Penelitian yang berjudul ”EKSEKUSI OBJEK JAMINAN FIDUSIA ATAS DEBITUR YANG CIDERA JANJI PASCA PUTUSAN MAHKAMAH KONSTITUSI NOMOR 2/PUU-XIX/2021” yaitu pertama bertujuan untuk mengetahui Eksekusi Objek Jaminan Fidusia Terhadap Debitur Yang Wanprestasi Pasca Putusan Mahkamah Konstitusi Nomor 2/PUU-XIX/2021, dan Kepastian Hukum Atas Tindakan Parate Eksekusi Yang Dilakukan Kreditur Ketika Debitur Cidera Janji (Wanprestasi) Pasca Putusan Mahkamah Konstitusi Nomor 2/PUU-XIX/2021. Metode penelitian yang digunakan dalam penelitian ini adalah Normatif. Normative merupakan metode penelitian kepustakaan yang memfokuskan pada kajian tentang norma – norma hukum yang terdapat dalam nilai – nilai, hukum positif, putusan pengadilan, dan peraturan perundang – undangan. Menggunakan pendekatan perundang – undangan dengan cara memahami undang – undang yang berkaitan dengan isi dan regulasi terhadap permasalajhan hukum yang ingin peneliti selesaikan dalam penulisan ini. Peneliliti juga menggunakan pendekatan konseptual, yang berasal dari pendapat par ahli tentang ilmu hukum. Berdasarkan hasil penelitian dapat disimpulkan Jaminan fidusia termasuk dalam gagasan jaminan, bersama dengan semua fitur material lainnya. Undang-Undang Jaminan Fidusia Tahun 1999 mendefinisikan “fidusia” dalam Pasal 1 Ayat 1. Jaminan fidusia yang dimaksud dalam Pasal 1 Ayat 2 Undang-Undang Jaminan Fidusia ialah hak jaminan barang yang bergerak, baik dalam bentuk fisik atau juga tidak memiliki wujud, serta barang yang tidak bergerak, terkhusus bagi struktur yang tidak bisa terbebani dengan hak tanggungan. Mahkamah Konstitusi memastikan bahwa standar hukum yang berlaku sejalan dengan tujuan negara kesejahteraan yang telah ditetapkan oleh Undang-Undang Dasar Negara Republik Indonesia. Keluarnya Putusan MK No. 2/PUU-XIX/2021 memberikan angin segar bagi debitur, karena putusan tersebut memberikan kepastian hukum yang adil dan perlindungan debitur terkait objek jaminan fidusia. Dalam hal ini, apabila tidak terjadi kesepakatan wanprestasi dan debitur menolak untuk menyerahkan objek jaminan fidusia secara sukarela, maka seluruh mekanisme dan prosedur hukum eksekusi sertifikat jaminan fidusia harus dilakukan dan diberlakukan sebagaimana eksekusi putusan pengadilan yang telah berkekuatan hukum tetap.

Indonesia’s multicultural and multi-religious society often leads to interfaith marriages, which present complex legal implications, particularly regarding the rights of spouses and children in matters of inheritance. Interfaith marriage raises significant legal questions under Islamic law, especially in terms of the status of heirs when religious differences exist between the deceased and the beneficiary. This study aims to examine the legal position of wives and children from interfaith marriages as heirs within the framework of the Compilation of Islamic Law (Kompilasi Hukum Islam/KHI). Employing a normative legal research method, this study analyzes statutory regulations, legal principles, and authoritative interpretations of Islamic inheritance law. The findings reveal that interfaith marriages give rise to legal consequences in three main areas: the legality of the marriage itself, the division of marital property, and the rights of children as descendants. According to KHI and prevailing Islamic jurisprudence, heirs who differ in religion from the deceased are not entitled to inheritance. However, the concept of mandatory will (wasiat wajibah) offers an alternative legal remedy, allowing non-Muslim heirs to receive a portion of the estate under certain conditions. This research implies the need for greater legal clarity and public awareness regarding inheritance rights in interfaith marriages to ensure justice and certainty for all parties involved.

Indonesia has a vast territory, most of which consists of the sea. Indonesia's strength lies in its natural resources, particularly the abundant marine resources, especially in incredibly diverse fisheries. With the many benefits received by the Indonesian nation, it also brings issues such as limited surveillance capabilities at sea and Indonesia's strategically located territory that can provide opportunities for the exploitation of marine resources by irresponsible parties, particularly the most frequent criminal activity, which is illegal fishing by foreign parties, resulting in significant losses for the country. The problem statement encompasses two aspects for examination: firstly, whether Indonesia's act of sinking Malaysian-flagged vessels can be justified based on the 2012 Memorandum of Understanding between Indonesia and Malaysia; secondly, the legal efforts Indonesia must undertake to defend its territorial sovereignty from illegal fishing activities by foreign fishing vessels. The research method used was normative legal research, examining from the perspective of positive law. The research findings reveal discrepancies in Indonesia's actions of sinking Malaysian-flagged vessels based on the 2012 Memorandum of Understanding. Consequently, Indonesia has fulfilled its obligations as stipulated in the Fisheries Law. However, this fulfillment of obligations occurred without prior investigation into the previously agreed bilateral agreements.

The problem in this research is that the act of default can cause losses to the contract partner, so the contract partner who is harmed has the right to ask for legal protection through the court to force the person who committed the default to carry out his obligations in accordance with the agreed contract. The purpose of this study is to determine the type of legal protection that each party has and investigate the challenges associated with putting current regulations into effect. The concepts of justice, legal certainty, and legal protection are examined along with pertinent laws and regulations using the normative legal method. The results of the study show that current regulations already cover various forms of protection, such as electronic contract requirements, business actors' obligations to provide transparent product information, and sanctions for violations of the law. However, the implementation of regulations faces obstacles, including lack of legal awareness and technological limitations. This study recommends strengthening government supervision, increasing digital literacy among the public, and collaboration between stakeholders to create a safer and more equitable e-commerce environment.

Penelitian ini mengkaji tentang penegakan hukum pidana pajak di Indonesia menghadapi dilema fundamental antara fungsi penerimaan negara (budgetair) dan fungsi penegakan keadilan. Secara teoretis, asas ultimum remedium berfungsi sebagai pedoman untuk menempatkan hukum pidana sebagai upaya terakhir. Melalui mekanisme Pemeriksaan Bukti Permulaan, doktrin yang lazimnya pasif ini diformalkan menjadi sebuah prosedur hukum yang menawarkan jalur penyelesaian alternatif bagi Wajib Pajak di luar sistem peradilan pidana. Namun dalam praktiknya, mekanisme ini melahirkan persoalan hukum yang signifikan. Metode penelitian ini menggunakan penelitian hukum Normatif. Hasil penelitian ini menunjukan bahwa berdasarkan data empiris mayoritas Wajib Pajak memilih jalur administratif, sebuah fakta yang mengindikasikan efektivitas mekanisme ini dalam memulihkan kerugian negara secara cepat. Artikel ini berargumen bahwa Bukti Permulaan yang secara teoretis menegakkan ultimum remedium, dalam praktiknya justru menciptakan sebuah paradoks. Analisis mendalam mengungkap bahwa Bukper berfungsi sebagai instrumen bifurkasi prosedural yang didorong oleh pragmatisme fiskal, salah satunya untuk mengatasi daluwarsa administratif. Desain ini menciptakan kondisi koersi prosedural yang secara de facto menggeser beban pembuktian kepada Wajib Pajak. Pada akhirnya, penelitian ini menyimpulkan bahwa Bukti Permulaan telah berhasil mentransformasikan asas yang seharusnya menjadi obat terakhir menjadi ancaman pertama yang efektif, sebuah arsitektur hukum yang efisien bagi negara tetapi berisiko mengikis prinsip keadilan prosedural dan asas praduga tak bersalah.

The purpose of this study was to determine whether the Ramp Check inspections conducted by the Malang PPP Technical Implementation Unit (UPT) on public transport vehicles were in accordance with Road Traffic and Transportation Law No. 22 of 2009. As mandated by law, the main objective was to determine the extent to which these inspections ensured vehicle safety and roadworthiness. Problems with human resources, equipment, and inter-agency cooperation are some of the issues revealed by this study's examination. Government Regulation No. 79 of 2013 and Ministerial Regulation No. 132 of 2015 provide a clear legal basis; however, the analysis concludes that the implementation of inspections at Malang Type B Terminal is not ideal. This report further details the existing regulatory obstacles and offers suggestions on how to strengthen the inspection system. It concludes with recommendations on how to address issues with operational processes and law enforcement to improve regulatory compliance. The ultimate goal of this study is to help improve the Ramp Check system, which will result in safer roads and better public transport in Malang

The purpose of this study is to examine and analyze the decision of the Sungguminasa District Court No. 17/Pdt.G/2007/PN. Sungguminasa District Court Decision No. 17/Pdt.G/2007/PN Sungguminasa is in accordance with the facts and applicable legal provisions, and to determine and analyze the judge's decision on breach of contract in Sungguminasa District Court Decision No. 17/Pdt.G/2007/PN Sungguminasa, which applied the principle of Audi Et Alteram Partem. This study uses a normative research type supported by normative legal entities. Therefore, this research was conducted by processing legal materials obtained from various sources and literature. The results of this study describe the judge's legal considerations regarding the decision on civil case (breach of contract) No. 17/Pdt.G/2007/PN. Sungguminasa was not in accordance with the legal facts presented in the trial because it did not assess the events that occurred in their entirety regarding the physical changes to the object of the dispute, namely from type 45 to type 90, and the price increase as evidenced by the results of the local investigation and witness testimony. Thus, these changes were not taken into consideration by the judge in making the decision, as there is no obligation for a contract or agreement to be made in writing (except in formal agreements mandated by law) because as long as the requirements for a valid contract as stipulated in Article 1320 of the Civil Code are met, the contract is valid even if it is only made verbally, but it is better if the contract is made in writing

This normative juridical study analyzes the supervision of public transportation in terminals as an implementation of the state's constitutional duty to provide safe and high-quality public services. The research examines the legal basis, authority, and supervisory mechanisms regulated by Law No. 22 of 2009 on Road Traffic and Transport and other relevant regulations. The analysis reveals that while the regulatory framework is comprehensive, the effectiveness of field supervision faces significant challenges. Primary issues include inconsistent law enforcement, limited resources, and insufficient inter-agency coordination, all of which impede the core objectives of supervision: safety and order. These findings recommend a necessary transformation in the supervisory approach, specifically through the digitalization of processes, strengthened sanctions, and enhanced synergy among authorities. These measures are critical for addressing legal and implementation gaps, ensuring legal certainty, and protecting the rights of public transport users

This research examines law enforcement at the Batu Passenger Terminal using an empirical legal approach. Its objectives are to analyze the regulation of passenger terminals from both a normative and theoretical perspective and to identify the forms of law enforcement that are implemented. The findings indicate that terminal regulation in Indonesia is comprehensive, based on Law Number 22 of 2009 and the Minister of Transportation Regulation Number 24 of 2021. Theoretically, these regulations reflect the principles of legal positivism (law as a formal rule), sociological jurisprudence (law must be relevant to social needs), natural law (law based on morality and justice), and progressive law (law must be adaptive). These regulations cover terminal classification, facility standards, and obligations for all parties. The forms of law enforcement are multidimensional, consisting of criminal sanctions for serious violations (such as not stopping at a terminal), administrative sanctions for operational and service violations, and preventive and repressive actions in the field. This study concludes that law enforcement at terminals is not merely focused on imposing penalties but is a holistic effort to create a safe, orderly, and just transportation system

This normative legal research examines Order Policy at the Hamid Rusdi Passenger Terminal by analyzing the applicable legal framework and its implementation. The primary focus of this study is to identify and analyze the roles and authorities of the Head of the Technical Implementation Unit for the Management of Transportation Infrastructure and Road Traffic (UPT P3 LLAJ) in Malang in enforcing order at the Hamid Rusdi Passenger Terminal, as stipulated in East Java Governor Regulation No. 54 of 2018. This research also investigates the philosophical foundation of order from legal and public policy perspectives, highlighting the principles of justice, legal certainty, and utility. The findings indicate that order policy at the terminal is a vital instrument integrated within Law No. 22 of 2009 concerning Road Traffic and Transportation (UU LLAJ). The study concludes that the enforcement of order at passenger terminals, led by strategic officials such as the Head of UPT P3 LLAJ Malang, is not merely for discipline and repressive control, but also serves as an essential public service aimed at enhancing the efficiency, safety, and comfort of transport users
