Abstract

Penelitian ini bertujuan untuk menganalisis keabsahan sertipikat hak milik atas tanah perorangan dan faktor-faktor yang menyebabkan sertipikat perorangan terbit di atas aset tanah pemerintah. Tipe penelitian yang digunakan penulis yaitu Penelitian Normatif Empiris dengan kategori Live Case Study yaitu merupakan pendekatan suatu peristiwa hukum yang prosesnya masih berlangsung atau belum berakhir. Hasil penelitian menunjukkan bahwa: Unsur-unsur keabsahan sertipikat hak milik yaitu data subjektif dan data objektif tidak terpenuhi atau tidak didukung oleh warkah pendaftaran tanah dan faktor-faktor yang menyebabkan sertipikat perorangan terbit di atas aset tanah pemerintah yaitu tidak tertibnya administrasi pertanahan dan peta pertanahan tidak lengkap. This study aims to analyze the validity of individual land ownership certificates and the factors that cause individual certificates to be issued on government land assets. The type of research used by the author is Normative Empirical Research with the Live Case Study category, which is an approach to a legal event whose process is still ongoing or has not ended. The results of the research show that: The elements of the validity of a certificate of ownership, namely subjective data and objective data, are not fulfilled or are not supported by land registration documents and the factors that cause individual certificates to be issued on government land assets are the lack of orderly land administration and incomplete land maps.

Abstract

Tujuan penelitian ini untuk menganalisis penyebab terjadinya tindakan kekerasan yang dilakukan oleh penagih utang (debt collector) dan upaya mencegah tindakan kekerasan yang dilakukan penagih utang di Kota Makassar. Jenis penelitian yang digunakan yaitu penelitian kualitatif dengan pendekatan normatif empiris. Teknik pengumpulan data yang digunakan adalah penelitian kepustakaan dan penelitian lapangan. Analisis data yang digunakan di dalam penelitian ini yaitu menggunakan analisis kualitatif dan kuantitatif. Hasil penelitian ini menunjukkan bahwa bahwa debt collector, yang memiliki ikatan sosial yang lemah dan nilai-nilai yang berbeda dengan masyarakat luas, cenderung melakukan tindakan kekerasan dalam proses penagihan. Hal ini disebabkan oleh berbagai faktor, termasuk tekanan pekerjaan dan sikap tidak kooperatif dari debitor. Upaya pencegahan tindakan kekerasan dalam penagihan utang dapat dilakukan melalui peningkatan kualitas komunikasi yang baik antara debt collector dan debitor, serta kepatuhan terhadap standar operasional prosedur dan pemahaman mengenai hak dan kewajiban masing-masing pihak merupakan faktor kunci dalam membangun hubungan yang baik antara debt collector dan debitor sehingga tindakan kekerasan bisa dihindari dalam proses penagihan. The purpose of this study was to analyze the causes of violent acts committed by debt collectors and efforts to prevent violent acts committed by debt collectors in Makassar City. The type of research used is qualitative research with an empirical normative approach. The data collection techniques used are library research and field research. Data analysis used in this research is using qualitative and quantitative analysis. The results of this study indicate that debt collectors, who have weak social ties and different values from the wider community, tend to commit acts of violence in the collection process. This is due to various factors, including job pressures and uncooperative attitudes from debtors. Efforts to prevent violent acts in debt collection can be made through improving the quality of good communication between debt collectors and debtors, as well as adherence to standard operating procedures and an understanding of the rights and obligations of each party are key factors in building a good relationship between debt collectors and debtors so that violent acts can be avoided in the collection process.

Abstract

Tujuan penelitian ini untuk mengetahui bentuk wanprestasi yang terjadi dalam Perjanjian Pengikatan Jual Beli terhadap objek tanah yang terjadi di Kota Makassar dan mengetahui pertimbangan hukum Hakim terhadap perkara wanprestasi Pengadilan Negeri Makassar. Metode penelitian yang penulis gunakan kualitatif dengan pendekatan normatif-empiris. Hasil penelitian dalam Perjanjian Pengikatan jual beli tanah kedua bela pihak mengikatkan diri dalam jual beli tanah di kelurahan Bangkala, Kecamatan panakukan Kota Makassar dengan luas tanah 8700 m2, lebih lanjut kedua belah pihak juga diharuskan menjalankan kewajibannya masing-masing dengan itikad baik, dan memiliki hak yang diakui berdasarkan kesepakatan para pihak. majelis hakim melakukan pertimbangan-pertimbangan hukum terhadap alat bukti dan saksi yang dihadirkan dalam pesidangan, dengan mengikuti dasar pembuktian dalam hukum acara perdata sebagaimana ketentuan HIR Pasal 164 sebagai dasar dalam memutus perkara.

Abstract

Sertipikat sementara terbit tanpa surat ukur, yang saat berlakunya aturan lama fungsi dan kekuatan hukum sertipikat sementara bisa dipersamakan dengan sertipikat. Tujuan penelitian yaitu untuk mengetahui pertimbangan hukum hakim terhadap kedudukan sertipikat sementara dalam putusan No.158/Pdt.G/2020/PN.Mks, Penelitian ini dilakukan di Pengadilan Negeri Makassar. Metode yang digunakan bersifat kualitatif dengan pendekatan yuridis normatif teknik pengumpulan data melalui wawancara yang dianalisis secara kualitatif deskriptif. Hasil penelitian ini menunjukkan bahwa kedudukan sertipikat sementara memiliki kepastian hukum yang lemah dalam fungsinya sebagai alat bukti kepemilikan hak atas tanah. Sertipikat sementara merupakan sertifikat yang lemah dimata hukum yang berlaku saat ini sehingga dalam kasus ini hakim menganggap bahwa kedudukan sertipikat sementara sangat lemah karena tidak adanya surat ukur secara rinci. Temporary certificates are issued without measurement letters, which when the old regulations come into force, the function and legal force of temporary certificates can be equated with certificates. The aim of the research is to determine the judge's legal considerations regarding the position of the temporary certificate in decision No.158/Pdt.G/2020/PN.Mks. This research was conducted at the Makassar District Court. The method used is qualitative with a normative juridical approach, data collection techniques through interviews which are analyzed descriptively qualitatively. The results of this research indicate that the position of a temporary certificate has weak legal certainty in its function as proof of ownership of land rights. The temporary certificate is a weak certificate in the eyes of the current law, so in this case the judge considered that the position of the temporary certificate was very weak because there was no detailed measurement letter.

Abstract

Penelitian bertujuan untuk mengetahui kekuatan pembuktian rincik sebagai alat bukti kepemilikan atas tanah dan menganalisis pertimbangan hukum hakim dalam putusan perkara perdata Nomor 378/Pdt.G/2023/PN Mks. Metode penelitian yang penulis gunakan metode penelitan normatif-empiris. Hasil penelitian menunjukkan bahwa kekuatan pembuktian rincik sebagai bukti kepemilikan atas tanah akan memiliki pembuktian yang kuat sepanjang rincik itu terdaftar dalam buku F dan buku C yang ada di kantor Kelurahan atau di kantor Desa. Sehingga dapat dijakian dasar sebagai bukti kepemilikan dan dipergunakan untuk permohonan sertifikat, tetapi apabila tidak terdaftar maka rincik itu tidak memiliki kekuatan pebuktian. Sedangkan pertimbangan hukum hakim mengenai Sertifikat Hak Milik Nomor 124/Kel. Barombong dengan menekankan bahwa sertifikat tersebut adalah bukti sah kepemilikan tanah yang telah melalui prosedur hukum yang benar. Karenanya sertifikat tanah yang sah dan terdaftar memberikan kepastian hukum yang kuat bagi pemiliknya The research was conducted to determine the strength of detailed evidence as evidence of land ownership and to analyze the judge's legal considerations in the civil case decision Number 378/Pdt.G/2023/PN Mks. The research method that the author uses is a normative-empirical research method. The results of the research show that the evidentiary power of details as proof of ownership of land will have strong evidence as long as the details are registered in book F and book C at the Subdistrict office or at the Village office. So it can be used as proof of ownership and used to apply for a certificate, but if it is not registered then the details have no evidentiary power. Meanwhile, the judge's legal considerations regarding Certificate of Ownership Number 124/Ex. Barombong emphasized that the certificate is legal proof of land ownership that has gone through the correct legal procedures. Therefore, a valid and registered land certificate provides strong legal certainty for the owner

Abstract

Penelitian ini bertujuan untuk menganalisis: pemenuhan unsur pelanggaran peraturan perundang-undangan yang berlaku di Indonesia dalam praktik undisclosed advertisement, dan penegakan hukum terhadap praktik undisclosed advertisement. Jenis penelitian yang digunakan oleh penulis adalah penelitian normatif, lokasi penelitian yang penulis teliti adalah di Dewan Periklanan Indonesia, dan Komisi Penyiaran Indonesia Daerah Sulawesi Selatan. Teknik penelitian yang digunakan oleh penulis adalah melalui wawancara, observasi, dan studi kepustakaan. Hasil penelitian menunjukkan bahwa: praktik periklanan undisclosed advertisement termasuk bentuk periklanan yang tidak jujur yang bertentangan dengan Etika Pariwara Indonesia, Pasal 17 Undang-Undang Nomor 8 Tahun 1999, Guides Concerning the Use of Endorsements and Testimonials in Advertising, dan Pasal 19 Peraturan Menteri Perdagangan Nomor 50 Tahun 2020, penegakan hukum terhadap pelaku tindakan undisclosed advertisement dapat dilakukan melalui Dewan Periklanan Indonesia. Penegakan hukum dilakukan melalui pemberian teguran dan peringatan, serta himbauan penghentian penayangan iklan This research aims to analyze: 1) fulfillment of the elements of violation of laws and regulations applicable in Indonesia in the practice of undisclosed advertisement, and 2) law enforcement against undisclosed advertisement practices. The type of research used by the author is normative-empirical research, the research location is at the Indonesian Advertising Council, and the South Sulawesi Regional Indonesian Broadcasting Commission. The research technique used by the author is through interviews, observation, and literature study. The results showed that: 1) the practice of undisclosed advertisement is a form of dishonest advertising that is contrary to the Indonesian Pariwara Ethics, Article 17 of Law Number 8 of 1999, Guides Concerning the Use of Endorsements and Testimonials in Advertising, and Article 19 of the Regulation of the Minister of Trade Number 50 of 2020, 2) law enforcement against the perpetrators of undisclosed advertisement can be done through the Indonesian Advertising Council. Law enforcement is carried out through giving warnings, as well as appeals to stop airing advertisements

Abstract

Customary institutions have an important position for indigenous peoples both as cultural symbols and as a means of controlling the lives of indigenous peoples so it is important to be legally protected. Customary institutions need legal certainty through normative recognition from the government. The purpose of this research is first, to analyze the existence of indigenous peoples through three indicators: (1) there is a customary law community (2) there is an area or customary land (3) there is a customary legal order. Second, to analyze the registration of customary land rights as a legal strategy to empower customary institutions. The type of research used is qualitative with a normative-empirical approach. The normative approach uses the Regulation of the Minister of Agrarian and Spatial Planning/Head of the National Land Agency Number 14 of 2024 concerning the Implementation of Land Administration and Registration of Customary Land Rights of Customary Law Communities. While the empirical approach is through a survey of the existence of indigenous peoples. There are two types of data used, namely primary data obtained through interviews and secondary data obtained through the review of laws and regulations, journals and legal literature. The results showed that first, the existence of Patongloan customary law communities fulfills the indicators: (1) There is a group of people who have an attachment to hereditary traditions adhered to as guidelines for daily life including in dispute resolution, (2). There is a customary area occupied by the community to fulfill the needs of life together, called customary land. (3), There is a customary legal order inherited by the Patongloan community. Second, the strategic step to empower Patongloan customary institutions is through the registration of customary land rights at the Enrekang Regency Land Office. This study recommends that Patongloan customary institutions register their customary land in the form of management rights and/or as joint property rights.

Abstract

The purpose of this research is to find out the legal arrangements related to the redistribution of agricultural land in Indonesia and how the implementation of this agricultural land redistribution activity at Pangkajene Kepulauan Regency and to see the related obstacles in its implementation. The empirical juridical approach method is the research method used, and uses nonrandom sampling techniques, which are deliberately chosen with certain parameters. Research with primary data and secondary data that are assessed in quality by separating in the form of sentences that are in harmony with the subject matter being studied. The location of the assessment was carried out at the Pangkajene Kepulauan District Land Office and in the Biraeng Village, Minasatene District and Minasatene Village, Minasatene District. From the research results, it is known that the application of Government Regulation No. 224 of 1961 is not in line with current developments, so with the issuance of Presidential Regulation. Number 86 of 2018, could be a solution in solving cases that occur. Redistribution of Agricultural Land in Pangkajene Kepulauan Regency is well implemented. Although there are obstacles, namely the lack of good coordination between the regional government and the community and the target subject has not been designated as the recipient of agricultural land redistribution activities.

Abstract

This research was conducted in Erelembang Village, Buttono Pao District, Gowa Regency and the office of the Alliance for Indigenous Peoples of the Archipelago (AMAN) in South Sulawesi, with the aim of knowing the fulfillment of the requirements for the recognition application for Matteko customary forest in the Kecamatan Buttono Pao and what factors are the obstacles in the application for recognition. Matteko's indigenous peoples' rights to Matteko's customary forest in Tapio Pao District. This research is a normative legal research with a focus on empirical juridical studies. The results of this study indicate that the requirements for the application for recognition of customary forests of the matteko customary law community have been fulfilled and the factors that hinder the recognition of customary law communities are that there are no technical procedures and mechanisms for recognition and respect for indigenous peoples as well as other factors that result in the role of local governments being less optimal in providing protection and recognition of indigenous peoples, the Government has been slow to identify the Matteko indigenous peoples, so that the Matteko indigenous peoples never know their rights and there is no socialization of their customary territories.

Abstract

This study aims to determine the occurrence of agreements in electronic transactions, and forms of dispute resolution in electronic transactions. Thisaresearch was conducted in Makassar Cityausing normative legal research methods, namely research that uses data collection as the main data source and/or data collection through interviews as the main resource person. The results show that there is an agreement in an electronic transaction if there is an offer, acceptance, payment, and delivery, this has been regulated in Government Regulation number 80 of 2019 concerning trading through electronic systems, there are two forms of dispute resolution in electronic transactions, namely legal remedies Preventive measures can be interpreted as all efforts made to prevent the occurrence of an unwanted event or situation. In e-commerce transactions, this unwanted situation is the occurrence of losses, especially losses on the part of consumers and secondly, repressive legal remedies are legal remedies taken to resolve a legal problem that has already occurred. This legal remedy is used if there has been a dispute between business actors and consumers.
