Abstract

Justice collaborators, or "crown witnesses," have become essential in modern criminal justice systems, particularly in dismantling organized crime and uncovering complex murder cases. This study explores the legal protections afforded to justice collaborators in Indonesia through a doctrinal analysis of the Supreme Court Decision No. 1704 K/PID.SUS/2022, commonly known as the Richard Eliezer verdict. The objective is to critically examine the adequacy and application of legal safeguards provided to individuals who cooperate with law enforcement while implicated in serious crimes. Employing normative legal research methods and a statutory and case approach, the paper reveals discrepancies in the implementation of protections for justice collaborators. While the Indonesian Witness and Victim Protection Agency (LPSK) offers procedural protections, this analysis identifies significant gaps in enforcement, judicial interpretation, and institutional coordination. The findings underscore a need for stronger legislative frameworks and consistent judicial standards to uphold the rights and safety of justice collaborators. The implications extend to criminal law reform and the balancing of retributive justice with restorative mechanisms. This study contributes to the legal discourse on human rights protections in criminal procedure, particularly concerning vulnerable individuals assisting the justice system under duress or threat.

Abstract

This paper is the result of descriptive research to examine the use of firearms by certain Immigration Officials within the scope of the Directorate General of Immigration in the implementation of Immigration functions in the field of law enforcement and state security. The purpose of this study is to provide an overview of the use of firearms in accordance with Law Number 63 of 2024 concerning the Third Amendment to Law Number 6 of 2011 concerning Immigration. The approach method used is the normative juridical method, namely the application of analysis based on a statutory approach and a comparative approach to international practice. The results of the study state that there is no regulation governing the use of firearms within the scope of the Directorate General of Immigration so that it must be made immediately in order to provide comprehensive legal protection in the implementation of the Immigration function.

Abstract

General elections are the main means of realizing people's sovereignty in Indonesia's democratic system, which is based on the principle of the rule of law. In practice, legal issues arise regarding the mechanism for replacing elected members of the House of Representatives of the Republic of Indonesia (DPR RI) before their inauguration, especially when the replacement is not entirely based on the highest number of votes. This condition has sparked debate regarding its compatibility with the principles of legal certainty and democracy. This study aims to analyze the compatibility of the mechanism for replacing elected DPR RI members prior to inauguration with the principle of legal certainty and to examine the legal consequences of this practice. The research uses a normative legal method with a legislative, case, and conceptual approach. The legal materials consist of primary legal materials in the form of legislation related to elections and secondary legal materials in the form of literature and legal doctrine. The analysis is conducted in a prescriptive-analytical manner. The results of the study indicate that the provisions on the replacement of elected candidates in Law No. 7 of 2017 on General Elections still contain unclear norms, particularly regarding the reasons for resignation and the authority of political parties in determining replacement candidates. This ambiguity has the potential to cause legal uncertainty, disregard the will of the voters, and reduce the legitimacy of the election results. Therefore, it is necessary to strengthen and affirm election regulations in order to guarantee legal certainty and protect the sovereignty of the people. This article contributes by critically examining the normative ambiguity of pre-inauguration replacement mechanisms and its impact on legal certainty and popular sovereignty.

Abstract

This study critically examines the constitutionality of Indonesia’s presidential candidacy threshold under Article 222 of Law No. 7 of 2017 in relation to the principle of popular sovereignty in Article 1(2) of the 1945 Constitution. The threshold requiring a party or coalition to hold 20% of DPR seats or 25% of the popular vote has been controversial for limiting voter choice and reinforcing oligarchic dominance. Using a normative legal research method, the study applies doctrinal interpretation through grammatical, systematic, historical, and teleological approaches to evaluate whether the threshold is consistent with constitutional democracy. The analysis identifies a disconnect between the legislative rule and the constitutional concept of sovereignty residing with the people, informed by theories of democracy, sovereignty, and progressive legal thought. While procedurally legitimate, the threshold lacks substantive constitutional validity because of its exclusionary impact on political participation. The study proposes four reform options: repeal, proportional adjustment, judicial reinterpretation, and constitutional amendment. These reforms would realign electoral rules with democratic principles and restore voters’ political agency. A doctrinal reinterpretation model is offered, framing the threshold as a regulatory instrument rather than a rigid barrier, advocating a legal structure that promotes inclusivity and reflects the people’s general will.

Abstract

The rights of justice collaborators (JCs) to obtain sentence reductions in murder cases remain inconsistently applied within Indonesia’s criminal justice system. This research addresses three core issues: the normative legal basis for JC rights, the consistency of judicial decisions in granting those rights, and the necessity for legal reform. Using a normative juridical approach supported by document analysis and expert interviews, the study examines Law No. 31/2014, SEMA No. 4/2011, and recent judicial decisions, including the high-profile cases of Richard Eliezer and Abdul Khoir. Findings reveal that while legal provisions exist, the absence of detailed indicators, formal mechanisms for status determination, and binding multi-institutional coordination leads to implementation gaps. Judicial discretion remains unchecked, resulting in unequal treatment of justice collaborators with similar contributions. The study concludes that a lex specialis law is urgently needed to standardize definitions, evaluation mechanisms, and inter-agency protection schemes. Recommendations include harmonization of technical norms, incorporation of JC recognition in verdicts, and alignment with UNCAC and UNTOC standards. This would strengthen legal certainty, uphold the principle of nulla poena sine lege, and enhance the effectiveness of the criminal justice system in addressing serious crimes through systemic cooperation.

Abstract

Undang-Undang Lalu Lintas dan Angkutan Jalan (UULAJ) mengatur bahwa kecelakaan lalu lintas merupakan tindak pidana yang memerlukan perhatian serius dari berbagai pihak. Angka kecelakaan yang terus meningkat memperburuk penanganan perkara ini, yang berdampak pada kesulitan aparat penegak hukum dalam menyelesaikan kasus dan memastikan pemenuhan hak-hak korban. Penelitian ini, yang bersifat hukum normatif, fokus pada analisis terhadap peraturan perundang-undangan, keputusan pengadilan, dan asas-asas yang terkandung dalam UULAJ. Penelitian ini bertujuan untuk mengkaji penerapan Restorative Justice (Keadilan Restoratif) oleh penegak hukum dalam penyelesaian perkara pidana kecelakaan lalu lintas, serta untuk mengevaluasi kesesuaian penerapan restorative justice dengan prinsip hukum positif Indonesia. Temuan penelitian ini menunjukkan bahwa penerapan keadilan restoratif dalam kasus kecelakaan lalu lintas memiliki potensi besar untuk menciptakan keadilan yang lebih manusiawi, sekaligus mendukung asas peradilan yang cepat, sederhana, dan murah.

Abstract

Penelitian ini bertujuan untuk menentukan hak waris anak angkat yang tidak terdaftar, pertimbangan orang tua angkat dalam memberikan warisan, serta perlindungan hukum yang tersedia bagi anak angkat yang tidak terdaftar. Dalam masyarakat patrilineal atau matrilineal, jika orang tua tidak memiliki keturunan atau ahli waris, keponakan atau keponakan perempuan yang memiliki hubungan darah diadopsi sebagai pengganti. Keponakan atau keponakan perempuan ini dirawat, dibesarkan, dan dididik berdasarkan rasa kekeluargaan dan kemanusiaan. Metode yang digunakan dalam penelitian ini adalah kualitatif dengan pendekatan yuridis normatif. Pendekatan ini didasarkan pada hukum yang berlaku dan kenyataan praktis, yang didasarkan pada data primer berupa literatur dan data sekunder berupa literatur. Hasil penelitian menunjukkan bahwa anak angkat yang tidak terdaftar tidak berhak atas warisan dari orang tua angkatnya karena, berdasarkan statusnya, mereka tidak dapat menjadi ahli waris. Namun, anak-anak yang diadopsi tetap memiliki bagian dari harta yang ditinggalkan oleh orang tua angkat mereka, yaitu melalui hibah atau wasiat wajib, yang diatur hingga maksimal 1/3 dari harta pewaris. Pertimbangan orang tua angkat dalam memberikan warisan kepada anak-anak yang diadopsi tidak hanya didasarkan pada status mereka sebagai anak yang diadopsi, tetapi juga pada fakta bahwa mereka masih memiliki hubungan dengan orang tua kandung anak yang diadopsi yang telah meninggal. Perlindungan hukum bagi anak angkat yang tidak terdaftar dapat diperoleh berdasarkan Pasal 209 ayat (1) Kitab Undang-Undang Hukum Pidana (KUHP), serta ketentuan pendukung lainnya. Oleh karena itu, meskipun tidak terdaftar, anak angkat tetap memiliki hak yang dilindungi secara hukum dan dapat menerima bagian dari warisan orang tua angkatnya melalui hibah atau wasiat.

Abstract

This study was motivated by the important role of terminal supervisors in maintaining order and safety in public transportation, which often faces various administrative, technical, operational, ethical, and legal violations. This study formulates two main issues: the duties and responsibilities of supervisors in enforcing order and safety. The method used is normative juridical with a legislative and conceptual approach. The results of the study show that violations include vehicles without route permits, unroadworthy vehicles, shadow terminals, and violations of service ethics and traffic laws. Meanwhile, the implementation of terminal supervisors' duties still faces various obstacles, such as limited human resources, limited authority, a lack of technological facilities, and a lack of synchronization of regulations between agencies. This study emphasizes the importance of strengthening legal authority, training, and inter-agency synergy to improve the effectiveness of supervision at terminals

Abstract

This study was motivated by the importance of legal protection for passengers as consumers of public transportation services, especially in relation to the responsibility of transportation companies in the event of an accident. The research question in this study is what form of responsibility public transportation companies have for accidents that befall passengers and what legal measures passengers can take to obtain compensation. The method used is normative juridical research with a legislative and conceptual approach. The results show that public transportation companies have full responsibility for passenger safety from departure to arrival at their destination, in accordance with Law Number 22 of 2009 concerning Road Traffic and Transportation and the Civil Code. Passengers who suffer losses due to accidents have the right to claim compensation through civil, criminal, or administrative mechanisms in accordance with the level of fault committed. Thus, the role of public transportation companies is very important in providing legal certainty, protection, and a sense of security for the community who use transportation services

Abstract

This research will explore the use of technology so that it can strengthen the legal system in Indonesia and examine best legal practices in various countries to improve consumer data protection in e-commerce. Consumer protection legal research is increasingly urgent given the risks that continue to evolve and have a significant impact on consumers. The formulation of this research problem is: 1) How is the protection of business civil law in providing protection for consumers related to the misuse of consumer personal data in e-commerce transactions? 2) What are the legal actions against the misuse of consumer data in e-commerce? This thesis research uses normative legal types on consumer protection and misuse of personal data while also researching legal aspects that regulate consumer rights and the protection of unauthorized users. The results of the study show that the protection of consumers' personal data in e-commerce transactions in Indonesia is regulated by various laws and regulations, which are relevant to the civil law aspects of business. Cases of misuse of consumer data in e-commerce have encouraged increased awareness of the importance of protecting consumer rights in civil relations between consumers and business actors.
