Abstract

This paper is a normative research that tries to decipher the differences regarding changes to the provisions of the execution of fiduciary guarantees after the decision of the Constitutional Court. The debate is based on the opinion that the Constitutional Court's decision changes the characteristics of executing fiduciary guarantees to become more complicated because it costs more and takes a longer time. The data source for this paper is in the form of Constitutional Court Decisions and laws and regulations. The author uses interpretation techniques to examine and analyze the problems in this article. As a result, the reformulation of the provisions on the execution of fiduciary guarantees carried out by the Constitutional Court is by the principles of justice, benefit, and legal certainty. The Constitutional Court has determined that the execution of a fiduciary guarantee object can only held if there is an agreement regarding the breach of contract and there is a willingness to surrender the fiduciary guarantee. They are regulated so that debtors are not treated arbitrarily by creditors. The decision provides options to maximize simple lawsuits and utilize electronic court and trial administration. Tulisan ini merupakan penelitian normatif yang mencoba menguraikan perbedatan mengenai perubahan ketentuan eksekusi jaminan fidusia pasca putusan Mahkamah Konstitusi. Perdebatan tersebut didasarkan pada pendapat bahwa putusan Mahkamah Konstitusi mengubah karakteristik eksekusi jaminan fidusia menjadi lebih rumit karena mengeluarkan biaya lebih besar dan waktu yang lebih lama. Sumber data tulisan ini berupa Putusan Mahkama Konsitusi maupun peraturan perundang-undangan. Penulis menggunakan teknik interpretasi untuk menalaah dan menganalisa masalah dalam artikel ini. Hasilnya reformulasi ketentuan eksekusi jaminan fidusia yang dilakukan oleh Mahkamah Konsitusi sudah sesuai dengan prinsip keadilan, kemanfaatan dan kepasatian hukum. Mahkamah Konsitusi telah menetapkan bahwa eksekusi objek jaminan fidusia hanya dapat dilakukan apabila ada kesepakatan mengenai cidera janji dan ada kerelaan menyerahkan jaminan fidusia. Hal ini diatur agar Debitur agar tidak diperlakukan secara sewenang-wenang oleh Kreditur. Putusan tersebut memberi pilihan untuk memaksimalkan gugatan sederhana dan memanfaatkan administrasi perkaran dan persidangan secara elektronik.

Abstract

General elections serve as a democratic mechanism aimed to a lawful transition of power based on the constitution. The legal basis for general elections is found in Article 22E, while the election of the President and Vice President is governed by Article 6A of the 1945 Constitution of the Republic of Indonesia. There is no provision regarding the presidential threshold in the 1945 Constitution, as this regulation is an additional provision in Article 222 of Law Number 7 of 2017 concerning General Elections. The research methodology employs normative legal research with a juridical and conceptual approach by examining and studying relevant literature on the research topic. From a constitutional perspective, the presidential threshold provision lacks constitutional grounds. Constitutionally, every citizen has equal rights before the law and in governance. However, this limitation impacts an individual's right to be elected and to vote. From the democratic principle standpoint, political parties as representatives of the people will be restricted according to the regulations of the presidential threshold. This regulation, based on the previous general election results, eliminates the political rights of new or small parties to nominate candidates for President and Vice President.

Abstract

This study investigates the correlation between dowry productivity and women's economic empowerment strategies, along with their influence on marital assets. This study is significant in altering women's perceptions regarding the imperative nature of effectively managing dowry in order to enhance the economy. This study employs empirical law methodologies that are studied via the lens of reinforcement theory. Information was gathered through the use of interviews, documents, and surveys. Interviews and surveys were conducted in the city of Bandar Lampung, namely instructors at the Religious Affairs Office (KUA), and productive dowry managers, as well as prospective brides and grooms, while document analysis included journal articles, books, and legal regulations. The research findings indicate that the approach to enhancing women's economic status through the utilization of dowries commences prior to the wedding and continues until the marriage ceremony, by offering favorable incentives to women. The initial phase is dissemination, specifically emphasizing the significance of a fruitful dowry to alter women's outlook when selecting enduring dowry items. Furthermore, there is a need to enhance the availability of resources to transform dowry assets into productive assets. Thirdly, aid in the administration of the dowry procedure as a means of acquiring company capital, and fourthly, safeguarding the wife's ownership of dowry items as her personal possessions from the moment of marriage. Implementing an effective technique for enhancing dowry production will bolster the presence of marital assets. All revenues derived from the creation and administration of the dowry are the shared duty and joint property of the husband and wife. The consequences of enhancing the economic status of women through productive dowries include achieving self-reliance and resilience in the household economy.

Abstract

This research aims to analyze the incompatibility of Ministerial regulations in the implementation of government which are formed based on attribution of power and intends to formulate a concept to prevent Ministerial regulations from resulting in regulatory obesity. The focus of this research is to answer the questions regarding the position of Ministerial regulations within the Indonesian legal system and how the incompatibility of Ministerial regulations based on attribution power affects the administration of government. This paper is a normative research using secondary data and literature study for data collection.The research findings indicate that firstly, within the legislative regulations system, Ministerial regulations are considered as delegated legislation or delegated regulations based on regulations above them. Secondly, through the independent authority of ministries and/or Ministers, a wide scope has been opened for creating regulations based on the independent authority of Ministers and/or ministries. This has resulted in an anomaly, namely the emergence of laws that provide attribution power to Ministers and/or ministries to directly create Ministerial regulations. This situation creates incompatibility in the administration of government because attribution power cannot be exercised by Ministers as assistants and mandate holders of the President.

Abstract

This study scrutinizes the status of the regulations enacted by the Nusantara Capital City Authority (IKN Authority) within the Indonesian legislative hierarchy, based on Law Number 3 of 2022, also known as the IKN Law. A normative research approach underpins this analysis, utilizing legislative and conceptual methodologies. The investigation concludes that the IKN Law’s Article 5 paragraph 6, was drafted to accommodate all regulations formulated by the IKN Authority. These regulations, born out of the authority's attribution, hold an equivalent standing to those issued by a minister, institution, or agency at the central level given that the IKN Authority is an institution at the ministerial level. Consequently, the formulation of these regulations adheres to the rules governing central-level regulations, with the Supreme Court conducting their review. The unique aspect is the subject matter, which relates to the governance structure of the IKN Authority. Moreover, the formulation of regulations by the IKN Authority should: 1) Define the IKN entity’s position as a unique regional government entity; 2) Outline the types of regulations to be enacted; 3) Clarify the source of authority, which is attribution-based; 4) Specify its position in the hierarchy, equivalent to Regional Regulations; 5) Detail the formulation process and treatment, aligning it with the creation of regional legal products; 6) Elucidate the subject matter of the Regulatory Authority; and 7) Highlight the review process, which can be escalated to the Supreme Court.

Abstract

Considering the increasing number of unemployed and the depletion of job vacancies, so many people are struggling with the economy. This flannel craft training aims to increase the interest in entrepreneurship of housewives in Purwosari hamlet. Flannel fabric is attracting attention and many fans among the public. This study uses the Participatory Action Research (PAR) method with 4 stages, namely planning, action, observation, and reflection. This flannel craft training lasted for 1 day and was attended by 40 participants from housewives from the Purwosari hamlet. The products made are brooches and keychains made of flannel. Interest in entrepreneurship increased from 39.3% or in the category of less interest to 90.1% or in the category of very interest. With this training, it is hoped that it can be a solution to the difficulties of the family economy and can create jobs through entrepreneurship

Abstract

Indonesia ranks as the second-largest producer of plastic waste in the world, with plastic taking around 1,000 years to decompose, leading to environmental pollution. One effective solution is the implementation of the 3R concept (Reduce, Reuse, Recycle) and the production of ecobricks, which can be easily done using available materials and tools. This community service project aims to raise public awareness, particularly in Karang Umpu Village, about using ecobricks to maintain environmental cleanliness and health. The method used is educational outreach, enabling the community to understand how to manage and repurpose plastic waste. The results showed an increase in public knowledge regarding the types, utilization, and management of plastic waste by 85%, compared to 53% before the outreach. With this outreach, the community is expected to be able to manage and repurpose plastic waste through the ecobrick method, preventing waste accumulation and reducing environmental pollution, thereby creating a clean and healthy environment.

Abstract

This research aims to strengthen the institution of the House of National Representatives (DPD) in the national legislation programme, to be more representative in accommodating national aspirations. Through a normative juridical approach and analysis of Siyasah duturiyah, this research examines the principles of justice, deliberation, and participation under the values of Sharia in public policy making. This research is normative juridical research by collecting primary and secondary legal materials relevant to the research utilizing a statutory approach and conceptual approach in both positive law and siyasah duturiyah. The results found that to strengthen the control and development of DPD in the national legislation, it is necessary to amend the 1945 Fundamental law of the Republic of Indonesia, revise the Law No. 17/2014, revise the Law No. 27/2009, separate arrangements regarding the assignment and functions of DPD, adopt a strong bicameral system and likely bicameral. The impact is hoped to enrich the study in the field of Fiqh Siyasah and Fundamental law, especially in the context of developing a more inclusive legislative system under the framework of the Unitary Republic of Indonesia.

Abstract

Stunting is a failure in children's growth and development. Stunting is caused by chronic malnutrition that occurs within 1000 days of life. Malnutrition among children under five is one of the main problems of the Indonesian nation because it has an impact on the low quality of human resources. Improved nutrition is needed to avoid these problems for children aged 6-24 months. Moringa leaves (Moringa oleifera) have nutrients that can help improve children's nutritional status. The content of macro minerals such as calcium, potassium and phosphorus plays an important role in the growth of bones and teeth, activating nerves and the brain, as well as maintaining heart health. Method: This Community Service Activity uses a demonstration method which aims to promote the method of processing Moringa leaves. We know that Moringa leaves are rich in nutritional content which supports nutritional development, especially for stunted children as additional food at posyandu. Results: During the training, participants participated in the activities enthusiastically.  This was proven by several questions asked by participants regarding how to make Moringa leaf pudding.

Abstract

This study examines the governance design of the Nusantara Capital Authority (Otorita Ibu Kota Nusantara), as established in Law No. 21 of 2023 amending Law No. 3 of 2023 concerning the Capital City of the State. The objective of this research is to assess whether the governance design of the Nusantara Capital Authority aligns with the principles of regional autonomy and to propose a future governance concept for the Nusantara Capital Authority. This research adopts a normative juridical approach, using statutory and conceptual methods, and utilizes secondary data consisting of primary, secondary, and tertiary legal materials. The findings indicate that the governance structure established under the IKN Law does not conform to the principle of regional autonomy, and as such, the Nusantara Capital Authority cannot be classified as a special regional government. The Nusantara Capital Authority does not possess the independent authority to manage its governmental affairs, as in the case of autonomous regions. Based on these findings, the author proposes a governance design for the Nusantara Capital Authority as an administrative area with the status of a Special Zone, which would exercise authority in the preparation, development, and relocation of the Capital City. Therefore, the recent amendments to the IKN Law have not altered the governance design of the Nusantara Capital Authority, which continues to maintain its status as a special region, despite not being in line with the principle of regional autonomy. Penelitian ini mengkaji desain tata kelola Otorita Ibu Kota Nusantara (Otorita Ibu Kota Nusantara), sebagaimana ditetapkan dalam UU No. 21 Tahun 2023 yang mengubah UU No. 3 Tahun 2023 tentang Ibu Kota Negara. Tujuan dari penelitian ini adalah untuk menilai apakah desain tata kelola Otorita Ibu Kota Nusantara telah sesuai dengan prinsip-prinsip otonomi daerah dan untuk mengusulkan konsep tata kelola Otorita Ibu Kota Nusantara di masa depan. Penelitian ini menggunakan pendekatan yuridis normatif, dengan menggunakan metode perundang-undangan dan konseptual, serta menggunakan data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa struktur pemerintahan yang dibentuk berdasarkan UU IKN tidak sesuai dengan prinsip otonomi daerah, sehingga Otoritas Jasa Keuangan tidak dapat diklasifikasikan sebagai pemerintah daerah khusus. Otoritas Modal Nusantara tidak memiliki kewenangan yang mandiri untuk mengelola urusan pemerintahannya, seperti halnya daerah otonom. Berdasarkan temuan ini, penulis mengusulkan desain tata kelola Otoritas Ibu Kota Nusantara sebagai wilayah administratif berstatus Kawasan Khusus, yang akan menjalankan kewenangan dalam penyiapan, pembangunan, dan pemindahan Ibu Kota. Oleh karena itu, amandemen UU IKN yang dilakukan baru-baru ini tidak mengubah desain tata kelola Otoritas Ibu Kota Nusantara, yang tetap mempertahankan statusnya sebagai kawasan khusus, meskipun tidak sejalan dengan prinsip otonomi daerah.
