Abstract

Kekerasan seksual terhadap anak merupakan isu serius yang masih marak terjadi di lingkungan pendidikan, termasuk di Indonesia. Dampaknya mencakup kerusakan fisik, mental, dan sosial anak, serta menghambat tumbuh kembang mereka. Di SMP Desa Numbing, kurangnya pemahaman dan sosialisasi terkait perlindungan anak menjadi hambatan utama. Penelitian ini bertujuan untuk meningkatkan pemahaman siswa mengenai kekerasan seksual melalui kegiatan sosialisasi dan edukasi hukum. Kegiatan dilakukan melalui penyuluhan interaktif dua arah, meliputi koordinasi, pra-survei, pemaparan materi, pembagian buku saku, diskusi studi kasus, dan evaluasi melalui kuisioner online. Hasil dari kegiatan ini menunjukkan peningkatan pemahaman siswa SMP Desa Numbing terhadap kekerasan seksual. Kegiatan dilaksanakan pada 10–11 Juni 2024 dan diikuti oleh 46 siswa kelas VII dan VIII. Pra-survei menunjukkan bahwa 58,7% siswa menganggap sentuhan tanpa izin dapat dibenarkan jika hanya bercanda. Setelah pemaparan materi oleh dosen hukum pidana dan sesi diskusi, evaluasi pasca-kegiatan menunjukkan perubahan persepsi signifikan. Siswa menyadari bahwa tindakan tersebut merupakan bentuk kekerasan seksual. Dengan demikian, kegiatan pengabdian ini berhasil mencapai tujuannya dalam meningkatkan pemahaman siswa mengenai pencegahan dan konsekuensi hukum kekerasan seksual terhadap anak. Kesimpulan kegiatan ini ialah meningkatnya pemahaman siswa SMP Desa Numbing terhadap kekerasan seksual setelah sosialisasi. Harapannya, pengetahuan yang diperoleh dapat berkontribusi dalam upaya pencegahan serta meminimalkan risiko terjadinya kekerasan seksual di lingkungan sekolah.

Abstract

Trafficking in persons is regulated in Law Number 21 of 2007 concerning eradicating the Crime of Trafficking in Persons. One form of legal protection for victims is the provision of compensation in the form of restitution. Children and women were often victims of the crime of trafficking in persons. The problem how is the application of compensation in the form of restitution to children as victims of criminal acts of trafficking in persons in the jurisdiction of the city of Padang. What are the obstacles in the application of compensation in the form of restitution to children as victims of criminal acts of trafficking in persons in the jurisdiction of the city of Padang? The study uses an empirical legal. Data collection techniques are through interviews and document studies, and data analysis is qualitative. The conclusion is the application of restitution for children who are victims of criminal acts of trafficking in persons in the jurisdiction of the city of Padang has not been optimal. The obstacle in implementing restitution for children as victims of the crime of trafficking in persons is the lack of awareness of law enforcement officers on victim protection, especially restitution, which results in the rights of the victims of criminal acts being often neglected because they tend to be law enforcement are more focused on imposing criminal charges against perpetrators.

Abstract

This article aims to analyze the relationship between state withdrawal and the jurisdiction of the International Criminal Court (ICC), particularly in the context of the Philippines' decision to withdraw from the Rome Statute. The problem is focused on the legal implications of such a withdrawal, especially in terms of how it influences the ICC's authority to investigate and prosecute crimes committed prior to the effective withdrawal date. This issue is exemplified by the Philippines' controversial "war on drugs" campaign under President Rodrigo Duterte, which has led to the deaths of thousands of civilians and is alleged to constitute serious human rights violations and crimes against humanity. In order to approach this problem, a normative theoretical reference is used to examine international law and the principles of accountability that underpin the ICC’s mandate. Data is collected through a comprehensive analysis of legal texts, court rulings, and relevant case studies. This study concludes that despite a state’s formal withdrawal from the Rome Statute, its responsibility for international crimes committed before the withdrawal remains intact. The ICC continues to hold jurisdiction over such crimes, as demonstrated by its ongoing investigation into the deaths linked to Duterte’s policies. This case highlights significant challenges related to political sovereignty, while also raising critical questions about the tension between national autonomy and global justice.

Abstract

Penelitian ini menganalisis ketidaksesuaian praktik hukuman mati di Indonesia, khususnya untuk kejahatan narkotika, dengan standar hukum internasional seperti ICCPR dan General Comment No. 36 Komite HAM PBB. Dengan metode yuridis normatif dan pendekatan interpretatif-komparatif, penelitian mengungkap bahwa Indonesia masih menerapkan hukuman mati untuk kejahatan non-kekerasan, bertentangan dengan prinsip “kejahatan paling serius” dalam hukum internasional. Temuan baru menunjukkan bahwa reformasi KUHP 2023, meski memperkenalkan masa percobaan 10 tahun, belum mengarah pada penghapusan substantif hukuman mati, melainkan hanya modifikasi prosedural. Analisis ini juga mendalami konsekuensi moratorium dan potensi status hukuman mati di masa depan, termasuk implikasi diplomatik dan hambatan ekstradisi. Penelitian menyoroti perlunya harmonisasi kebijakan nasional dengan norma HAM global serta rekomendasi untuk moratorium eksekusi.

Abstract

Perlindungan anak adalah segala usaha agar setiap anak dapat mewujudkan hak dan tanggung jawabnya terhadap tumbuh kembang anak, baik secara alamiah, jasmani, rohani, dan sosial. Dalam melaksanakan kegiatan pengabdian dengan model siklus deming yang terdiri dari empat tahapan, yakni perencaraan, melakukan, pemeriksaan dan tindak lanjut. Diagram tersebut menunjukkan hasil pemahaman siswa SMP Numbing setelah menerima pemaparan materi terkait bullying. Berdasarkan diagram tersebut, mayoritas siswa, yaitu 66%, setuju bahwa mereka mengerti bullying dapat berupa fisik, verbal, dan sosial. Sebanyak 26% siswa sangat setuju dengan pernyataan tersebut, sementara 8% sisanya menyatakan tidak setuju. Ini menunjukkan bahwa setelah menerima materi, sebagian besar siswa mengalami peningkatan pengetahuan terkait bentuk-bentuk bullying, dan menunjukkan pemahaman yang cukup baik. Pengabdian perlindungan anak terhadap tindak pidana bullying dilaksanakan agar siswa-siswa di SMP Numbing mendapatkan pengetahuan dan bimbingan terkait segala jenis bullying, sehingga mereka dapat mencegah dan meminimalisir tindakan bullying yang kerap terjadi dilingkungan sekolah. Berdasarkan hasil dari kuesioner sebelum dan sesudah pemaparan, menunjukan bahwa siswa-siswa tersebut mengalami peningkatan.

Abstract

The armed conflict between Israel and Iran, involving cross-border missile launches through Syrian airspace, presents complex challenges under international law. This study analyzes the legal implications of such violations, focusing on state sovereignty, state responsibility, and the justification of force under Article 51 of the UN Charter. Using a normative juridical method, the research evaluates the effectiveness of international legal instruments such as the UN Charter, the 1944 Chicago Convention, and the Articles on Responsibility of States for Internationally Wrongful Acts (ARSIWA) 2001 in addressing modern aerial threats involving third-party states. The findings reveal a legal vacuum regarding the regulation of long-range missiles and armed drones, often exploited by powerful states to avoid accountability. Syria, a neutral state in the Israel-Iran conflict, has suffered civilian casualties and sovereignty violations without effective international legal remedies. Furthermore, the self-defense justifications put forward by both Israel and Iran fail to meet the criteria of necessity and proportionality and infringe upon the principle of non-intervention. The weak response from the international community exacerbated by the UN Security Council’s inaction and ICAO’s limited mandate underscores the urgent need for legal reform. This study advocates for the enhancement of international institutional mandates, the development of additional protocols on aerial warfare, and the ratification of ARSIWA to strengthen legal accountability and protect third-state airspace in armed conflict.

Abstract

The northern coast of Bintan Island, Indonesia, faces recurring oil sludge pollution during the northeast monsoon, primarily due to illegal discharges from ships in the Singapore Strait. This environmental threat has degraded coastal ecosystems, reduced fishery yields, and weakened tourism-based livelihoods. Currently, there is no coordinated response involving multiple stakeholders. Cleanup efforts are limited and fragmented. This study explores ecotourism as a strategic response to environmental and economic challenges. In response, the study introduces oil sludge ecotourism as a dual-purpose strategy that integrates coastal clean-up with sustainable tourism. By reframing remediation as a conservation-oriented experience, this model aligns with ecotourism principles emphasizing ecological restoration, community participation, and low-impact engagement with nature. It offers the potential to raise environmental awareness, diversify local incomes, and strengthen stewardship. If implemented effectively, oil sludge ecotourism could transform pollution-affected coastal zones into resilient, conservation-driven destinations. This model may serve as a replicable solution for other regions facing similar challenges, demonstrating how environmental degradation can be converted into opportunities for sustainable development.

Abstract

Humanitarian law is a set of rules based on international treaties and international customs that limit the powers of belligerent parties to use the means and means of war to defeat the enemy and regulate the protection of war. International humanitarian law is closely related to human rights (hereinafter referred to as human rights), both of which concern the right to protection and the existence of human beings that must be guarded and protected when related to threats of violence and violations that occur to humans when war occurs. Problems regarding human rights violations are related to the protection of human dignity from crimes, especially international crimes that are cruel and have a broad impact on humanity. The formulation of the research problem: 1) The crime of genocide that occurred against the Rohingya ethnicity in the perspective of international criminal law? 2) Accountability for the crime of genocide against the Rohingya? Research conclusions: 1) If a crime does not contain an international dimension, then there is the main condition, namely the touch of universal human values, legal awareness and a sense of justice for mankind. Although there is no international dimension in it, but the incident can be said to be an international crime because it caused reactions, sympathy, and condemnation by the entire international community for such heinous and inhumane acts. 2) The responsibility for all inhumane treatment of the Rohingya Ethnic, seen from the Rome Statute setting regarding individual and command responsibility can be punished. The responsibility in the ICC is that the Court adheres to individual criminal responsibility (Individual Criminal Responsibility) which in Article 25 paragraph (1) of the Court's jurisdiction is over persons or individuals who must be responsible for the crimes they have committed as stipulated in the ICC Statute.

Abstract

This study examines state legal responsibility in addressing corporate- driven climate violations in developing countries, focusing on the gap between normative commitments and actual enforcement. The central question is how state liability should be constructed to effectively regulate corporations that contribute significantly to greenhouse gas emissions and environmental degradation. Using a juridical normative and comparative approach, the analysis covers Indonesia, Brazil, and South Africa to identify similarities, differences, and weaknesses in integrating international principles into domestic legal systems. The findings reveal that while national laws recognize the duty to protect the environment and uphold human rights, enforcement remains fragmented, symbolic, and subordinated to short-term economic interests. This creates a structural accountability gap that facilitates corporate impunity, compounded by power imbalances, inadequate institutional capacity, and the absence of robust extraterritorial enforcement mechanisms. The novelty of this research lies in an integrated framework combining state responsibility, corporate accountability, and climate justice, emphasizing extraterritorial obligations and independent national climate adjudication mechanisms. This model operationalizes climate justice as a binding legal standard, harmonizes domestic laws with international obligations, and improves access to justice for affected communities. The tangible output of this study is a normative–comparative regulatory model and policy recommendations for legislators, environmental law practitioners, and international organizations to reform legal frameworks for corporate climate accountability in developing countries. By bridging the gap between norms and practice, the framework offers both conceptual contributions and practical guidance for legal reform, ultimately promoting sustainable development grounded in ecological protection and intergenerational equity.
