Abstract

At this time, the existence of corporations is felt to be increasingly important and strategic, in addition to being able to help turn the wheels of the economy, corporations have also reached almost all spheres of life. Corporations do not only carry out activities that aim to achieve their goals based on the provisions of the laws and regulations that govern them but in certain cases, many corporations commit criminal acts of corruption. Corruption is developing in various sectors, including state-owned companies.  The purpose of this study is to determine the criminal liability of corporations in the crime of corruption. The research method used is normative juridical, where this research was conducted by examining library materials in the form of secondary data obtained from various legal materials. The research results show the law must be interpreted as a regulation that is real and applies to all humans without exception. All acts of corruption committed by corporations must be subject to sanctions if they are contrary to applicable legal regulations. So that the law will function in order to achieve the objectives of the law, namely certainty, justice and benefit.  That that corporations are responsible as legal subjects in criminal acts of corruption. Legal subjects are not only individuals or individuals but legal entities such as corporations that can be held accountable. The existence of an error is an absolute element that can result in a corporation being held criminally responsible.

Abstract

The purpose of this research is to understand and analyze an act that can be categorized as a money laundering crime complete with all its elements. Then also understand and analyze the relationship between money laundering crimes and corruption crimes. The research method used is the normative legal research method through literature study with the data source, namely secondary data. The research results show that the crime of money laundering cannot be separated from the original act, namely the crime of corruption. In processing a money laundering crime, it is not necessary to prove the predicate crime first, because the object of the money laundering crime is the assets resulting from the predicate crime

Abstract

Peningkatan bullying di sekolah salah satu pemicunya adalah lebih banyak siswa pasif dan diam dalam menghadapi tindakan bullying, hal ini disebabkan siswa belum paham mengenai bagaimana bertindak efektif menghadapi bullying. Kegiatan Pengabdian kepada Masyarakat (PKM) ini bertujuan untuk meningkatkan pemahaman dan kesadaran siswa SMA mengenai aspek hukum dan psikologis dari tindakan bullying. Kegiatan dilaksanakan di SMAN 1 Garut pada bulan Mei 2025 dengan melibatkan 30 siswa sebagai peserta. Metode yang digunakan berupa ceramah interaktif, berbagi pengalaman dari pelaku dan korban bullying, dan diskusi untuk memperdalam pemahaman. Tujuan utama PKM adalah meningkatkan kesadaran siswa terhadap dampak psikologis dan konsekuensi hukum dari bullying, sekaligus memotivasi mereka untuk berperan aktif dalam mencegah bullying dengan menjadi upstander—individu yang berani melawan atau melaporkan tindakan bullying. Evaluasi dilakukan melalui pre-test dan post-test untuk mengukur peningkatan pemahaman peserta. Hasilnya menunjukkan peningkatan pemahaman secara umum sebesar 29,78%, dengan rincian, pemahaman aspek hukum meningkat 17,78%, pemahaman psikologis bullying meningkat 21,9%, pemahaman tentang peran upstander meningkat signifikan sebesar 48%. Temuan ini mengindikasikan bahwa pendekatan interaktif dan penyampaian materi berbasis pengalaman nyata efektif dalam meningkatkan kesadaran siswa. Kegiatan ini juga mendorong perubahan sikap dari pasif (bystander) menjadi aktif (upstander), yang diharapkan dapat mengurangi kasus bullying di lingkungan sekolah

Abstract

Sebagai salah satu negara yang wilayahnya dilalui jalur ring of fire (cincin api) dunia. Indonesia menjadi negara yang rawan terhadap bencana gempa bumi dan erupsi gunung api. Menurut Badan Nasional Penanggulangan Bencana (BNPB), erupsi gunung api merupakan bencana yang dapat mengakibatkan korban terbanyak ke-2 di Indonesia setelah bencana tsunami. Gempa bumi sendiri merupakan getaran yang terjadi di permukaan bumi akibat pelepasan energi secara tiba-tiba yang menciptakan gelombang seismik. Peristiwa tersebut ditandai dengan patahnya lapisan batuan pada kerak bumi. Seperti yang terjadi pada tanggal 21 November 2022 pukul 13:21:10 WIB di Cianjur. Dimana gempa bumi berkekuatan 5.6 Magnitudo dirasakan oleh masyarakat Cianjur dan sekitarnya. Gempa bumi ini menyebabkan tanah longsor di beberapa lokasi di wilayah Cianjur dan mengakibatkan 268 korban jiwa dan lebih dari 2.000 rumah mengalami kerusakan. Penanggulangan bencana harus ditangani secara integral, holistik dan komprehensif. Untuk mengatasi permasalahan bencana tersebut, berbagai pihak telah terlibat dalam persoalan tersebut, sehingga Pemerintah harus bertanggung jawab dalam penanggulanggan bencana. Guna membantu antisipasi dan penanganan bencana alam di wilayah Cianjur, maka Batalyon B Pelopor Satuan Brimob Polda Jabar turut serta terlibat dalam membantu penanganan bencana, yaitu melalui Tim SAR yang ada di lingkungan Mako Brimob Cipanas. Akan tetapi, seberapa penting peran Batalyon B Pelopor Satuan Brimob Polda Jabar dalam penanganan bencana di wilayah Cianjur masih perlu dipertanyakan, karena sejatinya tugas Brimob ialah mengatasi gangguan keamanan berkadar tinggi dan ada BNPB dan BPBD yang memang secara khusus menangani bencana alam. Tentu saja hal ini perlu dikaji lebih lanjut, sehingga dapat diketahui secara pasti peran Brimob dalam penanganan bencana alam, khususnya yang terjadi di wilayah Cianjur.

Abstract

Legal awareness is a crucial factor in preventing the emergence of social ills and juvenile delinquency. The phenomena of drug abuse, promiscuity, brawls, and various other forms of deviant behavior reflect a weak understanding and compliance with legal norms among the community, especially the younger generation. This low legal awareness not only has an impact on increasing the potential for legal violations, but also threatens social order and security stability in the community. This study focuses on two main problems, namely (1) the factors causing low legal awareness in the community, and (2) a conceptual model of legal awareness that can be applied to prevent deviant behavior. The purpose of this study is to identify the determinants that influence low legal awareness and to formulate a collaboration-based legal awareness model that can be implemented in an integrated manner by the government, law enforcement officers, educational institutions, community leaders, and families. The method used is a literature study with a qualitative approach through analysis of literature, laws and regulations, and the results of relevant previous research. The results of the study indicate that low legal awareness is influenced by the low level of legal education in the community, weak social control functions of families, minimal involvement of religious and community leaders in moral development, and inconsistency in law enforcement. The proposed conceptual model emphasizes early legal education, strengthening the role of the family, optimizing religious and social activities, increasing persuasive public campaigns, and implementing firm but humane law enforcement.

Abstract

This study examines the professionalism of the Indonesian National Police in handling thuggery disturbances in traditional markets within the jurisdiction of Bogor Regency, along with the forms of legal protection provided to business actors and the broader impacts of thuggery on market security, order, and economic activity. The research employed a normative juridical method with a statute approach, relying on primary, secondary, and tertiary legal materials collected through library research. The findings reveal that police professionalism in addressing thuggery has not been fully optimal. Although the police have carried out both preventive and repressive measures in accordance with applicable regulations, the handling remains reactive, incidental, and unsustainable, failing to eliminate thuggery practices comprehensively. Legal protection provided by local governments and law enforcement officials tends to be normative and administrative in nature, lacking effective integration and neglecting victim assistance and recovery aspects. Thuggery has been proven to produce significant negative impacts on traditional market environments, including the erosion of security and public order, the emergence of informal power structures that supplant formal authority, increased operational burdens on small traders through illegal levies, and declining market competitiveness. Furthermore, thuggery undermines public trust in law enforcement institutions and discourages investment in the micro, small, and medium enterprise sector. This research concludes that an integrated, cross-sectoral approach is essential, encompassing strengthened whistleblower protection, intensified security measures, improved inter-agency coordination, and policy-level reforms in traditional market governance to effectively eradicate thuggery and ensure sustainable legal protection for market business actors.

Abstract

Background. The rapid evolution of financial technology has shifted banking activities toward fully digital environments, creating new opportunities for efficiency while simultaneously exposing customers to broader and more complex risks. Traditional regulatory frameworks, originally designed for conventional banking, often struggle to address issues arising from digital transactions, data processing, and emerging online service models. This situation has prompted regulators and financial institutions to reconsider existing norms to ensure stronger and more adaptive customer protection. Aim. This study aims to examine how technological developments influence regulatory reform in order to strengthen the protection of bank customers. Methods. A qualitative approach is applied through systematic analysis of regulatory developments, institutional policies, and emerging patterns of consumer risk in digital banking. Results. The study finds that technological growth drives regulators to refine customer protection rules, especially in areas related to customer rights, digital accountability, and data security. Banks also adopt updated internal policies to meet evolving regulatory expectations. Conclusions. Financial technology plays a significant role in encouraging regulatory reform, pushing authorities toward more adaptive and forward-looking frameworks. Implication. Continuous regulatory development is essential to ensure that customer protection remains effective as digital financial services continue to advance. Abstract

Background. Pre-project selling has become a dominant marketing strategy in Indonesia’s property sector, yet it often exposes buyers to legal uncertainties, particularly regarding delayed construction and unmet contractual promises. Aim. This study examines the extent to which pre-project selling practices comply with Indonesia’s Consumer Protection Act and evaluates the adequacy of current legal safeguards for property buyers. Methods. Using a normative legal approach, the study analyzes statutory provisions, developer–consumer contracts, and relevant court decisions to identify compliance gaps and recurring legal issues. Results. The findings indicate that although the Act provides fundamental consumer rights, weak enforcement mechanisms, asymmetric information, and inadequate oversight allow developers to circumvent their obligations. Many contractual clauses tend to disadvantage buyers, and dispute resolution often results in limited remedies. Conclusions. Existing regulations do not sufficiently protect consumers in pre-project selling transactions, leaving buyers vulnerable to financial and legal risks. Strengthening regulatory oversight, standardizing contract terms, and enhancing sanctions for non-compliance are crucial to improving consumer protection. Implication. The study contributes to academic discourse on consumer law, provides policy insights for regulators, supports better awareness for society and property buyers, and offers a reference for international scholars examining consumer protection in emerging markets.

Abstract

Background.The high rate of early marriage in Indonesia is influenced by factors such as tradition, social norms, economy, and low parental education levels. Parents often serve as the final decision-makers in child marriages, making their participation crucial in prevention efforts. Aims. This study aims to analyze the effectiveness of public policies in preventing early marriage through approaches that involve active parental participation. Methods. The method used is sociological juridical with a qualitative approach, conducted through discussion forums, coaching, and legal and health education for parents. Conclusion. The results show that the government has issued various policies, such as Law Number 16 of 2019, as well as programs such as BIMWIN, BRUS, marriage clinics, and women’s and children’s empowerment. However, these efforts are not yet optimal without improving parental capacity and awareness. The novelty of this research lies in its emphasis on legal and health education for parents as a strategic step in preventing early marriage. The implication is the need for integrative policy synergy between the government, society, and families

Abstract

Background. Richard Posner, in his Economic Analysis of Law, argues that business crimes involving the abandonment of concession lands (Hak Guna Usaha/HGU) reflect the existence of externalities and market failures, where corporate concession holders who neglect their lands cause substantial losses to both the State and society. Aims. This study aims to evaluate the economic and legal impacts of business crimes arising from the abandonment of plantation concession lands (HGU) in Indonesia and to provide alternative policy solutions for resolving this issue. Methods. The research employs a normative legal method with an evaluative approach, examining the phenomenon of abandoned plantation HGU lands from both regulatory and economic perspectives. The analysis seeks to produce concrete recommendations for optimizing the management of abandoned plantation lands through an integration of legal and economic principles. Result. The findings reveal that, as of 2024, the Ministry of Agrarian Affairs and Spatial Planning (ATR/BPN) recorded approximately 1,347,099 hectares of abandoned HGU lands across Indonesia, accumulated between 2020 and 2024. Under existing fiscal regulations, HGU concession holders are required to pay Non-Tax State Revenue (PNBP) of IDR 26,500 per 100 hectares annually. Based on this rate, the total potential State revenue loss due to abandoned HGU lands is estimated at IDR 356,981,235 (three hundred fifty-six million nine hundred eighty-one thousand two hundred thirty-five rupiahs). Conclusion. The study concludes that the widespread abandonment of HGU lands represents a significant economic loss and legal inefficiency. Lands that should generate income for the State instead become sources of conflict, inefficiency, and administrative burden, illustrating the failure of both corporate governance and legal enforcement mechanisms. Implication. The implications of this research emphasize the necessity of developing criminal, civil, and administrative law instruments to prevent and sanction corporate violations that cause State losses. The study proposes the formulation of a criminal law–based regulatory framework as a deterrent mechanism to ensure corporate accountability in land management and to restore the economic and social function of land in accordance with Indonesia’s constitutional mandate
