Abstract

Dibentuknya BPD merupakan hasil dari reformasi sebagai upaya dari perwujudan demokrasi di tingkat desa. BPD mempunyai pengaruh yang sangat penting dalam pemerintahan desa, yaitu untuk menggali, menampung, menghimpun dan menyalurkan aspirasi masyarakat, sehingga BPD menjadi tumpuan harapan masyarakat terhadap program-program yang akan dilaksanakan oleh pemerintah, khususnya bagi kesejahteraan masyarakat dan pembangunan desa itu sendiri. Metode penelitian yang digunakan dalam penelitian ini adalah Metode penelitian kualitatif. Faktor penghambat yang ada di desa Rabasahain yaitu sarana dan  prasarana kurangnya fasilitas bagi BPD dan sekertaris Desa tidak adanya Ruangan bagi BPD dan sekertaris Desa untuk bekerja,artinya sarana dan prasarana di desa Rabasahain belum memadai. Berdasarkan uraian di atas maka penulis menarik kesimpulan sebagai beikut: Kerjasama pemerintah Desa di Desa Lasaen dan Desa Rabasahain baik dalam tahap perencanaan dan evaluasi Namun belum berjalan secara efektif. kerjasama Pemerintah Desa di Desa Lasaen da Desa Rabasahain dipengaruhi oleh bebrapa faktor penghambat yaitu : Rendahnya sumber daya manusia dari segi kualitas pemerintahan desa   sehingga kerjasama pemerintah Desa hingga pelaksanaan tidak efektif terhadap  program program pembangunan yang ada pada Desa. Fasilitas sarana dan prasarananya kurang mendukung.

Abstract

Peraturan Daerah Kota Kupang tentang rencana detail tata ruang Kota Kupang di setiap bagian wilayah Kota Kupang mengembangkan ruang terbuka hijau dengan luasan 30% (tiga puluh persen) dari luas wilayah kota sedangkan pada tahun 2024 ini, ruang terbuka hijau di Kota Kupang baru mencapai sekitar 15% untuk luas Kota Kupang 180,3 km2 belum cukup untuk meningkatkan ruang terbuka hijau serta berdampak menimbukan kerusakan terhadap lingkungan, meningkatnya produksi sampah, menurunya kualitas air tanah, meningkatnya polusi, serta banjir dan berkurangnya ketersediaan lahan yang diperuntukkan untuk lingkungan hidup. Penelitian ini merupakan penelitian Hukum Normatif-Empiris, di mana penelitian ini dilaksanakan di Kota Kupang. Data yang diperoleh dalam penelitin ini adalah data kualitatif, dengan menggunakan pedoman undang-undang bersama wawancara dan responden kemudian diolah menjadi deskriptif kualitatif. Hasil dari penelitian ini menunjukkan bahwa: (1) Pemerintah Daerah Kota Kupang dalam pengaturan kewenangannya belum mampu mengelola serta mencukupi kebutuhan ruang terbuka hijau berdasarkan Peraturan Daerah Kota Kupang Nomor 12 Tahun 2011 Pasal 10 menetapkan perlindungan terhadap kelestarian kawasan lindung sebagai penopang kehidupan masyarakat, pembatasan pertumbuhan wilayah perkotaan agar kawasan lindung tetap terjaga, dan pengembangan Ruang Terbuka Hijau (RTH) di setiap Kawasan Wilayah Kota (BWK) Kupang dengan luas minimal 30 persen dari total luas wilayah kota. (2) Pengaturan kewenangan pemerintah daerah kota kupang dalam mengoptimalkan ruang terbuka hijau dipengaruhi oleh faktor-faktor yang bersifat teknis maupun non teknis seperti aksi dari organisasi-organisasi peduli lingkungan yang terjadwal, banyaknya hunian di bantaran sungai, dan aktifitas usaha pada fasilitas ruang publik. Diharapkan agar pemerintah daerah Kota Kupang dapat bertanggung jawab dengan profesional serta dapat mengoptimalkan ruang terbuka hijau di Kota Kupang dengan sebaik-baiknya.

Abstract

The Village Head and the Village Consultative Body are two parties who are referred to as working partners in the process of implementing development programs in the village, this is because the BPD together with the Village Head determines the Village work program. In addition, the Village Head has the authority to lead the implementation of village government programs, while the BPD institutionally represents the village population and acts as a supervisor for the implementation of government programs in the village. Another function of the BPD is to accommodate and channel the aspirations of the village community. The village head and BPD must have the same thoughts in implementing village government, so that village government can be implemented in accordance with community expectations and demands. The problem formulation in this research is: (1) What is the working relationship between the Village Government and the Village Consultative Body? (2) What are the inhibiting factors in implementing development programs in Tribur village, South Abad District?The results of this research used empirical juridical research methods and the data was analyzed descriptively qualitatively where the focus of the research was planning, implementation, supervision and evaluation; namely research where the data was directly obtained from the research location for 15 people.

Abstract

The Akle Health Center of Kupang Regency always strives to serve the community well.well in all care needs including curative services(treatment), preventive (prevention efforts), promotive (health improvement)and rehabilitation (health restoration) with the hope that patients who obtain health services feel satisfied with the services provided.The purpose of this study is to determine the effectiveness of health services at the Akle Health Center, Kupang Regency, and to find out the inhibiting factors for the effectiveness of health services at the Akle Health Center, Kupang Regency. The type of research conducted is empirical juridical research. The types and sources of data used are primary and secondary data. Primary data is data obtained directly from the research location through direct interviews with respondents and based on researcher observations.Secondary data is data obtained from literature studies.Data analyzed descriptively qualitative. The results of this study indicate that: (1) The Effectiveness of Health Services at Puskesmas Akle Kupang Regency are: (a) Implementation of Health Services at Puskesmas Akle Kupang Regency, (b) Implementation of Preventive Health Services, (c) Implementation of Promotive Health Services, (d) Implementation of Curative Health Services, (e) Implementation of Rehabilitative Health Services. (2) Factors inhibiting the effectiveness of health services at the Akle Health Center, Kupang Regency are: (a) Human Resources, (b) Infrastructure Facilities, (c) System factors, Procedures and Regulations, (d) Skills.

Abstract

The implementation of Government Regulation Number 94 concerning Civil Servant Discipline at the Belu Regency Education and Culture Office has not been fully effective where there are still violations of civil servant discipline including violations of time discipline and work discipline such as arriving late, leaving early, leaving the office and work for personal interests. The problems in this thesis are (1) How is the Effectiveness of the Implementation of Government Regulation Number 94 of 2021 concerning Civil Servant Discipline at the Belu Regency Education and Culture Office? (2) What are the Factors that hinder the Effectiveness of the implementation of Government Regulation Number 94 of 2021 concerning Civil Servant Discipline at the Belu Regency Education and Culture Office? This research is a normative legal research supported by empirical legal research where the data is obtained directly from the research location by observation and interviews. to compare the applicable regulations with the reality that occurs in society and use qualitative descriptive juridical analysis. The results of this study indicate that (1) the local government of Belu Regency has provided TPP (Income Improvement Allowance) as an appreciation from the government, especially from the leader of the region related to work discipline. where employees who are absent are not in accordance with the provisions of working hours, the TPP of these employees is automatically deducted by the electronic attendance system, namely vinzer print, provisions like this, the local government has tried to maintain discipline within the scope of the State Civil Apparatus in carrying out its duties and obligations, but the system that has been implemented by this local government does not rule out the possibility of violations of discipline. These violations make the application of a provision or regulation in an agency not run effectively. (2) Factors inhibiting the implementation of Government Regulation Number 94 of 2021 concerning Civil Servant Discipline at the Education and Culture Office of Belu Regency, namely: civil servant awareness factors, and cultural factors.

Abstract

Village community empowerment is the duty and authority of the Village Head as contained in article 26 of Law Number 6 of 2014 concerning Villages, it is stated that the Village Head is in charge of organizing Village Government, implementing Village Development, Village Community Development and Village Community Empowerment. Village government organizational structure The village head is the leader of the village helpers/officials. This research was conducted in Oabikase Village, West Insana District, and Kiusili Village, South Bikomi District, TTU Regency. This research basically uses empirical juridical research methods, namely: research carried out directly to related parties in order to obtain information on the problem under study. Respondents are methods that take the pointer process based on the purpose for which information is to be obtained, then 44 people are used. According to the author's observations, the community in Oabikase Village and Kiusili Village are still not independent and prosperous in knowledge, ability and skills, so there are indications that the Village Head has not carried out his duties and authorities to optimally improve community empowerment. Although BUMDes have been established in the two villages, because the abilities, skills and knowledge of the community are still limited so they have not been able to use them optimally. The implementation of the duties of the village head in community empowerment and the use of Oabikase Village and Kiusili Village in Kefamenanu District, North Central Timor Regency has not run optimally, this is evident from the uneven infrastructure development. Oabikase Village and Kiusili Village still have factors that hinder government administration activities, including human resources.

Abstract

The purpose of this study is to analyze the implementation of the Regulation of the Minister of Education and Culture Number 64 of 2015 concerning Smokefree Areas in the School Environment as an Effort to Prevent Smoking in Students at Atambua Christian High School, Belu Regency. This type of research shows empirical juridical research. The results of this study indicate that the implementation of the Regulation of the Minister of Education and Culture Number 64 of 2015 concerning Smokefree Areas in the School Environment is not / or has not been effective. There are several factors that influence the successful implementation of this regulation including legal structure, legal substance, and legal culture. These three factors certainly have an interest that always hinders or influences the implementation of rules regarding Smokefree Areas so as to make these rules ineffective. Based on the results of the study, the authors have several suggestions, namely increasing supervision of the implementation of the no smoking area policy in the school environment, ensuring law enforcement against violations of regulations consistently and firmly to create discipline in the school environment and conducting regular counseling and education programs to all students, teachers, and staff including school guards about smoking and the importance of a smoke-free environment.

Abstract

The purpose of this study is to analyze the supervisory function of the regional people's representative council on the implementation of the 2021-2022 stunting budget in South Central Timor District. The type of research used by researchers is empirical legal research. The types of data used in this research are primary data, secondary data, and tertiary data. Data collection techniques using interviews, observation, and literature/documentation studies. The population in this study includes all parties involved in the function of the South Timor Tenggah Regency Regional House of Representatives in supervising the stunting budget in South Timor Tenggah Regency, namely, the Health Office, DPRD members, and the community. The sample technique used in this study was purposive sampling. Data processing techniques through editing, coding, tabulation, and verification. The result of this study is that the Government of Indonesia is very serious in dealing with the problem of stunting in Indonesia so that the government issued several regulations in order to prevent and control stunting in Indonesia. The regulation of the supervisory function by the DPRD on the implementation of the stunting budget has not been implemented properly due to the lack of communication between the executive and the legislature.

Abstract

Pemeliharaan sarana dan prasarana pelayanan umum yang ada di Kecamatan Amanuban Tengah dilakukan oleh perangkat kecamatan dan yang bertanggung jawab akan pelaksanaannya adalah seorang camat yang menjadi kepala pemerintahan. Berdasarkan observasi peneliti di Kecamatan Amanuban Tengah banyak sarana yang kurang dalam memberikan pelayanan terhadap masyarakat kemudian kondisi infrastruktur jalan belum sepenuhnya terawat dan banyak jalan yang berlubang dan rusak, hal ini tentunya perlu perhatian dari pihak kecamatan Amanuban Tengah. Penelitian ini bersifat yuridis empiris yaitu penelitian yang dilakukan berdasarkan pengamatan dan wawancara secara langsung di lapangan. Hasil penelitian ini menunjukkan bahwa: (1) Koordinasi antara pihak kecamatan dengan aparat desa sudah berjalan dengan baik hanya saja belum ada tindakan nyata yang dilakukan karena harus ada kerjasama dengan Pemerintah Kabupaten Timor Tengah Selatan. Apabila kerjasama yang dilakukan hanya antara pihak kecamatan dan aparat desa saja secara otomatis perbaikan dan pemeliharaan saran dan prasarana di Kecamatan Amanuban Tengah tidak akan berjalan, sebab pihak Pemerintah Kabupaten Timor Tengah Selatan merupakan pihak penting dalam dalam urusan perbaikan sarana dan prasarana yang ada. (2) Faktor-faktor yang menjadi penghambat fungsi koordinasi camat Amanuban Tengah dalam pemeliharaan prasarana dan sarana pelayanan umum yakni: Keterbatasan sumber daya, Keterbatasan wewenang, Kurangnya kolaborasi antar instansi, Ketidakpastian kebijakan, Kurangnya keterlibatan masyarakat, Ketidakmampuan manajerial, Anggaran yang terbatas.

Abstract

Regional Taxes and Levies are one of the important sources of regional revenue to finance the implementation of Regional Government as regulated in NTT Provincial Regulation number 7 of 2020 concerning Fisheries Business License Levy. Regional Regulation of East Nusa Tenggara Province Number 7 of 2020 concerning Fisheries Business License Levy and Law No. 1 of 2022 concerning Financial Relations between the Central Government and Regional Governments gives authority to the Central and Regional Governments to collect Taxes and Regional Levies as a source of local revenue. One of the sources of the APBD comes from the Fishery Business Permit Levy. This is closely related to the collection of fishery business licenses. This research is a normative-empirical legal research that uses primary data and secondary data collected using interview, observation, and documentation techniques and processed using editing, coding, verification, and interpretation techniques and analyzed using qualitative descriptive techniques. The results of this study show that (1) The regulation of content material in NTT Provincial Regulation Number 7 of 2020 concerning Fisheries Business License Levy at Oeba Fish Market specifically related to the issuance of fishery business licenses and the collection of business license levies has been regulated in the NTT Provincial Regulation, the implementation strategy has not been implemented effectively. (2) Factors that hinder the regulation of East Nusa Tenggara Provincial Regulation Number 7 of 2020 concerning Fisheries Business License Levy and its implementation are legal factors and community legal awareness factors.
