Abstract

This research purposes to recognize the crime of corruption that occurs can injure the justice of society, then also want to know the lightness of the judge's decision in corruption and its implications for a sense of justice. The research method that I use in this paper is a normative juridical research method by multiplying data sources through documentation research on secondary data. The results of the study show that corruption can harm the justice of society, this is because the perpetrators of corruption have taken people's rights against the law, the perpetrators of corruption hamper the progress of the nation, corruptors corrupt democracy and afflict the people. The lightness of judges' decisions in corruption cases has implications for people's sense of justice. This is because the judge's decision is the crown and the culmination of the reflection of the values of justice, essential truth and human rights. The judge is the spearhead of justice for society.”

Abstract

This study aims to determine the forms of corruption committed by state officials to enrich themselves in their activities as public officials and the content of criminal acts for perpetrators in state finances in Indonesian law. The research method used in this paper is a normative legal research method with data collection techniques in the form of secondary data obtained from various kinds of reading materials relevant to the problem. The data can be obtained and collected, processed and analyzed to answer the existing problem. The result of the study is that the form of corruption of public officials is to abuse their authority with elements against the law and result in state financial losses. The contain of criminal weighting for perpetrators of criminal acts of corruption is that the perpetrators can be sentenced to the death penalty by the provisions of the Corruption Crime Act. The weighting of this crime becomes important, robs the people of rights that are contrary to the values of public justice. Indonesia should be able to follow in the footsteps of the Chinese state that death punishes the thieves of state money severely

Abstract

AbstrakPenelitian ini bertujuan untuk mengetahui peran kejaksaan sebagai lembaga penegak hukum bidang penuntutan dan juga ingin mengetahui peran surat dakwaan jaksa penuntut umum dalam penegakan hukum kejahatan korupsi dalam sistem peradilan pidana Indonesia. Metode yang penulis gunakan dalam penulisan ini adalah metode penelitian hukum yuridis normatif dengan menggunakan data sekunder yang berasal dari bahan-bahan hukum yang relevan dengan masalah yang diteliti. Hasil penelitian menunjukkan bahwa peran jaksa sebagai lembaga penegak hukum bidang penuntutan yang diberi kewenangan membuat surat dakwaan khususnya dalam hal pemberantasan korupsi memiliki arti yang sangat penting  dalam mewujudkan tercapainya tujuan hukum. Hal ini dikarenakan jaksa merupakan bagian dari sub sistem peradilan pidana yang ada di Indonesia. Sebagai sub sistem jaksa memiliki kewenangan dalam hal pemberantasan korupsi dengan memberikan tuntutan pidana paling berat kepada pelaku korupsi melalui surat dakwaannya.”

Abstract

The rise of cybercrime has caused the public to worry about criminal acts of theft and falsification of personal data in electronic form. Therefore, the government is obliged to provide protection to the public from all forms of disturbances caused by misuse of information technology and digital transactions. Based on this, this research aims to find out and understand what are the obstacles for BSRE as an agency providing electronic certificate management services which cannot provide services in general. Then, does BSRE's authority to provide general electronic certificate services to the public conflict with statutory regulations? The method used in preparing this research is the Normative Law research method with the data source, namely secondary data collected through literature study. The research results show that the obstacle for BSrE as an agency providing electronic certificate management services is that it cannot provide services in general because it is still separated by agency and non-agency provisions which limit the scope of BSrE in providing electronic certificate services to the public/general public. Furthermore, BSrE as an electronic Certification Organizer only serves the public as Indonesian citizens who have the status of government or agency employees.  Keywords: Security Strategy; Certification; Electronics.

Abstract

This study uses a normative juridical research method through literature study by collecting secondary data. In this study, it was found that the discussion about corruption never ends. Legal subjects that can be held accountable come one after another. The legal subject in this case is "any person who unlawfully commits an act of enriching himself or another person or a corporation that can harm state finances or the state economy." Regarding punishment for legal subjects who commit criminal acts of corruption, especially in certain circumstances, namely punishment toughest to death penalty.Keywords : Punishment, Legal Subject, Corruption.

Abstract

Problems on Lesbian, Gay, Bisexual, and Transgender (LGBT) in social life seem to be more real currently. Even though religions prohibit the behaviors of LGBT, the positive law, which is Law no.1 of 1946 on Criminal Code, does not regulate legal sanctions on LGBT. This article studies the importance of positive laws that regulate legal sanctions on the actors who practice LGBT in public. Still, as important as others, this article also tries to find out the causes of sexual disorder behaviors of LGBT. This research applies the method of normative law. Still, this research was conducted by studying the literature and collecting secondary data. After gaining the data, they were analyzed to answer the formulated problems. The research results show there must be legal sanctions on LGBT behaviors. The nation should not punish LGBT-infected people, but she must punish the people who practice LGBT in public. There are many factors causing LGBT. They are the influence of environment, childhood trauma, same-sex harassment or abuse, inferior feeling and fear of loving the opposite sex, family problem such as divorced parents, etc

Abstract

As a state of law, Indonesia highly upholds the legal values existing in societies. By highly upholding the legal values indicates that Indonesian is a nation who abides the law. One of the laws that must be abided by people is criminal law sourced from the Criminal Code or as familiarly known as KUHP. As a positive law Criminal Code (KUHP) is prevailing all over the territorial of Republic of Indonesia and shall be a guide for the entire legal apparatus to impose sanction for violation and crimes. Unfortunately, the Criminal Code which is currently used by the law enforcers as a guide and reference to punish the guilty persons is no longer appropriate with the cultural value of our nation. Actually Criminal Code as the colonial law product is not relevant any longer with the condition of the era and ideology of Indonesian. It is impossible that Indonesia that have been feeling independence for decades but still use the law product of the nation who had occupied it. Consequently, it is urgent that the Indonesian criminal law renewal must be carried out and cannot be negotiable.

Abstract

This research aims at finding out the legal protection of copyright according to positive laws of Indonesia, and the types of legal sanctions rendered if there is an infringement on the economic rights of a songwriter. This research applies the juridical normative method to literature studies. The data which is presented in this research is secondary data. The findings show that the protection over works on songs in Indonesia has been provided by Law No. 28, 2014 concerning Copyrights. The law states that a song is one protected intellectual property. In its practice, the protection over copyright follows the automatic protection system, which means that the protection is without the process of recordation. The legal consequence is that every person who illegally commits a copyright crime, either for economic rights or for commercial use, shall face criminal sanction. Besides, the other parties other than the creator can be prohibited to exploit the creator’s economic rights. Within the sanction, other parties besides the creator are prohibited to exploit the creator’s economic rights.

Abstract

The discourse surrounding the legalization of Class I narcotics, particularly marijuana (Cannabis Sativa), as one of the alternative medical treatments, has been continuously debated for the past few years. Various studies have been advancing with technological progress, prompting some other countries to start legalizing marijuana for medical purposes with certain restrictions. In Indonesia, there is a clear law, namely Law Number 35 of 2009 concerning Narcotics, which imposes restrictions and prohibitions on the use of various narcotics. Violators of these regulations are subject to criminal sanctions. In this legal research, the author will conduct a literature study using a statutory approach, which involves examining all relevant laws and legal regulations related to narcotics and the legality of the policy on the use of Class I narcotics as alternative medical treatments, such as the 1945 Constitution of the Republic of Indonesia (UUD 45), Law Number 35 of 2009 concerning Narcotics, Law Number 17 of 2023 concerning Health, and Law Number 39 of 1999 concerning Human Rights. The research findings indicate that juridically, the Narcotics Law, especially Article 6 paragraph (1) letter a and Article 8 paragraph (1), prohibits the use of Class I narcotics for medical purposes, which is clearly contradictory to Article 28C paragraph (1) of the 1945 Constitution where every person has the right to develop themselves through the fulfillment of their basic needs, the right to education, and to benefit from science and technology, arts, and culture, for the purpose of improving their quality of life and the welfare of humanity. Furthermore, the Health Law does not specifically regulate the use of marijuana for medical purposes, but only addresses general regulations regarding the use of narcotics. It is hoped that the results of this research can become a reference for policy makers to legalize the use of marijuana as an alternative treatment.

Abstract

Tujuan dari pelaksanaan Pengabdian Kepada Masyarakat yang berjudul “Sosialisasi dan Pelatihan E-Litigasi di Lembaga Bantuan Hukum Unggul Tangerang Selatan Guna Meningkatkan Profesionalisme dalam Rangka Pendampingan Masyarakat Pencari Keadilan Melalui AplikasiKomputer” adalah sebagai upaya pemenuhan kewajiban Tri Dharma Perguruan Tinggi. Pengabdian Kepada Masyarakat dilakukan di LBH Unggul yang berdomisili kantor di Villa Pamulang Jl. Ismaya II Blok U 11 No 29 Pamulang, Tangerang Selatan, Banten pada tanggal 24 November 2019.Berdasarkan hal di atas, kegiatan pengabdian kepada masyarakat dengan memberikan informasi dan atau tambahan pengetahuan mengenai sistem e-litigasidalam rangka mendukung penggunaan teknologi di Pengadilan merupakan suatu hal yang bermanfaat. sebagai wujud eksistensi Perguruan Tinggi yang bertujuan untuk memberikan konstribusi besar kepada pengembangan dan penerapan ilmu kepada masyarakat.Metode yang digunakan pada Pengabdian Kepada Masyarakat ini berupa ekspositori yaitu penyampaian materi secara verbal dan inquiry yaitu pembelajaran yang menekankan pada proses berpikir kreatif kritis dan analitis terkait penggunaan sistem elitigasidalam peradilan cepat untuk menghindari pungutan liar serta peluang korupsi yang mungkin terjadi di Pengadilan.Hasil Pengabdian Kepada Masyarakat yang diperoleh adalah beberapa pengacara yang tergabung dalam LBH Unggul sudah mulai mendaftarkan akun e-courtnya dan menambah pengetahuan dalam penggunaan fitur-fitur dalam sistem e-court dan elitigation.Kegiatan ini diharapkan mampu memberikan gambaran serta informasi berkaitan dengan cara penggunaan sistem e-litigation sebagai fasilitas berbasis teknologi dalam upaya pembayaran perkara serta birokrasi lainnya dengan basis online kepada pengacara di LBH agar dapat menyelesaikan kasus perkara lebih efisien dan cepat.Kata Kunci : Pengabdian, E-Litigation, Pengadilan, Teknologi
