Abstract

Since the Independence Day of Indonesia, Islamic law has played a significant role in shaping Indonesian society, as Muslims contributed largely to the composition of the Indonesian population. This article starts with the critical analysis of the national law, Pancasila as philosophy of the Indonesian legal system, to the rises of Islamic law in Indonesia. How Islamic law has been transformed over its rich history will also be examined, namely the implementation of Islamic law in Indonesia. The paper tries to give readers a broader understanding of Islamic legal concepts, as this will enable them to understand the differences and similarities between the national and Islamic legal system. Moreover, it will provide readers with enough knowledge to analyze applications of Islamic law, specifically, to the practices and implementation of this law in Indonesia in order to comprehend the unique ‘model’ of Islamic law to develop national law in this developing nation.

Abstract

This research aims to describe the concept of religious moderation, examine religious moderation in Islamic education, and examine models of religious moderation practice in Indonesia. This research uses a phenomenological approach. The type of research includes library research. The data used is secondary data sourced from documents. Data collection techniques were carried out through online searches. Next, the data was analyzed using an interactive analysis model. This research shows that religious moderation is a tolerant religious attitude. The main principle of moderation is finding a middle point characterized by tolerance. Religious moderation in Islamic education is the concept of moderate Islamic education, which places more emphasis on substantive teaching aspects. Islamic material puts forward teachings that bring benefits and soothe humanity. Teaching a moderate understanding of Islam in educational institutions is mandatory for all educational institutions. The practice model of religious moderation in Islamic education has been practiced in several institutions in Indonesia, both educational and non-educational institutions, through training. Some elements implemented are an inclusive curriculum, inter-religious dialogue, respect for diversity, and prevention of radicalism. Religious moderation is a religious attitude that respects differences. Religious moderation in Islamic education emphasizes substantive teachings. The practice model of religious moderation in Islamic education has been practiced in educational and non-educational institutions.

Abstract

This article discusses Islam's arrival in Palembang and the style of its society. As one of the oldest cities in Indonesia, Palembang in the past was very interesting to study. The existence of Sriwijaya as the most significant maritime kingdom in Southeast Asia and Palembang Darussalam as one of the Islamic sultanates in Indonesia made Palembang one of the centers of great culture and civilization. The arrival of Islam in the city of Palembang is unique. It makes Palembang the Veranda of Medina, proving that the Islam developed in Palembang is good and can be quickly absorbed by the people. The method used is a historical approach, examining sources based on books, papers, journals, and other scientific articles and analyzing them using historical analysis. The results show that Islam in Palembang has a very long history. A new chapter began when Palembang became a sultanate. At this time, each sultan competed to establish Islam in Palembang. The Samaniyah congregation, founded by Shaykh Muhammad bin 'Abd al-Karim al-Samman (d. 1775 AD), was the first congregation that was very popular in Palembang.

Abstract

Religious traditions are closely related to religious teachings and are an integral element of community life, particularly in Kuang Dalam. These traditions not only reflect spiritual expression but also play an important role in strengthening social solidarity and preserving cultural identity. This research uses a descriptive qualitative approach with ethnographic methods to understand the religious traditions of the Kuang Dalam community in depth, including birth, marriage and death traditions. Data were obtained through participatory observation, in-depth interviews and documentation, and analysed interpretively to explore the values, symbols and meanings of these traditions. The results show that religious traditions such as nujuh bulan, nunde keluagh, and marhabah in the birth cycle symbolise gratitude and prayers for the safety of mothers and children. Marriage traditions, including bepandas and cake auctions, emphasise the sacredness of marriage and community solidarity. Death traditions, such as ngurus mayit, reflect respect for the dead and social support for bereaved families. These traditions enrich spiritual life, strengthen social harmony and preserve local identity amidst modernisation

Abstract

This writing aims to explore the rise of Europe and Colonialism in Muslim countries, focusing on the cases of Egypt and India. The goal is to gain a deeper understanding of the European resurgence and Colonialism in Muslim countries such as Egypt and India, with the hope that it can serve as a valuable lesson to avoid repetition in the future. The method employed is qualitative research based on library research, where all data sources are obtained from books, journals, and other scholarly articles closely related to the discussed topic. All data is inventoried, content is analyzed, and then compiled into a report. The findings reveal that the occurrence of colonialism in Egypt and India is attributed to the poor conditions of the society in those regions, encompassing economic, political, social, and religious aspects.

Abstract

Menghalangi keadilan merupakan suatu kejahatan jika tujuannya adalah menghalangi penyelenggaraan peradilan. Tujuan dari penelitian ini adalah untuk mengetahui faktor-faktor yang menjadi pertimbangan hakim dalam memutus kesalahan pidana bagi pelaku pembunuhan berencana saat melakukan tindak pidana menghalangi keadilan. Penelitian ini menggunakan analisis kualitatif dan pendekatan normatif penelitian kepustakaan. Berdasarkan temuan tersebut, hakim mempertimbangkan hal-hal berikut dalam menjatuhkan putusan 802/Pid.Sus/2022/PN Jkt. Dalam kasus pembunuhan berencana, sel bagi pelaku penghalangan keadilan layak dilakukan karena mengikuti aturan hukum yang berlaku dengan mempertimbangkan faktor yuridis, seperti dakwaan jaksa penuntut umum, keterangan terdakwa, saksi, alat bukti, dan pasal hukum pidana, serta tidak faktor yuridis, seperti latar belakang terdakwa melakukan tindak pidana. Pertanggungjawaban pidana terhadap pelaku obstruction of justice pada kasus pembunuhan berencana yang dilakukan oleh aparat kepolisian dalam putusannya sudah sesuai, namun demikian sanksi pidana yang ditetapkan dalam kasus tersebut masih belum memenuhi rasa keadilan, karena semua unsur yang memberatkan sudah terpenuhi.

Abstract

Islamic education in Indonesia operates within a highly plural society and continues to adapt to rapid social change. Despite its traditional roots, pesantren and madrasah remain central to shaping moral formation, communal resilience, and inclusive religious identity. This study examines how Islamic education contributes to social transformation and what socio-theological values emerge from faith-based practice. Using qualitative library research and thematic analysis of recent peer-reviewed literature, the study integrates sociological perspectives with theological insights to interpret how institutions embed Qur’anic–Hadith principles in educational life. Findings show that pesantren safeguard tradition while cultivating moderation, solidarity, and moral literacy, whereas madrasah combine Islamic studies with modern sciences to strengthen critical thinking and civic responsibility. The study’s originality lies in its interdisciplinary socio-theological approach, revealing that spiritual values such as ʿadl, raḥmah, ukhūwah, and taʿāwun shape not only personal ethics but also social behavior, interfaith engagement, and ecological consciousness. These insights highlight Islamic education’s capacity to negotiate globalization, technology, and secular pressures without diminishing theological depth. The research implies the need for value-based curricula, leadership development, enhanced digital literacy, and expanded interfaith initiatives to sustain a moderate and future-oriented model of Islamic education.
