Abstract

This study aims to analyze the level of public understanding in Ranto Natas Village regarding the dangers of drugs, online gambling, and online loans, which have become pressing issues in Indonesia. The research employed a qualitative method through literature review and field observation. The findings indicate that most villagers demonstrate a relatively high awareness of these threats, supported by the roles of religious leaders, community figures, village authorities, and educational programs such as the KKN STAIN Madina. Nevertheless, a small portion of residents remain vulnerable, particularly to drug abuse and online gambling, driven by economic hardship, low education, weak family supervision, and extensive access to technology. This study contributes to strengthening preventive strategies through community-based education, digital literacy, and family involvement to safeguard young generations from the adverse impacts of drugs, online gambling, and illegal online loans.

Abstract

Objektif. Desa Tangga-Tangga Hambeng adalah desa yang berada di Kecamatan Padang Bolak Tenggara, Kabupaten Padang Lawas Utara, Provinsi Sumatera Utara. Semakin berkembangnya zaman, pengetahuan manusia semakin luas. Pada mulanya manusia hanya memanfaatkan apa yang ada di alam, namun sekarang manusia sudah mengelola apa yang ada di muka bumi. Semakin berkembangnya zaman, peradaban semakin berkembang dan canggih. Apabila zaman dahulu komunikasi dilakukan secara manual, tetapi sekarang sudah ditemukan teknologi-teknologi canggih yang membawa ke bentuk digital. Material and Metode. Pengabdian ini menggunakan metode partisipatif melibatkan warga dan NNB di Desa Tangga-Tangga Hambeng. pendekatan yang digunakan yaitu bekerja sama dengan masyarakat untuk memperoleh data Hasil. Pengabdian masyarakat berfokus pada pemanfaatan media sosial aplikasi tiktok bagi generasi millenial. Kesimpulan. Dengan melibatkan masyarakat pengabdian ini berhasil memperluas wawasan tentang pemanfaatan media sosial aplikasi tiktok bagi generasi millenial. Langkah-langkah konkret telah diambil untuk mengembangkan, memanfaatkan serta mempromosikan media aplikasi tiktok sebagai bagian dari hiburan.

Abstract

Pondok pesantren memiliki peran penting dalam membentuk karakter santri melalui pendidikan berbasis nilai-nilai Islam. Kajian ini bertujuan untuk menganalisis proses pembentukan karakter santri di Pondok Pesantren Darul Ulum serta faktor-faktor yang mendukung keberhasilannya. Kajian ini menggunakan metode Participatory Action Research (PAR), yang melibatkan interaksi langsung antara santri, pengasuh pesantren, dan pihak terkait dalam memahami serta mengembangkan strategi pembentukan karakter. Data dikumpulkan melalui observasi partisipatif dan wawancara mendalam. Hasil kajian menunjukkan bahwa pembentukan karakter santri dilakukan melalui tiga aspek utama, yaitu pendidikan formal di madrasah, pembiasaan dalam kehidupan pesantren, serta keteladanan dari Ayah dan ibu guru. Nilai-nilai seperti kedisiplinan, tanggung jawab, dan kemandirian diinternalisasi melalui berbagai aktivitas harian dan program pesantren, sehingga membentuk pribadi santri yang berakhlak mulia serta siap berkontribusi dalam kehidupan bermasyarakat.

Abstract

The practice of granting clemency to corruption offenders who return misappropriated assets remains insufficiently examined within the framework of Islamic law, giving rise to an unresolved tension between humanitarian considerations and substantive justice. While existing studies have largely addressed clemency and asset recovery from the perspective of positive law, scholarly attention to their normative implications in Islamic law remains limited, particularly with regard to ghulul (the misappropriation of public wealth), the obligation of restitution (rad al-mazalim), and preventive sanctions (tazir). This article critically examines whether granting clemency to corrupt offenders who return assets can be justified under Islamic law, while also assessing its compatibility with Indonesia’s positive legal system. This study employs a juridical-normative approach by analysing primary legal materials, including presidential regulations on clemency and statutory provisions on corruption eradication, alongside classical and contemporary Islamic legal sources. The findings indicate that although clemency in positive law may function as a humanitarian and rehabilitative instrument, its legitimacy must be contingent upon full asset restitution and a careful evaluation of its socio-economic impact. From an Islamic legal perspective, sincere repentance (taubat nasuha) accompanied by restitution constitutes an absolute moral and legal obligation; however, it does not negate the necessity of tazir sanctions as a deterrent mechanism to safeguard the public interest and prevent the recurrence of similar offences. This article underscores the need to reconceptualise justice in the adjudication of corruption cases through the integration of Islamic legal principles into clemency and asset restitution policies, with the aim of establishing a more comprehensive and substantively just framework for corruption eradication in Indonesia.

Abstract

Additional penalties in the form of monetary compensation in Indonesia’s corruption punishment system serve as instruments for recovering state financial losses and as a means of deterrence. This article analyzes the normative framework for the punishment of corruption crimes, focusing on the concept and mechanism of monetary compensation based on Law No. 31 of 1999 in conjunction with Law No. 20 of 2001 and its application in court decisions. The novelty of this research lies in the integration of normative analysis with jurisprudential review of the practice of imposing and executing monetary compensation, so that it not only assesses the appropriateness of legal regulations but also the effectiveness of their implementation in criminal courts. This research uses a normative legal method with a legislative and jurisprudential approach through a literature study of primary and secondary legal materials. The results of the study show that although the regulation of monetary compensation has a clear legal basis, its implementation still faces obstacles in the form of inconsistencies in sentencing, difficulties in asset tracing, and obstacles in the execution of decisions, which have resulted in the recovery of state financial losses not being optimal. Therefore, this study recommends harmonizing regulations, strengthening technical guidelines for the judiciary, and increasing the capacity of law enforcement officials in order to achieve effective and fair punishment for corruption.

Abstract

The increasing complexity of modern finance requires a strong ethical and legal framework. Islamic law offers a foundation such as Sharia principles that can effectively curb economic violations. This study develops an integrative framework by integrating fiqh al-jinayah into corporate management and offers targeted policy recommendations. Using a normative-doctrinal methodology, this research combines a comprehensive literature review with thematic content analysis of corporate Sharia policies and a comparative examination of Sharia-compliant and non-Sharia-compliant practices. The study's findings indicate that empowering the Sharia Supervisory Board (DPS) and conducting internal Sharia audits to institutionalize the values of amanah, siddiq, and ta'zir significantly enhances transparency and accountability. These measures help prevent embezzlement, fraud, and money laundering while promoting profit-sharing financing models. The moral approach of Sharia law complements the existing legal regime by addressing the root causes of corporate misconduct, linking divine accountability with procedural rigor. The research contribution seeks to align corporate regulations by incorporating ta'zir-based sanctions for financial violations, explicitly granting the Sharia Supervisory Board (DPS) sanctioning authority, and implementing ethics-based capacity-building programs for executives and board members. This initiative paves the way for integrating Islamic legal principles into modern business processes and strengthening corporate governance with a Sharia-based value orientation.

Abstract

This study examines the extent to which victim blaming shapes judicial reasoning in child rape trials, focusing on the acquittal in Decision No. 42/PID/2017/PT Bjm and addressing a gap in systematic appellate-level analyses of PERMA No. 3 Tahun 2017 implementation. It employs doctrinal legal analysis combined with qualitative content analysis of two primary decisions—Decision No. 20/Pid.B/2017/PN Mrh and the aforementioned appellate ruling—and evaluates them against relevant normative frameworks, including the Criminal Code (KUHP), the Criminal Procedure Code (KUHAP), and Undang-Undang Tindak Pidana Kekerasan Seksual. The findings indicate that the appellate panel systematically shifted the evidentiary burden onto the child victim by privileging her conduct while discounting non-physical forms of coercion and psychiatric evidence of trauma. This pattern operationalises notions of victim precipitation and conflicts with procedural and protective norms, thereby producing secondary victimisation through courtroom rhetoric that denigrates victims. Conceptually, the article advances an integrated analytical framework that combines the ideal-victim construct, victim blaming, and secondary victimisation to interpret appellate reasoning, thereby refining the role of victimology as a trauma-informed evaluative lens for judicial texts. Juridically, the findings reveal a structural tension between appellate practice and KUHAP’s recognition of psychological harm as valid evidence, as well as PERMA No. 3 of 2017’s prohibition of victim-blaming conduct, with broader implications for child protection, judicial integrity, and public confidence in the justice system. The study therefore recommends targeted reforms: explicit statutory recognition of non-physical coercion and psychiatric evidence; enforceable ethical sanctions and monitoring mechanisms to ensure PERMA compliance; trauma-informed judicial training; and harmonised institutional measures that internalise child-protection principles, including the integration of Islamic law–informed recommendations within a broader institutional harmonisation framework to ensure alignment with national pro-victim legal reform.

Abstract

The research was a qualitative legal study concerning alternatives to the death penalty as stipulated in Law Number 1 of 2023 on the Criminal Code, and it was evaluated from the perspective of maqashid al-shari'ah. The method involved initially collecting both primary and secondary data, which were then scrutinized within relevant literature. After examining and analyzing the data, the researcher concluded that the alternative provisions to the death penalty in Law Number 1 of 2023 on the Criminal Code exhibit both similarities and differences compared to Islamic law as interpreted by maqashid shariah. The similarities include that both the Law and Islamic law offer alternative sanctions that no longer involve taking a life, which in the context of the National Criminal Code could be considered aligned with maqashid shariah. However, a notable difference lies in cases of murder or taking another's life, where Islamic law does not allow for the alternative sanction of diyat (financial compensation) unless the victim's family forgives the perpetrator. For the National Criminal Code to align with maqashid shariah in providing an alternative to the death penalty for murder (resulting in the loss of life), it must first secure forgiveness from the victim's family as a prerequisite to commuting the sentence from death to life imprisonment or a maximum of 20 years in prison.
