Abstract

This study discusses cartel practices in the rice supply chain with a focus on the implications of the Indonesian Farmer Shop (TTI) program. The complex rice supply chain has affected the price of consumer rice and farmers' grain. This study uses a qualitative approach with a normative juridical method and organized crime theory. The results of the study show that although the TTI program has a clear basis, cartel practices emerge due to the domination of actors in rice marketing and laxity in implementing policies. The TTI program creates shorter supply chains, but cartel practices still exist. This research reveals that cartel practices arise from the implementation of the TTI program which is controlled by certain parties with strong control. Obstacles in bookkeeping and supply management also influenced the emergence of cartels. Cartel practices arise not because of regulations, but because of their implementation which tends to be abused by cartel actors.

Abstract

This article explores the limitations of using physical force in educating children in Indonesia. It examines the prevalence of violence by parents and teachers in education. Increased public awareness and concern for children's rights have made the use of violence in education a taboo. This research uses a qualitative method with secondary data using literature and analysing court decisions from the human rights perspective. This study aims to determine the limits of tolerance for violence and corporal punishment. The court decisions have been taken as the data to be analysed from various locations where decisions have been issued were taken into consideration to depict the similarities and differences in deciding matters related to corporal punishment towards children. This article examines historical, cultural, and religious factors that influence the use of physical force, including interpretations of Islamic teachings. This paper also presents arguments for and against corporal punishment as an educational tool. This research sheds light on the complexities surrounding the permissibility of physical force in children's education and the conflicting views in society, providing insight into evolving understandings and legal perspectives on the subject.

Abstract

Pandemi Covid-19 yang saat ini melanda dunia, temasuk Indonesia, telah membawa perubahan dalam berbagai aspek kehidupan, termasuk pada aspek hukum. Sebagai ujung tombak dari sistem peradilan pidana di Indonesia, Direktorat Jenderal Pemasyarakatan Kementerian Hukum dan HAM turut menjunjung tinggi hak asasi manusia dengan menerbitkan Permenkumham No. 43 Tahun 2021. Dengan diterbitkannya Permenkumham No. 43 Tahun 2021 menjadi solusi dan terobosan untuk menekan lajur penularan covid 19 di lingkungan lapas, rutan, dan lpka. Di mana ketiga tempat tersbut merupakan institusi tertutup yang memiliki tingkat hunian tinggi sehingga sangat rentan terhadap penyebaran dan penularan virus covid-19. Namun dalam praktiknya masih terdapat beberapa permasalahan yang muncul terkait aturan ini, antara lain pengulangan tindak pidana yang dilakukan oleh narapidana, rasa ketidakadilan terhadap korban, dan diskriminasi masyarakat terhap para narapidana. Berdasarkan permasalahan tersebut, tulisan ini ingin mengkaji tentang implementasi dan dampak kebijakan tersebut. Penelitian ini merupakan penelitian descriptive legal study guna memperoleh gambaran secara integral dan komprehensif serta sistematis. Hasil penelitian menunjukkan bahwa implementasi kebijakan pengeluaran narapidana melalui asimilasi di rumah dan reintegrasi sosial masih belum maksimal, baik dari segi struktur hukum, subtansi hukum, maupun budaya hukum. Dampak positif dari pelaksanaan aturan tersebut antara lain, pengurangan penghuni lapas sebagai upaya pencegahan penularan covid-19, anggaran negara berkurang, dan optimalisasi pembinaan di lapas, sedangkan dampak negatif antara lain adanya pengulangan tindak pidana oleh narapidana asimilasi dan reintegrasi dan meningkatnya kecemasan masyarakat..

Abstract

Tulisan artikel ini bertujuan untuk mengkaji optimalisasi pendekatan keadilan Restorative Justice terhadap penyalahgunaan narkotika di Indonesia sebagai solusi terhadap lapas yang over kapasitas dengan menggunakan metode penelitian yuridis normatif. Hasil penelitian ini menunjukkan bahwa dengan adanya pedoman penerapan Restorative Justice yang telah dikeluarkan oleh Mahkamah Agung yang sifatnya wajib dipedomani oleh seluruh perangkat pengadilan negeri di Indonesia serta didukung pula dengan pedoman keadilan restoratif yang telah dikeluarkan oleh jaksa agung, sebagaimana yang diketahui jaksa selaku pengendali perkara berdasarkan asas dominus litis dapat melakukan penyelesaian perkara tindak pidana penyalahgunaan narkotika melalui rehabilitasi pada tahap penuntutan,dengan demikian diharapkan dapat menjadi solusi terhadap keadaan lapas di Indonesia yang over kapasitas, sebagaimana diketahui setengahnya merupakan napi penyalahgunaan narkotika.

Abstract

Dewasa ini diperkirakan jumlah anak Indonesia usia di bawah 14 (empat belas) tahun yang secara ekonomis aktif adalah sekitar 2 (dua) sampai 4 (empat) juta anak. Tetapi sekadar angka saja, tidak dapat menggambarkan penderitaan fisik, intelektual, emosional dan moral yang harus ditanggung pekerja anak. Angka itu tidak mengungkapkan bagaimana hari depan seseorang anak yang tidak berpendidikan, hari depan seseorang tanpa harapan akan perbaikan. Pertanggungjawaban pelaku tindak pidana perdagangan anak terdapat di dalam Pasal 83 Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak. Pemerintah diharapkan dapat membuat Undang-Undang Tindak Pidana Perdagangan Orang yang lebih komperhensif. Adanya sanksi hukum yang lebih berat terhadap semua pihak yang terlibat didalam praktek Perdagangan Manusia.

Abstract

The position of fatwa institutions in cases of blasphemy by cult groups is often seen as representing only the majority Muslims and blaming minority Muslims, as in Indonesia, or seen as a tool to suppress anti-government groups, as in Malaysia. This study aims to explain the position of the Indonesian Ulema Council (MUI) and Jawatankuasa Fatwa in handling heresy, including the reasons behind the differences in the positions and roles of the two institutions. Researchers use qualitative methods with a comparative legal approach. This study found that MUI's heretical fatwas had no legal force, the central MUI has the authority to enact heretical fatwas within MUI institutions, but not absolutely to respond to national laws, and not play a role in the criminal justice system. Meanwhile, Jawatankuasa Fatwa Kebangsaan (JFK) has the force of law with certain conditions, however, the federal state Jawatankuasa Fatwa has the authority to determine heretical fatwas to respond and strengthen state regulations (blasphemy laws). This research can be used as a reference for law enforcement in handling blasphemy cases by considering the views of MUI and Jawatankuasa Fatwa, which are regulated adequately by laws and regulations.

Abstract

The issuance, printing, production, and distribution standards of Indonesian travel documents refer to international standards of travel documents and the Regulation of Minister of Law and Human Rights. However, significant issues have risen that the Indonesian passport holders without the bearer’s signature who applied for German visa were rejected by the Embassy of Federal Republic of Germany in Jakarta. Besides, the stolen and lost Indonesian Passport policy is fragmented between the Indonesian National Police, Immigration offices and the Interpol. Using the document analysis and policy evaluation, this paper investigates the issuance standards of Indonesian travel documents under the ICAO Document 9303 about Travel Documents and the policy and management of the stolen and lost Indonesian travel documents. This study shows the Indonesian travel documents have not fully complied with the ICAO Doc 9303 in which the bearer’s signature is a compulsory either in the biodata page or in additional pages. Data of stolen and lost Indonesian Passport have not been recorded in the Interpol Stolen and Lost Travel Documents (SLTD) database. We propose the infrastructure of the security, cooperation, and management of the SLTD, and all Indonesian travel documents must be redesigned and equipped with the chip features.

Abstract

Discretion is used as a solution to deal with the problem of the principle of legality in terms of governance that is not regulated by law. On the other hand, discretion is relevant to corruption where the actions of state officials and corrupt government will hinder the achievement of state goals. Therefore, it is necessary to identify who is responsible for the misuse of discretion. In this article, we will discuss the implementation of vicarious liability in corruption related to the administration of regional government administration in order to effectively impose criminal sanctions on corruptors in the misuse of discretion in the context of administering government administration. Abstract

The police are one of the many law enforcement officers who have the authority to carry out investigation and investigation duties for all criminal cases. Street crime is one of the many crimes classified as a criminal element that is still developing in society and often causes disturbances in security and order. The COVID-19 pandemic gives an indication of a significant increase in street crime, including in the jurisdiction of the South Tangerang Police. This study tries to see the effectiveness of law enforcement, especially the prevention of street crime from the pre-emptive aspect in the jurisdiction of the South Tangerang Police and identify important factors that affect.

Abstract

Maritime immigration control and inspection at Indonesia's sea borders encounter significant difficulties due to poor coordination and collaboration among border authorities. This study explores the implementation of maritime immigration regulations in Indonesia, highlighting their lack of alignment with international standards, particularly in terms of border immigration management and inter-agency cooperation. The research aims to assess the existing legal framework and procedures for immigration control and inspection at Indonesia's maritime borders. The methodology applies both internal and external policy evaluations, conducted through an analysis of national regulations and interviews with relevant agencies. The findings show discrepancies between national regulations and international standards, along with weak border immigration management and inadequate coordination, leading to inefficiencies in maritime border control and inspection. This study contributes to providing a framework for maritime border management, the aspects of control and inspection at Indonesia's maritime borders, and redefining the phases of immigration control and inspection in these areas.
