Abstract

This researches aims to see the position of a creation registration letter of art painting as a form of legal protection for painting works in the face of the principle of automatic protection adhered to in Law no. 28 of 2014 concerning Copyright. The research method in this study is juridical-normative with an analytical descriptive approach. The results of the research show that a creation registration letter can be one of the perfect initial proofs if the painter as the creator will make efforts to protect the law against his work either through criminal law remedies and/or filing civil lawsuits. Therefore, the registration of creation through the registration of creation of a painting is important for every painter to obtain a creation registration letter from the state, this is an effort to protect their intellectual property rights.

Abstract

Sumber daya air merupakan elemen terpenting di dalam kehidupan manusia. Ketiadaan akses atas air bersih yang berkulitas tentu menimbulkan permasalahan bagi keberlanjutan hidup manusia. Hal inilah yang melandasi pentingnya keterserdiaan air bersih sebagai bagian pemenuhan dan perlindungan hak asasi manusia. Penguasaan atas sumber-sumber daya alam khususnya sumber daya air merupakan kewenangan negara namun di dalam pengelolaannya yang harus dimanfaatkan untuk kesejahteraan masyarakat. Oleh karena itu, setiap kebijakan pemerintah yang mengakibatkan tertutupnya akses manusia untuk memperoleh layanan air bersih bagi pemenuhan kebutuhan hidupnya maka akan menimbulkan pelanggaran HAM, apalagi perbuatan itu dilakukan oleh entititas pelaksana tanggung jawab negara termasuk Badan usaha pemerintah (BUMD). Penelitian ini bertujuan untuk menelaah secara kritis berdasarkan konsep-kosep yang relevan mengenai kewajiban pemenuhan dan penghormatan HAM oleh Perusahaan Daerah.Hasil penelitian menunjukkan adanya korelasi yang jelas antara kewajiban penghormtan dan pemenuhan HAM oleh pemerintah yang dalam hal ini dilaksanakan oleh perusahaannya sebagai manifestasi Pasal 33 ayat (2) dan (3) UUD 1945 guna perlindungan dan pemenuhan HAM khususnya di bidang pelayanan air bersih. Hal ini mengingat di dalam perkembangan konsep HAM juga menempatkan Perusahaan sebagai pengemban kewajiban dan tanggung jawab HAM terutama dalam rangka penghormatan dan memenuhi hak-hak dasar manusia termasuk pemenuhan hak atas air bersih.

Abstract

The development of digital technology has changed the way people produce, distribute, and use musical works. However, this progress has also increased the potential for copyright infringement, especially on User-Generated Content (UGC) platforms such as YouTube, TikTok, and Instagram. In this context, Law No. 28 of 2014 on Copyright protects the moral and economic rights of creators, but it lacks the technical rules required to address violations in the digital environment. The absence of a notice-and-takedown mechanism, safe harbor provisions, and an obligation to use automated detection technology indicates that Indonesia’s legal framework remains inadequate to address large-scale infringements. In contrast, the United States, through the DMCA 1998, provides detailed regulation of notice-and-takedown procedures, safe harbor requirements, and platform obligations in dealing with repeat infringers. Through a normative, juridical, and comparative legal approach, this study analyzed differences between the Indonesian and U.S. systems and identified gaps that weakened copyright enforcement in Indonesia. The findings show that Indonesia requires more specific technical regulations to support adequate protection on digital platforms. Therefore, this research proposes an ideal protection model comprising four integrated components: clear, binding technical regulations, automated detection technology, a centralized copyright database, and a fair monetization mechanism. The integration of these elements is expected to strengthen copyright enforcement, enhance legal certainty, and support a more accountable and sustainable digital ecosystem.

Abstract

Verbal aggression among adolescents on social media is a growing concern, as social media serves as a key platform for interaction and self-expression. One factor influencing this behavior is emotional intelligence. However, empirical evidence on the effect of emotional intelligence on verbal aggression among adolescent social media users in non-metropolitan areas, such as Bontang City, remains limited. This study aims to examine the effect of emotional intelligence on verbal aggression among adolescents in Bontang. A sample of 100 adolescents was selected through purposive sampling. Data were collected using a Likert scale and analyzed using simple linear regression (SPSS 24.0). The results indicate that emotional intelligence significantly influences verbal aggression (p = 0.001; R² = 0.106). These findings highlight the importance of emotional intelligence in reducing verbal aggression. Therefore, enhancing emotional intelligence through character education and digital literacy can be an effective strategy to reduce verbal aggression among adolescents, particularly in developing regions.   ABSTRAK Perilaku agresi verbal pada remaja di media sosial menjadi perhatian utama, karena media sosial kini berperan sebagai platform interaksi dan ekspresi diri. Salah satu faktor yang memengaruhi perilaku ini adalah kecerdasan emosional. Namun, masih sedikit bukti empiris mengenai pengaruh kecerdasan emosional terhadap agresi verbal pada remaja pengguna media sosial di daerah non-metropolitan seperti Kota Bontang. Penelitian ini bertujuan untuk menganalisis pengaruh kecerdasan emosional terhadap perilaku agresi verbal pada remaja di Kota Bontang. Sampel terdiri dari 100 remaja yang dipilih menggunakan purposive sampling. Data dikumpulkan dengan skala Likert dan dianalisis menggunakan regresi linear sederhana (SPSS 24.0). Hasil penelitian menunjukkan bahwa kecerdasan emosional berpengaruh signifikan terhadap perilaku agresi verbal (p = 0.001; R² = 0.106). Temuan ini mengindikasikan bahwa kecerdasan emosional berperan penting dalam mengurangi perilaku agresi verbal. Oleh karena itu, peningkatan kecerdasan emosional melalui pendidikan karakter dan literasi digital dapat menjadi solusi efektif untuk menekan perilaku agresi verbal pada remaja, terutama di wilayah berkembang.

Abstract

This research is motivated by the increasing potential for violations of trade secrets by business actors, particularly in the MSME sector, related to information of economic value in the technology and business sectors that is kept confidential. This study aims to understand the legal regulations regarding NDAs as an instrument for protecting trade secrets in Indonesia and Azerbaijan. This research uses normative legal methods and data obtained through library research, analysis of statutory regulations, studies of NDA violation cases in Indonesia, and literature related to the implementation of NDAs in Azerbaijan. The results show that in Indonesia, NDAs are not specifically regulated by law, but have legal force based on the principle of freedom of contract as stipulated in Article 1338 of the Civil Code. Meanwhile, in Azerbaijan, the implementation of NDAs is more effective due to support from government policies and legal institutions that assist MSMEs in maintaining the confidentiality of business information. These findings suggest that strengthening regulations and legal awareness regarding the use of NDAs is necessary to optimize the protection of trade secrets for MSMEs in Indonesia.

Abstract

A trademark constitutes an essential component of intellectual property rights, serving as the identity and distinguishing mark of products or services in commercial activities. Indonesia's trademark registration system follows the first to file principle under Law Number 20 of 2016 concerning Trademarks and Geographical Indications. However, this system remains vulnerable to abuse by parties acting in bad faith, as evidenced in the LOPSTER vs. LOBSTER case (Medan Commercial Court Decision Number 1/Pdt.Sus-HKI/Brand/2025), where a trademark registered in bad faith successfully passed the administrative examination at the Directorate General of Intellectual Property (Direktorat Jenderal Kekayaan Intelektual, DJKI). DJKI possesses limited authority to reject trademark applications based on bad faith elements, resulting in trademark cancellations being processed exclusively through Commercial Court litigation. This study employs normative juridical research with statute and comparative approaches to analyze DJKI's role in the trademark registration process and compare it with the United States Patent and Trademark Office (USPTO) system, which operates under the first to use principle requiring evidence of actual trademark use in commerce. The comparative analysis reveals that the USPTO's verification mechanism for actual use effectively prevents speculative registrations and bad faith applications. The findings demonstrate that optimizing DJKI's role requires implementing a hybrid approach that maintains the first-to-file structure while integrating actual use verification mechanisms, thereby enhancing preventive functions and reducing trademark disputes that reached over 156,860 cases during 2021–2025. This research contributes practical recommendations for strengthening DJKI's examination procedures and policy formulation to provide more effective legal protection for business actors

Abstract

The centralization of one-stop royalty management through the Lembaga Manajemen Kolektif Nasional (LMKN) in Indonesia has triggered structural polemics, ranging from bureaucratic ineffectiveness to a crisis of trust among songwriters. Although the government has issued Regulation of the Minister of Law Number 27 of 2025 to strengthen supervision, the institutional framework that positions the state as an active operator still fails to address the root problems. This study analyzes the optimization of LMKN's role in the national music royalty ecosystem through a comparative examination of the institutional model in the United Kingdom. The research employs a normative-juridical method with statutory and comparative legal approaches, examining Law Number 28 of 2014 concerning Copyright and Government Regulation Number 56 of 2021, juxtaposed with the Copyright, Designs and Patents Act 1988 (CDPA 1988) of the United Kingdom. The results reveal that Indonesia's state-centered model imposes a dual burden on LMKN as both regulator and operator. In contrast, the United Kingdom's market-based model proves more effective by delegating operational functions to private institutions and adjudication to the Copyright Tribunal. This study recommends transforming LMKN into an independent, quasi-judicial supervisory body akin to the Copyright Tribunal, focusing on tariff dispute resolution and transparency audits, while returning royalty collection to a regulated market mechanism.​

Abstract

Abstract Protection for shareholders is essential in corporate practice to provide legal certainty for shareholders. This study aims to analyze the effectiveness of shareholders agreements as an important instrument for overcoming the limitations of articles of association in order to increase legal certainty for shareholders, as well as to analyze legal comparisons between Indonesia and Canada regarding the regulation of shareholders agreements in order to increase legal certainty for shareholders. The research method used is normative juridical, with a legislative approach and a comparative law approach. The results of the study show that in Indonesia, shareholders agreements are recognized as civil agreements that are binding on the parties as long as they do not conflict with the UUPT and the articles of association. However, in Indonesia, this is not explicitly regulated in the law. In contrast, in Canada, shareholders agreements have obtained special provisions through the Unanimous Shareholders Agreement (USA), which can explicitly limit or take over some of the authority of the board of directors. In Canada, shareholders agreements can be an alternative for dispute resolution. This study recommends harmonizing shareholders agreements with the articles of association and explicit provisions regarding shareholders agreements. Keywords: Shareholder Protection, Shareholders Agreement, Indonesian Law, Canadian Law.

Abstract

The increasing prevalence of criminalization practices against curators in the performance of their duties and authorities indicates weaknesses in Indonesia’s bankruptcy law framework, particularly concerning the legal status of curators as a profession. Curators are often placed in a vulnerable position when carrying out statutory mandates, especially in the administration and liquidation of bankrupt estates, which may give rise to disputes with debtors or third parties. This research aims to analyze the legal position of curators as a profession within Indonesian bankruptcy law and to formulate an ideal legal framework to provide legal protection for the execution of curators’ duties and functions. The research employs a normative legal research method using statutory, conceptual, and comparative approaches, specifically by comparing the regulatory regime governing the curator profession in New Zealand under the Insolvency Practitioners Regulation Act 2019. The findings indicate that the current regulation of curators in Indonesia remains fragmented and fails to provide adequate legal certainty, thereby creating opportunities for criminalization and disparities in law enforcement. Therefore, this study concludes that the enactment of a specific law governing the curator profession as lex specialis is an urgent necessity to affirm the professional status of curators, strengthen oversight and accountability mechanisms, and provide proportional legal protection so that curators may perform their duties independently, professionally, and in good faith.

Abstract

Pada era digital, intensitas penggunaan media sosial, khususnya TikTok berpotensi memengaruhi tingkat konformitas melalui paparan konten dan interaksi daring. Penelitian ini bertujuan untuk mengkaji hubungan antara intensitas penggunaan media sosial TikTok dengan tingkat konformitas pada mahasiswa FISIP Universitas Mulawarman. Pendekatan yang digunakan adalah kuantitatif dengan desain korelasional. Subjek penelitian berjumlah 365 mahasiswa FISIP Universitas Mulawarman sebagai subjek yang dipilih menggunakan teknik purposive sampling sesuai dengan kriteria yang telah ditentukan. Pengumpulan data dilakukan dengan mengunakan dua instrumen penelitian, yaitu skala intensitas penggunaan media sosial dan skala konformitas. Data yang diperoleh dianalisis dengan bantuan software IBM SPSS Statistics 21. Teknik analisis data yang digunakan adalah Spearman’s Rho. Hasil analisis menunjukkan bahwa terdapat hubungan dengan arah positif dan signifikan antara intensitas penggunaan media sosial Tiktok dengan tingkat konformitas pada mahasiswa dengan nilai signifikansi p = 0.000 (< 0.05) dan koefisien korelasi = 0.185. Hal ini menunjukkan bahwa semakin tinggi intensitas penggunaan media sosial TikTok, maka semakin tinggi pula tingkat konformitas mahasiswa.
