of land by local communities. Legal efforts to resolve land tenure issues in the IKN need to be differentiated based on when the issues arose. Problems that occurred before the establishment of the IKN should be resolved through non-litigation efforts such as negotiation and mediation, while post-establishment IKN issues should be addressed by adjusting the implementation of the land acquisition scheme to the existing conditions in the field.

Abstract

Perceraian merupakan hal yang harus dihindari dalam suatu perkawinan, namun karena adanya konflik dan perbedaan tujuan antara kedua pihak yang menjalankan rumah tangga sehingga seringkali perceraian menjadi pilihan. Dalam hal ini hukum adat Dayak Benuaq juga berusaha untuk mengakomodir hal tersebut dengan menyelenggarakan sidang adat untuk menyelesaikan perkara perceraian. Lembaga Adat yang dalam hal ini berwenang menyelenggarakan sidang adat juga berwenang mengeluarkan putusan berupa Surat Keterangan Cerai Adat yang kemudian menjadi bukti bahwa pasangan tersebut telah sah bercerai. Tujuan penulisan ini adalah untuk mengetahui bagaimana putusan yang dikeluarkan oleh Lembaga Adat dalam perkara perceraian menurut mekanisme hukum adat Dayak Benuaq, yang untuk menjawabnya menggunakan pendekatan sosiolegal dengan melakukan wawancara dengan berbagai pihak yang terkait serta tetap membutuhkan pendekatan doktrinal untuk mengkaji peraturan perundang-undangan yang terkait. Dengan adanya kekuatan hukum tersebut maka suatu putusan dapat mengikat kedua belah pihak yang bercerai serta mampu melindungi hak dan kewajiban masing-masing pihak.
