Abstract

General elections are a manifestation of popular sovereignty as stipulated in the 1945 Constitution of the Republic of Indonesia, which is carried out directly, publicly, freely, confidentially, honestly and fairly. An election process that takes place with integrity is essential to ensure the legitimacy of the outcome and to maintain public confidence in the democratic system. However, abuse of voting rights, such as voting more than once at one or more polling stations, is one form of serious violation that can undermine the integrity of elections. This study aims to explore the role of the Election Supervisory Agency (Bawaslu) of Palangka Raya City in maintaining the validity of ballots in the Presidential, Vice Presidential, and Legislative Elections, as well as examining the supervisory strategies implemented to deal with violations committed by certain individuals. By using a systematic monitoring approach, strict law enforcement, and socialization related to violations in elections, Bawaslu is expected to ensure the implementation of elections that are fair, democratic, and in accordance with applicable legal principles. This research provides an in-depth description of the efforts made by Bawaslu in strengthening the election supervision process to prevent fraudulent practices and ensure the sustainability of a healthy democracy.

Abstract

This study examines the legal protection afforded to workers who experience delayed wage payments without the imposition of penalties on employers, as regulated under Law No. 13 of 2003 on Manpower and Government Regulation No. 36 of 2021 on Wages. The delayed payment of wages constitutes a violation of workers’ rights and may give rise to industrial relations disputes if not addressed effectively. The prevailing legal framework obliges employers—whether through intent or negligence—who delay wage payments to pay a penalty amounting to 5% per day from the fourth to the eighth day of delay, followed by 1% for each subsequent day, up to a maximum of 50% of the wages due. However, many workers are either unaware of their legal entitlements or reluctant to report such violations due to pressure exerted by employers. Using an empirical juridical research method and a qualitative approach involving interviews and field observations, this study aims to: (1) explore the legal protection mechanisms available to affected workers, and (2) identify the obstacles to enforcing sanctions against employers who fail to pay the prescribed penalties for delayed wages

Abstract

This study explores the role of the Kedamangan institution in adjudicating cases involving the dissemination of false information within the indigenous Dayak Ngaju community in Jekan Raya, Palangka Raya City. Anchored in Article 18B(2) of the 1945 Constitution of Indonesia and regional customary laws such as the Tumbang Anoi Agreement of 1894 and Central Kalimantan Regional Regulation No. 1 of 2010, the research examines how the traditional leader (Damang) exercises judicial authority in imposing the Singer Sule Kasalan Luang sanction—a customary fine imposed on individuals who spread defamatory or harmful false news. Utilizing an empirical juridical method, the study combines normative legal analysis with qualitative field data, including interviews with former Damang Kardinal Tarung. Findings demonstrate that the Damang holds recognized authority to resolve disputes and impose sanctions through culturally embedded mechanisms aimed at restoring communal harmony and deterring future offenses. The research also establishes that decisions rendered by the Damang, when accepted by both parties, possess final and binding legal force (BHT) under customary law and may be enforced without recourse to the state judiciary. However, dissatisfied parties retain access to formal legal institutions, reflecting a pluralistic legal framework that accommodates both customary and positive law. This study underscores the relevance of indigenous legal practices in addressing contemporary issues such as misinformation, and highlights the need for further research into the comparative effectiveness and legal recognition of customary justice across diverse regions.

Abstract

Penegakan hukum pidana di bidang perpajakan di Indonesia merupakan bagian integral dari strategi negara untuk meningkatkan kepatuhan wajib pajak serta memaksimalkan penerimaan pendapatan negara. Dalam konteks ini, Penyidik Pegawai Negeri Sipil (PPNS) di lingkungan Direktorat Jenderal Pajak (DJP) memiliki peran sentral dengan kewenangan melakukan penyidikan terhadap tindak pidana perpajakan. Namun demikian, pelaksanaannya di lapangan tidak terlepas dari sejumlah tantangan, khususnya terkait tumpang tindih kewenangan antara PPNS DJP dengan aparat penegak hukum lain, seperti Kepolisian dan Kejaksaan. Tulisan ini mengulas posisi PPNS DJP dalam sistem penegakan hukum pidana perpajakan serta hambatan-hambatan yang dihadapi. Melalui pendekatan yuridis normatif, ditemukan bahwa meskipun PPNS DJP memiliki peran utama dalam penyidikan kasus perpajakan, masih terdapat kendala koordinasi lintas lembaga yang perlu diatasi untuk menjamin efektivitas dan efisiensi dalam pelaksanaan penegakan hukum pajak di Indonesia

Abstract

This study aims to analyze the implementation of Inherent Supervision (Waskat) within the National Police with a case study of a murder committed by a police officer in Palangka Raya. Although the Chief of Police Regulation Number 2 of 2022 has been drafted as a guideline for internal supervision, in practice there are still gaps that allow for behavioral deviations by members of the National Police. This study uses a qualitative approach with an in-depth interview method with related parties, including members of the National Police, internal supervisors, and witnesses and the victim's family. The results of the study show that the supervision carried out is still limited to administrative and technical aspects, while ethical and moral aspects are often less considered. The case that occurred in Palangka Raya is a real example that ineffective internal supervision can damage the image of the National Police and reduce public trust in the police. This study suggests the importance of strengthening a more transparent external supervision mechanism, as well as increasing training and ethical awareness for members of the National Police to improve integrity and professionalism. Thus, more effective supervision can help create a National Police that is more accountable and trustworthy to the public.

Abstract

Perkembangan teknologi informasi dan komunikasi yang pesat telah mengubah pola interaksi masyarakat, termasuk dalam hal transaksi elektronik. Namun, seiring dengan meningkatnya aktivitas transaksi elektronik, potensi pelanggaran hukum juga semakin besar. Penelitian ini bertujuan untuk mengkaji aspek hukum pidana terhadap pelanggaran hukum transaksi elektronik di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan studi kasus. Hasil penelitian menunjukkan bahwa Undang-Undang No. 19 Tahun 2016 tentang Perubahan atas Undang-Undang No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (UU ITE) telah mengatur secara komprehensif mengenai tindak pidana di bidang transaksi elektronik. Namun, penerapan UU ITE dalam praktiknya masih menimbulkan berbagai permasalahan, seperti terlihat dalam kasus-kasus yang dianalisis dalam penelitian ini. Diperlukan pemahaman dan penafsiran yang baik dari aparat penegak hukum dalam menerapkan ketentuan UU ITE agar tercipta kepastian hukum dan keadilan bagi masyarakat. Kata Kunci : Hukum Pidana, Pelanggaran, Transaksi Elektronik, UU ITE.

Abstract

Perkembangan teknologi kecerdasan buatan (Artificial Intelligence/AI) telah melahirkan tantangan baru dalam ranah hukum pidana, salah satunya melalui fenomena deepfake. Teknologi ini memungkinkan penciptaan konten visual dan audio yang menyerupai kenyataan, namun bersifat manipulatif dan berpotensi menimbulkan kerugian serius, baik terhadap individu maupun terhadap tatanan hukum. Penelitian ini bertujuan untuk menganalisis urgensi pengaturan hukum pidana terhadap penyebaran konten deepfake di Indonesia. Metode yang digunakan adalah pendekatan yuridis normatif dengan analisis terhadap peraturan perundang-undangan, doktrin, dan putusan hukum yang relevan, serta ditunjang dengan studi komparatif dari regulasi internasional. Hasil penelitian menunjukkan bahwa sistem hukum Indonesia saat ini belum memiliki aturan eksplisit mengenai deepfake, sehingga menyebabkan kekosongan hukum (legal vacuum) yang berdampak pada kesulitan pembuktian dan lemahnya perlindungan terhadap korban. Beberapa ketentuan dalam KUHP dan UU ITE masih bersifat umum dan tidak mengakomodasi kompleksitas karakteristik deepfake. Oleh karena itu, diperlukan reformulasi hukum dalam bentuk undang-undang khusus atau amandemen terhadap regulasi yang ada guna mengklasifikasikan kejahatan deepfake sebagai tindak pidana tersendiri. Negara juga perlu memperkuat kapasitas penegak hukum serta mendorong kolaborasi lintas sektor dalam merespons tantangan teknologi manipulatif yang semakin masif di era digital.

Abstract

Lingkungan hidup adalah suatu sistem yang saling terikat dan harus dijaga keseimbangannya, baik dari perspektif ekologi maupun ajaran Islam. Dalam pandangan Islamic Environmental Justice, keseimbangan (mizan) menjadi prinsip utama dalam pemanfaatan sumber daya alam untuk menghindari eksploitasi berlebihan yang dapat merusak ekosistem. Penelitian ini menyoroti pengelolaan sampah di Kota Palangka Raya, khususnya pelaksanaan kebijakan bank sampah dan efektivitas platform digital Info Bang Apul dalam meningkatkan kesadaran masyarakat terhadap pengelolaan sampah. Metode yang digunakan adalah pendekatan empiris dengan data kuantitatif, didukung oleh data kuesioner yang diperoleh dari 136 responden. Hasil penelitian mengungkapkan bahwa meskipun telah terdapat aturan seperti Undang-Undang Nomor 18 Tahun 2008 tentang Pengelolaan Sampah dan Peraturan Walikota (Perwali) Kota Palangka Raya Nomor 20 Tahun 2019 tentang Kebijakan Pengelolaan Sampah, pelaksanaannya masih menghadapi berbagai kendala. Kendala utama adalah rendahnya pemahaman dan keterlibatan masyarakat dalam pengelolaan sampah. Jika ditinjau dari perspektif hukum lingkungan dan keadilan ekologis dalam Islam, kondisi tersebut mencerminkan bentuk ketidakadilan ekologis, di mana masyarakat belum mendapatkan akses yang merata terhadap solusi pengelolaan sampah yang berkelanjutan. Teknologi bank sampah digital seperti Info Bang Apul memiliki potensi dalam meningkatkan efektivitas pengelolaan sampah tetapi masih memerlukan sosialisasi lebih lanjut agar lebih dikenal dan digunakan secara luas oleh masyarakat. Selain itu, perlu adanya peningkatan fitur pada Info Bang Apul guna memberikan informasi lengkap dan menyediakan berbagai layanan untuk meningkatkan partisipasi masyarakat. Penelitian ini merekomendasikan strategi peningkatan pengetahuan masyarakat melalui edukasi serta optimalisasi peran pemerintah dengan sosialisasi. Dengan penerapan prinsip keadilan lingkungan Islam dan penggunaan teknologi digital, diharapkan pengelolaan sampah yang lebih berkelanjutan dapat tercapat di Kota Palangka Raya.   The environment is an interrelated system whose balance must be preserved both from the ecological and Islamic perspectives. From the perspective of Islamic Environmental Justice, balance (mizan) becomes the main principle in the usage of natural resources to prevent excessive exploitation that may damage the ecosystem. This research focuses on analyzing the waste management in Palangka Raya City, Central Kalimantan Province, Indonesia, especially in the implementation of the waste bank policy and the effectiveness of the Info Bang Apul digital platform in increasing society’s awareness of waste management. The method used in this research was the empirical approach with quantitative data, supported by data from questionnaires which were spread to 136 respondents. Results of this research showed that even though there are already regulations such as Law No. 18 of 2008 on Waste Management and the Regulation of the Palangka Raya City Mayor No. 20 of 2019 on the Waste Management Policy, their implementation still faces various obstacles. The main obstacle was society’s lack of understanding and involvement in waste management. If analyzed from the perspectives of environmental law and ecological justice in Islam, such a condition reflects a form of ecological injustice, where society still has not obtained equal access to the solution of sustainable waste management. Digital waste bank technologies such as Info Bang Apul have the potential to increase the effectiveness of waste management. However, there is still a need for further introduction so that society may know and widely use them. Apart from that, there needs to be an increase in Info Bang Apul’s features to provide more comprehensive information and add various services to increase community participation. This research recommends strategies to increase society’s knowledge through education as well as the optimization of the government’s role through program introduction. It is hoped that the application of the Islamic environmental justice principles and the usage of digital technologies may lead to the achievement of more sustainable waste management in Palangka Raya City, Indonesia.

Abstract

Broadcast media plays an important role in disseminating information, entertainment, and culture to the public. In Indonesia, radio, as one of the oldest and still relevant media, has an important function in promoting musical works, including disseminating copyrighted songs. However, the use of songs on the radio must comply with applicable legal provisions, including the obligation to pay royalties to copyright owners through collective management institutions, such as LMKN based on Government Regulation Number 56 of 2021. This study aims to review the legal regulations related to the use of songs by radio stations within the framework of copyright royalty management, as well as transparent and effective royalty management mechanisms. The method used is normative legal research with an analysis of primary and secondary legal sources related to PP No. 56 of 2021 and Copyright regulations. The results of the study show that the implementation of these regulations has challenges, such as minimal socialization, complex procedures, and limited supervision. However, the implementation of the royalty management mechanism through LMKN can help protect the rights of creators while supporting the interests of the broadcasting industry. The need for increased socialization, a simpler reporting system, and effective supervision are strategic recommendations to ensure the success of song copyright royalty management on the radio.

Abstract

The law in each society has its own style and nature. Customary law is a law that always grows from a real need for life and a way of life in society, which is the whole culture of the community where customary law applies. Customary law if violated will certainly be subject to sanctions. Customary law in Palangka Raya against perpetrators of adultery will be punished in the form of sanctions, namely by paying a singer or jipen fine to complete peace according to Dayak Ngaju custom. Based on the facts in the field, if a criminal act of adultery is committed by a wife with an unmarried man against her husband, it certainly raises questions about Damang's authority as Dayak Traditional Chairman so that it can be known and understood that what are the legal acts in the settlement of adultery committed by the perpetrator.
