Abstract

This study aims to determine and analyze the obstacles in the implementation of compensation payments on land acquisition for the Nipa-Nipa’s Dam in Gowa Regency and toafind out and analyze the howathe problem of compensation for land acquisition for the Nipa-Nipa Dam in Gowa can be solved. The research method used is an empirical-normative research method, which is field data as the main data source such as the results of interviews and observations. The results of the study indicate in the implementation of compensation payments on land acquisition at the Nipa-Nipa Dam in Gowa Regency, the obstacles are, the occurrence of free buying and selling of land, the existence of absentee/guntai land ownership, and not agreeing with the price offered. compensation for land acquisition for the Nipa-Nipa Dam in Gowa Regency, namely, the active role of the land acquisition committee in conducting consensus deliberation, mediation and persuasive approaches, understanding and understanding of the social function of land. The Central and Regional Governments, especially the Gowa Regency land office, should be obliged to provide an in-depth understanding of land acquisition through legal counseling, especially land law (Agrarian) both to sub-district, village/kelurahan government officials, as well as leaders and the community intensively so that better implementation in the future. People whose land is affected by the construction of the Nipa-Nipa Dam in Gowa Regency have a better understanding of the social functions of land, so that they do not ask for such high compensation so that land acquisition for the construction of the Nipa-Nipa dam can be completed.

Abstract

This thesis aims to determine the process of issuing the bill of lading at PT. Samudra Indonesiaand the legal consequences in the process of issuing bill of lading through sea transportation.Themethod used in writing this final report is a normative-empirical method, the data used isprimary data, namely data obtained by direct interviews with PT. Samudra Indonesia Makassarbranch and secondary data obtained from literature/books, documents and laws andregulations.The results of this study indicate the publishing process Bill of Lading(consignment). In the implementation of issuing the Bill of Lading, the Shipper places an orderfor the ship (booking space), makes Shipping Instructions (SI), Shipping Instructions are thensent to the Shipping Company to do a Stuffing Report, after doing a Stuffing Report publishingDraft Bill of Lading, Shipping Line and Shipper represented by PT. Samudra Indonesia'scorrection has been completed and it is correct that the Bill of Lading has been issued. The legalconsequences in the issuance of this bill of lading are the birth of rights and obligations on theagreed agreement, namely,the carrier binds to carry out the safe transportation of goods orpeople from a certain destination, while the sender binds himself to pay the cost of transportationand the expeditor is an intermediary who is willing to serve the transportation of goods and isresponsible for ordering transport, as for the consequence of not carrying out the obligation tocause a default, namely the party the defaulter compensates for the loss to the aggrieved party.

Abstract

Penelitian ini dilakukan di kota Makassar, dengan tujuan untuk mengetahui perlindungan hukum pemegang sertifikat hak milik atas tanah melalui keputusan hukum tata usaha Negara. Penelitian ini merupakan penelitian kualitatif dengan focus kajian yuridis deskriptif. Hasil penelitian menunjukkan bahwa Keputusan Tata Usaha Negara (KTUN) yang telah dikeluarkan dianggap sah menurut hukum, akan tetapi di dalam praktiknya hampir semua surat keputusan terdapat klausula pengaman yang berbunyi, “Apabila di kemudian hari terdapat kekeliruan dan kekurangan, maka surat keputusan ini akan ditinjau kembali”. Rumusan seperti ini bertentangan dengan asas kepastian hukum karena klausula ini dapat menggoyahkan sendi-sendi kepastian hukum dan melemahkan perlindungan hukum kepada subjek hukum. Keputusan Tata Usaha Negara di bidang pertanahanpun kerap kali dibatalkan seperti pembatalan sertifikat hak atas tanah walaupun sertifikat ini merupakan bentuk pengakuan dari pemerintah terhadap hak-hak atas tanah masyarakat dan mempunyai akibat hukum, namun masih banyak kasus pemegang sertifikat hak atas tanah yang beriktikad baik, dihadapkan pada gugatan pihak lain yang merasa berkepentingan dengan tanah/sertifikat tersebut. Hal ini membuktikan bahwa dengan memiliki sertifikat tanah, dalam kaitan dengan kepastian dan perlindungan hukum pemilik tanah belum aman dari gugatan pihak-pihak yang merasa berkepentingan dengan terbitnya sertifikat tanah.

Abstract

This study aims to determine the elements of unlawful acts against the Peace Decision No.23/Pdt.G.S/2019/PN Tka in civil cases and to find out the actions that can be taken against parties who commit acts against the law on the Peace Decision No. 23/Pdt.G.S/2019/PN Tka. The research method used is normative legal research and empirical research. Normative legal research is legal research carried out by examining library materials as the basis for research by conducting searches on regulations and literature related to the problems studied. Empirical research includes a study that seeks to identify the laws that exist in society with a view to knowing other symptoms. The results of the study indicate that the elements of unlawful acts have been fulfilled in the Peace Decision No. 23/Pdt.G.S/2019/PN.Tka where the respondent party does not pay the installments that have been determined by the judge in the peace deed and the actions taken against the party who committed an unlawful act on the Peace Decision No. 23/Pdt.G.S/2019/PN.Tka. 23/Pdt.G.S/2019/PN.Tka is to apply for execution.

Abstract

Auction is the sale of goods that are open to the public with a written and/or verbal price offer that is increasing or decreasing to reach the highest price, which is preceded by the announcement of the auction. This study aims to determine the legal protection measures against the winner of the land auction. The research method used is empirical legal research by collecting systematic data, recording, interpreting, and critically analyzing facts or data as well as making reports and information on symptoms studied from various aspects to find conclusions. All data that has been obtained are then analyzed and described in a qualitative descriptive manner. The results showed that the auction rules were not implemented in practice. Makassar District Court Decision No. 278/Pdt.G/2018/Pn.Mks cancel the SHM owned by the Auction Winner because the SHM is manipulative. The lack of in-depth data analysis and the application of the rules of the auction procedure on Mortgage are the factors that cause the winner of the auction to lose his rights. One of the actions that can guarantee legal protection for the winner of the auction is through the courts. Where in this case, the auction winner can make the decision of the case his basis for demanding accountability for the parties involved in the auction process for the land object. Such as KPNL and BPN carry out administrative responsibility and the seller (Bank) compensates for all costs that the winner of the auction redeems in the auction process. Abstract

This study aims to: (1) determine the elements of unlawful acts on the sale of company goods to third parties in Makassar. (2) knowing the legal remedies taken by the company against the helper selling the company's goods without permission to a third party. The type of research used is normative-empirical, normative research is used to answer the first problem, and empirical research is used to answer the second problem. The results of this study indicate that: (1) the sale of company goods by assistants to third parties without the company's permission is an act against the law as regulated in Article 1365 of the Civil Code. (2) Legal efforts made by the company against the company's assistants filed a lawsuit to the Makassar District Court.

Abstract

This study aims to determine and analyze the position of the will of the heirs to the absolute part of the heirs. The research method used is qualitative legal research. The types and sources of data consist of primary data in the form of laws and regulations, and Court Decisions as well as secondary legal materials consisting of books, articles and journals related to this research. The entire legal material is collected in a structured systematic manner using qualitative measures and presented in a descriptive analysis. The results of the study indicate that a will or testamental grant that violates the "legitieme portie" is considered "null and void" by itself andais considered to have noibinding force fromithe start. However, inipractice, a testament deed / will grant isivalid even if it containsia violation of the heir's legitimacy portie, ias long as it has not been canceled by the injured heir, so that its nature is no longer "null and void" but becomes "cancellable" and There are 2 (two) types of legal consequences related to a grant or testamentary grant that violate the absolute or legitime portie depending on the legitimate action. If the legiti- mate does not object, then the act of grant or testamentary grant that violates the absolute or legitime part of the portie is considered valid and enforceable if the legiti- mate demands his rights, then the provision in the grant or testamentary grant that violates the absolute part or legitime portie cannot be carried out and refers to Article 920 of the Civil Code, thus the deed remains valid as long as it is not contested by the heirs.

Abstract

This study aims to determine: 1). How is the implementation of legal protection against the granting of a marriage dispensation application at the Sungguminasa Religious Court 2). How are the rights of children as a result of the marriage dispensation at the Sungguminasa Religious Court. The research method used is field research with data collection techniques, namely interviews and documentation and analyzed qualitatively. The results showed 1). The implementation of legal protection for the granting of a marriage dispensation application at the Sungguminasa religious court. Regarding the Marriage Dispensation at the Sungguminasa Religious Court, the judge basically understood well, in which case the judge in deciding the decision on a marriage dispensation case referred to the Compilation of Islamic Law (KHI) and Law Number 35 of 2014 concerning Child Protection. In determining the application for a marriage dispensation, the judge has used various considerations and legal grounds related to the granting of a marriage dispensation. Although the age limit for marriage requirements has been regulated, at the practical level the application is flexible. This means, if it is a case of an emergency in order to avoid mafsadah (damage) then dispensation must be given and immediately married. 2). As a result of the stipulation of marriage dispensation at the Sungguminasa Religious Court, it causes the rights of the child to be unfulfilled. In this case, the child loses the opportunity to continue his education, loses the opportunity to develop and express, be creative, and take advantage of free time. If viewed from the application of Law Number 35 of 2014 concerning Child Protection against marriage dispensation cases at the Sunggumiansa Religious Court, it has not been effective because in this case the form of protection provided by the Religious Courts to applicants for marriage dispensation is limited to protecting children from discriminatory treatment regardless of the rights of the child being protected. other.

Abstract

Penelitian ini bertujuan untuk menganalisis dampak hukum dari perjanjian jual beli tanah yang tidak dilakukan di hadapan Pejabat Pembuat Akta Tanah (PPAT) di Kabupaten Bima. Penelitian ini menggunakan metode kualitatif dengan pendekatan normatif-empiris. Data dikumpulkan melalui wawancara dengan Koordinator Kelompok Substansi Pendaftaran Tanah dan Ruang, Tanah Komunal, dan Kelembagaan BPN Kabupaten Bima, serta dengan Kantor Notaris/PPAT Rajiman, S.H., M.Kn., Kepala Desa Lido, dan melalui penyebaran kuesioner kepada 45 responden dari masyarakat Kabupaten Bima. Hasil penelitian menunjukkan bahwa perjanjian jual beli tanah yang tidak dibuat di hadapan PPAT hanya menghasilkan akta di bawah tangan, sehingga peralihan hak atas tanah tidak dapat didaftarkan di Kantor Badan Pertanahan Kabupaten Bima. Hal ini melemahkan kekuatan pembuktian akta tersebut, karena hanya dibuat oleh para pihak tanpa melibatkan PPAT, yang berakibat pada lemahnya kepastian hukum peralihan hak. Upaya yang dapat dilakukan oleh pembeli tanah yang melakukan jual beli tanpa PPAT adalah meminta penetapan dari Pengadilan Negeri untuk mendapatkan kepastian hukum sebagai pemilik sah atas tanah tersebut. This research aims to analyze the legal impact of land sale and purchase agreements that are not carried out before the Land Deed Making Official (PPAT) in Bima Regency. This research uses qualitative methods with a normative-empirical approach. Data was collected through interviews with the Coordinator of the Land and Space Registration Substance Group, Communal Land, and BPN Institutions of Bima Regency, as well as with the Notary/PPAT Office Rajiman, S.H., M.Kn., Head of Lido Village, and through distributing questionnaires to 45 respondents from the community Bima Regency. The results of the research show that land sale and purchase agreements that are not made before the PPAT only result in private deeds, so that the transfer of land rights cannot be registered at the Bima Regency Land Agency Office. This weakens the evidentiary strength of the deed, because it was only made by the parties without involving the PPAT, which results in weak legal certainty regarding the transfer of rights. Efforts that can be made by land buyers who carry out buying and selling without PPAT are to request a determination from the District Court to obtain legal certainty as the legal owner of the land.
