Abstract

The large number of private universities in Indonesia creates a quality gap. The unification of private universities is a solution to improve the quality of private higher education. One of the successful ones is the Surya Sehat Midwifery Academy Surabaya with Dr Soetomo University Surabaya. However, the unification process still needs to be examined more deeply about the basic considerations for the unification between the two private universities and the legal consequences of the unification. The unification of the Surya Sehat Midwifery Academy with Dr Soetomo University resulted in the loss of the Surya Sehat Midwifery Academy in the higher education database and merged into Dr Soetomo University into a midwifery study program at the health sciences faculty. which is quite long, namely three years, causing legal uncertainty in the field. This should not need to happen if the government, in this case the Ministry of Education and Culture, applies a Standard Operating Procedure (SOP) for licensing and furthermore to avoid service barriers for alumni of the Surya Sehat Midwifery Academy Surabaya, it is necessary to include alumni data in the health sciences faculty database so that it is physically integrated. as well as virtually.

Abstract

The government has the authority to control and guarantee the availability of natural resources for the benefit of society. Within its authority, the government has regulated and provided guidelines for the exploitation of natural resources in the mining sector in Indonesia through Law No. 4 of 2009 concerning Mineral and Coal Mining (Minerba Constitution). This research aims to determine criminal liability and criminal law enforcement of the mining of uruk soil without a Mining Business License (IUP). The method used in this research is normative legal research. The results showed that several conditions must be filled for a person or legal entity to be sentenced, including the existence of a criminal act committed, the ability to be responsible and the element of error of intentionality or negligence. As stipulated in article 158 of the Law of the Republic of Indonesia number 4 of 2009 concerning Mineral and Coal mining. Law enforcement by the police of the Directorate of Special Criminal Investigation of East Java Regional Police, through investigation, has succeeded in finding suspects on behalf of supono or supo. Based on witness statements, expert statements, suspect statements, and evidences, it have fulfilled the criminal elements of mining uruk and sand land without being equipped with a Mining Business License (IUP) as stipulated in article 158 of RI Law number 4/2009 concerning Mineral and Coal mining.

Abstract

National Social Security will be administered by the BPJS, which consists of the Health BPJS and the Employment BPJS. The obligations of companies are to register as BPJS participants and pay BPJS membership dues. This research aims to understand and analyze the legal provisions if the company does not pay BPJS Health contributions even though it has deducted employee salaries. Apart from that, this research also aims to understand and analyze legal protection for employees who are not paid BPJS Health by the company. The type of method applied in this research is normative legal research. Companies are required to register themselves and their workers as Participants in BPJS. The sanction for those who do not register are administrative sanctions and criminal sanctions are imposed if the company is proven to have committed a crime of embezzlement by not paying salary deductions. The dispute resolution mechanism for BPJS Health participants who do not receive health services is mediation or negotiation before taking the litigation route or trial process in court

Abstract

This research will explore the use of technology so that it can strengthen the legal system in Indonesia and examine best legal practices in various countries to improve consumer data protection in e-commerce. Consumer protection legal research is increasingly urgent given the risks that continue to evolve and have a significant impact on consumers. The formulation of this research problem is: 1) How is the protection of business civil law in providing protection for consumers related to the misuse of consumer personal data in e-commerce transactions? 2) What are the legal actions against the misuse of consumer data in e-commerce? This thesis research uses normative legal types on consumer protection and misuse of personal data while also researching legal aspects that regulate consumer rights and the protection of unauthorized users. The results of the study show that the protection of consumers' personal data in e-commerce transactions in Indonesia is regulated by various laws and regulations, which are relevant to the civil law aspects of business. Cases of misuse of consumer data in e-commerce have encouraged increased awareness of the importance of protecting consumer rights in civil relations between consumers and business actors.

Abstract

Penggelapan adalah tindakan tidak jujur dengan menyembunyikan barang orang lain tanpa sepengetahuan pemiliknya, bertujuan untuk mengalih milik, menguasai, atau menggunakan barang tersebut untuk tujuan lain. Tindak pidana ini diatur dalam Pasal 372 KUHP, namun dalam penelitian ini, penulis fokus pada tindak pidana penggelapan dalam jabatan yang diatur dalam Pasal 374 KUHP. Penggelapan dalam jabatan terjadi ketika seseorang menguasai barang karena hubungan kerja atau mendapat upah untuk itu, dan diancam dengan pidana penjara maksimal lima tahun. Penulisan tesis ini bertujuan untuk menganalisis pertanggungjawaban pidana pelaku penggelapan dalam jabatan, serta pertimbangan Majelis Hakim dalam menjatuhkan putusan, berdasarkan Putusan Nomor 260/Pid.B/2023/PN Spt. Pendekatan yang digunakan adalah pendekatan kasus (Case Approach) untuk mempelajari penerapan norma hukum dalam praktik, serta pendekatan perundang-undangan (Statute Approach) dengan menelaah regulasi yang relevan. Hasil penelitian menunjukkan bahwa terdakwa, PURNOMO Als DEWO Bin (Alm) LAIMAN, selaku Sales GSO PT. MITRA PUTRA PROFITAMAS (SUZUKI), melakukan penggelapan barang milik perusahaan antara tahun 2018 hingga 2020. Dalam menentukan pertanggungjawaban pidana, harus dipenuhi unsur tindak pidana, kesalahan, dan adanya pembuat yang dapat bertanggung jawab tanpa alasan pemaaf. Berdasarkan fakta persidangan dan keterangan saksi yang saling mendukung, perbuatan terdakwa terbukti memenuhi unsur-unsur penggelapan dalam jabatan.

Abstract

Kejahatan narkotika di Indonesia semakin mengkhawatirkan, dengan peredaran narkotika yang meluas di masyarakat akibat tingginya permintaan dan kurang tegasnya negara dalam memberikan sanksi. Pemufakatan jahat dalam jual beli narkotika, yang termasuk dalam tindak pidana yang direncanakan bersama, mendapat sanksi yang sama dengan pelaku kejahatan yang telah selesai, sesuai dengan Undang-Undang Narkotika. Kejahatan ini, yang dianggap sebagai kejahatan luar biasa, sangat merugikan, terutama bagi generasi muda, karena dampak negatifnya dapat merusak pola pikir hingga menyebabkan kematian. Penyalahgunaan narkotika sering dimulai dari penawaran pengedar kepada korban yang akhirnya ketergantungan dan terlibat dalam peredaran narkotika. Oleh karena itu, pemufakatan jahat antara penjual dan pembeli narkotika harus dihukum tegas demi menciptakan negara yang aman dari dampak buruk narkotika. Penelitian ini mengkaji penegakan hukum terhadap pelaku pemufakatan jahat jual beli narkotika di wilayah hukum Kepolisian Daerah Sulawesi Utara. Penelitian ini menggunakan pendekatan yuridis normatif, yang mengkaji bahan hukum primer dan sekunder untuk memahami peraturan perundang-undangan. Prosesnya meliputi pengumpulan bahan hukum, analisis dengan penafsiran hukum dan teori relevan, serta menarik kesimpulan deduktif yang mengaitkan peraturan dengan kasus terkait. Dapat disimpulkan Penerapan hukum pidana materiil terhadap pelaku permufakatan jahat dalam jual beli narkotika Golongan 1 Bukan Tanaman sesuai Pasal 114 ayat (2) UU No. 35 Tahun 2009 memenuhi unsur-unsur hukum yang melibatkan setiap orang, tanpa hak, dan peran sebagai perantara dalam transaksi narkotika, seperti menawarkan, menjual, memberi, menerima, atau menyerahkan narkotika golongan 1.

Abstract

ni adalah mengenai analisa hukum pengenaan pajak penghasilan terhadap Youtuber serta sanksi hukum atas ketidakpatuhan Youtuber dalam melaksanakan kewajiban pajaknya berdasarkan hukum pajak Indonesia. Hasil pembahasan menunjukkan bahwa Youtuber dapat dikenakan pajak karena termasuk subjek pajak penghasilan orang pribadi dalam negeri dan penghasilanYoutuber termasuk objek pajak yang mana sumber penghasilannya masuk kategori penghasilan dari pekerjaan bebas. Peraturan terkait pemungutan pajak penghasilan youtuber sama halnya dengan peraturan pajak penghasilan pada umunya. Aturan terkait pemungutan pajak penghasilan youtuber dapat dilihat dalam Peraturan Pemerintah Nomor 23 Tahun 2018 tentang Pajak Penghasilan atas Penghasilan dari Usaha yang Diterima atau Diperoleh Wajib Pajak yang Memiliki Peredaran Bruto Tertentu dan Peraturan Direktorat Jenderal Pajak Nomor PER-17/PJ/2015 tentang Norma Perhitungan Penghasilan Neto yang mengacu pada Undang-Undang Nomor 36 Tahun 2008 tentang Pajak Penghasilan. Sanksi Administrasi, yang terdiri dari: 1) Sanksi Denda, 2) Sanksi Bunga, maka akan dikenakan sanksi sebesar 2%. 3) Sanksi Kenaikan Tarif, 4) Sanksi Pidana dapat dikenakan kepadaYoutuber apabila : a) Dengan sengaja tidak menyampaikan Surat Pemberitahuan Tahunan (SPT) secara tidak benar atau tidak lengkap, maka akan dipidana kurangan paling lama 1 tahun. b) Dengan sengaja tidak melakukan kewajibannya meliputi tidak mendaftarkan diri untuk memperoleh Nomor Pokok Wajib Pajak (NPWP),sengaja menyampaikan Surat Pemberitahuan Tahunan (SPT) dan/atau keterangan yang isinya tidak benar atau tidak lengkap, sengaja menyetorkan pajak yang telah dipotong atau dipungut, sengaja tidak melakukan pembukuan atau pencatatan, maka akan dipidana paling singkat 6 bulan dan paling lama 6 tahun. c) Sanksi pidana juga dikenakan kepada para pihak seperti Konsultan Pajak apabila dengan sengaja tidak memberikan data atau informasi sesuai dengan permintaan Dirjen Pajak, maka akan dipidana kurungan paling lama sepuluh bulan dan denda paling banyak Rp. 800.000.000.

Abstract

The Industrial Revolution 4.0 has drastically transformed global industries, introducing advanced technologies such as automation, artificial intelligence, and digitalization into the workplace. This rapid technological shift has presented significant challenges for labor laws, which are often designed for traditional work environments. This study explores the implementation of labor law in the context of the Industrial Revolution 4.0, analyzing the challenges faced by both employers and employees in adapting to these new technological advancements. Using a qualitative methodology, this research employs a juridical review of existing labor laws, supported by an in-depth case study examining how these laws are applied in technology-driven industries. The findings indicate that labor laws often lag behind the technological advances, leading to gaps in legal protections for workers and ambiguities in employer obligations. The case study highlights specific instances where current labor regulations fail to address issues related to remote work, job displacement due to automation, and workers' rights in the gig economy. Solutions are proposed to modernize labor laws, ensuring they are adaptable to future technological developments while safeguarding workers' rights. The study concludes that there is an urgent need for legal reforms to balance innovation with fair labor practices in the era of Industry 4.0.

Abstract

The implementation of specialized medical education involves two main aspects: academic training and healthcare services at Teaching Hospitals. While Postgraduate Medical Students (PPDS) fall under the authority of educational institutions, they also serve roles in hospitals, creating the need for clearer legal regulation. Unlike the well-defined relationship between educational institutions and teaching hospitals—governed by a Cooperation Agreement under the Medical Education Act—the legal status of PPDS within hospitals remains unregulated. This study aims to identify the legal basis for PPDS involvement in healthcare services and assess whether such involvement constitutes an employment relationship under labor law. Using a juridical-normative approach, the research finds that, due to the lack of specific legislation, each Teaching Hospital independently regulates the PPDS relationship through internal policies. Labor law defines employment relationships cumulatively, requiring elements such as work, orders, and remuneration. The study concludes that PPDS service in hospitals does not fulfill all these elements—particularly remuneration—since the incentives PPDS receive differ from the legal concept of wages. As a result, the relationship between PPDS and Teaching Hospitals cannot be categorized as an employment relationship under labor law.

Abstract

Permasalahan pengungsi menjadi perhatian khusus dari dunia internasional karena jumlahnya terus meningkat dan telah menjadi isu yang membutuhkan perhatian khusus dari masyarakat internasional. Pemerintah Indonesia telah membentuk suatu Peraturan terkhusus untuk menangani pengungsi, yakni Peraturan Presiden No. 125 Tahun 2016 tentang Penanganan Pengungsi Luar Negeri, sehingga ini dapat menjadi suatu standar acuan untuk pemerintah Indonesia menangani pengungsi. Penanganan pada pengungsi dilaksanakan berawal dari penemuan, penampungan, pengamanan, hingga pengawasan keimigrasian. Rumusan masalah yang penulis kemukakan dalam penelitian ini adalah: Bagaimana permasalahan pengungsi internasional dalam perspektif hukum di Indonesia? Bagaimana bentuk perlindungan hukum bagi pengungsi internasional di Indonesia? Metode penelitian yang dipakai dalam penelitian ini adalah yuridis normatif. Berdasarkan hasil penelitian didapatkan kesimpulan bahwa: Penanganan pengungsi diatur dalam Peraturan Presiden Nomor 125 Tahun 2016 tentang Penanganan Pengungsi dari Luar Negeri. Keputusan Presiden tersebut memiliki fungsi untuk memberikan kepastian hukum tentang penangan pengungsi, mengingat bahwa Indonesia bukan negara yang meratifikasi Konvensi Jenewa 1951 dan Protokol New York 1967 tentang Pengungsi. Pasal 4 Perpres 125 Tahun 2016 tentang Penanganan Pengungsi dari Luar Negeri disebutkan bahwa penanganan pengungsi terdiri dari penemuan, penampungan, pengamanan, dan pengawasan keimigrasian. Pengawasan keimigrasian dilaksanakan oleh Direktorat Jenderal Imigrasi dalam hal ini adalah Kantor Imigrasi dan Rumah Detensi Imigrasi.
