Abstract

The Law on Human Rights can generally be understood as provisions that protect human freedoms in sustaining their lives, including obtaining suitable housing, especially in preserving what has been theirs from the beginning. In the case of the eviction of settlements in the Kampung Bayam area, legal protection of human rights has not yet been realized to this day. The eviction carried out by the Jakarta Provincial Government was arbitrary, without considering its impact on residents who lost their homes and also as a form of deprivation of the economic, social, cultural rights of the Kampung Bayam community. Furthermore, until now, there has been no apparent effort from the government to restore the housing rights of the residents of Kampung Bayam. Moreover, Indonesia is a country based on the rule of law, which means Indonesia should prioritize the protection and respect of human rights as its main focus.

Abstract

Responsibility to Protect (R2P) is an international principle that emphasizes the obligation of every country to protect the human rights of its citizens. Although human rights violations against the Rohingya ethnic group in Myanmar are an internal problem, resolving them is still difficult. Further evaluation by the UN is needed to ensure the effectiveness of R2P implementation. The UN implements R2P through the Security Council and Human Rights Council to overcome the humanitarian crisis against the Rohingya ethnic group. The type of research used is literature study by reviewing existing literature related to the written topic. The method used is a qualitative research method with the data source used in the form of secondary data obtained from several national journals, articles and previous research. The result is that we can see that the implementation of R2P in this conflict is still facing difficulties, as shown by the UN Presidential Statement in November 2017. The role of the UN Human Rights Council helps in resolving cases of human rights violations against the Rohingya ethnic group, although the implementation of R2P is difficult in Myanmar's internal conflict with the Rohingya ethnic group.

Abstract

Human rights is a right owned by every individual on this earth that is absolute and cannot be reduced. In the international world, human rights are protected and have legal regulations, but human rights violations still often occur in individual humans, one of which in this case is Palestinian civilians. The research method used in this research is normative juridical method. The results of this study state that Israel in attacking Palestinian civilians, has ignored the 1949 Geneva convention that has been ratified by Israel. In this case, international institutions such as the UN Security Council need to take a role in mediating the conflict. However, Israel has not ratified the Rome Statute of 1998 so it is not yet the authority of the ICC to prosecute, so a referral to the UN Security Council is needed. The national law that was established because it did not ratify the 1998 Rome Statute has not achieved justice and works the other way around because it protects Israel to be tried by the ICC. In addition, in the case of wars such as the Israeli-Palestinian conflict, non-derogable rights need to be applied and should not be limited because it can be considered a violation of human rights. However, Israel ignores this right by attacking Palestinian civilians and medical personnel.

Abstract

This research aims to analyse the application of the principle of freedom of contract in the lease agreement between residents affected by eviction and explain the legal steps that can be taken by residents affected by eviction from potential eviction again. This research uses Empirical Juridical method and approach in the form of analytical descriptive using case approach. Based on the results of the research, the principle of freedom of contract is the principle of the parties in making agreements. However, the application of this principle is not reflected in the residents affected by the eviction of the Ciliwung river who were relocated to the Rawa Bebek flat. Residents must occupy it using the lease method. This action is not based on the principle of freedom of contract so that the affected residents are forced to agree to the contents of the agreement. If seen from the perspective of residents affected by the eviction, the principle of freedom of contract does not exist in the implementation of the lease agreement. Legal steps that can be taken are non-litigation efforts such as mediation, negotiation and also litigation efforts through the court.

Abstract

Kondisi fatherless yang terjadi pada masa dewasa awal sangat berpengaruh dengan bagaimana kehidupan individu selanjutnya. Tujuan penelitian ini adalah untuk mengetahui bagaimana gambaran self acceptance pada perempuan dewasa awal dengan pengalaman fatherless. Jenis penelitian ini merupakan jenis penelitian kualitatif dengan pendekatan fenomenologi. Metode pengumpulan data yang digunakan adalah wawancara dan observasi. Teknik pengambilan sample menggunakan teknik purposive sampling. Teknik analisis data yang digunakan terdiri dari menyiapkan dan mengolah data, membaca seluruh data, mengcoding, mendeskripsikan hasil coding menjadi tema yang dianalisis, menyajikan tema dalam bentuk naratif, dan menginterpretasikan data. Hasil penelitian menunjukkan pengalaman fatherless memengaruhi self acceptance DCR dimana konsep dirinya belum stabil, penilaian terhadap diri sendiri belum konsisten, tingkat kemandirian yang berubah-ubah, hingga penghargaan terhadap diri sendiri yang masih sangat rendah.

Abstract

Penelitian ini bertujuan untuk mengetahui perlindungan hukum bagi pencipta yang karya videonya diunggah kembali atau biasa dikenal dengan reupload di YouTube secara ilegal oleh pihak-pihak yang tidak bertanggung jawab menurut Undang-undang Nomor 28 Tahun 2014 Mengenai Hak Cipta dan juga untuk mengetahui lebih dalam mengenai upaya hukum yang dapat dilakukan oleh konten kreator dalam mengatasi pelanggaran hak cipta terhadap pelaku reupload. Penelitian ini menggunakan metode yuridis normatif menggunakan deskriptif analisis dalam mengolah data dengan pendekatan kualitatif guna menentukan isi dan makna aturan hukum guna dijadikan rujukan dalam menyelesaikan permasalahan hukum yang menjadi objek kajian. Hasil dari penelitian adalah tindakan mengunggah kembali video (reupload) milik orang lain di YouTube demi kepentingan pribadi termasuk pelanggaran hak cipta. Pelanggaran tersebut muncul dikarenakan tidak adanya izin dari sang pencipta video yang mengizinkan video miliknya dipergunakan oleh orang lain. Pelanggaran tersebut menyebabkan tidak dipenuhinya hak moral dan hak ekonomi pencipta video yang telah bekerja keras dalam membuat video tersebut. Sehingga diperlukan perlindungan hukum bagi pencipta yang karyanya berupa video atas adanya reupload secara ilegal di YouTube guna menjamin kepastian hukum.

Abstract

This study aims to analyze legal protection and legal remedies due to spoiler film piracy through the Tiktok application, referring to Law No. 28 of 2014 concerning Copyright. The phenomenon of violations of film spoiler practices in the form of content through the TikTok platform has a negative impact on creators or copyright holders. Both morally and economically. In this case, of course, legal protection of cinematographic works must be enforced. Although legal regulations related to copyright of cinematographic works are available, in reality many people pirate spoiler films. This study uses a normative juridical method by reviewing theories, concepts, legal principles and related laws and regulations. The results of this study conclude that the protection and enforcement of copyright law for cinematographic works in the form of preventive and repressive, by providing licenses, supervision and law enforcement based on the perspective of Law No. 28 of 2014 concerning Copyright. The study shows that film spoilers in the form of content on the Tiktok application are very easy to use and the government is not firm in supervising electronic system providers, in this case Tiktok. Therefore, more effective supervision and law enforcement are needed to combat future film spoilers.

Abstract

Perkembangan fasilitas teknologi mempermudah manusia untuk memanfaatkan berbagai sarana platform digital yang ada termasuk platform User Generated Conten (UCG). Namun, disamping berbagai dampak positif yang ada ternyata juga membawa dampak negatif berupa maraknya pelanggaran hak cipta karya seni musik dan lagu. Tidak adanya pengaturan hukum yang jelas dan tegas bagi perlindungan karya seni dan lagu yang dimanfaatkan melalui sarana platform digital berbasis UGC ini, hal ini tentu bisa menimbulkan kerumitan dalam penegakan hukum bagi pihak-pihak yang tidak bertanggung jawab atas pemanfaatan karya seni dan lagu. Adapun fokus permasalahan yang dikaji dalam penelitian ini adalah “bagaimana pengaturan perlindungan hak cipta karya musik dan lagu di dalam digital services platform berdasarkan Undang-Undang Hak Cipta (UUHC) dan bagaimana perlindungan hak cipta karya seni musik dan lagu di dalam digital services platform berbasis UGC berdasarkan UUHC”. Metode penelitian yang digunakan adalah yuridis normatif yang sumber datanya berbasis pada data sekunder berupa bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa di dalam UUHC masih terdapat kokosongan norma yang mengatur mengenai perlindungan atas pemanfaatan layanan digital platform yang berbasis UGC termasuk pasal-pasal yang mengatur mengenai penegakan hukumnya. Oleh karena itu, penting bagi pemerintah untuk dapat melakukan revisi dan evaluasi terhadap beberap pasal yang relevan  di dalam UUHC khususnya terhadap pasal 10 dan pasal 114. Hal ini penting guna memberikan perlindungan hukum dan kepastian hukum terhadap hak ekslusif pencipta dan pemegang hak cipta.

Abstract

The rapid growth of the esports industry in Indonesia has led to increasingly structured employment contracts between players and teams. Among the most contentious provisions is the freeze clause, which grants teams the authority to suspend players' professional activities without clear justification, time limits, or compensation. This study aims to examine the legality of such clauses within the framework of Indonesian contract law, focusing on the principle of balance and the protection of parties in unequal bargaining positions. Employing a normative juridical methodology, this research uses statutory analysis and case-based interpretation to evaluate the enforceability of freeze clauses. The findings reveal that when applied unilaterally, freeze clauses violate the principle of good faith and may constitute misbruik van omstandigheden (abuse of circumstances). Such clauses not only disrupt the professional careers of esports players but also undermine the foundational values of fairness and reciprocity in contract law. The originality of this research lies in its legal scrutiny of esports contract practices, a relatively underexplored area in Indonesian legal scholarship. The study highlights the urgent need for contract reforms and the development of protective legal standards within the esports industry. It also offers practical pathways for dispute resolution—through mediation, arbitration, or litigation—providing strategic guidance for players seeking justice.

Abstract

This study examines the implementation of direct and indirect license systems in copyright royalty management, particularly in the music sector, by comparing the regulatory frameworks of Indonesia and the United States. In Indonesia, copyright royalties are predominantly managed through a collective licensing system via LMK (Collective Management Organizations) and LMKN (National Collective Management Organization). Although the legal framework permits licensing directly between creators and users, the lack of explicit regulation on direct licenses creates legal uncertainty and risks overlapping claims. In contrast, the United States recognizes and regulates direct licenses under the Copyright Act of 1976, allowing copyright owners to manage their economic rights independently or through Performing Rights Organizations such as ASCAP, BMI, and SESAC. This legal certainty enables greater flexibility, negotiation power, and transparency for creators and industry stakeholders. The study employs a normative-empirical legal method, combining statutory analysis with interviews, to explore how Indonesia might benefit from clearer legal provisions to support a dual licensing approach. Strengthening legal clarity on direct licensingcould ensure fairness, legal certainty, and adaptability for both creators and music industry actors in Indonesia’s growing creative economy.
